When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     I am systems engineer in infy and my H1B has been initiated. Mean while I have been Placed in CTS as Associate with 100% hike on my current salary. I am waiting for the result of lottery. So I want to ask what should I do in case I get my visa selected in lottery. Do i have the option to quit infy after getting my visa result, will infy give me my visa if I want to quit and want to join CTS? Please tell me have will be best for me.

    • If you quit infy even though u got selected in lottery they will cancel visa..I am also from CTS.just ask CTS hr u join after 1 month….

      CTS will file green card after year 1. where as Infosys and TCS will never file and will wait to utilise 6 years of H1-B.
      Your choice
      CTS is a best option amongst big MNCs as they file GC

      If you leave Infy before your H-1 is approved, then they can withdraw it and you will be considered out of lottery.

          Just getting selected in the lottery doesn’t allow you to use that visa in future. That petition has to get approved and only then can you use it for a different employer.

    Anyone from IGATE/Capgemini who got the receipt, what was the last VRF status before getting receipt details. Was that

    Processing Status: Case Filed with Immigration
    Pending With: Immigration
    ??

    I doubt if IGATE is filing all the cases for all the candidates.
    I think if your status in the VRF say’s :

    Processing Status: Case Filed with Immigration
    Pending With: Immigration

    Means it is not filed!

    Anybody who received their receipt, can you help out here to understand what exactly VRF status means?

      Now related to results on lottery, all i know is that the previous trend in CG has shown that
      they start sending results only after Mid of May…

    if your current status is “AcknowledgeFromUSCIS” –> it means rejected internally

    or “AcknowledgeByUSCIS” ??? –>Petition filed with USCIS

    Not sure if its true or not.. just my friend updated me….

    any body has AcknowledgeByUSCIS status in GICIS portal… Please check and reply…

      Well, I love to wear my sarcastic hat at times.

      Can someone help me to write a program (Mac please) that overrides my keyboard keys with few heavily used responses. The use cases are:

      Pressing F1 populates the text “Yes, you have been selected in the lottery” (to be used in response to hundreds of questions where someone received the receipt number but wasn’t sure that they made through the lottery)

      Pressing F2 populates the text “Yes, once the check is cashed, it means you have made through the lottery” (to be used in response to hundreds of questions where someone saw their check being cashed but wasn’t sure that they made through the lottery)

  33. I lost One of the documents , i submitted with the petition and later got a duplicate issued with FIR/News paper advertisement etc process
    Meanwhile the scan of lost document was submitted with the petition
    What should i do now, is there someway i can get the scan of duplicate copy introduced or what should be my action in this situation

    • TO Admin/Mr. Saurabh,

      No action required at the moment. I am not sure what document you are referring to, but it looks like a degree or mark sheet. You need to submit copy of those documents and not originals. So its ok to have submitted the copy. If USCIS needs original for verification, they will ask for same (although highly unlikely) and you can submit the duplicate at that time.

  34. My Check got encashed on April 21st. AD/RP/VT/1st. Still no receipt. Employer confirmed again that check has been encashed but the receipt is delayed for some reason. Has the receipt lost in transit ?

    • Imcool,

      Ask employer is the receipt number is mentioned behind the check. Usually that is the case. Also, your employer should follow-up w/ USCIS if they still don’t know the receipt number.

      Yes it is one degree certificate and one experience letter, the issue is the original degree certificate for which i submitted a scan has a certain serial number while the duplicate i got issued has “Duplicate” written on it and has a new serial number
      My concern is the scan and original (if asked by visa officer during stamping interview) will not match and may create an issue
      What do you think?

        I still don’t think it would be an issue. This is a not a fraud document that you have submitted. Both documents refer to the same thing even if one is marked as original and the other one is a duplicate.

    ~65% of all H1B petitions are from India and i bet 80% of them are from Consultancies and IT giants just casting a big net and grabbing H1 B’s to be used whenever they want to, leaving behind well deserved candidates.

    i am not giving a solution here but just presenting a fact. This creates an opportunity for USCIS to find a way to better allocate the visas. I know people from IT giants and consultancies deserve it as much as others do but there has to be a need for the visa as in a project that requires immediate resources. The visa should not be given to people who show fake projects or for people who will be flown to the US when they get a project.

