When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     Guys who are AD and Regular Processing, take it easy and expect to hear an official receipt only after April 25th… USCIS probably only went through about AT MOST 20,000 petition as of April 16th. Give it some time, they are humans too.

    • Keep in mind, out of 236,000 petition, about 20-30k are filed with more than 1 application. USCIS will look into unique applications per person. If two or more application get picked, you can only choose 1 to proceed with H1b petition (you cant keep all). This allows everybody get a chance. So there really is about 200,000 petition… about 4-5k petition are usually picked but either denied/returned back due to incomplete LCA filing/ fake degree etc.. So the total applicants are around the 190,000 to 195,000 figure. This allows for a better probability.

        USCIS will look for the uniqueness of the petition based on combination of unique identifier of employer and candidate. every petition is unique if not duplicative. If multiple petitions from different employers filed means, uscis have to process both . Its upto candidate to choose the one he wants to work with. Other approved petition will go waste or he can use latter before expiry

        • I know of some guys filing from 4 different employers. These guys are gaming the H1b Loophole.. that is unfair for single petition like most of us.

  7. I am a genuine Non-AD/ PP/ VT and slowly throwing in the towel, mentally. It looks like they were really fast this year and most PPs have been sent out already. Hope dies last….in trading that means you lost already if there is only hope left…

  8. It seems like over for PP. If you see WAC16137520xx , most of them say that ‘receipt was sent’ and not “EMAILED”. I guess they started adding data for RP petitions. 3rd time is no charm either 🙁

    I believe USCIS works on Sat too.

    • Same here , I almost lost hopes for AD/PP.

      I would wait till Wed and If I did not receive any notification by Wed then Game is Over.

      This is my 2nd & last attempt. Chances of getting selected are getting slimmer day by day.

  11. According to my attorney, NonAd and Ad are not issued separately. I believe this is true (at least for now) since the 2nd round lottery is for both degrees. We saw AD came earlier in the week because those are who got picked the 1st round.

    So now the pressing question is- can we see more PP receipts coming in next week? Till what day?

    Can someone ask his/her attorney about this. I would really appreciate that!

  12. Did any one from CTS check the fedex number provided in the document uploaded in onec app? I checked the fedex tracking status and it is showing 1 as delivered and another with no updates. Which one is the valid one? I think the 2nd one which has no updates was assigned to get delieverd to CSC centre. Please clarify.

    • Did you check the ship date? it would be around mid feb 2016 and deliver date as apr 1st.it was assigned a tracking no and then went to different location and package was again shipped with same tracking no for apr 1st delivery. during the second transit few petitions would have been pulled/modified and also each lca has around 30 petitions so tracking no wont be helpful whether your petition reached uscis or not.

        Dude.. Relax.. Its same for everyone. The shipment package with our 1C case id shows “Label Created” and the other one shows as Delivered. So its safe to assume that CTS wouldn’t mess up with all of our H1B petitions. Enjoy your weekend. Get ready to receive good news in the coming weeks. All the best to everyone who are waiting.

  13. I see few people quoting percentage numbers from immigration girl blog and considering it as a progress of how many petitions have been issued. However, that is not the case.

    USCIS doesn’t how many petitions amongst the total petitions were filed as PP, and how many receipts they have issued among them.

    What the blog is mentioning is percentage of petitions that were filed under PP and have been issued receipts. So it is (Number of PP petitions applied by her firm for which receipt is issued) / (Number of PP petitions applied by her firm)

    We don’t know what is total number of petitions applied by her firm and it is not a safe assumption that it is a good indicative of overall sample size.

    So stop using those numbers as indication of how much progress has been made w.r.t. issuance of receipts.

  14. USCIS started sending email receipts 2 days earlier than last year.
    (this year – Apr 12/ last year – Apr 14)

    So, maybe earlier than Wed 20th will be the end of all PPs..
    considering the last day(Apr 22nd) of PP last year I guess. T. T

And this is associated with not just me but a bunch of few innocent lifes … If I get it I give them a life they deserved as a tribute of my respect, being a son and only support… If I don’t get it its simply and end of the selfconfidence an end of the long struggle an end of a gruesome run just before the finishing line… I can’t rise again as I have already hold it so long , can’t pretend to be strong when I already feel being at the verge of all my morale being exhausted…. If god is there , this is the time he should hold my hand before I fall in to the core of void …..

    I was just silently monitoring this blog. I am already an H1B holder and was just watching this blog to update myself for this H1B session, since i applied for one of my friend. However, this is not my business at all that what kind of language people use in these blogs, yet i believe that you should keep a eye on these blogs as you are doing a really good job over here at international level, but many people over here doesn’t seems to be with good manners and education as they use such an abusive language. I recommend you to delete such blogs as this is an international forum and doesn’t put good image of country.

    @Other People:- I know that you might not be happy with H1B selection process, but this is an international forum and you might have Advance degree or lot of work experience. You should keep this in mind that it is noticed by other people in world. So, i request you to please behave properly as this shows how well educated you are. I know, i am no one to point out your mistakes or conducts but some of the abusive comments in this blog is creating wrong image of country. Some of the good person like Saurabh creates these blogs to help other, don’t try to ruin these experience. Believe me, how intelligent or good you are, these comments leave bad impression to folks of other country.

      Thanks for the feedback. I agree that the language goes down the drain and this is a recurring thing every year in April-May when lottery happens and the debate starts of who is entitled and who is not.

      Usually it is difficult to keep track of all messages as 100s of messages are posted every hour, and I have my regular day job and personal life to take care of. It is 2AM where I am right now and I am cleaning up the blog.

