When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Hi Team,

    I filed from small company in US, and I have not got any updates from them. Neither check clearance or lottery selection / rejection. Consultant asking to wait for end of this month or till mid of next month for updates.Do you feel are there any hopes ? I am non AD/ RP. They even did not disclose me centre. Do you feel can I have 1% of hope or shall I switch to plan B altogether?

    My case is showing following status: –

    On May 20, 2016, we transferred your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC16142XXXXX, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice. If you do not receive your notice by June 19, 2016, please go to www.uscis.gov/e-request to request a copy of the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    Can you share your experience if you have come across similar cases in recent past.

    I am L2 EAD and i applied for H1 . Today i checked my status on USCIS which says my case has been approved. Now my question is, my L2 visa and my EAD expires in beginning of Oct 2016. What I would have to do in my case ? Will i get direct transfer from L2 EAD to H1 in order to continue my job which is going on OR do i need to leave USA before Oct and need to re-enter with H1 stamping ?

      Wait to get the approval notice and see if it has an attached I-94. If yes, then you will remain on L-2 status until Sep 30 and will move to H-1 automatically from Oct 1. No need to get immediate visa stamped.

    • I talked to Raj. Acceligent has not receieved any new recipts since 3 may 2016. And so they have nothing new to share.

    • If that is so, isn’t it unprofessional of you to ask them the same thing again and again even when they do not have an update? That is basically the definition of Insanity. Doing the same thing over and over expecting a different result. Find your peace and be patient for an update. These things take a lot of time. Nothing unprofessional about anyone.

      • Let me put it another way. Lets say you are visiting a hotel, you pay for everything, and the service is not good, will you not ask for better service or at least tell the mgmnt to improve the service. It’s ridiculous to say, that asking for an update just is insane. Peace will come, in time…..

        • Well yes, That makes sense but I am not sure what the relevance is though! Going to a hotel and what we would be paying is for their service. They have to do a good job, or else it is a bad experience for customers. But H1B is not a service, and one should not be paying any company to get a H1B. But if someone does, that is their choice. But they should at least be mindful that they are doing business with a company who is trying to make money out of the situation. Both the applicant and the company are just looking for their own benefit. One should not expect professionalism in a case where the everyone are involved in doing an unprofessional task.

          • Talking about looking for our own benefits, aren’t we all doing the same, in one way or the other? I agree with most of the things you say above, one shouldnt be paying for h1b. I am not talking about the method of acquiring a visa, I am talking about a company, that boasted about being a transparent and reliable. Is it too much to update your applicants just once in a while. This shows the mindset with which a company would treat an employee after hiring him/her. I dont support paying to a consultant for acquiring h1b visa. But sometimes circumstances leave you no choice but to take this route. I hope you understand the point I am trying to make, as I have understood yours.

    Am in L2 EAD and currently working. I applied H1 through a consultancy(Since my current employer wont file H1) and it got picked. My question is

    1)When it gets approved, Starting from Oct 1, should I be working under that consultancy or can I transfer to any employer after it gets approved?

    2)Consultancy said they had submitted the client letter and all information to USCIS. Any chances of RFE?

      • Can’t you understand the simple thing? L1 is more of a locked Visa and her/his spouse cannot switch jobs. Both may be trying to get a better package to make their ends meet luxuriously.

        I am sure you aren’t aware what is L2 EAD. L2 EAD is a dependent visa based on spouse’s L1 visa. L2 person can work on EAD until L1 stays here. To be on safer side for L2 EAD, H1 visa is the perfect visa and right step so L2 applicant won’t be dependent anymore and can work independently on H1. Its not harm for anyone that L2 applicant applies for H1, harm is that so many applicants files more than one H1b petition which may affect genuine applicants.

    • L2 to H1,

      1. You should be working for H-1 employer from Oct 1. I have heard mixed responses about H-1 transfer prior to Oct 1. Some say it is possible, while others say it isn’t. So if you can find another employer, ask them about this and talk about timing. They can file soon after current H-1 approval, or file on Oct 1. Once filed, you can work for this new employer as well.

