When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Completely agree with you. H1-B visa is very dehumanizing. Its an insult to self respect and self worth. You can not rejoice if you get selected ( coz it was luck and not your hard work), but you can feel sad if rejected ( coz they didnt count your merit).
This random lottery devalues a person from within. Its an insult and should be scrapped or reformed to have a merit based selection criteria as in O1 visas.

Ha Ha, H-1B is programmed for US companies, so they can bring foreign workers or engage MS completed students in their farms. Whereas the individuals can accept any offers and join one company. ?
What about people who work their ass off to acquire skills and get a direct offer from top US MNC. Mind you that is even difficult than getting admitted in US University.
There are a lot of people who did not do MS but are experts in their areas with multiple patents and various research papers.
We cannot distinguish between AD vs Non-AD. I also know a lot of shady USA universities distributing MS degree for free. In fact, such universities are more in number.
I do not think this is the right approach to solve this problem.

For people who have worked hard, have multiple patents and research papers, they do not need to file for H1-B visa to work in US. They can ask employers to file O-1 visa. O-1 visas are for people with exceptional ability in sciences, engineering, arts, sports etc. O-1 visa gives you the ability to work for your employer for 3 years and after that it can be extended year after year indefinitely.
For O-1 visa it doesn’t matter whether you have US Masters degree or not. You can have degree from any university / college on this planet, but you have to prove your worth by showing significant scientific/ engineering achievement.
There is no upper cap limit on O-1 visa. Any number of O-1 can be issued in a year. The reason many desi consultancies do not go for O-1 visa is because their candidates are ordinary and will never qualify for O-1 visa.
I FULLY SUPPORT Scrapping H1-B altogether and let O-1 be the only path for foreign talent in USA.
How many without even an MS degree has multiple research papers and patents are coming through this outsourcing companies? And those who do are surely eligible for O1 and need not worry about H1B.
Ideally, I believe it should be a point system, where you get points for AD, experience, papers and patents, salary, years of exp etc. and visas are given to the 85k that accrues the most points. But, that, as I mentioned, would be ideal.

Ive been following ImmigrationGirl page on FB and thats where I’m getting the info. I strongly feel that’s the percentage of notifications sent out per category. I could be wrong but any hope is better than nothing. I’m in the same boat as you. Good Luck!

So these numbers represent percentage of petitions they filed for which they have received receipt numbers. It is quite possible that lot of them are not selected in lottery. So these numbers don’t tell anything as they will never reach 100%.

Non AD/PP still awaiting results. Asked my lawyer and he said the check hasn’t been used by USCIS. My question is, one, do I still have a shot? Two, does USCIS first in-cash all picked candidates’ checks or in-cash as they send out receipts?

This message is for the AD people whether PP or RP. After all the results are done, congratulations for the winners, and for the losers we have to make our voices heard. It is really unfair for students who work their ass of to get accepted in the best universities in the US, and then work their ass off to succeed in their masters and/or PhD, and then succeed in their internships, and then graduate, and get offers from the best companies to struggle in a game of luck and chance. For this reason, I suggest the following: We can make a hashtag #ADH1BReform or whatever we choose and explain our achievements, our stories and our struggles to reach the point we are at now. We are a lot. There are thousands of OPT students already. It will definitely be a twitter trand. Hopefully this will push someone to do something about it. I agree with you. Its a never ending wait. Its not fair that someone who works their ass off to get into a good school and then a good job and paying that amount of taxes has to hang their entire future on a random receipt generator. A lot of people I know who got their applications picked last year through bodyshopping consultancies did not even have a job offer to begin with and then a couple of them did not even end up coming to the US after getting picked in the lottery. Its not fair.
Honestly I have nothing against the Non AD guys, as long as everyone has one genuine application and a job offer.