      I do go through messages later to remove the abusive and hurtful comment. However, as long as the debate doesn’t get abusive I let it proceed.

      If anyone objects to particular comment, then please at mention me and I will take a look when I go through old posts.

      I am not going to delete your comment as it is a good reminder of how to have amicable discussion in a public forum.

  17. By looking at all forums and stats, I guess non AD – PP can expect receipts till coming Friday 22nd. We can kiss good buy if we don’t get by this date mostly.

    After that as PP starts on 16th May, technically they could send till that date.

  19. AD people are the ones who go to desi consultancy. They are the ones who file multiple fake applications.
    Most of the people in India do not know about desi consultancy or could not muster the courage to apply through them.

    • Guys its not the qualification that matters i have seen people who are diploma holders and doing much better than us. Just because we are visa applicants does not permit us to underestimate the skills of others and its a request that stop pulling each others leg. The people who are cursing others at this moment will they surrender their petition if selected, i guess not

        So who the hell works on machine learning, quantum computing, computer vision and big data? Never heard IT companies working on that.

        All these things need advance knowledge of mathematics, statistics, optimization and probability theory.

        Max Infosys wale sale abhi 12th grade ka probability me question nahi kar payege.

        There is difference between IT and computer science, keep it clear!

  21. I have emailed all senators I could find email for, alerting them about fraudulent nature of H1b visa applicants who completed BS/MS here in the US. When one is interviewing for this type of visa in a consulate, they explicitly ask you whether you will return to your home country after you finish the studies, and you need to show that you won’t try to stay in the country. Applying for H1b from F visa is fraud, and goes directly against those limitations of F visa.

      Just because you didn’t pursue an advanced degree in the US doesn’t mean that you should take it against the ones who are applying for H1 in the advanced degree category.
      Go check the rules and regulations for F1 before making such a stupid argument.
      By the way, could you provide a link where you got the info from?
      You know what….nevermind, your information is fully incorrect, and the advanced degree H1b applicants know that for a fact.
      And your email wouldn’t even have reached the spam folder of any of the recipients. You better email your employer/ attorney on the status of your petition.

      You are partially right. We do say at the interview (and every time at the port of entry) that we have intent to return to our home country after completion of our studies, and that is indeed a requirement. However, if you have read a few lines further, you would have noted that it allows for provision of change of mind /intent after a reasonable amount of time (typically 90 days). So, if someone decides to apply for permanent residency after the reasonable hiatus of their interview or last entry, they do not fall under the purview of visa fraud. The downside is, however, once you have exhibited immigrant intent via petition of permanent residency, you would never be able to get F1 or F1 extension, and potentially would get into huge trouble if you try to reenter US with F1 visa. Anyway, H1b being an non-immigrant visa does not have this problem.

      Now you may burn in Hell.

Also do u know how much F1 visas contribute to the US Economy? Do ur research and then open ur shitty mouth..then again if u had any kind of research/educational abilities u would have had an AD.

      Plus H1 visa is also a non immigrant visa….so technically there is no fraud. Also if F1 visa ppl just study and leave it is also brain drain for USA, hell that’s the reason OPT STEM students now can work for 36 months without a H1.

  22. Sadly, I think PP is almost done. This year, I think USCIS managed to accelerate the process.

    AD/PP/CA is now at 53% as of 5:30 CST
    AD/PP/VT is now at 50%
    Non-AD/PP/CA is now at 25%
    Non-AD/PP/VT is now at 29%

    They are at the mathematical percentages, especially for Non-AD appro. 60000 /216000 = 27.8%
    I’m also Non-AD/PP/CA but,, I think It’s all but hopeless.

    • Yes. If the sample is big enough to represent the population, I’m afraid this is it. 53% is almost the best possible rate for AD…

      I’m AD/PP/VT, no response. Guess it’s time to pack up and say goodbye to USA.

    • I am assuming you are showing the number from immigration girl. The statistics is not true for all application.

      Today CSC processed application starting EAC1613850002 to EAC1613852000 which is about 2k application.

      I think each service center is only processing about 2k application per day,which bring 10k application per week. Take 3 service center and it goes to 30k application for this week. So we still have some hope for next week. Best of luck .

      • How can you figure out the 2000? I’m not sure all the case numbers are consecutive.

        I just ran a random check a few. EAC1613852000 show received on 4/11 while EAC1613852001 shows received on 4/15. All three after this show received on 4/11 again.

        Anyway, I really hope you’re right. 30K sounds like only 35% (30/85) of the result being issued? Almost sounds too good to be ture. But reaaally give me hope!

          First 2 digits represent year which is always 16
          Next 3 digit represents day in sequence starting from 1 on oct 2015.138 means april15th
          next 5 digit represent case number.
          I agree that you would see different date but those date are when they recieved the application and the reciept number represent process date

    • Yes, sadly I think PP is almost done now. If you check WAC16137520xx almost all of them say that receipt was sent “NOT EMAILED”.
      It’s like I should not hope at all.

  23. H1-B visa is very dehumanizing. Its an insult to self respect and self worth. You can not rejoice if you get selected ( coz it was luck and not your hard work), but you can feel sad if rejected ( coz they didnt count your merit).

    This random lottery devalues a person from within. Its an insult and should be scrapped or reformed to have a merit based selection criteria as in O1 visas.

    Today is Ram Navami and I pray to Lord Rama that Trump becomes president and ends this H1-B program altogether. H1-B has become the hot bed of desi fraud in USA and it will hurt the reputation of our country in the long run. This can not be accepted.
