When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Is there anyone here for medical technologist position/MLS? I have completed all the documents required by my employer/agent and we are regularly communicating until this last week of March, but I just want to make sure if the file was submmitted. I can’t directly ask them about it because it might give them a bad impression for not trusting them. Are there some ways to find out if the employer filed for you? Thankyou.
No you can’t track it by yourself. You need the tracking number from the courier and check if it was delivered to the USCIS, so you have to ask your employer about it. BTW I’m just like you a MLS.

I completely agree with you. Because when i see the total no of LCAs filed with start date between July 1st and sept 30th 2016, it comes to 214K and considering each LCA can have multiple H1Bs , give or take 300K is my guess too…
In 2015 number of LCAs between 2015 July to September were: 307,106
With your logic 2015 should have got appx 400k applications.
It is going to be between 160k-190k this year.
@DataAnalysis – I hope you are not missing the fact that 2015 includes location change, employer change and project changes cases as well for which employers will file LCA. But for the number 214K that we are seeing between July 1 and Sept 30 2016, it does not include any location change, employer change and project changes cases as employers dont file LCAs for these cases 3-4 months in advance as they never have visibility. So everything that you see for July 1 and Sept 30 2016 are purely for new H1B. Hope you get my point

Although I do not completely agree with your assumption let us dig deeper into your data.
2015:
Total applicants 233k
July – September: 307k
With your logic in 2015 – 74k were transfer etc cases(307k-233k)
Let us add the same number for 2016
214k + 74k = 288k
This number less by about 30k as compared to last year. So it still cannot go 300k.
@DataAnalysis – 214K LCA does not necessarily means 214K H1B, it means atleast 214K H1B. Each LCA can translate into multiple H1B filing. So give or take, my assumptions is 230-250K H1B filing. I sincerely hope my math is wrong and total numbers are less and that increases our possibility to crak the lottery.

It’s so scary. I am currently a student graduating around July. I am not eligible for OPT because of the extra time i spent on CPT. Since I don’t have degree yet, I am not eligible for Advancr degree quota.

I didn’t analyze the LCA data but i see a lot of spike in H1b filing in March .. And probably more number of graduating students.. Though i was optimistic that count will be less as i heard less number of petitions being filed in Indian MNCs.. But since we have presidential elections in Nov, ppl are putting more effort in terms of multiple filing and cosultancy filings… So my guess is, its gonna be rough this year too…..1:3.7 for non AD ppl… I have started working on alt. options too… Have little faith now….

Seeing lot of good analysis. But I came to know that this year 150k students became graduates and applying for H1B (not sure about the count). In that case, we can expect the same count as in 2015 right.
No, there were about 34k on OPT extension this year + regular OPT ~ 20k + new grads for H1B ~ 10k, so in all around 50-60k would be advanced degree applications.

180k is what I am sticking to. There is always a chance of +- 10k.
I see lot of people doing lot of analysis here. But my theory is simple – any LCA with a start date of July 1 2016 upto Sep 30 2016 has to be for new H1 filing and if this theory is correct then the number stands at 214 K. Because I dont see a reason for any employer to file LCAs with 3-4 months down the line start date for any reason other than for new H1B. And many of these LCAs will be for multiple H1Bs. So my prediction is it will be atleast same or more tha last yr. Pls correct me if I’m missing a point here

Every H1B needs a separate LCA. But every H1B petition can have multiple LCAs filed for them.

Obviously you don’t know how this works. Every petition needs to be sent out with a certified LCA. LCA states that there is a job position with a specific salary available in a particular location in the firm. If there is a single LCA filed for two H1 petitions, that means both are fighting for the same job position. If your employer is telling you he has filed your H1, and you are finding that the total LCA count to the total H1 count is less, then understand that you are tricked. Your employer didn’t file your H1 this year.

A company can file single LCA for multiple positions if the designation, job duties and salaries of all of them are same.

