When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   6. Its time for the H1b program to end…..all i see is scams by these desi consultancies. They don’t pay wages when in bench, no holidays, fake resume, fake interview.

    Don’t build your career on crime. Don’t work for these body shops.
    The day you join a desi consultancy your career just ended, your career will not progress and you will be stuck there for-ever.

    • Really Very bad,

      US Government designed the H-1B program to fulfill their requirements, and set a FY date, so people can go there and start work on the available vacancies.

      But Big companies( Indian IT) sponsor the H-1B to retain the employees, and get it stamped as per their need. Then actual travel happens after one year or so. Mean while they block a H1B resource. The salary they pay is like pea-nuts.
      The client letter they produce at the time of stamping and actual client they work is different.

      Is this crime or not ??

    • I support you. H1 B should end, the only visa to allow foreign worker to work in America should be the O1 visa. It has no cap limit and it can be filed any time of the year and the beneficiary can star working any time of the year.

      The only catch is that you have to be brilliant to get an O1 visa. Its not for run of the mill folks which constitutes the majority over here.

  8. I think it is not just H-1B petitions received each year that breaks the record but also the active users and comments on redbus2us.

    For H-1B 2015 there were very few comments, for H-1B 2016 page roughly 26,000 comments (and counting) and for H-1B 2017 maybe even higher 😛

    I am about to finish my first 3 year H1B period, I did my masters here.
    I have not used any of my STEM OPT period after my 12 month OPT period.
    Is it possible to go back to F1 status and use this 24 month OPT now ? and after this 24 months when I want to come back to H1, my petition would be Cap-subject ?

    Please let me know.

      You cannot go back to F-1 to use those 24 month OPT period. If not used after the completion of your initial OPT, it is lost.

      Even if cap is reached on April 1, USCIS will accept applications for 1st 5 business days (April 7 in this year). That’s when they will make the announcement.

    • Applications acceptance will be closed if the limit is exceeded.

      No. of petitions wont be revealed today if it more than CAP, may be by 12th or 13th they will after conducting lottery.

        • Hey man, last year they closed on Apr 7th at around 7.30PM Local time.

          Apr 7th 7.30PM – They announced we have got more than CAP – Number not mentioned

          Apr 13th 1.00PM – They announced Lottery done and revealed that they received close to 2.33 Lakhs.

          Hope I am clear.

        • Because they accept for 1 week, all the petitions. After 1 week they check total number, if its below 65k they will continue to accept but if its above 65k they will stop. Last year by 7th 233k application were already received.

  13. Understand that US job market is not doing great this year.I am more specifically talking about IT job market.
    Was wondering as to why still there is so much rush for H1B. This was not the case 3-4 yrs back, when the job market was so so and cap reached only much later, understandably so.

    Any thoughts?

      Its a known fact.. USCIS Says….

      Multiple or Duplicative Filings

      According to an interim rule announced on March 19, 2008, employers may not file multiple or duplicative H-1B petitions for the same employee. To ensure fair and orderly distribution of available H-1B visas, USCIS will deny or revoke multiple or duplicative petitions filed by an employer for the same H-1B worker and will not refund the filing fees.

      Don’t know why you are so happy for those people who applied for multiple petitions and will rot in hell.
      If you have enough money to apply for multiple petitions and know the fact that it’s legal won’t you do the same.
      Don’t compare yourself with others and get jealous. It will ruin you not others (Im not cursing you, just telling the fact).

      Guys not everyone is perfect. All of us are doing mistakes if we don’t get something honestly. Don’t blame others if you are unable to do it. Just accept it and think positively.

        Two petitions from unrelated employers are OK, but the definition of unrelated is ambiguous.

        Expect potential RFE to prove the companies are not related to each other.

