When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Premium processing is almost over. All those who applied PP – AD and non AD …move on. Better luck next time. Last premium notification in 2015 was sent on April 27th. This year it will no different. Only a few lucky ones will get email notifications. For all others in PP- you lost the lottery. Come up with plan B.
At least, a couple of PP reciepts continued to be sent out till Apr 27th last yeart, the announced PP starting date.
It’s May 12th this year. So, there’s a little bit of chance.

Employer might have noted each check number with respect each petition at the time of filing.
Now the employer must have checked his account which check got cashed as the statement includes the check number as well

As u know quite a lot about H1B , could u pls help me answering the below.
Everybody knows the cap count is 85k (20 for AD and 65 for Non-AD). Also knows that they conduct lottery for the 20k first and later, the 65k. And ofcourse we know that the unselected
AD guys will be put into 65k lottery just to ruin the life of Non-AD guys and by the time u might have thought i am a pissed off Non-AD guy but i am not.
So here’s the real question which is confusing everybody because as of now there are only 2 categories
1) AD
2) Non- AD
But what we see now is a trend of receipts getting generated in the below order as per assumptions
I) AD/PP [90% done]
II) AD/RP [80% done]
III)Non-AD/PP [50% done]
IV)Non-AD/RP [20% done]
1)How does the Premium processing impact the lottery ??
2)Are all RP guys getting fooled by USCIS by having a secret lottery in the above shown 4 different categories or its really just 2 ???
All these questions can into my mind just because i feel as everything is over by now and the next week is only for the left over which i believe is only a handfull.

Where are you getting all these trends? It’s all BS. RP ? 80% done. That’s ridiculous. PP will go on till May 12th. Don’t lose hope yet.
1. PP applications only get processed faster. Chances of selection in the lottery whether it’s RP or PP is the same.
2. USCIS is not fooling anyone. First lottery for US Masters Quota is completed, then lottery for remaining applications is done. People who studied in US deserve to work in US because they have invested time and money in US by paying thousands of dollars in tuition. So, it makes sense for USCIS to conduct lottery twice for AD applicants.
Masters quota should be further increased. Limit for regular quota should stay the same. Indian companies misuse H1b visa program by spamming thousands of applications, many of these visas won’t even be used in 1-2 years. These companies deny the opportunity for more worthy candidates from rest of the world and US Masters candidates to get H1B visas. Indian companies should get only 8000 – 10,000 visas every year. Fraud companies such as Infy, TCS, Cognizant should be banned for 1-2 years until they learn to play by the rules.

1. Filing in PP doesn’t impact your selection chances. You still have same chances to get selected had you not applied in PP.
2. I don’t know where you are getting the percentages from. This is how lottery works – they pool in all AD applications and select 20K petitions for the AD quota. Then the non-selected AD applications are added to other non-AD applications, and 65K petitions are selected for general quota. That’s the end of it. Nothing suspicious going around and no one being made a fool of.

Why cant USCIS wake up and work on improving the process for H1b selection and result declaration. They seem to be aware of current pathetic process , and still reluctant to improve it.
A lot has been discussed about loopholes in H1b , major one is multiple petition per person.
Let me talk about biggest flaw in Result Declaration , and below solution to it.
“Print all selected case numbers on USCIS site , once lottery is done. ”
There should not be any problem , as lottery decides the picked case numbers. The trauma and endless wait for 2-3 months for lakhs of applicants will get relieved.
Believe me , it is the uncertainty that is more killing in h1b process.
Let us take it forward to USCIS .

No news yet. The GI team didn’t even send across an official note confirming that the H1B lottery is done like they had done last year. Those people are lazy as hell. I really think that we will have to wait for at least two more weeks for the updates. The Managers behave as if they are not at all concerned about this matter. They don’t know shit.

As u know quite a lot about H1B , could u pls help me answering the below.
Everybody knows the cap count is 85k (20 for AD and 65 for Non-AD). Also knows that they conduct lottery for the 20k first and later, the 65k. And ofcourse we know that the unselected
AD guys will be put into 65k lottery just to ruin the life of Non-AD guys and by the time u might have thought i am a pissed off Non-AD guy but i am not.
So here’s the real question which is confusing everybody because as of now there are only 2 categories
1) AD
2) Non- AD
But what we see now is a trend of receipts getting generated in the below order as per assumptions
I) AD/PP [90% done]
II) AD/RP [80% done]
III)Non-AD/PP [50% done]
IV)Non-AD/RP [20% done]
1)How does the Premium processing impact the lottery ??
2)Are all RP guys getting fooled by USCIS by having a secret lottery in the above shown 4 different categories or its really just 2 ???
All these questions can into my mind just because i feel as everything is over by now and the next week is only for the left over which i believe is only a handfull.

Hearing randomly from a couple of forums that ppl at CTS started getting mails. Are there still hopes? When can we expect the mails to start coming and until when can we have hopes?
I don’t think anyone got update from GM. They will start sending out results only from May 1 st week..

Nothing to worry dear on this, I am also from Chennai CTS waiting for the Lottery results for RP, we need to be patient since this year many big players not processed visa for employees due to fee hike. Probability of getting selected is good this year. Be positive.

Hey ,I have doubt, how ppl are getting to know that their cheque got cashed , I have applied through one consultancy , I didn’t get any news, in short , I didn’t ask them as of now. however waiting eagerly. is there any other way to check on any portal. its my 2nd trial they charged me 2.7 lacs INR… its huge money for me second time …. how long do you suggest me to wait, or shall I send email them to asking for my result. please advice ….

Why did you trust on such outsider consultancy’s.. They take away money from candidates & even if its not selected they deduct around 50 K-80K. If its really genuine consultancy they should have taken atleast 4350 $ * 66 = 2.87 K Rs.
Ask them to provide you filled copy of I-129 form containing LCA case filled details as well Fed-ex shipment details & do make sure that all the details are matching. Always try to apply through Big company where there less chances that they are making Fraud. As per my knowledge, even US govt. considers this things to prevent fraud made by smaller companies.

Comment from a fellow H1b seeker (A CMU Grad) has amazing news – his friend found that his check got cashed today who applied under AD PP CA. That’s the only reason I am saying there might be little hope for ppl like us.
Apart from that USCIS never said they will notify PP early in this lottery process than regular.They only promise that it will be processed in 15 days after May 15, 2016.I am not sure why we all assume that PP petitions are notified first.I think everyone has equal chance of getting notified until 12th May.

If your application is not selected, USCIS will send rejection letter. Ask for it to your employer in June.

I have a doubt in my mind from long time…..Looking at the random selection by USCIS, I always believe that they may consider other factors also while selecting the application. If they follow random selection, then how, most of the Indian companies gets 30% of their applications selected?
If they really follow the random process, then there are chance that Infy may get 5% , Wipro may get 45%, TechM may get 30 % of their applications gets selected. But that’s not the reality.

Infy files 50 petitions for BOA project. None gets selected. Its direct loss of BOA . Which means less revenue for a credible and a huge brand in US.
How can they give more visas to desi consultants than a reputed company in US like IBM just becoz the process was random.

Dude, get your maths correct. By the rule of probability most companies will get 30% of their applications selected with some lucky companies getting a little bit more than 30% and some unlucky companies will get just a little less than 30%. It all boils down to mean and standard deviation and variance.
