When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Sorry if my communication was not clear. Yeah, my wife had M.Tech from India so I spoke to advisor about the graduate certificate she said they will not be eligible to get OPT nor on-campus jobs (unless you have F1 to avail 20hrs work permit). So, I thought better get her enrolled in Masters to get benefits of F1 visa (20hrs work permit and OPT). One, suggestion I don’t know which state you are living in but you can enroll your wife in masters and apply for in-state tution fees (Check the clause of the state and also the university). I did that for my wife and in just $9000 her whole MS would be completed. Anyways now her masters after 2 semesters got converted into PhD from Fall 2016. So, take away from this discussion is get your wife into F1 and enroll her for MS, try to get in-state tution fees by checking in admin building of the university. Hope this helps

Yes, checks are cashed only when one makes through the lottery. If employer cannot see the receipt number behind the check, then they should contact USCIS.

But this is truth bro. I have contacted my employer, he is uncertain about receiving any further approval receipts as we are already in to mid of May.
They are just holding verbal rejection confirmations because they are waiting for return packet from USCIS .
I’ am happy that around 60k applications were picked but this would not only include India but other countries as well.
The sad part is another One Lakh, 60k + applicants are out of this game. We have to understand & believe that this game is based on pure luck. But still I presume that there could be some favoritism for Big IT Gaints (not proved,people talk abt it).
Few might say that this Lottery method is not fair but due this very lottery systems many of them are able to apply for H1 B otherwise only highly skilled individuals with magnificent academic score & work experience would enter this arena.
What I believe every individual possess some kind of unique skill, few might be able to project the same in academics & in there respective IT organizations. However, there could be other individuals with extra ordinary skill set which they might not have applied during education.
Some times I fee like lottery system is providing equal opportunities for every one but since I lost this game, I feel like entire H1B visa approval process(lottery) is fraud.
If it’s luck, keep on trying because some day or other luck has to work for you.
But we need to open a forum where we can discuss abt other opportunists in equally developed countries like Australia, Canada, NZ & others. Let work it out guys…

USCIS will not cash the check and then return the petition. If they cash the check, it means petition has been selected. However, are you sure that your employer is telling you the truth about check cashing?

1. I don’t see any more hope for RP candidates getting receipts. There may still be outliers like lost in transit, wrong employer address etc but these are exceptions and not the norms.
2. If the check was cashed, then USCIS would have mentioned the receipt number at the back of the check. Ask the employer about it.
Those who didn’t get selected till today you can repeat the below words daily morning 2 times. Hope good things will happen

Its not as simple as you wrote my dear friend. Just imagine there are only 4 major cities Sydney, Melbourne, Brisbane, little bit of Perth the job created by whole of Aus is created by one state in the US so opportunities are always good in US. I have my colleague (Sri Lankan) here in USA he is Australian citizen. He says there are no opportunities in Aus and to get a job you need white skin even if you have PR. I am not misguiding or demotivating but telling what I learnt about Aus and at the same time I am not denying the fact that there are no successful people in Aus who made fortunes. Also, think once you loose your job in Aus will you get a new job easily like in the US? Here atleast there are consultancies to maintain your status but what about Aus or Canada?
Yes your right, Aus Job market is very small and they will always look for multi talented people. We can not simply get jobs in Aus. and also the cost of VISA is same as H1 and you need qualify PTE or IELTS with 7 score. Take right decision before going to apply.
Here is my take on this:
I gave PTE exam (scored 79+ in three sections and 77 in writing). I was about to apply for ACS (skill evaluation) when i my brother in law in US found a consultant to sponsor my H1 on 29th March. I put everything on hold for Aus PR and applied for H1 and have been waiting since them. My Plan A became Plan B.
Job market for sure if not good in Australia. I agree with all the comments above. My friends who went last year with PR havnt got job yet and are doing odd jobs. But i still recommend that we apply for PR while we wait for H1 next year. My cousin works in US and has PR for Australia as a backup. He will eventually move there as Green Card is just a dream these days. What if you dont get into H1 lottery next year as well? And what if Aus changes some rules which makes PR difficult which actually happens every year with new policies.

Guys, I just checked with my attorney. USCIS is done with sending Receipts to everyone. Now Attorneys are getting next phase of communication. Those have not received anything from their attorney, I would suggest them to work on/execute Plan B. Those who do not have any update from their attorney, will soon get the rejection letter from USCIS. All the best for the next year.
@admin I got receipt on Apr 12th. As per USCIS, for regular process, the receipt validation will take between 90 to 150 days. In that case, can i say for my case already 32 days have been complete by considering today’s date 5/13.
it depends on volume of applications. it includes all, not only h1s. last year my petition was picked in april11th. RFE received in dec. till dec it was under “Case Received Status”. petition denied in march 16. so we have to wait until they pick our case. you can raise SR though. fortunately picked this year too.

RFE on client letter. RFE responded. USCIS went to client visit and denied saying that thr was no client. per employer, they said client bankruptcy . Game over.

MRCC didnt share actual RFE notice to me but have been told that it was related to client letters, Project SOW etc. RFE responded in Oct and case denied on 27th Nov.
I believe MRCC was not having actual client letter & project running(i.e. no SOW) to produce to USCIS.

Those who are not selected till now are the unlucky one’s. Better look for other opportunities. Whatever happens is for a good. No Problem at all, my employer told me if my passport is not at least 3 years valid I’ll just renew it now and bring it during stamping, I think as long as you have the newly renewed passport no prob at all.
Did anyone receive a receipt notice today from fragomen?. I think today is May 13th(Friday) and i hope this would be the final day in terms of receiving receipts for this fiscal year as i heard in many posts saying receipts keep coming until May 15th. Should i consider game is over if i do not receive any communication today too from my employer or are there still some hopes next week?

I will respond to only the serious portion of the question. You need to have approval notice and visa stamp in hand, before traveling to US. So traveling just on pending receipt is not possible.

Not possible. You can only move from RP to PP, not the other way around.

I got my I797 receipt form from Employer. It has receipt number WAC16155***** On uscis website it is showing invalid number. Should I contact my employer or wait for few days ? I got it today only. Non Ad RP
Please Contact your employer. There is no reason to wait if it is showing Invalid. Please double check with your employer about the receipt number.

Im also facing the same issue . I have communicated on the same to my employer . They said “It’s not an issue it’s just the technical error in the USCIS portal. Nothing else to panic about.”

At times this is a technical glitch on USCIS site. As long as you have the correct receipt number, it should be fine. Try again in few days, and if it still fails then ask employer to follow-up w/ USCIS.

By looking at trend. Yes it’s every Friday Cognizant is releasing but that doesn’t mean that USCIS is sending in batches. May be Cognizant is sending out in batches once it receives bunch of reciepts. I almost lost hope now. NON AD/RP/CA.