As I said dude, this is your story. speak for it. Of course we can distinguish between AD and non-AD. We really have different stories.
I guess you need four groups:
AD genuine with high salaries
AD through desi consultancies
non AD IT
non AD exceptional candidates (e.g.,IIT undergrad toppers coming to Google/Microsoft)
I believe only group 1 and 4 are the ones who actually contribute to US economy and create more jobs, but unfortunately most of H1b visas are bagged by group 2 and 3. Surely Congress should fix this. It should not require increasing H1b cap.
most of the nonAD people that the Indian IT firms bring these days does not know basic maths or physics (and proudly acknowledges that). Lot of them whom I knew at school used to barely pass. I am sure they do not have any patents/research papers. the exceptions can surely opt for O1.
And how many AD holders go to universities like Yale and Stanford? There are plenty that pay and get a diploma from places with names like “University of the NW side of Western Detroit”, which are just mills. So, there needs to be a filter there too. Getting into a third class desi diploma mill in USA is no holier than working on a third class job in India for 3 years and then paying a third class consultancy to file for H1B.

I feel 20000 AD cap should be removed and treat them normally . Coz during their F1 interview they say that they will go back to thier home country after getting their degree.

I think your statements earlier are not very well informed. Getting an MS from a US university in itself is nothing to differentiate you per se, from all other applicants, unless you are from MIT, Stanford or the top 10 Tech schools.
Have you started a company and gotten the interest of VCs? have you created anything of value that can benefit the US economy ? Can your skillset help a company earn millions in dollars by contributing to an important line of business ?
Unless you do the above an AD from the US does not essentially differentiate you from others, as anyone with financial means from a 3rd world country can come to my country and study here.
I have seen some incredible talent in my company who came on H1B and created technologies the company is minting cash on.
I want the best of the best to come here, and we don’t care even if you have a college degree or not.

So, now my questions is; What are the next steps? WIll they process the pettion with 15 days and then it will be either decision or RFE? And if it is approved, when will I be eligible to start working?

H1b Applicant,
PP’s 15 day SLA doesn’t start until May 16. So they have until May 31 to adjudicate your petition. Even if approved, you cannot start working on H-1 until Oct 1. If you are on OPT, then you can work on OPT or cap-gap until then.
NON-AD PP, received receipt this morning :). My gf is also NON-AD PP and received her receipt yesterday. Both of us petition is in CA center (WAC-xxxxxxxxxx), Hope all of the genuine petitions got selected 🙂

What is this all fuzz about people mentioning filing single / genuine petition . Some people are acting like, as h1 is there birth right and others are stealing from them by filing multiple petitions.
People are talking like they never cheated in there life and there life is been taken away by others filing multiple petitions. How many of those guys who are complaining never cheated while filing taxes?
I am not encouraging people who file multiple petitions, but there is no need to make big deal out of it. I had a unlucky friend whose petition did not get through lottery for 3 years and now he filed 2 petitions. Sometimes it’s unavoidable though not legal.
I am no one to say what dream you wanna chase or what you wanna comment / complain on this forum, but grow up guys.

I think the bigger problem is companies like Tango Charlie Samantha, his dyslexic sister, SYStematic INFOrmation and the like, who randomly file orders of 30k applications to get 10k approvals (and sometimes end up wasting some of it)…. just so they have control of the outsourcing market …

There was a USCIS document from 2005-06 which said that they select extra petitions to make-up for the ones that are lost due to denial. See the cap is really not 65K as they keep aside almost 6K for Singapore and Chilean nationals. But they accept more to make-up for the denied ones.
It was easier earlier when they knew exactly how many are denied and can keep cap open. Now that we have lottery on day 1, it may be more about projections based on historical data etc.

AD/PP/VT, OMG what a relief ! this was my 2nd time and hope all AD/Non- AD genuine applicants get picked this time. Because I know how much we struggled for this and there are people out there abusing H1B. I am sure these people will pay big price for this in future !!

Does anyone recommend upgrading my regular process to premium processing after May 16th if i don’t hear by then? I guess i cannot upgrade before that. My OPT expires May 30 and no extension. Please advice.

If you decide to upgrade it, why don’t you do it now??
You cannot upgrade it now until you get the receipt notice I think. So, you are going to have to wait.

We have two applicants in my office, me and my co-worker.
My co-worker got the receipt yesterday morning. We both are AD/PP/VT, handled by the same Fragomen lawyer & assistant, and second attempt. I haven’t received it yet. Does it mean that I don’t have that odds?
Nope! Does not mean anything. USCIS does not take into account which lawyer or employer has filed your petition while sending out receipt emails. All the best and don’t throw in the towel yet.

My lawyer friend told me it also may because my co-worker got selected during the AD selection round, but I didn’t. So there is hope for the general selection.