      2. Even though they have submitted the information, RFE can still be issued for this or any other reason.

    AD/RP petition selected in lottery. Upgraded to PP on May 12th. Today, I received an RFE…really worried..Still waiting for details. What are the chances of approval on RFE. This is my only chance. Are RFEs common?

      If not – why did you hurry in to upgrade the petition?

      USCIS has already received higher than normal PP applications and is issuing RFEs for most just to buy themselves. Upgrading to PP at this stage always is like inviting an RFE.

          Trivial RFE would be missing signature document, or missing employer tax id number etc.

          Complicated RFE would be establishing employer-employee relationship, proving H-1 applicant is qualified for position, proving offered position is qualified enough for H-1B sponsorship etc.

  13. Got a status update today – Was AD/RP/VT – Now California?

    Two questions before you go through the details.
    1. Do I get a new receipt number?
    2. USCIS status page shows ” Case Was Transferred And A New Office Has Jurisdiction”
    3. Got 2 email updates from USCIS which says my case is in “Initial Review”. There is some more details around background check etc. Is that common?

    Fortunately ,I got my receipt number on April 27th under Non-AD, Regular processing from VC.

    With your prior experience ,could you please let me know when I can get to know Approval/RFE status on my case, any probable timelines?

    Thank you very much for your efforts and giving useful info to all of us here in this forum.
    I had old H1B approved & stamped in 2007 but it was never used and i was never in USA. Visa was valid from Oct 2007 till Sept 19, 2010. Is there any chance that my petition comes under H1B cap exemption?. I had a new employer who is ready to do H1B transfer.
    My company had already applied for this year in cap subject case but till now i did not hear anything from USCIS. Mostly it was not selected in the lottery. Hence thought of using my old H1B.

      Recently few folks reported about getting H-1 approved in cap-exempt category even if previous H-1 was approved more than 10 years ago. So worth a shot.

    • Hi Saurabh, usually they say the petition is valid for 6 years, meaning you can get a cap exemption in that time span if you are getting a new petition raised. However, as the admin said, heard about a few cases where people with even 10years old petition got cap exempted. So, worth giving it a shot.

      Also, my case is kind of similar to yours. I am from Infosys and I have applied for h1b in 2015 from a private consultancy based in US. Got picked in the lottery, however, I went for stamping and they denied to stamp as my consultancy couldn’t provide me with all the right papers(client letter etc). Now they sent my petition back to USCIS for review, and it is stuck with them for more than 6months now.

      I have recently learnt that I can still get my petition transferred to other companies(without going through lottery). However I am having a hard time in finding an employer to get my h1b transferred.

      I can get it transferred to Infosys itself, however I am kind of sure that Infosys policies wouldn’t allow them to get my h1b transferred to them. Also, they have raised h1b to me in cap subject this year, but it didn’t get picked up(just like your case). Can you please guide me on how to find employers who can sponser h1b transer to me, or any other suggestion which can help my case for that matter. Thank you.

    On May 18, 2016, we transferred your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC1614xxxxx, to another USCIS office. That office now has jurisdiction over your case.

      This is my second attempt for getting H1B Visa ,so can share last year’s experience which many of us Infosions are already knowing.
      Second batch do come,second list always comes ,people have received confirmation about selection in lottery in last week of June also , so there is still hope guys.

    Just confirmed with GI team. Total they have filed 8k+ recipients and in that they received 3k results who are selected and they are waiting for second batch of results . It can be rejection list also and they are not sure to say all 8k will get selected in infy ., so there might be possibility of 1k selected maximum in next batch .

    said 5 petitions get picked in lottery out of 36. 1 opt rest Non AD/RP CA .When I asked about my case they said I would get to know before July 15. Please let me know Is there any chances getting case picked and receipt number that USCIS send receipt numbers after PP cases.

      I don’t think receipts would be received now. There may still be outlier cases like lost/delayed in transit; but majority of them should have already been received by now.

    • I recieved below response from GSD team.
      We are receiving receipt notice batch wise from USCIS. We are yet to receive the complete lottery results for H1B petition. If your petition is selected in lottery and once we received the receipt number/notice we will update you via email. Request you to wait until then!

