When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     I am on my CPT and just got my new i20 which does not have a receipt number in Change of status/cap gap field. Does this mean I did not get selected for H1b Lottery? I am AD/RP/CA.

  8. infy have scheduled maintenance for GICS from 21st to 23rd…So i feel even though infy has receipts for RP they will be updating GICS from Monday.

  10. For all those saying the below are H1 cap subject petitions, I highly doubt it. Looking at the receipt number, ‘133’ looks like April 7th or April 8th. If the lottery was conducted on April 9, then how come the receipts were generated before the lottery took place?

  11. Dear All,

    I asked about this before and I did not get a clear details.

    I have applied for H1b through, Ogle tree Deakins and being tracking the application progress on visatrax.com (INSzoom), on my account it says prepare H1B change of status petition, under this it says that only 84% complete. For the next step, it says (log receipt and inform client). So far I have no update from them and I am loosing my hope and getting more anxious.

    I was wondering if there is any way to find out if my application got picked up not.

    FYI: I have applied through AD/RP (I guess).

    Looking forward to hearing from those who have some wisdom in this situation.

    • I am working with them right now though for a H1B Cap Exempt petition. Contact the Paralegal, and copy the Attorney, and ask them if you have received it.

      They are terribly bad at updating the online portal. I received my receipt 10 days ago, however in the system it still says 83% Complete – Next Step: Log Receipt and Inform Client.

  12. Just got to know from my school that there was a sevis update and my application has been picked. This was my third and last time. I cant express how relieved I am. I wish all the very best for all them who have been slogging all these years even with an advanced degree.
    A quick question if anyone knows about it. Can we get the receipt number from the school or not ?

    I just want to know that how people are getting the number like WAC1613351743. I just want to know that it is generated once USCIS approve the case or we can ask from attorney/employer this to track our case. If I will ask then will they provide to me.

    In Brief:- I don’t have anything to track my case. Can you tell me what I can ask from my employer/Attorney to track my case.

    • Hope for Best,

      Numbers are generated sequentially. People are going to USCIS site and randomly putting numbers until they hit a number which is valid and shows case as approved etc. These numbers are assigned only to petitions that have been selected in the lottery. Your employer/attorney will receive one if your petition gets selected.

    I have been following this forum for a while and wanted to share a few pointers:

    -> Processing for selected application was started last week itself. Few of my known associates were on AD/PP and they started receiving the approval by last Friday. So, please don’t spread rumors that the processing (approval/denial) starts only after the data entry is completed.

    -> Until some one works in USCIS himself/herself, no one knows the process in detail. Probability is high that they send PP receipts more than RP in first few weeks but there is no way of knowing the exact percentages. So, please keep your hopes up.

    -> A lot of you have been following the immigration girl’s blog. Please stop thinking in terms of the stats posted by her for the number of applications that got selected from the one’s she applied for. There are many more law firms applying for people and they might have better or worse stats. It is still possible that you get the receipt soon for PP. USCIS’s process is completely RANDOM where we can only speculate the current status.

    -> PP folks – Only lose hope once the USCIS publishes the article stating that the data entry is completed for FY 2017. Before that anything is possible. Last year, May 4th was the date when USCIS announced the completion of data entry, after that, only RP selected candidates received the notification via regular mail as PP were notified of their selection via emails.

    -> It is definitely possible that some PP applicants are yet to receive an email notifications that their case has been picked up. However, the chances gets slimmer by each passing day. I am myself an AD/PP/VT applicant and losing hopes day by day. But cant do anything apart from praying at the moment.

    -> People also talk about joining a second Masters if they are not picked. Please note that if you have already done first Masters here and have applied for OPT then enrolling in a second Master wont get you any OPT. Only way you can get an OPT then would be if you enroll in PhD. program. Also, people thinking on going for CPT from day 1 will have great problems in getting H1b later since their application might get approved but their Change of Status will be denied citing the reasons of non maintenance of F1 visa (How were you able to work from Day1?) So, these people will need to go to India for stamping and will need to answer the same question: Why did the COS got denied? and how were you working on CPT from day 1. I know that there can be exceptions for sure but most of the people trying to find a quick fix land in trouble.

