When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

        • Is this info accurate? I mean last week when I called, I was told that they have been updating respective applicants as soon as they are selected. Why would they wait till16th when data entry is already completed.

          • Yesterday Only they replied to my mail saying that they got the receipts but name are with attorney so they will share on 15th May which is definitely contradicting with what they said earlier but we don’t have much options here so lets wait till 15 May and see what happens.

    I did my MBA in a top school and spent $100k to get a good career. As you know MBAs have only 1 chance, and my hopes r gone now on h1 and my opt ends this month. On the next steps, most say joining college that gives cpt day 1, but I see there r risks associated with it and might have issues with h1 later on. Also, most went from MS-MS or MS-MBA, but not MBA to MS that too to a low profile university. If I stay here I will stay obviously to work as I cannot spend now without working.
    Based on your knowledge/experience, what do u think I shd do. Should I join college or go back to India and take a better career (ofcourse pay is low) and apply next year. What do the attorneys say with joining such cpt colleges. Please help me as I am confused.

    • It is your decision entirely to pursue a second masters program. However if you consider an MS within any STEM program as your 2nd Masters, yes you will be eligible for CPT and OPT subsequently. I know a few friends who came here to do an MBA and took this route to sustain status, work and study while on CPT/OPT. They have also found success in securing a work visa in subsequent years as an MS gives more time during your CPT/OPT duration.

    • Hi Noluck,

      I can understand and sympathize with your situation completely. I had a few friends who were in your shoes. They prepared a plan B (perhaps you are doing the same) which involved applying to global employers who can transfer you to a different country (Australia/Canada or EU) in case their H1B did not work out and then bring them back in L1. If your company has a global presence, please talk to your HR to see if they are willing to explore this option(most are). In case this is not an option, please try to see if you can get a job in such a company in India (or you may try Aus/Can). That way, although you may have to go to India for a short period of time, you can come back in L1.

      Fellow MBA here, can give you a few insights.

      I only know a few MBA’s who went for CPT, but with increased scrutiny on these type of programs, there is a good chance for rejection/denial for H1B next year, or worse being stranded in another country when you go for stamping. Also you might want to change employer asap if you opt for CPT to prevent scrutiny next year. There is risk in terms of money, opportunity and effort.
      Going to India would mean starting over with job search and will depend what your current role is, I believe your are not a consultant or part of company with global operations, otherwise they usually send MBA’s to other offices. So if your goal is to come back to USA or go to another developed country, your best bet would be a multinational tech company in India. If your goal is to further your career in India, you can target likes of Amazon India, Flipkart etc. You can also struggle a bit more and try to launch a business in India itself.
      Lastly, you are short on time, examine carefully pros and cons of each option and chose one, an MBA from a good school is great asset, don’t lose it on some shady schemes.

      Many are in cross roads like you. In my view, you doing another Masters in US will not really get you more probability for being picked in lottery. So, spending another couple years for education trying for lottery is not worth it. Also, doing full time job on CPT from a low profile school, which cuts corners is not the best thought….if you have MBA from good school, I would not recommend cutting corners with low profile school, it is risky and secondly it ruins your MBA brand equity. While, it is a tough decision, I would just move on and come back to India and take up good job in India. I know a good friend of mine, he choose to come back and work as a product manager in one of the top Startups in India. The reality is that, if you are from a good school in US, you can leverage that well and get a good role in Good startup and make decent money and gain experience…you may try for H1B next year…it is a very tough call to take, but sometimes you need to cut your loses…You have a long career ahead and cutting corners can be risky…Think about it and make an informed decision.

        Kumar, we should also mention what happened to Sadhu two years ago. One of our friend actually joined a low profile school to try again for lottery in the next subsequent year & he did get picked up but his application was denied later. The point we are trying to make is it’s an easy path but with some risk. But we would highly recommend you to try atleast one more time because you never know that decision might change your entire life.

          Thank you very much for your response, it does help. You mentioned give a try one more time, is it waiting for h1 next year by opting for cpt (of course I understand risks and that would be my decision).

          Right now I am in a position where I can’t take corners nor I can opt to directly come back to India without a job. I am planning to simultaneously apply in India and hope I get a good opportunity so that I can come back (end of day I need to pay loans).

      Does your employer offer working remotely, say from Canada? If yes, then you can move to CA and then try for H-1 next year.

      • No Saurabh, I work for a consulting company so no options to move to a different country. I am trying to look for options in CN or Aus, but both needs work permits or at least job offers, if I am not wrong. Getting them is not easy as of now, but I am trying to get my contacts to see if there are chances.

        Also, trying to see if I can join a college for 1 year MS degree and maintain F1 so that I could apply next year. Does this option seem sensible and is not a risk as I am not taking CPT? Please suggest

          F-1 runs into issues especially if it is through one of those schools that offer CPT from day 1 just to get more enrollment. If you are going through a better reputed school, then it shouldn’t be an issue.

    • It means the application has been approved and they have mailed the documents to you. If you do not get the documents by the date given in the status you can request them to send it again. Congratulations and all the best.

      OR.

      It is possible that something is missing in the documents that your employer mailed USCIS and they are returning it back. May be a missing signature, incorrect check amount or something like that. You have to wait and see.

        • I am having 12 years… Applied in 2007 ( for the FY 2008) for the first time, and uscis announced of lottery system only in that year; because of my stars, not selected. Then came recession and didn’t apply, but, got a very good job with very good pay in India, realized that God is with me.

          Again applied in 2014, didn’t pick, but, got a very good hike and bonus from my company. realized God is with me.

          Again applied in 2016 ( this year), again no luck… but, I am sure, something very good is waiting for me ( better than H1).

  6. My h1 got picked in lottery on 29th April. Non-Ad/RP/VT . When can i expect the receipt to be received? No response from employer on that .He says wait until approval.

    • Many employers tend to refrain from sharing the Receipt # and they let you know the final decision only on your petition. Don’t worry and check with your employer in another 15 ~20 days to get an update. You are already thru dude. So enjoy !

  8. USCIS is doing background check for all h1’s very deep it seems, one of my friend applied this year AD/PP, he told me that there is some verification going in his employer, he said they are verifying all h1’s they filed and selected it seems.

    What was the last day when cheque was encashed or an ack. receipt was received last time in 2015, for Non-AD/RP H-1B petition..

    And can we get to know whether VT or CA service centers have completed sending out ack reciepts to the Attorneys/Employers ?

  13. I have received my Receipt on 05/06. Notice Date 04/27.
    Non AD/RP/CA…….

    Looks like it is taking 9 – 10 days for CTS to receive and upload the receipts into Post-processing app. As we know, USCIS has completed the data entry on 05/02, so CTS guys can wait until 05/12 and move on if you didn’t make since then.

    This is my 2nd attempt and succeeded this time. I know how it feels as I already felt it last time. But the truth is H1B is not everything..Keep trying and you will succeed oneday.

    I have a query regarding wait-list petitioners as I there are multiple filings for a petitioner from different employer.

    1. When will USCIS notify about the wait-list petitioners ? Is there any time line? Will they provide any press note officially?
    2. Will USCIS share receipt number to the employer before the decision is made about the rejected/denied petitions that were selected in the lottery?
    3. Will they encash cheque first and then generate receipt notice only after the wait-list petition is considered?
    4. USCIS will officially announce the return of all petitions on a specific date? Does it include wait-list petitions as well?
    5. How do we know that the petition is under wait-list?

    Please respond to my query as this waiting is really killing giving so much stress.
