When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   1. IBMers don’t worry. I checked with my Case Manager. If your status is showing as “Closed”, then it indicates , that your case has been send to USCIS and it is a confirmation of the same. You might have received a mail for the same as well.

    I had earlier tweeted on #immigrationgirl, and she has replied back saying, that the regular processing is yet to begin.

    So just have faith in God and keep yours fingers crossed. Good Luck IBMers. 🙂

      • But for most of my friends inszoom is updated with ups tracking number but not mine. Got email saying submitted and inszoom case is closed. Is ur inszoom updated with ups/Fedex tracking number?

    • Lottery is already done! PP notification is done as well. It is the notification process of RP for AD and non AD that will start now.

      Again, all lottery is conducted together, not week after week. Stop giving false hope to people guys. Let us be real.

        On April 9, USCIS used a computer-generated random selection process, or lottery, to select enough petitions to meet the 65,000 general-category cap and the 20,000 cap under the advanced degree exemption. USCIS will reject and return all unselected petitions with their filing fees, unless the petition is found to be a duplicate filing.

      No one cares to send any confirmation of receipt got or not , or where to look in inszoom ?
      Or will we first get an email , and then get update in inszoom , there is no one to answer .

      • There is an option to check USICS status, but that says either the firm has not yet received the receipt or not yet uploaded by the firm.

        This time the process seems to be changed a little bit, last year it was not the same.

        • I dont even see any updates on my case since December 2015….. Looks like inszoom has nt even been updated. I did receive an email from my case manager on 11th April that the petition has been submitted. Not sure if they actually filed.

        What an unfortunate scenario from Ibm, cant do anything .

        Much before that , we got to know from USCIS that h1b cap has reached and they stopped receiving petitions.

        Just left out to regret why I didnt contact any desi consultancy sitting in America to get filed my petition , atleast they cud have sent it On time.

    • Guys.. It will be just two weeks. With 5500 applications processed alone at VT every day with 85-90% of them being the I-129 applications dated April 11th, that means, 24000 plus applications processed at VT we should expect them to announce the closing anywhere in the mid of next week.

      Besides we have CA which is also working fast enough.
      In or Out.. Just a week.
      The H1b phobia ends for the year early first week atleast for the AD PP/RP and Non-AD/PP.

  3. I work full time in US. I applied last year from my firm in AD but did not get selected. This year, I applied via a consultancy another H1B in addition to my firm’s petition. I got lucky and my firm’s petition is picked. Now I don’t care anything about the consultancy’s H1B petition. Can I get it discarded before I get any notification about it? Would that be an issue? Can I otherwise discard it after it gets picked before it gets an RFE? If I do that, would USCIS find it fishy?

    • I hope you get an RFE and then subsequently get banned from entering the US. People like you are exploiting this loophole and eventually making it unfair for other people who are genuinely filing only 1 petition (the employer they work/ plan to work for).

      • Get a life H1BAbuser. Two different employers is fair game. I didn’t make the lottery in my first attempt (this was the first year of lottery FY14), so I can understand the frustration, but no is entitled. If you have that shallow mentality, I guess you have bigger problems than not making the lottery.

    • Update from my Lawyer today !!!

      Unfortunately we haven’t received a receipt for your petition. We also haven’t received any H-1B cap receipt emails in several days. It is likely that your petition was not selected in the cap.
      As your current OPT will expire on May 30th, please let us know if you have started the process for the STEM OPT extension

      I am AD/PP/VT. Seems like I am done… Screw this lottery system..

      Today morning at 7.30 AM CST , my friend called me saying that her H1( AD/PP/VT) got picked in lottery , by knowing that the check got encashed . Her employer confirmed it. She is waiting for her receipt number to come .

      This says that still we can hope . Even am also in AD/PP .

  7. What are the chances to get denied once someone got selected in the lottery? Does this happen often and for what reasons?
    (I got selected and am in the States currently, just wondering if I should still be nervous about that)

    • As long as your documents are genuine, good school, relevant job and most importantly no fake multiple application, you will be fine. At the most you receive an RFE but the lawyer will handle it.

      My case got denied this Jan after getting selected in lottery last year. And with me 17 others got denied. There is a lot of scrutiny now a days and is very much possible.

  9. My company is a small company less than 25 employees in Virginia . .this year they filed 56 petitions

    I would like to know where will their processing centre f company based in Virginia ?
    Will the employers rank or size matters in selection process ?
    Also will the employer will come to know receipt through mail for regular processing ? Or till when can I wait for the receipt

  11. Look at that news release yesterday

    “For two weeks after premium processing resumes for H-1B cap-subject petitions, USCIS will not use pre-paid mailers to send out final notices for premium processing H-1B cap-subject petitions.”

    What do they mean by “after premium processing resumes”? Had PP been suspended before and now resumed?

    • PP had been suspended before and now resumed?,

      The official start date for PP is May 16 at the moment. Maybe that’s what they meant by resuming PP services. So after May 31, they would use pre-paid mailers and not until then.

          • That’s expected. They won’t entertain you until they’ll have any feedback for you. Either selected or rejected. Last year they’ve informed me in the last week of May that your case is not picked in lottery. You’ve missed the boat this year. Wait till May end and don’t lose hope.

