When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Firstly, congratulations on being selected.
Dependant – cannot work. H4 is a dependant VISA and anyone on that VISA cannot work. They can only depend on a working H1B spouse. They cannot study either. They will need an F1 VISA to study.
If you want your wife to work, apply a H1B VISA for her – just like the process which you have been through. Or, start your greencard process and if you can get your I-140 approved, (typically takes a year and a half from the time of approval), then you can apply a H4-EAD for your wife (which takes around 90 days to be processed). She can then work.
If she wants to study, you should apply for a F1 VISA. Post graduation, she might be eligible for work on an OPT.
H4 is strictly dependant.

Agree w/ DennyCrane’s response except H-4 holders can also study while being on H-4. However, they cannot avail any financial help like scholarships or make use of CPT, OPT etc. For that they need to be on F-1.

Dnt apply Jsmnc and gomiapp consultancies they are fake they wnt responde people and won’t show any proof as submitted h1b. This is only suggestion.
If USCIS can give a separate quota of 100-200 visas for people from AP/TG, everything will solve. Its these fake candidates with no real experience sneaking through the system.
A Telugu girl sitting next to me didn’t even know how to connect 2 boxes in a visio diagram by dragging the arrow!!! And he earns a hefty salary. She got through this H1 lottery and made her way to the US.
PS – I totally understand that these are several highly skilled friends from these 2 states. However, there are alarmingly higher number of dowry targetted fake candidates who make the states shameful.
So are you sure your resume does not have any fake content???? It is a fact that 99% of people approaching these bodyshop consultancies spread out in Hyderabad are FAKE themselves.

GI team has been instructed no to publish the results … HR is anticipating higher attrition in this quarter ,,,, also they wanted to flat the level 5 and 6…. reducing 5 by 20% and 6 by 15%….. that is why hike letters are getting delayed….. In my openion …..Vishal is big time non performer

My check was cashed April 19th . AD/RP/VT. Still no receipt. Checked and confirmed with Employer 3-4 times on this. Employer told there are few others like me who are sailing in the same boat and is hopeful that the receipts will arrive soon.

Ask employer to check the back copy of cashed check. It should have the receipt number. If not, they should contact USCIS.

What is the last date for waiting to get the receipt numbers from USCIS?

There is no official last date. However, if someone has other pointers to say that they have made through the cap but don’t know the receipt number, then their employers should follow-up w/ USCIS. May be the receipt notice got lost in transit.
If someone has no pointers about lottery selection, then chances of non-selection are pretty high. If one wants to be optimistic then they can wait until rejection notice is received, but at times the writing is on the wall.

i think techM management will release the results only in the month of June. TechM management is not ready to face the attrition. TechM management files very few H1b cases only. As per management they filed 2k to 2.5k H1b cases but the truth is they filed only 500 applications. carry on guys do not wait for the results.

I am in USA on L1 from company A, I have visa till June and I-94 till Oct. Company B has applied for my H1.
Now company A is telling me to go to for L1B renewal. Going for renewal will have any effect on H1B
These are two different visas, hence different processing. It should not have any effect on L1B renewal unless there is any issue with your renewal application.
With this English first worry about clearing visa interview, then about other things you have been so stressed about

Yes Saurabh, my receipt status in uscis portal tells that deficiency notice with the steps to be taken is sent to employer. I have even informed my employer for which they will follow up with uscis. Keeping fingers crossed,hope it will turn around fine.

If CA application is not picked at all, then you should not fear about potential RFE for multiple filings. However, there can still be RFE issued for a different reason.

Did your application go through the lottery? If not, then the chances are very very slim! If it did, and if it is under Premium processing, you should be receiving a decision latest by the end of this month.

I got selected by an employer Headquartered in New jersey they are sponsoring my H1B they applied for my visa on April 1 2016 and shared Fedex Tracking number to track the documents send
I can see the status on Fedex as No Schedule Delivery date and haven’t heard from my employer about rejection/selection in Lottery though i had a word with them they are still waiting to hear from USCIS

Even i have applied through a company headquartered in New Jersey and i got a tracking no. of the US postal services which shows package delivered. But still waiting for lottery results
Once your courier packet deliver to USCIS,the courier status will be change “Signed by A.SCOSS”, verify this on Fedxex.if not your employer did not send it properly and they are cheating.
But It states that it is in Fedex Facility Williston don’t know why it is not yet delivered though it arrived in facility on April 1st 2016
Most employers usually prefer USPS, since this is an official filing. As much limited as my knowledge could be, FedEx and UPS do not readily ship to these addresses. For example, mailing tax return documents to the IRS, I have had both FedEx and UPS simply say that they could not find the exact address in their system and guided me towards USPS. I am not saying all FedEx and UPS locations might do the same, but it is something that I have experienced over a couple of years. So, there is a huge possibility that the delivery has been messed up. If you are able to reach FedEx and they said the package was there on the 1st, then you at least know that your employer did send a package. No one can really verify if the package has the contents needed. And be mindful that any delivery delay or exceptions just mean bad luck. We cannot contest the situation in any capacity. If you have the tracking number, try and get to the bottom of it to see what actually happened.

H-1 PP adjudication started on May 12. So you should know the result (approval or RFE) by May 27.
OPTs are usually processed within 60 days. If it gets close to that timeline, you should open a SR with USCIS and request them to expedite your application.

You cannot apply using dropbox. If you read the dropbox criteria here, then it says “My most recent visa was issued in India”.
