When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.   1. Has anyone who applied PP start receiving approval notices from VSC yet?

    Also, I got my email receipt notice last Tuesday but my DSO is unwilling to issue me cap gap till I can provide the paper receipt. My OPT ends on 31st May so I definitely need something before then else I’ll have to stop working. Anyone know how to solve this?

    • Hye,

      Give them your petition copy along with your FEdex,USPS etc mail receipt and they will issus you interim cap-gap till 1st June. (i know not much of difference from 31st May to 1st June)
      Also, in the meanwhile if you get any updated that your petition in waitlisted, they will further extend till Jul 28.

      My OPT expires on 3rd May and with the frist option, i managed to get my interim extension from my DSO.

      Don’t loose hope until you get any denial (which i hope never happens)

  2. Mine is AD & PP / CA case. I have yet not received the receipt. Still there are chances or game is over? Do they intimate by E-mail that your case is not selected.

  3. Hi Guys! I need real advice here. I posted before but somehow my post vanished!

    If my OPT is expiring May31st (no extension ). What if I do not receive the receipt by May 31st? Should I stop working or I can work until my package returns?

    The reason I am asking this is, the USCIS website says Cap Gap expires on May 31st if you do not get receipt by then. (Cap Gap is extended to Oct 1st only if you atleast get a receipt) However my agency advised, i can work until my package returns (usually until June or July as per their calculation)

    Please advise me. I do not want to do anything that is not legal and land into difficult situation.

    • You DSO will not issue cap-gap in this case, hence you need to stop working right away. You will have 60 days to regain/maintain your F1 status or leave the country.

      Bottom line, without receipt, no I20.. No cap gap I20, no work authorization.

        Thanks for the information. It is very helpful.

        My second masters start in June end and I can resume my work in case my H1 does not go through. I work full time and my employer told me they cannot give me unpaid leave until June end and in the event of my H1 is not selected, I will have to leave my job. And cannot resume in June end.

        Any chance you know about any regulation that doesn’t allow employees to take unpaid leave?

        • As long as your employer is approving leaves, you are fine. There is no law that does not allow employees to take unpaid time off. Law does not state that leaves should paid in all the cases. Many contract house allow people to take 1 month leave in December, which is unpaid, and still maintain status. It is the understanding between you and your employer.

          Just be careful, some universities approve CPT right from day 1 and people had issues in past during COS on subsequent H1 filing or stamping.

            Thanks for your great advise. May I know what is COS? At the time of stamping? I have two admits. One from a not so reputed but cheap school and the other from a very good UNiversity which is super expensive. I am confused which to choose considering the expense involved in good school.

            Apart from that, I work full time and not through consultancies. They said I cannot take unpaid leave as long as my paid leaves are stil unused. That’s what the company s corrporate policy is. My boss is fine but the HR is not approving this.

            Really appreciate the help

        • You will have no work authorization for that month. So, even if there is a rule that says the company needs to give you unpaid leave, I would doubt you can do anything as you have no work authorization. Why would a company put you in work whether paid or unpaid when you have no work authorization?

          • Yes, I agree with you.

            In order to get unpaid leaves, you need to be employed. In order to be employed, you need to be eligible. As H1B_Without Consulting Company rightly mentioned, you will be out of status. Sorry to see you in this situation.

            You cannot start working right away after your school starts. How do you plan to work? On what status? CPT is the only alternative. Talk to DSO of the school and understand their CPT policies.

            CoS stands for Change of Status. F1 to H1 or H4 to H1 or similar.

          • My company allowed me to leave for three months last year and come back after I had work authorization. So, it depends on how flexible your boss is . It is usually possible to convince them if it is a small firm.

          • As long as I am not working and not getting paid during the most of June, I am maintaining the status right? My company said they cannot wait until June end and i will lose my current job in this case.

        • Have you mentioned to your boss that you are willing to work without getting paid for a month ?
          May be he will agree if his work is being done?

          • If it is a US based corporation, it is highly unlikely. They are opening themselves for a lawsuit in future for getting work done without pay… Desi consultancy wont mind that.

            If I were a contractor or through consultancy, I can stop working for one month. But as a full time employee, how do i justify my status and resume work from June end?

            HR is not flexible. My boss is but she can do nothing without HR’s approval. They clearly said my last day of work is May 31st

            I am not taking admission into a non reputed college to justify my day 1 CPT. As you know, some courses does require practical training from the beginning of the course. I will be attending a good school and take classes every week once or twice. My only concern is the fees as this professional degree requires a huge investment but I am open to it if thats my only option

      • Unfortunately, Company will never keep you on their payrolls if you are not in status. They are inviting a lawsuit in case this ever comes up in the future and they would not risk such a situation. Why don’t you leave on May 31st with mutual understanding with the company and and they agree for you to join back once you have proper work authorization. In case your work is important, they would not mind that or work offsite in case they have some international offices like in India maybe. That would be the easiest in my opinion.