The count could be around 250,000 this year…..i am not here to spread any kind of fear or rumors…..I have a valid H1 and got thru in 2016…The reason am keying in this number is after going through a number of blogs or websites….This site has been a morale booster and very helpful site with people like Saurabh Around…The info I got is from the following site

    Our office is filing more petitions this year than last year, so I am anticipating that USCIS may receive 250,000 applications this year. Based on the statistics from our office and our experience with lottery filings, here is my prediction on the chances of selection:

    If you are filing in the Advanced Degree cap (US masters or higher degree), approximately 60 to 65%

    If you are filing int he Regular cap, approximately 30 to 35%

  16. I see lot of people estimating number of applications mainly with the number of LCAs filed and fail to consider LCAs filed for multiple positions.

    Consider CTS in 2015:
    LCAs filed : 3,046
    Approved Petitions: 15,680

    Not all companies file LCAs for multiple positions of this magnitude. My employer has an LCA filed for each and every position. I expect the numbers to be pretty much around last year’s. i.e around 230K

    • CTS has got more applications that is twice than last year in an aticipation that 400k petitions will be filed for fy17 cap. But they won’t file for all of them. To my knowledge only TCS and HCL are genuine while filing.. Others use lottery system to control attrition , defer promotion etc.. Big guys will announce the fedex and lca details after uscis announces count only if its more than 200 k otherwise associates will come know that their petition is not filed and finally they will get msg like your appln is not selected in lottery.. unlike desi consultancies they wont show lottery rejection letter to offshore associates.. CTS files lots of greencard upon 3 yrs visa expiry.

    • But that should have been the case last year as well. The LCAs filed last year were 539,626 and the LCAs filed this year are 416,407. A reduction in LCAs will result in reduction in the number of applications, just not by the same magnitude. I do expect a 50,000 drop in the numbers but you never know.

        The LCA’s that you see for last year also has hell lot of em coming from the H1b ammendment rule made strict last year. Due to that, extra LCA’s were filed left and right. Do not count last year’s LCA count and compare it with this years.
        I expect the number of petitions to be much higher than last year.

  18. Looking at last year and this year trend in LCA filling, i really feel this year the number of petition 35% less than last year . I guess it would be 140K to 160K.

            I explained this earlier but probably it is buried under comments somewhere. Let’s take a hypothetical example.

            Employer files LCA on Mar 15. As LCA can be filed 6 months in advance, the dates mentioned would be 15 Sep, 2016 – 14 Sep, 2019.

            Employer then files I-129 (H-1 petition) on April 1, which can again be 6 months in advance. So this petition would be for period 1 Oct 2016 – 14 Sep, 2019 as I-129 should be for the dates covered in LCA.

            For this reason, these LCAs will show-up in FY-16 on DOL site even though the corresponding H-1 petition is for FY-17. Makes sense?

  19. This is my 2nd attempt and I studied here in US and I met so many friends who say I deserve to have H1-B because of so and so reasons
    Lets analyse how you are more deserving

    1. People who studied masters in US feel more deserving than who are applying from India
    My opinion why ? I studied here too but at the same time people applying from big MNC’s have tremendous experience already, but Yes but folks applying from desi consultants without prior experience and no masters directly from India that is something to talk about

    2. People who studied Masters from top universities stand better chances than those who have studied in mid level to low level ranked universities but still stand equal chance to people with 5 yrs of experience who is applying through MNC’s like Infy, CTS, TCS etc.

    P.S: Overall I think, one should not judge anyone, if you believe that person his getting favorable advantage.. believe in Karma. Karma is gonna decide sooner or later. Life is much beyond than H1-B. Don’t make H1-B your life goal

      Please dont say ppl who pursued MS is deserved more than the ppl who applied thru Indian Consultants. Even experienced ppl who can’t apply thru big companies are going behind consultancies.
      Moreover, not only the inexperienced ppl are putting fake experience. Even the MS students while attending visa interview, they would have committed to the interviewer that they will return for sure after completing MS but they are planning to settle down before writing GRE.
      And yes, as you said since they put hard work in studies, they have been allocated 20k separately.

