When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

It’s 7.35PM(Pacific Standard Time) on April 22 and I OFFICIALLY GIVE UP. Did I hear you say it’s too soon to give up? Yes, I know and I am giving up. This H1B lottery system is brutal. I’m moving on to plan B.

Guys who are not getting picked up in lottery, please keep in mind, if somehow you can get a job at university or a non-profit, ask them to file for a CAP EXEMPT H1-B visa. Once you have a CAP EXEMPT H1-B, you can work for a FOR PROFIT company on a part time basis on CONCURRENT H1-B.
Concurrent H1-Bs are not subject to CAP.
Also, if your current employer can change your work location to a non profit/ educational institution and show that your work benefits the non-profit/ educational institute, then your employer can make the case for a CAP EXEMPT H1-B visa.
Please try these avenues if you can.

That is not correct. You are mixing two things.
If a person gets cap-exempt H-1 through a school etc, then concurrent H-1 also needs to be from a exempted organization. If the person wants a concurrent H-1 from a for-profit organization, then he needs to have been counted in the cap at least once. In other words, he needs to have held cap-subject H-1 in the past.
There is no loophole like you are suggesting.
Is it game over for AD/RP ? It is time to pack and go home I guess . Here goes my PhD in a world class university with bunch of publications down the drain.

Listen, can you file for a NIW-I-140 petition? Since you have PhD with some publications, you can easily get I-140 approved and there are chances that certain I-140 holders will be given EAD and allowed to work later this year.
One more option is that you ask your professor to get you a post doc, or get into university as a researcher. University can file for CAP EXEMPT H1-B. Then, if you have good understanding with your professor, you can work for a ‘for profit’ company part time on a CONCURRENT H1-B. Such H1-Bs are not subject to cap !!! (major loophole)!!!
One more option is see if you can file for O1 visa. Dump H1, get on the O1 wandwagon.
So there are several options.
Why??? You are PhD and you have publications! Don’t give up! You should try O1 visa! For sure.

“USCIS first announced in a news release that it would temporarily adjust its premium processing practice due to the historic premium processing receipt levels, combined with the possibility that the H-1B cap will be met in the first 5 business days of the filing season.”
Wht I understood from this ,there is huge number of petitions for PP .So there is less petitions for RP.If AD/PP/RP and PP completed,there is better chances for RP.

All type of applications stand equal chance. We dont know exactly how many PPs got selected. Its just that PPs get notified first.

Point 1 : Nobody knows how many petitions filled by Immigirl except Immigirl and their team.
2: Lottery done on 9th April but USCIS announced on 12th April
3:Applicants started receiving mails before USCIS press release on 12th April.
4:Follow or check the USCIS press releases sequence and compare with what happen practically from Day 1
Main point for my assumption is USCIS only.If I am not wrong go through latest press note of USCIS.

It means who got picked in lottery for AD/PP/RP and PP for Regular H1B quota will get Approvals by the mentioned date

I think the lottery is done for all category.
Whether some one is picked or not, it can be confirmed from the notification that the each selected candidate receives either through email or the physical notice in regular mail.

1) Currently I am in INDIA working for company ABC. ABC has its own registered office in Newyork. (Which is mentioned in my LCA)
2) ABC has applied H1B visa for me. My work location would be at “Michigan” for client xyz.
As per my understanding, The H1B application for Newyork goes at “Vermont Center” While the application for Michigan gets applied at “California Center”.
I have no communication from employer saying at which center they have filled the H1B application for me. (Its a nonAD/RP/??)
Can someone please elaborate on this???Which would be the center in my case?

It will be sent based on the location you are going to work and not your employer location. So it should be filed for Michigan in ur case and it should be WAC.

For AD/RP/CA on 4/20/2016, she summarized as: ” We saw filing fee checks cashed in 10% of our cases filed as AD/RP/CA.” But on 4/21/2016 and 4/22/2016 she stated as: “We have received receipt notices in 14% of our cases filed as AD/RP/CA.” Why did she change from checks cashed to receipt received? Is that because the former percentage is too large and she wanted to give us more hope? Thank you!
That’s because no receipts were received by them by 20th, but they could see some checks being encashed. Whereas by 22nd Apr, they received some acknowledgements.

PP will still be issuing next, according to my lawyer. But that could end at any time.
That is what lawyers say. They said it last year as well. No one in my company received AD/PP receipts in last few days. I personally know many friends who aren’t picked up either. I would suggest you to focus on plan B.
Lets stay positive through next week to see a positive ray of hope! I am waiting too for a Non-AD/PP for a second time through a single employer

Please help me understand the process. Mustn’t USCIS have already cashed checks for all selected AD/RP? My guess is that all those who are picked up in lottery for AD/RP, must be able to confirm by the status of their checks

CTS – AD/PP/VT, got notification yesterday morning that my application is accepted. I know another person from CTS – AD/PP/CF who got the notification yesterday. My CTS friends who are AD/RP are still waiting though.

Mine is AD & PP / CA case. I have yet not received the receipt. Do they intimate by E-mail that your case is not selected or I have to wait till the petition being returned.
USCIS only notifies by email if you get selected. You have to wait for the petition to be returned to know that your case was not selected!