      • Cognizant waiting non ad/rp/ca : when did u check with GM team ? In some other forum people are claiming that GM team told tat its over now they are expecting only rejected petition. I guess dey are giving diff response to diff people

        • I checked with them yesterday. By phone and by raising GSD. Through phone too I got almost same update that they recieved 90% petitions and waiting for remaining and expecting before month end. Wait and watch game. Confused whether to wait or move on.

      • USCIS never sends receipts in batches…The last date for sending H1B receipt was May 2…So if we considered 1 week required for receiving receipts, the receipts should be received by May 9…On May 12, USCIS already started PP and now they started with RP as well…So almost no chances of getting receipt at this time from USCIS….May be your company is not disclosing the information……

    The employer informed that my cheque was not cashed and no receipts received till date.I need to check whether the employer filed my petition for sure,what are the details i can request the employer to know for sure that H1B application was actually filed

      If not selected, rejection notice is issued. It would have your name and employer’s name. That would tell w/ surety that petition was actually filed. However, it is up to employer whether to share it w/ you or not.

  27. My H1B was approved back in 2011 but i never got it stamped until 2013, when it actually expired. I could not travel due to some personal constraints.

    Now, my employer recently filed an Out Of Cap H1B for me which has been approved and ready for stamping. My question is: Am i still eligible to work in the States for 6 years from now on or is it lesser?

          Usually it has to be approved in previous 6 years. However, some people have recently got it approved for petitions as old as 10-15 years. So you can find an employer and discuss it w/ their attorney.

      • There is nothing called second batch. Infosys is awaiting the status of other application which were filed, the status might be selected or rejected. Cant clearly say the next set will have 100% selected list or the list after that is 100% rejected list. It all depends on the individuals case and they are random. As a rule of thumb if you don’t get the result in 3 to 4 weeks withing the data entry it means that your case is 90% rejected.

      I have observed Infy releasing H1 results in batches last year don’t know how many batches…..
      Have seen people receiving H1 results till mid June…. and of course unselected results were out by June end and there after…..

      Only one set is announced till now…. There should definitely be another set of results,….

    I am from Infosys, congratulations to everyone who has got selected. I am a third timer and till now I haven’t got any update. Infosys has updated everyone whose petition is selected so far. USCIS will be sending the results to Infosys US office through snail mail. Once the US office receive the mail they will send it to the offshore GI team. Once the GI offshore team receive the mail they will update the file number for selected candidates in the portal. The very next day of the update the selected candidates will get an email notification. As of today Infosys has updated all the selected candidates, Infosys has got no more info to update. They are waiting for the USCIS to send them the next set of selected application(if any). Some people have got a generic email telling that their lottery results are awaited, in this case the game is not completely over but there is only 20 to 30 % chances from now on. USCIS always send the selected results in bulk, so 70% of the selected result is already out, there is only 30% chances for those not selected from now on. Its very tough but I have been going through this for almost 3 years. Stay positive and hope for the best. All the best.

    • USCIS has already sent all the receipts in bulk a few weeks before….Even if they r coming by snail mail to Infy US Office, they should all have been received by now and it should have been updated by the GI Team in the batch of results published yesterday….

      Yes there may be delays in collating of receipts, data entry by the GI Team, USCIS sending delayed receipts, etc….But these r exceptional cases….chances are very very low I feel and diminishing every day… 2nd list they r talking about is probably the rejection list even though they are not saying it directly….In the mail yesterday they said wait for 2 more months!!!…Wat can it mean other than rejection?!?

      May be an incorrect data entry of name, which was later corrected. See if the status changes in few weeks, if not ask attorney to follow-up w/ USCIS.

          It always go to RFE first and then denial. I don’t remember a case where it was denied w/o RFE being issued.

            Even though you were selected in lottery, it **MAY** get denied. If that happens, you are out of lottery.

            I am not sure what you are comprehending from my responses. Let me start fresh. Forget everything I said before.

            Any petition can be denied based upon circumstances surrounding it. Your petition is neither a step child nor a blue eyed boy of USCIS. So it would be treated fairly at its merits and may be approved or denied. However, if it is not outright approved, USCIS will first issue RFE and then based upon RFE response approve or deny the petition.