  12. H1B Information

    Why not the USCIS release the data regarding how many more PP are pending or if RP is started or not. They can give some information day to day so that no need to think whether something is strted or over or not. Do the y face any problem by giving such information. Can anybody answer to my question

    Can any possible way to find whether my petition was filed based on my LCA number or through any other ways?.

    Since Infy GICS portal displaying the status like “AcknowledgeFromUSCIS”, but actually I don’t know whether they filed my petition or not.

    Mine is Non-AD Regular process.

    • There is no way to know the status now. One has to wait until he receives receipt number after lottery selection or rejection notice. Just Chill!

      • i just talked with my H1 Sponser (Desi Consultancy), according to him they are countinously checking their bank statement for cheque encashment status but so far no cheque got encashed for NONAD/RP guys, they have filled 11 petitions this year

    I have been following the thread for quite some time now and I wanted to let u know that the RP/AD results have started coming out.

    Also, i did my masters from CMU and currently working at Microsoft but i did apply two applications this year. My Microsoft application was PP and i havent heard yet, but i got from the other. So Im not sure if they are still handing out the PP cases.

      They are not suspending PP. They are saying that final notices will be sent through default mailing system (USPS first class) and not use employer provided pre-paid envelope (which could be 1 day FedEx etc).

        My non-AD / RP file has been picked as per my employer. My worry is on the salary offered $54800 per year for Business Systems Analyst role in Fairfax, Virginia. Does it satisfy the minimum salary limit ? Will there be any issues if it is on the lower side. My employer is not giving me straight answer on this. I am told the chances of rejection is high if the offer is below the minimum salary. I am not able to find out what the minimum is. Please help.

          If your employer filed the correct LCA, then DOL would have already taken care of minimum salary requirements.

    • You may want to ask them our LCA. The LCA has the prevailing wage info (which basically is the minimum wage as per DOL), and also includes your salary. You may want to verify both. You can also check the prevailing wage by searching for the same.

      The salary should be as per min wage act of US. But lottery results will never validate it….its random selection

      Chances of rejection are after lottery selection…. I am not sure if USCIS will say to cross check your salary or not in form of RFE….

      But it will be better to verify what is us min salary required for your role.
      54800 it is not min salary which i think. it is acceptable.

      I am from Infosys and my friends in US(2015 lottery) are having same package which got picked in lottery…..

      • Hi! Have you gotten any updates (i.e. have they notified of checks being cashed? any receipt number issuance on IMMSTAR?) I am with Deloitte and this year Deloitte is using RP. This is my second time, last year I was Non-AD PP but this year I filed as an AD RP. Hopefully I will get picked this year. Please don’t forget to state whether you are PP or RP!

  20. USCIS Will Temporarily Suspend Use of Pre-Paid Mailers for Certain H-1B Cap Subject Petitions
    For two weeks after premium processing resumes for H-1B cap-subject petitions, USCIS will not use pre-paid mailers to send out final notices for premium processing H-1B cap-subject petitions. Instead, we will use regular mail. USCIS will be doing this due to resource limitations as we work to process all premium processing petitions in a timely manner. After the two week period, we will resume sending out final notices in the pre-paid mailers provided by petitioners.

    • What is the final notice?? Is that the hard copy receipt???

      If so, there is lack of manpower for sure in sending out all PP notifications before May15th.
      Maybe that’s why there are hard copies coming and checks encashed without email notifications.

      Can we still have hope till May 15th ???

  22. AD/RP/VT – genuine 1 application. 1st for employer.
    employer told me checks were not cashed as of 4/20. Should I still keep hopes or start packing?

    I know we get these questions a lot – does USCIS cash checks all at once after the lottery for selected applicants or in batches of PP then RP

    This anticipation is really scary! !

  23. Believe it or not. More than it suppose to be!

    I know 11 people in the lottery including myself., all AD/PP. Only 4 of us got receipts. That’s below 40%. I feel there still room for ADPP. IG has the same expectation on her blog as well! Again, I believe PP’s not over yet!!

      I know you want to remain optimistic about your result, but you are not making any sense. Are you saying your data set of 11 people should have a selection percentage of XX% and until then it would sound too incorrect? Seriously?

      FYI, I know 4 people who applied in AD last year and no one made through the lottery. So it was 0% in my data set.

    • I don’t want to loose your hope but 2 out 8 is median chance if ur emp gets one more then its likely to deviate from median but emp who files more petitions has more chance to deviate from median while winning lottery

    My non-AD / RP file has been picked as per my employer. My worry is on the salary offered $54800 per year for Business Systems Analyst role in Fairfax, Virginia. Does it satisfy the minimum salary limit ? Will there be any issues if it is on the lower side. My employer is not giving me straight answer on this. Please help.

      They would have submitted LCA for the position and mentioned the prevailing wages for the zipcode in that LCA. As long as they pay more than that, you are legally ok.

      Having said that, it is possible that the company quotes the LCA in lowest grade even though you are qualified for more. In other words, you may be a Senior Engineer being recruited as an Associate Engineer.
