When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

    I need an important suggestion on this.

    I am on H4 in US now and applied for H1 with COS. My H1 petition has picked up in the lottery and my case type is Regular processing. My H4 visa is going to expire on August 30th 2016.

    1) I heard my COS will get denied considering my visa expiration date. Is it true that I should be with valid H4 on September 30th for COS to get approved??

    2)If the above is not true, then, as per Last Action Rule, would I end up with H4 again (provided H1 gets approved and then H4 extension gets approved)??

    3)Do you recommend to withdraw H4 extension and upgrade to premium processing?

    Saurabh/Kumar your valuable suggestion is important to me now. Please advise !!

    • As Your visa is expiring in 30th Aug 2016. you cant stay legally in country , until you and H1b apply for extension.

      There wont be any issue for H1B if you leave the country and get visa stamp and reenter in US after 1st October. I would recommend to go ahead with H4 extension. as it is required to show valid status in US when visa officer take your case.

      (note : this is purely as per my reading and understanding .it is always good to take second opinion.)

      1. Yes, USCIS may issue RFE asking for proof of H-4 status from Aug 30 to Oct 1. For COS to be approved, they need continuity of status through Oct 1.
      2. Last Action Rule takes effective date into consideration. So let’s say H-4 extension is approved on July 1 w/ effective start date of July 1; and H-1 COS is approved anytime w/ effective start date of Oct 1. So as per Last Action Rule, you would remain on H-4 until Sep 30 and then be on H-1 from Oct 1
      3. Has your spouse applied for H-1 extension? You can include your H-4 extension w/ spouse’s petition and file in PP. Once H-4 extension gets approved, just submit its approval copy when USCIS issue RFE for your H-1.

        Mine is also the same case. My H4 expired on this May 17th. But I got visa extension before that on May 10th. My H1 receipt date is on April 11. Will my H1 get RFE? Should I submit approval copy after that?

        • H4 Extension,

          I think you would be ok. You have already received the H-4 extension. So when they look-up the I-94#, they would see that it has been extended through Oct 2016. So you should be fine. Still if they want to see copy of spouse’s extended 797 and your H-4/I-94, they can issue RFE which can be easily addressed.

        My Spouse didn’t not file extension yet.
        1) Is there any chance for both H1 petition and COS to be issued for RFE considering this expiration date thing?
        2) If my H1b petition gets approved and COS gets denied instead of RFE, can I re-file COS with premium processing?

          1. H-1B and COS are processed together. So there would be just 1 RFE and would put entire process on hold. It would include proof of extension of status and may include other things as well (related to H-1 work, job, employer etc).

          2. They don’t deny anything w/o RFE. So RFE is issued and based upon RFE response it would be approved or denied. COS can be filed later as well, but there won’t be any PP option available when filed just as COS.

  3. Its been more than a month and still i am seeing below status only. There is no change in it at all. Any idea when i can see any changes in below status as per the date April 14,2016 when they have received it.

    My Q is that currently I am on OPT and have applied for two applications with USCIS.
    1) STEM Extenstion
    2) H1B Lottery – Selected and got the receipt (Its not authorized yet)
    I am having bunch of issues with my stem extension approval and USCIS gave a 2nd RFE on my case. Initially they said the everify # and employer name doesn’t match and I do not know the reason for second RFE yet. My original OPT ended on May 10th.
    What should I do to apply for capgap in case the stem is denied.
    What are my options to continue to my current job until Oct 1st.

    • H1, F1 struggle,

      It is an option to withdraw OPT extension and then continue working on cap-gap. Your DSO can help you w/ that.

      The catch is in case your H-1B petition is denied, you will not have option to avail OPT extension anymore.

      • Thank you for the suggestion. Yes, the same is the reason I wanted to know the cap gap process. My employer says there is no particular paper work of Cap-Gap and its only a letter he can type explaining the situation when I go for my COS stamping.

        1st RFE on STEM-extension was generated on Apr 25th, I responded on May 5th though I had the time to respond until Aug 25th officially.
        2nd RFE on STEM-extension is generated on May 18 and I am thinking I will get time until Sept 18th to respond. (Reason not known because I haven’t received the letter)

        I am thinking that can I take all the time and respond to the 2nd RFE around Sept 4th and as it is they take at least two weeks to respond so that I can come close to the October timeframe and may be take some days leave from work in case of any not so positive result happens on F1 extension. (This is the case when I think my H1b will go smooth.) Does this sound like an option?

        I for sure need H1 as my spouse is about to maxize on his H1 and we are currently not planning to leave US else I could have utilized another 24 months of STEM. I have applied for STEM only to be in status until October.

        I would be thankful if I can get a clarity on the cap gap process.

        • H1, F1 struggle,

          You can upgrade your H-1 petition to PP so that you know the H-1 result quickly. Once you have clarity about approval or denial, you can take appropriate action on your OPT. If H-1 is approved, you can withdraw extension and move to cap-gap by talking to DSO. if denied, you can respond to OPT extension and work on the same.