The employer wants me to file on his behalf. He wouldn’t do any work and told me to file the paperwork. =/ And i have ZERO clue of what to do. Here i am blessed with someone who wants to sponsor me but i dunno how to proceed.

I don’t think you need a lawyer to file this paperwork for you, you can do it yourself they just recommend to hire an attorney to do the job for more accuracy I guess, because the paperwork has a part where the attorney can fill in if he/she is filling for you and there’s a part where you can put the name of owner of company or person designated and authorized to do the paperwork. But at least if @Shah had started the paperwork this Monday would have definitely had a chance to apply this year
My LCA took less than a week, they said that it takes up to 7 days to get it back, if you file today and while you wait fill up the application you might be able to get it in, for what I’ve been reading it says that last year they accepted applications until April 7th. But when I went to talk to a lawyer about the H1B visa he told me that it was only 5 days. so until April 7th.

They accept for 1st 5 business days. As there was a weekend in b/w (both last year and this year), they are accepting petitions till 7th (which is still 5 working days).

It is too late to file LCA now. It takes a week or so to certify and then employer has to post on internal notice boards. LCAs are filed w/ DOL and not USCIS. They would continue to accept it even after cap has been reached.
USCIS will continue to accept applications but they will be rejected after the cap has been reached. As lottery is expected to be reached, USCIS will start rejecting any application received after April 7.

Will Denied Petitions add up to the next year Quota?
For Example : If in H1B FY 2016, out of 85000 petitions, 1000 are rejected/denied,
will that 1000 add up to FY2017 quota?
Will FY2017 become 85000+1000 from previous year denial?
No, its only 85,000 per year

They usually select few extra petitions to make-up for the ones that are denied after initial processing. The numbers are not published and they take-in extra petitions based on historical data. Also, remember 6500 are kept aside for Singapore and Chile residents and not available to others.

Here is my thought:
The date range in the LCA should be 6 months before you start.
Example: Sept 15th 2016
I filtered the number of LCA between April 1st and Sept 30th for the last 5 years and this is what I got:

2015-394601
2014-301427
2013-247992
2012-209525
After going through all the data analysis reports posted here, I’ll assume that numbers are going to be pretty similar to last year as job market in US pretty strong, and it directly increases applications. There might be some decrease wrt TCS etc, but then there are whole bunch of MNC’s, desi consultants who take advantage of job market. No major change has been introduced in the policy, and increase in fee impacts only a select few. So around 200k would be a good estimate.
Updating my forecast to 130k-140k on the basis of much larger data analysis.

I have to update it to 160k – 180k. Based on alternate ways of analysis.

You are right about the part that most LCAs for this year’s lottery will be filed between August and September.
But, I personally know that Delloite and some similar companies starts filing LCAs for H1 lottery aspirants from January.
So, if that is the case, then LCAs filed from Jan will have start date from 180 days from that time, I am keeping the start date as July.
Also note the sudden hike in application count when you consider May, June and July. May and June have about 10,000 filed. July has 25,000.
2016 -> July1 – Sept30 – 208,000
2015 (including transfers) -> July1 – Sept30 – 307,000 [Actual H1B lottery count – 235,000]
2014 (including transfers) -> May1 – Sept30 – 235,000 [Actual H1B lottery count – 185,000]
2013 (including transfers) -> May1 – Sept30 – 190,000 [Actual H1B lottery count – 125,000]
You are keeping the LCAs for transfers at a very less number. It is about 25,000 a month according to me. And, I feel that’s about right. Everytime a contractor moves to a different location, the consultancy files an LCA.
LCAs filed between Jan 2016 – Mar 2016 => approx 80,000.
Now, for 2016 if transfers amount to about 25,000 LCAs a month, then total LCA count for those months would equal about 280,000.
The best part here is that, it is still less than 2015 figures, but definitely more than 2014 figures.
So, after some changes I am extremely confident my numbers are right and the total H1 lottery count will definitely be less than last year’s count.
Cool. Now we are converging.
Even I think it is less than 2015 and similar or slightly more than 2014.
In 2014 number of applications were 172k.
That is why my guess is around 160k-180k.
180k looks more realistic. I am happy with these numbers. People were projecting 300k etc. It would have been a disaster.
180k -20k(advanced degree) = 160k
65k/160k appx 0.4 => Appx 1 out of 2 application will get picked.
Are you considering the fact that a single LCA can file for multiple H1B filing? For example I have seen quite a few LCA’s for 25 new filings.