        • Yes i can certainly go to Europe branch but it’s not very easy as it sounds.

          My visa has expired but I can stay here and work as long as i maintain the status. If I go to Europe, i will need a new visa to enter (which is tricky because they may reject it)

          And leaving the company for a month and joining again in June end is not that easy considering all the corporate policies and approvals for the position etc.

          This is really unfortunate and i am so stuck. not sure what is the best to do in this case. I have a great degree and great job but stuck because of the limitations of visas.

          • I am stuck in exactly the same situation! It may sound straight forward to move to Europe, but it is a pain! I lost my hope for AD/PP and already started to look for jobs in different countries, if that works!

          No my employer is asking me to wait eventually on the update . Mine is AD/PP/CSC .

          Yesterday also some of their checks got encashed . AM still hoping for good news to come.

          Last time when I spoke, they said, I can work even after May 31st , till I get update from USCIS, I will be automatically in Cap-Gap . If approval notice comes after that, my cap-gap continues till Sep 30 or else it will be stopped immediately for any notice of denial.

          Have you planned any backup options ?

            I should think of backup plans . That’s making me disappointed with future.

  6. Just got email replied from my law firm 9:20CST. They filed all PP/VT

    “Yes, as of yesterday we were still receiving receipt notifications. I would expect the receipt notices to finish trickling in next week.”

    • I wish this is true. My husband and I have been filing for last 3 years in hope one of us gets picked. If either of us don’t get through we have to pack and leave. Irony is I recently got a full time job offer with good package and position after 4 years of doing consultant jobs and seems like now I might have to start all over again.

  7. I hope everyone will know about this. I just want to insist this. As part of lottery, USCIS will draw 20000 Petition and those unselected AD petitions will be added to NonAD pool and draw again happens as part of NonAD. So until NonAD/RP is complete -you still have changes… So dont loose your hope…

  9. guys, I have a question. How can the lawyer inform if the check was encashed? The check is written by the company and company does not share its banking login-password with lawyer.

    So , how are so many guys getting messages from their lawyers about check being encashed?

    what is going on here?

    • It could be that the company has an escrow account from which the lawyer has the authority to sign off checks. this is a wild guess.

  12. What exactly does PP means? Premium processing after selection or Premium Processing means early intimation of selection in lottery?

    • it means that applications will be processed within 15 calendar days of the date when the petition was received. In case of filings for the 2017 cap season (i.e. starting from April 1st this year), the aplications will be processed within 15 days of May 16 (May 16th is the official commencement of premium processing- as announced by USCIS).

    • I got notice from the lawyer. I’m AD/PP. Just send an email for inquiry. I got their response pretty fast even when they didn’t get the email notification yet… They told me they received some but didn’t get mine back then. But they did send a separate email informing me that I got the receipt later.

    • yeah I have also applied AD/RP with them and I live in Boston, which is very close to Vermont. I have not received anything yet and since Boston is so close to VT, it is making me think that it’s game over for me as well.

    • Lottery has already selected the petitions.

      It is just the result that is out for PP and in process for RP

      So will visiting to Visa Balaji or praying more and more work ? I mean – its already decided , your extra prayers wont change the selected petitions results .
      Be prepared to accept the truth , there is no point in keeping false hopes and running away from reality

  22. Mine is non-AD/RP.. this is 3rd attempt …waiting.. waiting… So though of doing last bit from my side. Today travelling to Visa Balaji ….Guys don’t worry , & have fun filled weekend . If it’s meant to be it will be… Trust in Jesus!

  23. Mine is Non AD/RP ..This is what my employer replied when I asked for status , is it true?

    A. USCIS will inform us if your application is picked or not by May 15th 2016. Once we get an mail (land mail) confirmation, we will update you of your case number,

    B. USCIS will inform us if your application is approved or not by August 20th 2016.

    C . We will update you one checked has been cashed.

    Expect Non AD/RP (aam janta) emails from 25th EOD.

  25. I applied for the first time NON AD/PP with one application and I haven’t received any email or receipt and not sure what is the status.

    Can we still keep some hopes or game over for NON AD/PP ?

  26. Application picked in lottery…Masters/ Regular processing/ Vermont Center. Got notified today by my lawyer.
    Good luck to all others still waiting. Don’t lose hope.

  27. There are lot of ways where uscis can improve the process:

    – The entire process should be made online with passport as the unique identifier

    – If the selected candidates do not travel within 6 months from 1st Oct, then their visa should be cancelled and added back to the quota

    I saw seen lot of people waiting 1-2 years for assignments and never travel.

    Note : I understand that no one knows the exact process that uscis follows, but just wanted to comment on the existing workflow.