      Now tell me what was your answer to the interviewer for ‘What will you do after pursueing MS?

      • This is a misconception. F1 states that the intent of the person is to seek only education on that immigration status not employment.

        This is for the cases when people are enrolled in a degree program and do illegal jobs/ CPT that abuses student visa. All they want is to change to a different visa status if you want to reside permanently in US.

        If getting employment as per rules on F-1 was illegal, why would there be an OPT in first place? Why would there be a change of status provision for that also includes F-1 student to make shift to H1b without consular processing?

        In visa interview, all visa officers care about is how your profile is, your academics and finally where are you headed to. I knew a guy who studied at University of Wisconsin who had her sister residing in US on green card. Even his immigration petition for family based green card was filed during F-1 interview.

        He was swiftly granted visa. In another guy interval I knew, officer asked his plans after M.Eng. he told that he would probably apply for Ph.D or find a relevant job in his field in US. He was headed to Cornell and got his visa stamped.

  20. Oh USA, please attack India and make us your 51st state. We will all be US citizens and no H1-B headache. We were all UK citizens until 1947, then stupid MK Gandhi and others gave us freedom.

    If they had not given us freedom, we all would be UK citizens, earning in pound sterling and no visa required to travel to USA.

  21. People here does not like to see other people posting that there will be no lottery conducted this year, but when others people say that the cap has been reached on the first day they dont like it too. Lolz!! What do you really want????? ???

    • Nothing new. 1st day is the busiest and USCIS receives more than 65k on the first day when there is a huge demand.
      Anything above 65k is termed as cap reached.

  22. Wishing Everyone Best of luck. One more day to go …. For some reason i believe this year the number of application will be definitely a lot less then last year. My guess is around 140K to 160K + or – 5 to 10K

    Just for my knowledge, may I know last time when USCIS did not conduct lottery, I mean they received applications within the required quota only? And since when this trend of lottery started?

    • USCIS did conduct lottery last time ….It has been going on from 3 years or so as the number of H1B petitions received are much higher than the Quota….
      We should get to know by 7th or 8th if there is one this year..

  24. Can we expect news from USCIS on cap tomorrow? Last year it was on April 7th.
    If we don’t hear anything tomorrow, then probably less number of petitions were received?? Is it correct to deduce that

    • USCIS will announce when they have reached the cap quota. If you don’t here anything tomorrow or day after tomorrow then perhaps it means less number of applications and the cap quota is yet to reach.

  25. Mine is very unfortunate situation… Last year my h1b got picked up in lottery but rejected due to SOW submitted was expired.. this year I have applied with different employer not sure about lottery.. fingers crossed..

    • Why are you wasting your life? Even 1 h1b application is life sapping, you are ready to go through another one! I just hope you are not doing this through Desi Consultants, otherwise add being returned from port of entry to your worry list.

    I need to know one update,

    while filing my H1B in my company i have not updated my resume experience details as a current one(Currently i have 4 years and 11 months of experience) but in that resume i have updated as more than 3 years. I’m so scared now. Will it impact my H1B process if it got selected in lottery.

  28. What does “Certified” status denote in LCA count website? does it mean the corresponding H1B petition has been received (not yet selected in lottery) by USCIS?

      It means LCA has been approved. It has no co-related to actual H-1 petition which is I-129 and managed by USCIS (LCA is managed by DOL).

    First of all RedBus2US , great forum.
    I didnt get through lottery during 2014 season.
    Now i’m applying this year. I got a FedEx receipt from my Employer. Package is delivered on April 1st.
    And this time package delivered to California Service Center… My 2014 was Vermont Service Center.

    Lets see my luck this year… I wish all the fellow applicants good luck…

    H1 B Fever Started ?

        Come on.. its just a FedEx receipt number provided by FedEx(Post Man :p) to the attorney who shipped it using them.
        You can only use this number in FedEx Site to track the package.. USCIS is irrelevant here.
        Hope this clears your doubt.