You are doing a wonderful job, a couple of points from my side because I am not sure you have considered these
1. DOL website take normally a week time to publish LCAs the data available so far is LCA published till 20th March, there are a few more to come, LCA rates at. the end of March ~2000 – 2500 per day. I know this because last year my LCA was dated 25th March and it appeared in website in first week of April only.
So expect ~20000 more LCAs from today to 31st March
2. A single LCA’s can be posted for multiple job positions, Last year my LCA contained 10 positions though fresh H1 was applied for only 4 with same LCA
I have seen LCAs with 5,10, 100 even 200 positions so its difficult to predict how many H1Bs are going to apply with those LCA

You are doing good work. But, I can give you a better estimate.
Consider your stats:
2016 – Total LCA Till Date: 379,466 Infosys: 19,375 TCS: 5,276 Wipro: 6,783
2015 – Total LCA Till Date: 540,098 Infosys: 36,029 TCS: 17,822 Wipro: 10,580
Your 2016 stats doesn’t include 6 months of LCAs. These are LCAs that are usually transfers or cap exempt.
Now, you are betting on the estimate of LCAs that will be filed in those 6 months will be less than 100,000.
But, my stats show that about 160,000 more LCAs will be filed in the next 6 months.
How did I get that number?
Well, Oct 2015-Dec2015 about 80,000 LCAs were filed. All these LCAs are cap-exempt or transfers.
So, approximately 160,000 LCAs will be filed in 6 months. That takes the total LCA count for 2016 FY to 549,000.
The total petitions count will be approximately same. Don’t raise your hopes DataAnalysis. I am in the same boat, but I am being more realistic with numbers.
My bad. The total LCA count will be 539,000, which is very very close to the previous year figures.

Let me analyze your number little bit more
Your theory is base don 3 months data which comes to 80000 and then you assume each month it will be same.
80000/3 = 26666
You came up with 160000 y doing 6 * 26666 = 159996(apx 160000)
By this logic total transfer case in the year 2015 would have been 320000.
Now total LCA in 2015 – transfer case = fresh petitions in 2015
540,098 – 320000 = 220098 (very close to 233k)
So I guess you too have a valid point.
But here is where I differ from your analysis.
Most of the fresh h1b will have start date between 08/01 – 09/30, let us capture this data for each year. There could be some transfer cases during this 4-6 weeks but I do not think it is going to be huge.
2015: 08/03 – 09/30 = 237,365
2014: 08/11 – 09/30 = 176,854
2013: 08/26 – 09/30 = 125,877
2016: 08/15 – 09/30 = 158,738
Again pointing to 160k – 180k.

Feb – March 31st will not count, It starts from the new financial quarter. The LCA start date should be within 6 months before the start of employment (10/01/2016).

Filing LCA is a pre-req for H-1B petition which takes 1-2 weeks to certify. If the employer has not even started that process, then its not possible for this season anymore.

Dude, let make it clear for once and all, there are around 40,000 advanced degree applicants alone this year (US masters), may be even more. Even if there are 80-90,000 other applicants, the number reaches to around 140k, so lottery is imminent. Will there be 200k or 150k is up for debate, but your data is way off and unsupported.
Right. It may be somewhere between 150k-180k.
Im almost guessing that the applications would go below 125000.
Looking at the LCA data it is comparable to 2013 numbers, maybe slightly less than that. Have done lot of analysis on the data comparing individual company filing as well as yearly data since 2012.
Guys my prediction is this time it is going to be < 130k application. In fact I see it somewhere between 100k and 120K.