    -> Alternate option can be to migrate to Canada. But that process is also an year long process. So, give IELTS as soon as possible and start getting your Educational evaluations done. Best would be contact some agency in India that would be able to help.

    -> For UAE, please start finding jobs now and apply soon. Getting the Visa is easy once you have a job offer and since you have done studies in US, there is a good chance that you might get an offer. Else Singapore is also an option.

    I am posting this information here to help anyone who is in a situation like mine. I know that it can be very stressful for people to have invested money to study/come here and now thinking of leaving due to a flawed process. I am trying to keep my hopes up, please keep your hopes up too.

    P.S. Please don’t curse anyone who has applied multiple times via genuine job offers (yes there are applicants in that category) OR through consultancy OR year after year. Everyone dreams for a better life themselves and have every right to do so. Lottery is a random process and it cannot define who is right or who is wrong. If you do want to curse, then please go to USCIS website and start cursing. I am quite sure that you wont do that as you are scared 🙂 So please keep it civil here.

      AD people: If this is your last attempt and end up moving back to India, start a business if you have something in mind, 10 years later you will be rich and have everything you want. ( economy going from $2 T to $8 T or so is no small thing, its up for grabs if you have talent, be the next billionaire).

      Non – AD people: Although I wouldn’t deny that life in US is better, one can have comparatively similar lifestyle in other countries. Work hard, save money and start traveling as much as you can, one thing I’ll always regret is not exploring my country India enough.

      This is my third attempt all three AD PP. Never got picked up, I have already started looking at my options and my client agreed on porting me to Ireland. That’s a win-win. I have given lottery a chance to decide my fate for 3 years and it never favoured me, so I am sure that it’s time for me to leave.
      Should I have any complaints about the lottery? May be or may be not

    Please check your emails for the received date it and check it on USCIS. It will either be same or different, if different I dont understand why and if its same then good.

    USCIS California center has started approving Premium Processing I129 applications. Since USCIS sent out receipt notices for premium processing on April 11,with 15 days SLA they should be starting to approve the cases. Below are 2 examples I came across.

    This doesnt mean its an end to PP/RP. They are doing in batches so it will take time. I request DO NOT lose hope. Stay calm and good luck to everyone.

  22. on the email notice, i saw the received date as 04/11/2016 and on uscis is says, we received on 14th april? How is that possible?

    • Guys.. Just a suggestion.. atleast type the same in google before you ask.. Don’t behave as if you don’t have time.. There is lot of information with timeline available for similar cases and questions. Don’t feel the admin is entirely free and here just only to answer your questions.

      Also I see lot of hatred going on.. For USCIS it does not matter if you are Indian, Nepali, Bangladeshi, Pakistani or European in the selection of H1b. For them you are just an foreign applicant.

      Not trying to teach lessons.. trying to keep things simple and polite

        • If you look at all the comments this morning, I remember there’re at least 3 PP said their checks cashed today.I just saw another on IG as well. All without notification!

          If you have to wait for the receipt it will take you one more week.

  23. FYI,

    You may have seen an update from USCIS yesterday about pre-paid mailers for premium processing petitions (that’s a lot of p’s!). Here’s what it means: Normally, if an employer wants to receive a premium processing approval notice faster, they can include a pre-paid mailer for Fedex, UPS, etc that is addressed to the employer. When USCIS approves the premium processing petition, instead of sending the approval in regular mail, they will use the pre-paid mailer so the employer will receive it overnight.

    From now to May 30th, it looks like USCIS will not use those pre-paid mailers (if one was submitted with the cap-subject H-1B) and will instead mail the approval notice in regular mail. I don’t think this affects many people since the approval notice won’t take effect until October 1st. Getting it a few days faster in the mail really doesn’t accomplish anything at this point.

  24. Lottery is done. But PP notification is not, if you follow the comments this morning. There’re several PP got notified. My law firm also confirmed they’re still in-taking email notifications.

    • You can always ask your employer for the LCA. In my experience, once the H1 is approved, the attorney sent me an entire package that had my I797A, I797 Receipt, I-29 Form, LCA, etc, basically a copy of the entire package that was sent to USCIS for processing.

      PS – I have been on H1B since 2014, and have changed employer once. Both employers sent me the package. I believe that is the norm at least with US based direct employers.