It seems like there is no rules this year. This is my first time applying, non IT.
Did Fragomen email personally? I had to log in and check in my profile that a receipt no. has been updated. Looks like they update it on the same day of receipt around 5-6pm EST. All the best.
When will we ever not have lottery again? I am new to this whole thing. First time applying. Havent finished my PhD yet (will in June) but this whole lottery thing seems to be the case only for the last 4 years. Before, there was no lottery. I wonder how long this is gonna stay this way. It is just not sustainable. Any predictions? Is Obama’s executive action that is on hold now related only to DAPA or his actions regarding students with advanced degree will only be judged by the supreme court in June?
My 2 cents: If you are investing so many of your important years of your life, find an employer who will (or generally does) file O1. That way you would have a backup option in case H1b does not work. Although I believe with the new OPT rule you have 3 years, and lot is going to change in that time.

Finally got picked, through one of the two petitions.
I know you will be mad, but my two petitions are indeed different offers, from different companies. They have no relationship at all, and are not duplicated petitions. I tried really hard to get those 2 offers this year. Last year only 1 offer but failed in lottery.
I am now praying for my other petition not to get picked, so that I don’t waste others chance…

I am curious. I have an AD and 4 years experience and struggled to get 1 offer. How come fellow H1B’ers get offers very easily? If you can share, Which field are you working?
If you are Java J2EE or Big Data guy then you will get multiple job offers very easily…

It’s honestly because of the selfishness of people like you that we have to go through the process of Lottery and many of us end up losing our chances.
I agree but at least I am not making duplicated petitions. I got two different real offers and I refused to file more through consultants though one of the employers could do that for me.
It is fine if you blame me as what I have done for myself might have decrease others’ chance. But I think we should blame more on the damn lottery system itself. I failed last year so I know exactly how will you feel if you fail in the lottery.
But hold your hope and never give up. You never know what will happen tomorrow and you will always have good luck and it is only the matter of time.

My company applied through Fragomen, Non-AD/Non-PP/CA. Being impatient, I reached out to my DSO to check if there was any change to my SEVIS. She got back to me saying that there weren’t any changes. My OPT expires July 5th. Would that mean I didn’t get selected? Anyone know how fast they update SEVIS?

There are still receipts flowing in and the flow goes on till May 2nd week. You do have all the June for any Plan B. Be optimistic and hope for the best.. else as you might be on F1 you can transfer to any other school in 60 days as far as I know.

Hi, I asked my school and the international adviser said USCIS no more update the SEVIS until 3 weeks. so don’t worry. It does not mean you were not selected. My OPT expires May 30th. 🙁

Log in to your Fragomen profile. They do not email you personally, just update the receipt number in case you are picked.

Do not worry, I am on H1B from last 8 years. As per the trend the people who processed PP, do not panic you still have time till end of this month.
Most of them time PP will end during last month of Apr and the regular start from May. So stay calm and relaxed. All the best guyz. I got my H1B in 2007 and mine was PP, but got the update on May 6th.

If you did not get the GC, your 6 year H1B will be extended for 3 more years with an approved I-140. I know people on H1B from last 10 years

I received email from frogomen this morning. I am NON-AD tho. Some of my friends AD-PP in other teams received confirmation email yesterday. It seems like USCIS are still issuing receipts. Keep positive, best of luck!

but the only thing is we are getting notified in some order like AD/PP, NON-AD/PP,AD/RP,Non-AD/RP.

Mine is AD/PP/VT. Its day 4. I know PP applications can expect to hear anytime till May 16.
But guys, based on your experience, what do you think are the chances of getting AD/PP receipts next week on a scale of 1 to 10, 1 being the lowest possibility?
I guess there are still a handful of emails that will be sent out next week! Last year AD PP got email receipts as late as 2-3 weeks after lottery was conducted. So, keep your hopes alive it should be 8 / 10!

Same boat in AD/PP/VT. My check was cashed with a receipt number. I checked online with the receipt number it says that “Request For Premium Processing Services Was Received”. But I haven’t got any email about the receipt notice. I don’t know this is good sign or not…Just give some facts here.
Congrats, Your H1B is picked in the lottery, its just that your attorney didnt notify you or may be he didnt get an email yet!