Each of the last 3 years had predictions like these which tried to bring down the numbers citing different reasons and every single time they were wrong. However most of the IT companies(including mine) are doubling/tripling the H1B applications every year and this year is no different. At the end of the day Im almost guessing that the applications would go 250000+.
I dont think there is any effect on IT companies due to the hike in application fee for H1B. Ultimately they are gonna get back the money for those which did not get picked up.

Another way of looking at it is
388,216 / 539,990 * 100 = 71.89%
.7189 * 233000(last year applications) = 167503.7 => This is error prone.
Also fresh H1B filed now will mostly have job start date between Aug 2016 and Sep 2016.
That too gives around 170 -180k applications.
This looks more close to 2014(Aug – Sep) when we had 172k applications.

Good Analysis. But, keep in mind that your numbers for FY2017 does not include future LCA’s that will be filed from today to September 30, 2016.
Right. I expect this to be the busiest season. From now to September(5 months) it will be at lesser rate, except few transfer cases maybe.
So I think it may go close to 2013 numbers(slightly less). So we are looking at 2013 number or slightly lesser.

One can select data for future start date as well i.e. between now and Sep 30. The LCA are already filed for these cases which will go in lottery. I do not know if the analysis was done with this data included.

Yes this included LCA filed up to last week of September 2015. Mine is last week of september and it is present in their.
Still giving benefit of doubt I say it may still increase slightly but can’t go beyond 2013 numbers for sure.

Yes, that’s correct, my LCA is also shown in the data, so this data includes for majority of people who will are already working on OPT and filling their H1B. The decrease in numbers would either mean less people on H1B jobs – highly unlikely or less applications filled by desi consultants and likes of Infosys – more probable this year.
So are you guys saying that there would be no lottery to be conducted since we’d be close to 2013 data?
There was lottery in 2013(124k applications, if I remember correctly). So lottery may still be there but chances of picking in the lottery is much higher.
I was seeing these kind of analysis for the last 3 years and everytime they were horribly wrong. Tag this post and we will meet on April 8th and check on the numbers(although I hope Im wrong which to me is very unlikely – im having a reality check). I work for an IT company and I can personally see the stupendous increase in the number of petitions they are filing this year and also please keep in mind they can cover multiple positions using the same LCA. Im not here for an argument, just wanted let u know that I have seen these kind of “factual” analysis and every single time they were wrong.
You seem to be assuming very less number of LCAs that can be filed in 5 months.
If you look at LCAs filed from Oct 2015-Dec2015, the count is 81000. I believe all LCAs filed during those 3 months are either transfers or other cap exempts. So, at this rate another 135,000 LCAs can be filed in this fiscal year. (Considering another 5 months)
That will bring the count to 515,000.
(380,000+135,000)
That is still less than the count for last fiscal year. So, taking in your analysis in consideration and adding in my analysis, I am considering the count to be closer to last fiscal year. So, around 210,000-250,000.
Am I missing something here, if LCA are filed after September 2016, wouldn’t they be most likely for H1B 2018 and not 2017. Are we assuming start date as being after September, but in that case as well, the LCA will have to be filed by now, so must be included in the data we analyzed

I searched the data between 1st October 2015 to 30th Sep 2016 and there are 388,216 cases found in this period.
Can we know somehow how many cases for fresh h1-b and how many for transfers.

Most of the selected non-PP cases would know by June-July about their selection. Non-selected cases will start getting rejection notices after that month.
After doing an hour long analysis on US website http://icert.doleta.gov, I came to a conclusion that this year, the number of applications would range between 165000-185000 which is better compared to last year.
Note: Data analysis done considering LCA’s filed by large Indian IT MNCs and few small companies from US.

