When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   3. So I emailed Fragomen, and got an answer back immediately. My contact confirmed that they did receive notifications already, but she also said that they expect to to receive them on a rolling basis through mid-May.

  4. This year USCIS is going to deny Indian IT companies H1Bs big time, because of all the genuine american employees that were laid off in SoCal, Disney and Abbott, because of the body shops misusing this visa.

    I will be very happy to see that happen where none of the Body Shops can bring anyone into the USA, but hire here locally.

    • Don’t bother yourself, I emailed my contact in Fragomen and asked if she has received anything and she said they haven’t received any receipts for non-cap cases, which I know for a fact is not true 🙂
      BTW, I’m Non-AD/PP/CA

  7. Finally I got much awaited receipt mail from my Attorney (Non-AD/PP/VT).. they forwarded the original mail and it said the time stamp of 14-Apr 9:11 PM… so they are working late hours …

      As per my lawyer it means you can upgrade your application to premium from May 16th.

      Someone please correct me if I am wrong.

      My OPT expires May end and not sure it’s good idea to get it Premieum on May 16th. My lawyer adviced I will get the result in a week and that means it also includes rejection. So I will have to stop working.

      Any ideas?

      • If you submitted an H1B petition on time and are a currently on OPT, your cap-gap automatically applies. From USCIS website,

        “Once a timely filing requesting a change of status to H-1B on October 1 has been made, the automatic Cap-Gap extension will begin and will continue until the H-1B petition adjudication process has been completed. If the student’s H-1B petition is selected and approved, the student’s extension of status will continue through September 30. If the student’s H-1B petition is denied, withdrawn, revoked, or is not selected, the student will have the standard 60-day grace period from the date of the rejection notice or their program end date, whichever is later, to prepare for and depart the United States.”

        Regarding getting to premium processing, you can do that once you got a receipt #. So, no deadline.

        If the original petition was not filed w/ PP, then it cannot be upgraded to PP unless it makes through the lottery. This is b/c EAC/WAC number needs to be quoted in the PP upgrade form.

        In other words, the scenario you mentioned is not possible as you would have already made through lottery by the time you upgrade to PP – it’s a pre-req.

    Does anyone know what moment cheques are encashed?

    I mean, for a PP (as example), if he was selected in lottery, is it sure that at this moment, his cheque must be just encashed already or it can be done later?

    • Check must be encashed before receiving any communication from USCIS email( in case of PP), Postal Receipt (In Case of RP), in case of RP usually check get encashed before 3-4 days of official communication

    • No precise answer for your query, check can be en-cashed weeks later after you get to know about H1B selection as well, in some cases atleast in RP cases enchantments happens quit early, and from check’s image in statement (on back of check at clearing time USCIS write receipt number) you get to know receipt number. Although it involves mapping of check issued for particular case.

      Bottom line: relax and wait till you hear that good news.

        • No, from what I read here and other sites is this…..

          95% of all Non-AD/ PP will have been notified via email by next Tuesday…..

          So after Tuesday you and I (am the same as you, Non-AD/ PP/ VT) can forget about it, in a statistical sense…

            My lawyer sent me the FedEx receipt confirmation and there it said the name of the centre and also the name of the person who counter signed the petition.

    • On brighter side till may 1st week, on lighter side June 1st week, if your employer is quick in response, I have heard cases last year people are getting PP response till end of june, while processing started at 27th April 2015.

        • Andra people are the worst kind of people I have encountered in US. It doesn’t matter who the person is, even if they have something in common with each other, they just hook up based on region.

          In a group of 10 that includes not just Indians but people from other nationality, they simply switch to Telugu if there is another person in group that understands Telugu.

          They prefer favoritism for each other. I know a lot of them who filed 2-3 fake petitions for H-1B, some enrolled in fake university for CPT.

  11. Guys, I finally got the good news after 4 long years. My H1 was unsuccessful in lottery for last 3 years and this was my last year on L1 Visa and had planned to step out to office in India and golden email came in today eve. I was very hopeless but was patient, hate this lottery system which took 4 years for me. So keep your fingers crossed and I pray for people who are in similar situation as mine to get through soon.

    • Fragomen filed my application and I havent heard anything from it since the paralegal confirmed filing. I just wonder if they haven’t got any email from uscis or got a receipt email but not notify me for some reason.

  12. Guys, I need some help to figure this out. I am under non AD/PP. 3 out of 4 of my applications got picked up in the lottery. two applications were from one employer and other one is from a different company. I am wondering that there would be a problem now that I am having 3 wins. What should I do ? Please pray for me guys.

        in the last year lottery. but till waiting for the approval.

      • I agree that filing multiple petition will increase your odds to get selected. But same time USCIS consider it as one entry in 65000, cause just a single person is going to land against those. so he is not stealing anyone’s opportunity but increasing his probability in game.

        I’m believer of Karma, what goes around comes around.
        if you believe in your self , anyone filing 1000 petitions not going to affect you.

    Do you know the batches of email sent were only for the selected ones? Did they intimated the rejected during this time frame or it took longer to know that petition was not selected in lottery?

