When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. This is a strategic move and will require sometime, so plan well.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

If USCIS does it work correctly, then H-4 receipt should only have been issued only if your H-1 was also selected. Was everything sent in one packet? Was H-4 receipt issued to you, or to attorney?

H4 receipts, when filed with H1 application for COS is directly sent to applicant’s home address.
I can confirm that as one of my friend got his wife’s H4 receipt 2 weeks before his employer informed him about the lottery selection.

Actually they would not go to applicant directly if the attorney has submitted form G-28. In that case USCIS considers the H-4 applicant to be represented by attorney and will send community to them. Just like what they do w/ H-1 applications when attorney is involved and everything is routed to attorney and not employer.
Based on best of my knowledge and actual experience, my friend got his wife’s H4 receipt in mail at his residence. His H1 receipt was sent to attorney. I have myself seen that H4 receipt last year.
It came directly to me. H1B and H4 were filed simultaneously with same attorneys.

Vipul is right. I have gone through this process twice now, both times times H1B Change of Employer, and the attorney made my wife sign the G-28 forms. The I-797 Receipt does come directly to my home address, and the I-797C Notice as well. The I-797A however goes to the attorney on record.

I paid for my PP fee and I see that the check got cashed today by CSC. My employer says he did not receive any receipt yet in my case. I am confused, are there cases where PP check gets cashed inspite of not getting picked in the lottery? Or can I assume that my application got picked in the lottery and I just need to wait a few days to get the receipt?
I know that USCIS only opens the packets which got picked in the lottery, so I was assuming that mine got picked too. But I want to know if there are any rare cases where the PP check gets cashed even though the application did not get picked in the lottery.

I see quite a few PP in this situation. Check cashed or SEVIS changed without notification. This is why I still hold up my hope! ADPPVT no news…
You won’t get your PP fee even if your application does not get picked in the lottery. So, cashing that amount won’t indicate that your application is picked in the lottery

Entires fees including PP fees is returned in case petition is not selected in the lottery. USCIS won’t cash PP checks if the person didn’t make through the lottery.

premium is a service by which USCIS find you and decleare if you got selcted or not ,so even you are not selected the $ amount spend for PP still holds true as they are finding you wheather you got it or not .
PP fees do not get returned , the petition charges are if are not able to make it this year

That is not correct. PP denials are not sent any faster than non-PP denials. No PP checks are cashed in case of not selection in lottery.
From what you are saying, it implies selected PP application get faster lottery result and faster adjudication in the same price as non-selected PP application which gets only faster lottery result.

That was the question every one asks. I should have easily made if I has applied it. But my bank saving is just couple of hundreds dollars. I sent money home every month for education of my two younger bros, I am also leading a family, I have a wife and kid to feed on. E2 green card process needs around $ 10000. My company may sponsor O1 but it is not confirmed yet

suggest you talk to company about worksite offsite for an year while your GC is processed, you should get this in one year. Not in same boat but already in US working on 175k salary, but can’t extend stay because GC lines are too long in EB2 and H1 process is not too kind.

Non-AD/RP 2nd Attempt (virtually 3rd since last year infy did some nonsense priority list, got all the documents from me and did not apply. Was informed that they did not apply after the lottery was over. This is utter foolish move from their side thinking that they would be able to retain employees by their too good thinking.)

For two weeks after premium processing resumes for H-1B cap-subject petitions, USCIS will not use pre-paid mailers to send out final notices for premium processing H-1B cap-subject petitions. Instead, we will use regular mail. USCIS will be doing this due to resource limitations as we work to process all premium processing petitions in a timely manner. After the two week period, we will resume sending out final notices in the pre-paid mailers provided by petitioners.
When applying H-1, employers can submit pre-paid envelope to be sent final receipts. This way employer can pay for 1 day or 2 day FedEx service, because USCIS by default would use First Class USPS service. It also provides the employer ability to track the final notice so that its not lost somewhere or marked as undelivered.
What this alert says is that they will be using their default mailing service for now, and will use employer provided pre-paid mailers after 2 weeks.

You are absolutely right. But, last year I remember Immigration Girl has mentioned her PP approvals started from April 23. So, I am assuming since USCIS has been pretty fast this year, they would have started giving out early approvals three days sooner.
Obviously I can be wrong. I will keep checking tomorrow.