1. Can i travel back to india now from april to Oct? im on H4 now.
2. Can i apply through 2 sponsorers? both are different positions.
3. My spouse’s H1b is still processing, so my I94 has expired on march 24, 2016, will that cause any problem to my lottery?

1. Your H-1 will continue to be processed but COS from H-4 to H-1 will be abandoned. You can return on H-4 but need to enter on stamped H-1 visa or file separate COS from H-4 to H-1 in order to work on H-1
2. Legally, it is allowed to file through 2 unrelated employers
3. It will not impact lottery but it will impact the eventual outcome of your COS. They wouldn’t approve COS unless your H-4 extension has been approved. I assume your H-4 extension was also applied w/ spouse’s H-1 extension.
The LCA data is available (https://icert.doleta.gov/index.cfm?event=ehLCJRExternal.dspAdvCertSearch) for applications filled between October last year till date(start of new cycle), for example LCA’s filled in my organization are around 8, all of them being shown in this data, which will include three new petitions for H1B this year. The total count is around 68,000. I do not if this more or less as compared to previous years, someone else can give better insight by comparing the two.
Your search only covers FY2016 LCAs. FY2017 LCAs haven’t been unlisted yet.
No, the data includes LCA for which H1B will be filled for FY 2017, my personal LCA is shown as well, so anyone who is filling for H1B this year would have corresponding LCA data in this time period only. (LCA are filled before H1B petition, and data is already updated)

Almost all the H-1 petitions will have LCAs covered in FY-16 data. This is b/c the start date of LCAs would be prior to Oct 1 and hence part of this group.

I’m working in Infosys and I can see Infy filing a lot more visas than last year. Last year, around 4 petitions were filed from my project, this year the number has increased to 11. The case is similar for other projects as well. my petition didn’t get through lottery last year, hoping to get through this year…my prediction is total count will be >250K
Same is the case with me bro. Hope that this time I get through the lottery.
However, in my team and other teams in my unit, the number of visas initiated has dropped down from the last year.
I think due to the visa fee hike , this time there will be a 25% drop in application.
Even those big IT companies don’t generate 10K new jobs every year. The H1B positions are not all newjobs. Many of the petitions are for replace H1Bs that finish the 6 year period. So it works like a wave of 6 hear period (or 6+1 years). Of course there is a contribution of new jobs. Buy the replacements also contribute a lot.
2007, 2008 and 2009 had a huge number of applications. That explain the huge number of applications of 2014, 2015 and 2016.
2010 reached tbe cap months after it was a cruises year in US no much H1Bs to replace for 2017.
April is coming and you will see what I am taking about.
I understand your point but many would have gotten there green card or application approved, so they won’t have to file H1B. Majority of the applications would be for new hires, which has skyrocketed due to good job market.

It is illegal to file more than one application for the same individual. I advise you not to do that.
Same employer can’t file multiple petitions. In RV’s case it is different sponsors.
SO RV, if both of your petitions are selected, you can join any one of the sponsoring companies.

2) Assume, If a company has got LCA with a specific salary for an employee, is there any mandate that the LCA should be submitted for the same employee when the application is submitted with USCIS.

2. AFAIK LCA doesn’t have an employee name. It just states that a foreign worker will be hired for a specific role/salary etc. So it can be used for any employee’s I-129 application.
Same is my case. it will be my 3rd year the company is going to try. I am a civil engineer not IT person.

this H1-B program has been hijacked by IT industry at the expense of other engineering streams. Things like vendor, client, consultant, multiple layers of vendor client… simply do not exist for jobs in other engineering fields… these are IT specific and the multiple consulting companies like XYZ-Tech file H1 nilly willy.
What to do… can you forget civil enigneering for a while and give some money to one of XYZ -Tech, get a crash course in some current IT stuff and then file for your H1 with fake resume? File through multiple consultants. When any one clicks, go back to your civil engineering job with that H1.