          Do you know what your SEVIS record shows currently? Ask you DSO about it. As your OPT extension is not approved yet, you may already be in cap-gap (I suspect but not sure).

  7. For Infosys people – I raised ahd and got reply that all selected cases informed by USCIS are already updated. We haven’t received any status on your case.

    It means straight forward der is no 2nd list. It will only come if USCIS has selected list pending with them else 2nd list is all rejected one only…….

    I don’t think USCIS will still inform selected one

  9. Many people and other forums said that after May 12th the dream was over.

    Looking to this forum, I can see people being selected yesterday and today (I did not read everything to know if there is more).

    What I can say is: the dream is over, only, and really only, is over… not when people say it is over.

    I am glad to know people are still receiving receipt notices. I am still waiting mine (Non-AD/PP), and I have faith that it will came soon. But, for now, I am happy for those who already received and glad to know that the game is being played yet… The dream is not over!!!

    • When they said May 12th the dream is over, it is meant for PP applications, since that is the date USCIS promised to start processing PP applications – that would mean all selected people will be notified by then (again, only for PP). What you are seeing for the last couple of days are RP receipts. They keep coming in even after you think everything is over, since there is no established timeline for RP.

      • Your case might be in security check. Approval will happens soon depends on your check, if it goes too long…!!!!! It would be finger crossed.
        Better check with your employer or attorney to get more clarity.
        Last year Quota My case was rejected after three months from “Name was Updated” status.

    • When will I get to know if my application has not been selected in the lottery?
    o Request you to wait for 6-8 weeks to get an update on the application status, the same will be updated on GICS. USCIS typically sends the accepted applications first, followed by the applications that have not been selected. However there is no set process for this and we have received accepted cases very late in the past.
    Has it ever happened before? does anyone know about this?

  16. Looks like list is complete and all the receipts received so far have been informed and updated in GICS, as confirmed by the email from GI team. Congrats for succesfull applicants and rest should plan accordingly.

    • I don’t think it’s done. I called up GICS and they updated me that they have one more list which is not approved for disclosure.Once approved and they get that list, they would share the update with us. They informed me, it will take time to get the approval for disclosure and when it will happen, they don’t have clue on it.

    Case Was Transferred And A New Office Has Jurisdiction
    On May 18, 2016, we transferred your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC16XXXXXXX, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case.

    subject : H-1B Update | Results of lottery still awaited

    Dear Employee,

    This is to inform you that we have not yet received an update from USCIS regarding your H-1B petition. This process of receiving lottery selected cases and those that are not selected will carry on for the next two months. In case your petition is not selected we will update your record on GICS accordingly. In case your petition has made through the lottery, the approval process can take up to 4+ months after receiving the receipt.

    Dont know ..if I should keep hopes or …. 🙁

  24. This is the response I got from GICS team. “The receipts have come in hoards and the team at onsite has been ratifying details and collating a list / report. We would update as soon as we have a clear list from these sorting or receipts received at our US office. There would be emails sent to those whose cases have made it to the lottery and receipts received by us. There on the updates will reflect on the individual GICS records Note: Request you to wait for 6-8 weeks to get an update on the rejected application status.”

    Hope never dies…
    GICS just sent out a communication to all selected entries including me. It says that they are still in the data entry process for all receipts received and this might continue for another 2-3 weeks.

    Looking at this, you can expect more updates from GICS in batches.

    • Perhaps, No. I feel GI team updated file number yesterday itself. The latest mail from GI supports this. “This is to inform you that we have not yet received an update from USCIS regarding your H-1B petition. This process of receiving lottery selected cases and those that are not selected will carry on for the next two months. In case your petition is not selected we will update your record on GICS accordingly. In case your petition has made through the lottery, the approval process can take up to 4+ months after receiving the receipt.” .”GICS is updated with all the receipts which have been sent by USCIS and received by us.       • I agree .GICS HAVE updated all the records for which they have received response from USCIS. I THINK now chances are very rare may be small set of people will make it. Rest all its over. May be by June end they will mark it rejected in lottery. This is my second time still no update . I have given up now. 🙁

    Finally some good news. I don’t have my information yet. But my consultant told me its approved and selected in lottery. First attempt, nonAD, RP.
    My brother in law recommended this guy on 30th march and i sent him docs on 31st. Pretty happy with the way things turned out. I did not ask him anything else about the check and other things.

    Good luck to everyone waiting. Don’t loose hope yet like i had done.

    Can anyone tell me whats the procedure after this?

    • Hi congrats ankur. Have you received the receipt? I have applied and they said my cheque got encashed on April 26th itself. But didn’t send the receipt. Will it take time to receive the receipt???

        Thanks and congrats to you too. I haven’t received anything yet. The guy from their team told me that i have been picked up in the lottery and soon the immigration team will send me email with all the details. I hope they do it in 2-3 days. I will update the forum with whatever i receive. I hope it will help others.

      Was it updated in INSZoom.In my case i got only mail about the petition submission but nothing is updated in shipping log in INSZoom.

    • yes even I got receipt on this Monday .. I had chat with team they said we have around 1000 receipts pending .. we are processing the receipts so wait for till this month end….