Like every year, there is a debate going on about multiple filings. I just wanted to share my thoughts, which are little different from what has been discussed here.
H-1B program was catered around employers and not employees. That is why the petitioner is an employer and USCIS makes all the dealings, interactions etc w/ them and not the employee who is just a beneficiary.
From USCIS’ perspective, if they receive petitions from employer A and employer B, they will be treated equally and fairly as long as the position is for a genuine job opening. If it happens to be same employee, then that’s how it is. One employer’s position would remain vacant in this scenario. This would be similar to the case where employer A filed 2 openings for 2 distinct employees and one of them refused to join. Even in that case one position would remain vacant.
Because USCIS always look at it from employer’s angle, that is why when they banned multiple filing, it was for same employer filing multiple applications for same employee. They don’t take H-1 program from employee’s perspective and so filing through different employers is not considered multiple filing.
As long as someone is not paying for their own H-1, filing through multiple employers is fair game. If someone is paying for their H-1, then that is illegal and should NOT be done irrespective of 1 petition is filed or multiple.

I absolutely agree to your thoughts on this. I am an existing H1 Holder from 2014 and have been following this blog from last year to see trends.
I also would like to mention about one more thing I noticed, I saw concerns raised by AD candidates on spending time and money on US degree but still not getting preference in lottery. Well AD candidates get 2 chances, first 20K AD pickings and rest get merged with the remainder of applications and a fair chance again.
So even after getting 2 chances, if AD candidates think they are not getting preference I don’t know what else can be done by USCIS.
what can be done is all the accepted petitions arranged in descending order of salary and then USCIS pick first 85000 (adjustig the Chile and Singapore quota) and get done with it.
This way atleast there is some consideration given to talent, because more skilled the person is , more salary one can command.
Money cannot be a correct measure to decide things. Salary depends on job type, number of years of experience, employer, job location etc.

I will wear my “crooked H-1B employer” hat and see how I can handle this.
I will file petitions with enormous salaries, so that they are selected in the lottery (ascended by salary). Later, I will file H-1 transfers for all those selected applicants to new jobs which have more reasonable (read low but still as per new LCA) salary. So my low income “H-1 unworthy” applicants made through the lottery where only high paying jobs were supposed to have been selected.
Right.. OR you don’t give salaries to employees which you quote in documentation.. Illegal but things happen !!!

Do you have any first hand experience with any employee, employer, attorney regarding multiple filings.
Basically how USICS reacted to multiple petitions, genuine or not, what are the kind of RFE s, I read in immigration girl blog that she has very bad experience and the association of attorneys also sent a warning regarding multiple filings some time in Feb. What I presume is multiple filings are not straight forward, one should be very careful doing this to avoid future problems. The employer may landup in unnecessary trouble because of you.

I don’t have any first hand experience of any multiple filing scenario – positive or negative. Although I have read about experiences online (mainly positive). I also know attorneys who have published this strategy on their site to improve chances of lottery selection.
If a person applies through Google and a consulting company, I doubt if USCIS will consider this as illegal. If a person applies through 2 consulting companies, then USCIS may want to dig deeper to see if they are mutually exclusive or not. This becomes an even bigger problem if another applicant has done multiple filing through same 2 employers.
If the consultancy has applied with a job position in google, its a problem right?
One more question,
It would be a problem if USCIS determines that company and Google both conspired for the same position. If Google is unaware of the other petition, they wouldn’t be penalized for it. In addition, the 2 positions need to be for same job.

I would say tie H1B application to either passport number or SSN. And allow it for easy transfer. Before October. may be next day after approval.
As one guy cannot work in two offices on two H1B it seems illogical to give him 2 H1B. So allow one application and easy transfer. that way it can be fair game.
I am a Chemical engineer had work experience in India, Studied on full scholarship in decent school. Currently I am working so hard in this tough oil market to keep my job when most of the companies have laid off more than 50% of the employees.
I got already picked this year AD/PP. The problem with core field is if you are genuine it is very tough to find someone who will file extra application for you. If you are a con guy u can do as many application as you want.
I wont complain about the people who filed multiple applications (i didn’t complain when I didn’t get picked last year). American want to ban H1B saying we take their job, We want to ban multiple application and people coming from Indian MNCs. Almost same …..Survival of the fittest and not strongest.

I am AD/PP/CSC. My attorney told me that the law firm started recieving PP receipts This MONDAY. I don’t know wth happened,it is not a small law firm. She asked me to wait till this weekend, still hope.
PS: is there a chance that you got selected, but your check might be cashed late. My friend who got selected last year said her check hasn’t been cashed till April 29th.