    • Again what do you mean by well deserved, what have you done that makes you or some one else to deserve h1b more than some random guy, its the nature of consultancy industry to keep H1b visa at hand to fulfill their business needs. If uscis have a problem with that and they can have with any thing be it logical or illogical they would have done it its there country and let them decide the rules.

  41. People who filled with multiple application ,kindly don’t do that. Think about it because of you a lot people have to lose their jobs. It is not a good idea to pay a consultant 8 or 9k just to get another application sneak into the system. Feeling frustrated about the system .

      • But, using a consultant is a crime, isnt it? There are other genuine employees like me got it applied by genuine employers for real reasons such as need of specific special skills etc(not outsourcing). They are affected by these consultancies..

        • Using a consultant is not a crime. Companies like Deloitte, EnY and so on are consulting firms as well. If a person can get through to both these companies for example, and they file applications for him with competitive offers, would you call that a crime? However, hiring a consulting firm, paying them money for applying without a genuine project, that becomes an ethical violation – far from being a crime. It does effect many genuine candidates, but yes, in a random lottery based system it is everyone for himself. People rarely think about the person next to them in these kind of cases.

          • I was referring to the people paying money to consulting companies only.. Also, the outsourcing companies like infy, wipro, tcs etc.. For the sack of providing cheap workforce for trivial jobs to their overseas clients, they are shooting in the dark by applying a large amount of applications to get a good turnover. This is hurting genuine people with genuine applications badly..

            Ppl who are applying single petition… Dont call yourself genuine… Simply say that u dont have money to pay multiple… Each and everyone of us are selfish and will use the chance if we can…
            If u dont apply that single petition, that might be helpful for other genuine person… So either stop applying or stop blaming others…

        • The actual offence committed by the Indian IT companies, mostly they file H1 only to hold their employees without any genuine visa or job opportunities with the help of there strong hold with customers (issuing client certificate). And blocks H1 visa holders for years, and once their employees travel to US, the salary they pay are like pea nuts.

          For example: one of my friends H1 got stamped in 2015-Sept still he is struggling for a project in US, His manager assured (not confirm) that he may travel to US in July.

          Consultancy are far better, they call their employees as soon as the stamping is done and the salaries also 80% of the billing.

    • though I’m not supporting the idea of multiple applications, but it doesn’t matter. USCIS has to take 65K. 2 Application wud end up in 1 actual person and if there are vacancies left after whole process, they wud draw it again to fill in the blanks. Do guys, chill and don’t be frustrated by all this. Who knows you’ll get it through vacant positions (may be cause ur stars are at high that time 🙂 )

  46. I finally received the receipt after 2 frustrating attempts, but what i see now on the USCIS status tracker is
    “On April 28, 2016, we updated your name for your Form I-129, Petition for a Nonimmigrant Worker, ” is it something i should worry about, what does it really mean?

  50. Saurabh, if RFE is generated in PP case than also they generate the receipt and intimate the employer / attorney (as in regular case) that this case has been selected in lottery? Or they inform the employer / attorney after all PP and RP are completely dispatched? i.e. after 12th May.

      RFE is only generated if your case is being processed which is only possible if your application was picked in the first place. I am getting sick of you guys asking me the same questions repeatedly. Please look through the other posts for answers before asking me

I am still confused about selection in PP lottery and generation of RFE. But I think I should avoid asking you. You must be tired man. I leave it to Almighty to decide my fate.           • My only question is – if case is selected in PP than USCIS send the receipt or inform the employer / attorney by email before verifying that it is a RFE case or they send the RFE request only to the employer / attorney and that too after issuing the notice of selection to others who all are selected and are without RFE. I hope you must have understood this question. Thanks Saurabh – for at least showing the readiness to solve my query.

            All selected petitions will be notified about their selection through the receipt notice. This is independent of what happens during processing of each petition – RFE, approval or denial.

            After that each petition (PPs first) will be processed and would be approved or RFE would be issued. In case of PPs, employer/attorney would be notified over email.

            So if you have received receipt number, you are selected and now petition is pending adjudication. If you haven’t heard any receipt number, then most likely you didn’t make through the lottery as this is a PP scenario.