You can go for stamping anytime during the validity period of the approved petition. Petition is usually approved for a period of 1-3 years.
My company hired FRAGOMEN law company to file my H-1B this year. Two quick questions:

From what I read from others’ experiences is that they are a leading immigration firm. So they won’t be doing shortcuts or abusing the law.
You can use FedEx/UPS/USPS number to be sure that the package was received by USCIS. However, what’s in the package is anyone’s guess.

Guys do not fool yourselves. I checked with my friends in TCS, Infosys, Wipro & CTS they all are filing in huge numbers even more than last year from the fear of future h1b uncertainties.
Some of my friends are going with desi consultancies and they are not hesitant to spend extra money. There is a huge demand in job market.
Out of 200k who were not selected last year, my guess is, at least, 150-170k will file this year too.
Adding fresh graduate this year from US universities and fresh h1b petitions it will surely go above 300k this time.
With this logic around 235k won’t be selected this year.
Do not spread the rumors. Reliable sources in these companies say otherwise.

I got below updates from my friend
A. He s got confirmation email for the h1b applied at TCS . I mean he s got all set for the H1B and his application will be submitted on Apr 1st.
B. Only few have got all levels of approvals. it’s been secretly maintained like who has been identified for H1b.
C. Total count of applicant in his project are very few.
My predictions are
Above said points would have been followed across other companies. Because all those companies waited for sometime to accept documents from the applicants, which gives clue for decision making to restrict no of applicant.
It will be tough for folks who were not selected last year to apply this year as visa fees have been doubled ofcourse fees are to be paid after lottery.
Due to the new rule for which visa fees have been doubled, regular sponsoring companies will not apply in massive count as last year. But other exempted companies may apply a lot.
So my calculations gives totally count will be in between 120 k to 150k.

1) No obstacles – As it is no way related to US
2) Yes, you can come back and go for stamping – 6 Months is the normal time taken for a Regular processing file
the answer really depeds on whether your H1-B visa will be filed as consular processing or as a change of status (if you are currently in US). If it ill be filed as a change of status, then you can not go anywhere, if it was filed as consular processing, you can go anywhere you want, but traveling to USA can on any other visa can jeopardize your H1-B petition if selected in lottery.

One correction to your post – “then you can not go anywhere”. Even w/ COS, you can still travel outside of the US. It’s just that COS would be considered abandoned, and the petition will be treated as consular processing.

I did some research on LCA data, compared to previous years a huge dip. 1 00K less LCA’s filed so far this year compared to last year. My prediction is <200K applications this year

Now for a particular company do the following exercise:
For the year 2015, see the number of LCAs filed from January till mid March, let us call this ‘X’
For the year 2015 , see the number of LCAs filed from Mid March till end of year, let us call this ‘Y’
For the year 2016, see the number of LCAs filed from January till date. let us call this ‘Z’.
You will notice that X >> (Y + Z)
You should understand that not all LCAs are for capsubject petitions. But majority of them are.
Oneore thing is single LCA can be filed for multiple positions. I have seen LCAs with 10,20,100 even 150 positions. So 1 LCA may =X applications.
You have made a mistake. The 2016 data you are looking at is for FY 2016, which ends in April 2016. These are likely H-1b transfers, cap exempt petitions which are not subject to the new cap. ALl the petitions for the 2016 lottery will be classified as FY 2017 petitions. The DOL will not make FY 2017 data publicly available until the next quarter, ie around June 2016.

I opened one of the LCA and in that Period of Intended Employment start date is Sep 2016. Also job posting date is March 2016 so it cannot be previous year’s document. However my search parameters are FY 2016 and H1B as case type.

For FY17 LCAs, the date of job cannot be before October 1, 2016. The USCIS follows a financial year system, which means that financial year 2016 starts from October 1, 2015 and ends on October 1, 2016. The LCA you looked at is probably an H1b extension, which can be applied at any time during the year (not subject to lottery) and takes around 6 months to get verified.