@People who say multiple petitions (even legit) is just like interviewing for multiple jobs: You are the one not making any sense. Lets compare: You go to 5 job interviews, in the end if you get accepted by all 5 you will choose one and reject the rest, and the other 4 will be given to the second best candidates. You did not take away their chance of getting a job or at least, those 4 positions will be filled regardless.
When you send in 5 petitions, assuming legit, and say you get all 5. Are you going to accept all of them? Are you going to work all 5 jobs? As if you don’t then you are taking away other people’s chances. That is 4 other people whose lives were significantly changed one way or another. It is not like a job interview when if you decline the offer will go to the next one.

@Multiple Petition :It is the process that allows multiple petitions PERIOD. In a lottery if u are allowed to file multiple petition, people will file it.They are just increasing their chance of winning. Anyways it is a game of luck, it may happen that people with single petition gets picked up and multiple petitions don’t. Getting H1B does not in anyway mean that some are more intelligent and deserving while others are not.
So it’s not their fault that USCIS does not reuse the revoked petitions, the whole system is kind of flawed. Also, I don’t understand how these guys get 4-5 employers filing for them? One I know is consultancies having sister companies (which technically are different companies, and thus legal).
To your point, if the 5 employers are legit employers, and all get selected, the candidate probably signed an offer letter, and was in the process of being on boarded, and if they cancel the offer once their H1 is approved, good luck to them burning 4 bridges.

That is the fundamental issue within the system. That might be a bad example and you are absolutely right. The moment you send out your petition, it doesnt matter you send 1, 2, 3, or 100, you basically take away others chance. In this case, by sending out your petition, you lower my chance of getting picked. In other words, YOU take my spot. Would you consider not sending it and let me take it? I dont think so. If there is a prize for all qualified participant, no problem. If its a competition, people do whatever is necessary, or whatever is acceptable to win, or at least increase their chance to win. Again, I am talking about two separate employers no relationship with each other. Each petition follows the current rules.
Like I said, dont hate the player hate the game.

Dont worry bro..multiple petitions improve chances to get one picked, but they dont go for all approvals..I know few people who withdrawn theirs second pick after getting one approved ..so they are not taking anyone chances..USCIS will issue 65k approvals..At least people who are in US have a plan..what about Indian MNC’ s who apply for tons of people and dont send them until second or third year..are not they taking other chances..

2. You can wait till mid of May for the results.

This time they have initiated for all folks in our team but definetly they might have filed only for few folks based on priority. Same thing should be notified for us so that we can work on Plan B. Cannot keep things pending for this sake unnecessary. And feels sad to be on hope for no reason.

No emails will be sent for regular processing.
RP responses from USCIS come in mail.
Then the Attorney/Employer can use email or post to inform the beneficiary. Which is what I think people refer to when the said email here for RP.

This is not for H1B 2017 lottery. This most likely is case for change of employer (which is exempt from H1 quota). If you look at date before and after this application, it mentions 11 April.

Yes, I understand. Usually, premium processing date will be closer to 10th/11th April. Many employer prefer premium processing for new employees, which will show the date of receipt generation.
If this 2017 H1B application, I am happy for the folks who are getting selected now. I don’t want people to have false hope. Seeing this system and process for last 4 years, I think what I said made more logical sense.

I agree with ‘Vipul’. This could be change of employer, or other exempt cases, or it could also be FY 2017 cap case. No one knows, and it’s all speculation.

If I am not mistaken that case status means Someone requested the PP after his case was picked in the lottery. It clearly says we got your PP request on XXXX date. I do not think it means they generated the receipt for the PP.

USCIS announced May 4, 2015, that it has completed data entry of all fiscal year 2016 H-1B cap-subject petitions selected in our computer-generated random process. USCIS will now begin returning all H-1B cap-subject petitions that were not selected. Due to the high volume of filings, the time frame for returning these petitions is uncertain. USCIS asks petitioners to not inquire about the status of submitted cap-subject petitions until they receive a receipt notice or an unselected petition is returned. USCIS will issue an announcement once all the petitions have been returned.

From the language it looks like a petition that was originally applied in RP and then upgraded to PP. Refer to text “we received your request for premium-processing “.

You still cannot say that was RP. I did a change of employer using PP, and when I go look into the history of my case, the first update is the message above. “We received your request for premium processing ….. will mail a notice … “. The next day there was an update which said, ” We have received your i-29 and emailed you a receipt”.
Bottom line, if you want to check the case history, make an account on USCIS, add that ‘Case #’ to your account, and then you will be able to see the history of updates. Hope this helps.

