When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

USCIS announced on March 16th, 2016 that they will accept FY 2017 petitions from April 1st, 2016. Read Summary of USCIS press release FY 2017 .

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.
  • April 12th, 2016 – 6:30 PM EST : Official Update :  USCIS released a press note that H1B lottery was completed on April 9th and they received over 236,000 petitions for FY 2017 quota. Read Press Release Summary  
  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     Hi All,

    There is no point asking about the first and last name of the lottery selected employee.

    Don’t lose hope until the non selected receipts are updated in the system.

    Its entirely random and one can expect a receipt mail anytime, there is no pattern or any timings associated with that.

  4. Are the receipts sent alphabetical order wise? Does that mean the chances are lean for ppl starting with alphabets before “P/Q/R/S”? Any idea?

        • One of my friend who received the case number has name starting with “R” , the second person in my ODC who received the notice has name starting with “A” . So I don’t think its the alphabetical order that’s our HR/GIT is following.

          It might depend on the order in which the receipt was received by CTS and they are sending notification in same order. So keep your fingers crossed as we still may have chance.

          As per the admin’s comment in other blogs, we have hope till next week. After that probability will get lower and lower.

          Hope for the best and be prepared for the worst 🙂

        Believing in the Almighty is a different thing and eating samosa is another thing. If Almighty wishes you get the visa, it will be. No samosa can change it. So act mature and accept the loss gracefully, you will get the visa when the time comes. Chill.

  8. If i have been selected in lottery and now i come to know that the company for which i am travelling is not doing what they committed.
    1. As they paid for my visa can my visa be still valid if i deny them to join?
    2. How do i approach new company to travel?
    3. Can anything go wrong in doing all this. Can the company revoke my petition. I am fine to pay them visa fee.

    • Once you indicate that you are not joining the company they can revoke it. You can’t transfer your visa at this stage. Even if you pay the Visa fee, the chances are slim to get this transferred to another employer.

      1. Once approved, your petition can be used for cap-exempt purposes by a different employer. This petition can be withdrawn by employer anytime, but can still be used for cap-exempt purposes.
      2. Find an employer and ask them to file cap-exempt petition for you once current petition is approved. Submit copy of current approval notice or at least the receipt number for this
      3. They can withdraw the petition anytime they want. Do not pay them the money as that is violation of H-1 rules.

        “Dear Employee, Please note as and when we receive an update from USCIS as to whether the Petition is picked in lottery and whether it is approved, we would update the details in GICS system. Request you to wait for the same. Also refrain following up”

    Can I change from regular processing to premium processing at this stage and send additional documents to USCIS for my application? Or should I send additional documents only in case of a RFE? Please let me know. Thanks.

    I really appreciate if you could share your wisdom regarding green card. Please bear with me for this long message, but it is important to know the story to give a better suggestion. I am basically bypassing this H1b scenario due to its uncertainty and we are also living our uncertain life, which we would like to stabilize our life.

    First of all, my wife has a Master’s degree from one of the reputed universities and she also have couple of scientific publications. Currently, she is working as a process engineer in one of the major semiconductor company. She have applied for H1b visa this year and we have not received any updates so far yet, I am thinking that chances are getting slimmer as the days are progressing. Additionally, I also have a PhD in Neuroscience, but not much publications to apply for an EB1 green card.

    With this background, I started thinking plan B, which is applying for a green card, since her company will would like consider to apply for a green card, since she is been working about a year or so. Please let me know if you can help me with a bunch of questions I have. Below are the questions listed.

    1) How long does it take to get a EAD card if my wife applies under EB2 category and do we need to have H1b visa before applying for EB2 category?

    2) I know that we can apply for National Interest Waiver green card, without any employment or H1B visa. Since my wife have a Masters in Optical Science and also a Masters in Material Science, and some publications (3 papers and 2 conference papers). Does she have a better chance to apply under NIW green card?

    3) If My wife or I qualified to apply for an NIW green card, then how long does it take to get EAD card?

    I greatly appreciate your suggestions as I am in distress because of this H1b.

      1. She will get EAD once her I-485 has been filed. If applied in EB-2 India, this could several years. They are currently processing 2009 EB-2 India and your wife’s application will be from 2016.

    Please can you suggest me on below scenario.

    I am AD/RP candidate; I am working for Campnany-A on OPT.
    My compnay A refuse to file my H1b this year;
    So I have applied for h1b from Company/Consultancy -B. Fortunately my application picked in lottery.
    Now scenario is Company/consultancy-B, not giving me receipt and they are telling they will share after I join them on Oct.

    How can I get receipt from them? so I can believe they are telling me right.

  21. I applied for h1b….on april 15 i went for the change of driving licence from one state to other state….the driving office told me they are unable to verify my immigration status…..so they kept my case under review…
    Does it mean i am picked in the lottery….??

If USCIS has been received only 65004 applications for this year also i should heave not selected… :(…. Feeling very bad… Please suggest me…

    • Four Applications – Still not Selected ; Really Unfortunate, Most unlucky. That too 3rd Time – Feel Sorry for it. Pls change ur plan to other country or different options – Valuable time gone with American Dream and Money lost for Applying multiple applications. Think wise from now, Apply common sense… US option is not working for you Buddy – SaiRam

    • This year USCIS might have filtered all multiple employer filings in initial stage itself last year they issued rfe and denied but they year they could have removed in initial stage itself I have seen many single applicant selected but none of multiple applicants

        Its not like that buddy. As many offers you have.. Then companies won’t leave you.They can file the petitions from der end. Leave about these desi consultancies. Please don’t make assumptions 😉
        You should not file duplicate petitions and should not pay for H1b.

    I had been a constant watcher of the comments section here and added few points based on my old experience, last year.. Unfortunately this year too, we hit a new mark in petition filing.. though I too predicted that count will be less this year ( along with Data Analysis, Sid and few other gang members) but what really hurt is the number of AD people graduating every year, is just increasing in manifolds .. and we all proved to be wrong in our analysis.. though i still quoted that somewhat number will be same , might be less by 25-30 K but will be plus 2 Lac.. Well , I dont know fate of Data Analysis or Sid in lottery, but somehow my Future employer told me that I have been picked in lottery.( he got my NON AD/RP/VT receipt number yesterday).. It was such a relief .. i had been to US for 3 months trip and certainly wanted to shape my career there.. I had been trying since last year , every time single petition ( not saying I am worthy) and it came at such a time when I was just saturated wd my current role in current Org… Well no body has predicted future , but all you can do is have your plan B , C ready.. I had mine.. I applied to Canada, had offer letters from 2 companies in Bangalore and had been looking aggressively for a positive change( got admit in USF, UTD MIS course last year as well)… believe me though u r picked or not picked, actually , you wont gonna make a substantial difference in your life by earning in USD… there are many fruits which only ripe in India… Opportunities… and yes though I will go to US in Oct ( if petition is approved) I have my plan B,C ready….. Cheers to every one who got it and good luck for awaiting members….. Support Hillary Clinton, she might change visa system in our favor…. 🙂

    In a notification email on Apr 22, USCIS mentioned that 15-day processing period will begin on May 12, 2016. I am curious if people have started receiving approval notifications.