            Same goes for visa stamping. Any person is not in clear until the entire process is done.

            So the next step for your petition would be RFE or direct approval.

  31. I have got selected from IBM. Non AD/RP case.
    Few queries :-

    1) By when(usually), the application gets approved(in case there is no RFE) ? I know they say 2-4 months but generally by which month things get cleared ?

    2) After approval, by when the stamping happens ? Is it a date that USCIS tells you or is it something that your company decides?

    3) When does the process for dependent begins ?

I will be working directly with my employer i.e. no consultancy nor client company except for the attorneys that my employer filed the petition through.
    Do I need a client letter for my interview at the US Embassy/Consulate to get through? I really do not understand the concept of the Client Letter. Your sincere response will be much appreciated.

      Only if you are working in a consulting company, a client letter is required. This is to show that there is a billing client, who will pay for H-1V holders services, which in turn will be used to pay for H-1B holder’s salary.

      If your employer is a big product based company, then no issues and stamping should go through smoothly. If they are a small product based company, then consulate may ask for product details, market research etc. You should know what your job duties will be and how it will help the employer to make some $$$.

        No, I am not going to work in/with a consulting company. Rather, I will be working directly with a well established multinational manufacturing company. So that is why I am thinking that beside all the filling documents and the Notice of Approval that my company (employer) and the company’s attorneys will give me, the employer’s offer letter could be presented, in lieu of the client letter, to the consulate at the time of the interview, or is the client letter the same as the employer offer letter?

  33. My RFE seeks evidence which establishes that there will be specialty occupation work for the requested H-1B period.
    They are asking for:

    1. Copies of valid contracts, work orders, service agreements, correspondence, invoices, and proofs of payment between the employer and client companies for services similar

    2. Corporate tax returns for 2014 and 2015.

    3. Copies of company brochures, pamphlets, or other printed material describing the company’s products and services.

    4. If any, press releases, product reviews, and success stories other than those available on the company’s website.

    5. If any, sample cost and marketing analyses for the company’s products.
    6. Copy of a position description or any other documentation that describes the skills required to perform the job offered, the tools needed to perform the job, the product to be developed or the service to be provided, the method of payment, whether the work to be performed is part of your regular business, the provision of employee benefits, and the tax treatment of the beneficiary by you;

      Not sure what your question is. Looks like USCIS wants to verify your employer, their financial status etc. Is this a new consulting company? Most of this needs to be addressed by your employer.

    I applied as a computer application programmer and i did MS in information systems.
    I got rfe notice today morning.

    Please help/suggest me here or give any tips to make sure when respond to this rfe.

    The record does not establish the services of the person performing a ‘specialty occupation’. please submit one of the following.

    1) a bachelor’s degree or the equivalent is the minimum requirement for entry into the occupation;

    2) The degree requirement is common to the industry in parallel positions among similar organizations or, in the alternative, an employer may show that its particular position is so complex or unique that it can be performed only by an individual with a degree;
    3) The employer normally requires a degree or its equivalent for the position; or
    4) The nature of the specific duties is so specialized and complex that knowledge required to perform the duties is usually associated with the attainment of a baccalaureate or higher degree.

    Further more submit the detailed statement to:
    1) Explain the benefeciary propsed duties and responsibilities.
    2) Indicate the percentage of time devoted to each duty.
    3) State the eductional requirements to these duties and
    4) Explain how the benefeciary education relates to this position.

    USCIS interprets the term ‘degree’ in the above criteria to mean not just any degree, but a degree in a specific field of study that is direclty related to proferred position.

    If you publicized job opening, submitting the tear sheets or other advertisement documentation may hep establish the educational requirements for the proferred position of programmer analyst.

    If you have previously employed individuals of programmer analyst position submit the documents evidence such as W2 forms and copies of degress and transcripts that verify:
    -The number of employees you have employed in this position in the past.
    – The level education held by each individual and
    – The field of study in which the degree was earned.

      Your attorney should be taking care of this. They need to show what the minimum requirements for the offered position is. If there are others working in similar position, then their resume can be submitted. If they have posted the opening on job sites, then those ad printouts need to be submitted.