So in your case they processed I-907 prior to I-129. However, that is an exception and not the general flow. Still randomly picking numbers is subject to interpretation and both your and mine have flaws.
The only way to to know for sure, if it is your own case.
We did not receive any premium processing receipt email notifications today. It is technically possible that we may still receive some emails through May 16th. I went back and looked at last year’s statistics and found that April 27th was the last date we had received a premium processing receipt last year. Keep in mind that USCIS also mails a hard copy receipt notice for those that were selected in premium processing. We did receive some hard copy receipts today for some cases where we did not receive an email. So, don’t lose hope yet.

I was told by my employer premium processing check has been cashed by USICS (knowing this news, I’ve celebrated :-P) one week back, I didn’t hear about the receipt number yet.
Today after a week I tried to reach out to my university DSO to check if there is any update on my SEVIS, they didn’t provide me any information and they asked me to check with my employer ?
I’m not in a bad situation comparatively, as I’m confident I’ll get 24 months OPT
But, I believe there are lot of advantages if we get H1B, personally and professionally.
Can someone let me know what are my chances of getting my receipt and how long would the waiting time be?

There is a difference in getting Premium Processing cheque cashed and overall filing money cashed.
PP money will be cashed if you are filing for PP services.
Filing money will be cashed if you have been picked in the lottery.

I see AD PP coming up but very less.. non-AD PP coming up on Monday.. RP happened to see on some blogs rarely.. As of today still PP both AD and non-AD are showing up
I think RP will come to know starting tomorrow as they come by post which often takes 3-5 days and a day ore more to get notified by the attorney, i.e. post April 19
(April 13 + 5 + 1 = April 19 ).
Last year PP got email till April 22 and the last they say is on April 28. There are even cases picked later but the chances slim after April 22 …

Thanks for the info! I am a AD/PP and this is my once chance as a non-IT. My co-workers all got their receipts, except me and this makes my so upset and even lose my hope. I am even thinking to start pack and leave this country.

I always want to comment in this blog but don’t want to show my frustration here, Applied for last two years and waiting for the news for so long,Had sleepless nights , frustrated on the people who do scams in the beginning but realized this frustration is because i didn’t get picked,If i get picked i don’t even think about the scams. Because we need someone to blame for our bad luck, But anyways its our fate that which decides even its 1 application out X amount of application you will get picked. That’s what i realized once i got call from my employer saying that my checks got cashed (AD/RP/CA),Happy to share with you guyz……Hope all the deserved guyz get it even multiple or single application by the way i have single application both times.

You are not making any sense here. Do you go for only one job interview when looking for a job? If there are two or three or multiple employers are willing to sponsor the same person. Multiple employers here I meant legit offers.

I feel in case of multiple selections where you can only keep one – the others should go back to some common pools for some waiting list kind of selections..they should not be wasted..as whilst it is fair to apply multiple petitions from different employers but at the end of the day it is unfair to waste some precious seats for some really needy n desperate ppl who have spent like lot of money, energy n time..

I am already on L1 buddy and have plan b ready. You petition is just selected and not yet approved. If u wish negative for others, others won’t wish positive for you. So chill and don’t enjoy yet else your petition might get stuck in RFE and eventually rejected. Now enjoy refreshing the forum.

You can wish whatever you want. But you are still not making any sense. How does multiple petitions ruin the system? It water down the chance of others? Applying your logic to the master cap, those people have two chances in the same lottery. Does it, in your standard, ruin the system as well? Do those who have better education deserve to be in the master cap and have a better chance? Some people have better skill set and are able to find multiple sponsors to file petitions for them in the same FY, what’s wrong with that? Not to mention it is clearly stated on USCIS website two or more petitions for the same beneficiary is allowed as long as sponsors are separate entities and are not related to each other.
I wish you the best, but at the same time maybe people like you are really the ones who ruin the system.

I will not say AD deserves a special channce but the thing their life will take a big turn if they are not selected in their last attempt . This is my last attempt and i have genuine all my attempts even though i work consultancy .Hope the Deserved get them atleast .
There is cap for visa slot.Some will get and some won’t.And both AD and Non AD are deserving and genuine
When asked about lottery results in different formats, always the below reply from GM team:
“We may expect the lottery results by May 2nd week. “

But does it really get dispatched by the GM team only by then? cos last year from what i have heard. they started sending out mails from 3rd week of April. However in the GM Faq’s it has been mentioned it will be sent out on or before may 16. Would be hugely relieving if someone can tell the real scenario who has already been through this in CTS. It is so frustrating to ignore thinking about this and end up checking forums and Cognizant mails every now and then. TIA

It was my first time and will be my last one too. I have to say it was a nerve wrecking experience. I went from excitement, to anger and a bit of aggression to accepting the destiny that God has chosen for me and its not the USA unfortunately…..and I probably never wanted a weekend to pass by as quickly as the last one.