LCA can have a start date prior to Oct 1. Actually most of the H-1B petitions will have LCA start date prior to Oct 1. This is b/c LCA can be filed 6 months in advance. Typical example:
– Employer files LCA on Mar 15 for start date of Sep 15, 2016 and end date Sep 14, 2019. LCA is filed 6 months in advance
– Employer files I-129 on April 1 for start date of Oct 1, 2016 and end date Sep 14, 2019. I-129 is filed 6 months in advance and included within LCA period
Such a petition would be returned by above query and would be a valid sample.
Infosys Limited for example have filled around 33K LCAs for 2015 H1B. For 2016 it filled only 3K.
Make sense when you calculate the costs. 30K H1B applications with a $4,000 fee gives aroumd $120 million.

The cost is applicable only for the selected petitions, not for all of the 30k petitions. Except little legal cost, there is not much difference.
Though the cost is only applicable for the selected petitions, a company needs to issue certified checks to USCIS for the each petition. Once the checks are issued, those cash balance will be frozen by the bank. If an Indian company has 30K petitions, that means additional 30K*4000=120M cash will be frozen temperately, which seriously affects the cash-flow of a company because as you may know, usually a company does not maintain a large amount of cash on hand.
How do bank know they have issued a cheque?

That’s a very valid point..Cash flow is the key for a company operation. I am not sure, if the bank balance will be frozen for the check issued, as the bank is not aware of where the checks are issued…it is just the check issuer’s responsibility to have enough cash so that the check does not bounce…

I gone through the VisaDoor.com and seeing the companies like Infosys and TCS has very less number of LCA in 2016.
What is significanse of this.

I checked in visadoor.com H1B Realtime LCA decision, i couldn’t find my employer filed any LCA in the year 2016 until march 15th . What could be the reason ?

There are many other places where you have LCA informaiton. You can check our H1B visa Sponsors database as well. If nothing exists in any place, maybe they have never done it…
My old EAD card is expired on Feb 15 2016. I already apply for the opt extension and I still not receive the new EAD card. My company is sponsoring me H1B, they need the copy of my new EAD card. My question is what if I don’t get the new EAD card before April 1st, is it gonna affect my application of H1B?

It should not…You can send the application receipt copy that you submitted for new EAD card. Worst case, you may get RFE and it can be solved easily with your EAD card…

What do you think, why CEUROPE asked about law-follower companies? I have the same experience…
I had full interview process with 3 companies and part-process with another 2. I got answer from the first 3 and 2 of them want to charge me with lot of money, 3rd one with smaller amount in advance!
So please step back a little bit and answer to his/her simple question.
Of course I can share my process-steps, and their offers, with company and personal names, with bank account numbers in US and in India!!

What if all three companies processed your H1 without charging you a single penny and then you back out for reasons better known to you???
There are tons of candidate in their list who cracked their interviews waiting ahead of you.
Why should they bear the cost of the attorney, LCA, H1B filling when there is very high chance of you not getting picked in lottery or you back out after your application getting picked in lottery(In case you choose another employer who sponsored too)???
(Since they are aware of candidates filing via more than 1 company is common now a days and then candidate chooses the company)
Again, not all employers are genuine, where in you need to do a bit of background check on them too to go ahead with them.
If you still wanna get through without supporting the employer for the bit they wanna support you, then demand your current employer to sponsor. You will realize how much of trust they have grown on you 🙂

Best method is to join a company who in course of time starts trusting the skill and talent in you and want you to manage their work in onshore and process H1 for you……rest of all the methods are unfair.

Hi Bhagat, for specialization in Molecular Biology, this may not be the right forum for you. This is the forum full of folks with IT skills. In your case you may need to find a pharmaceutical company/ try research position at a university or the worst option would be to take a crash course in some IT field or fake resume to show IT experience. But it will be such a disgrace to have en education like you and still not get a H1B sponsor. This whole H1-B thing has been hijacked by IT folks, leaving very little space for other genuine engineering / science streams.