    • That would be by june end.one of my friends got that by june end.The NO u did not get mail.But still @CognizantH1B can confirm whether the batches mentioned by him were only selected ones.

    • Yes.. The mails that I mentioned were only for the lottery selected ones. All MNCs play smart with non-selected ones. They will make us to wait and mail after the notification from USCIS that they returned all the packets of non-selected petitions.. This way they can retain the unlucky fellows for two more months before paper submission.
      Last year, I got the mail that I am not selected on 14th July.

  14. Finally made the cut…. last attempt had to return to India this year if H1 was not picked….. though with gods grace and luck h1 got picked!!!

    29th April, 15 – Wed – Evening
    4th May,15 – Mon – Evening
    5th May,15-Tue-Evening
    6th May,15-Wed-Morning and Evening
    7th May,15-Thurs-Evening
    That’s it!!!

  16. People are cursing individuals who filed multiple applications through multiple employers. Some of them might have got genuine multiple offers and they have right to chose the employer after being selected in lottery. These people are very few in numbers.Main culprits are big MNC who files application in bulk to increase their chance in lottery. They file multiple application for one opening. They have lot of money to spend and this is their main business.They charge big bills to client but pay very less to employees.Many Master degree candidates don’t get visa because of them.

      I agree with your comments Lottery can be very cruel to lot of people 70% of the candidates will be disappointed and there is no easy solution if they increase the cap to 1 lac there will be probably be 5 lac petitions and its a vicious cycle
      Big MNC’S have the financial muscle to file in large numbers .In most cases it is to retain employees at offshore rather than any urgent need .Increasing the visa cost may be a solution to weed out some of these cases .Fingers crossed for now mine is Non AD /RP so just hoping will make the cut

      • True. Non AD/RP from health care. First petition. Declined multiple offers from other employers for concurrent H1b filings. Just didn’t feel right.

        Now wondering how long this waiting will last.

        They should put up the selected numbers on some accessible list and get it done with. Either way, we would know.

        I understand it could be another month before we know for sure. Did I get that right?

    • Do you think they applying H1bs in bulk to place associates in USA? in my 10 years career i have seen 5 H1bs not utilized because either people will go on maternity people, resign etc.. also many waited 2 to 3 yrs after getting stamped.. that time visa fee was 1800 $ only the main purpose is it to prevent the work being carried out in onshore so that offshoring can increase and also to use h1b count for pre sales work and also to prevent competitor from getting h1bs and suppress Aceen IBM market share and also they dont want any more startups or mid size IT firms to come in big 5 league.. all they need is 20 percent workforce in USA to run projects in offshore.. if total strength is 400 K , 40 K is enough but TCS revenue is 50 % from USA so they need only 20000 emps in USA with this they can survive for long enough

      with the automation projects being carried out, last year net emp addition was less in India.. if MS students dont get visa or if desi consultanices/ mid size IT firms dont place people in USA, projects will come to easily to big 5.. Big guys like google apple salesforce microsoft are clients for Big MNCs

      So you will have multiple companies file an h1b for you and invest in you and you would just leave the rest of them hanging? They will lose all of their money (if more than one petitions are selected) or at least some of it (attorney fee in case of an unselected petition), you will just happily walk away from them. why not be a decent person and decide on the job and then apply.

      P.S. Before you lash out at me, i had multiple job offers and I chose one before applying for my h1b.

      • Why are you so harsh at multiple filings.. If you are not doing so shut up and do your work. If you don’t get this year you may think of the same or regret, or if it repeat next year you may get regretted once more.. Don’t simply say that multiple filings or Mnc’s are not bringing you H1 . It is you , not trying more.. You know that while tossing a coin it can get head or tail . You can’t simply blame that you did not get what you want..

      • Getting US job opportunity completely depends on luck rather than technical skills. so nothing wrong in enhancing the luck by filing multiple petitions.
        Multiple petitions with different and unrelated employers are completely valid.
        Same employer filing multiple petitions for the same employee is invalid.

      my son got selected last year april and submitted rfe in jan 2016 and waiting for the approval.
      but now they have started fresh for 2017.
      My question is will they approve the old pettition.

      • USCIS dont have any time line for approval as such, if you can transfer your case to premium processing, you would get result in 15 calendar days. Wish you all the best.

      I guess mine is not selected in lottery 🙁

      I mailed them asking for a status update yesterday night and they replied that they are sending out notification immediately once they receive it from USCIS. I haven’t got any, so mostly it’s game over for us if we are ad/pp(I know it feels too bad to hear this)

  20. AD/PP – I received the email notification on Monday night. Two of my colleagues received it yesterday AD/PP.

    They started sending Non AD/PP receipts since this morning. Haven’t heard AD/PP receipts from my employer since this morning.

    VERMONT had more selections for AD people. For Non-AD people CA will have more selections.

      My receipt was generated on 11th and my employer received the confirmation on 13th night 930 pm from fragomen. They are slow. I have been reading on other forums too.
