When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Got receipt number today (04/14/2016) from my attorney for an email dated 04/13/2016: 9 pm. AD/PP/VT single filing from MNC pharmaceuticals. First time application. USCIS will process the application in 2 weeks as mentioned in the email.

my petition was denied on 21 Dec 2015 at last year. up to feb end i don’t find any employer whose ready for the my h1b file this year but after some days pass i was listen good news on 5th march employer was ready for the h1b file for this year.

I graduated with an MBA from the US last year. At the end of my first year of MBA I got into an internship with a company that had never sponsored an H1B. They liked my work, so they offered me a part time job for the second year and offered me a full time position. That part-time job helped my pay all of my expenses and the school fee for the second year. They applied an H1B for me last year and applied again this year. Looking at me they started sponsoring international students and this year they applied for 4 H1Bs. I haven’t heard anything for my AD/PP/CA application. I am supposed to root my life from here and leave. Also, I feel worse for my company and they will probably stop sponsoring. That means one less employer in an already competitive market. There’s a lot of stories like mine out there. If only people did not put multiple applications to get the odds in their favor and just let the system work the way it is supposed to.
Buddy, I am an MBA here, with similar situation, graduated last year and have AD application this year. I have seen MBA’s getting rejected last year, most of them ended someplace better, one friend in Switzerland, one in London, Singapore etc, world is big enough to accommodate talented people.I agree that system has been screwed up by a lot of fake applicants, and makes me sad to see people from my country trying unethical means to get into US. Anyways, talent and education doesn’t go to waste, cheers to next adventure, whatever it might be.
this is the reason I want this H1-B program to end forever, it benefits no one except immigration lawyers and some desi consultancies. How good it would have bene if they considered merit while selecting petitions… would it not have bene bettre if they selected forst 85000 in the descending order of salary ? USA would have benefitted in such case yb getting taxes on high slaaries.

Honestly, I feel miserable when I read others get receipt or good news . What good is H1b selection process doing good to India – a big question . If only we had put the same interest and effort in India , we wud have made it ‘slightly’ a better place to live and work.
Even if not selected , I will never be part of this foul play next year. It s all a random gamble , and who knows what kind of lottery formula is really used in it. It s all doubtful game.

The lottery system is purely luck based on w, which is better than but the indian caste based discriminatory system.
What are you talking about, do you understand caste system, the quota, how it was created and what are points against and for it? Do you think US doesn’t have similar policies (ever heard of affirmative action, points based system in admission to Harvard, yes it is based on race). In this age of BIG DATA at least the results should be uploaded in a central repository and everyone should be able to search their name if they are selected in lottery or not, these notifications via emails and snail mail are the old miss American pie days..
wat do you expect, USCIS is a govt organization. Govt organizations are same everywhere be it India or USA. Step into a USPS post office, or DMV or any SBI branch in India to feel what I mean.

Till yesterday I was pretty much excited about all this process but now that I have seen my petition document, I am not sure if going to US would be a wise decision. Let me explain:
My salary in US would be $60000 per year.
Considering 30% tax, I would get in hand=$32000.
Deduct $10k for accommodation = $22000 (Married )
Deduct $10k for transport, Food = $12000
Deduct $2k for other expenses = $10000
Per month saving =$833 = Approx Rs 55,000 which me and my wife already save here.

if tax rate is 30% then how come it is 32K and not 42K? I don’t know where you are planning to stay that you are budgeting nearly $1000 a month for food and transport.
You have calculated based on current offer. Think about after an year or so. You would definitely be earning more. Plus think about other perks like lifestyle etc
How many years of experience do you have? And in which state will you be working? If it’s CA and especially the bay area, I wouldn’t recommend moving with that salary.

Ok. It is very low for that many years of experience for any state. It looks like a clear case of exploitation – the main reason why US senators are trying to reform the H1B program. Since you are starting so low, it is unlikely you will get a huge raise when you switch to any other company too (unless you are exceptionally skilled and the company makes an exception). You should wait till you find out the work location because cost of living varies from state to state and you may be okay with that salary in some midwest states (Oklahoma, Dakota, Iowa, Nebraska)
Agreed. This salary is too low. Please don’t come with this salary. It might sound nice to come to US but once reality sinks in you will definitely regret unless your only aim is to live here.
Do not listen to the people who are telling you not to come, I already live in US (DC) and with OPT with a salary not too high I was able to live and save money to keep paying my studies, if you know how to manage your money plus administrate well the saved money you have you will be fine, think positive and positive things will come, probably a pay raise and stuff like that, good luck and don’t listen to the haters.

you are doing calculations wrong, taxes are not 30% flat, you get exceptions as well.

That is something they quote in petitions and even my attorney quoted something like 70 K for myself where as my existing is about 2wise of that.
I think they just pick a template and put that across as gross. Actual gross depends on your location and skill-set[Technology+Experience+Interview]. And hey it might be a challenge to cope up in 60K in SF but might be doable in lets say Dallas.

Sorry I disagree, as far as I have seen petitions the salary is very accurate on what is in your offer letter.
Please don’t post inaccuracies, that your current is twice that.

LCA mentions the minimum salary that you can receive. You can very well receive more than that what’s quoted in LCA. Just ensure its not less than the LCA.

You are right about your salary. You will struggle miserably with this salary.
You did not even spoke about the internet, phone bills, medical insurance , car insurance, Electricity/Gas, Gasoline, car registration(every year) and more.
At this salary, no matter which state you are in you will struggle. Starting should be 100k at least, else it is all compromise. You do not save a dime and sleep on the floor.
However like others mentioned you may switch your job and try to get a better offer.
60k is like the least salary you can get here.
Now you are being unreasonable. Almost all reasonable employers in the Bay Area offer free health insurance. With Metromile you pay less than 30 dollars a month for car insurance. Gas is so unbelievably cheap in the US (less than half the price in Western Europe) and so are restaurants. Car registration is less than 100 dollars a year.
Also, phones are usually covered by your employer and you get three free meals a day, monthly massage budget, etc.
For $60 K, tax will be $18 K as per your 30 % tax rate, so you may get $ 42 K in hand.
As per my understanding, all of your earnings will come under 30% tax rate, only a portition of it will come.
i;e some portition of $ 60 K will be charged @ 22 % tax and remaning small portition @ 30 % tax.

You are talking about just the state tax. You still have to give federal taxes which is the main tax.
Believe me, anything below 100k is like below poverty line.
I have seen people saving less here, driving 4th hand 15-year-old car(in India they have better vehicle), spending majority of their time searching for deals, post to sell their dustbin for $5 :), no bed or mattress, no furniture, in India they have LED TV here they buy 2nd hand CRT, 20 years old sofa.
In India they will spend Rs 50 happily on friends, here they start choking even if $1 is spent on somebody else.
Buy stuff in a store, use it and return it. It is so degrading.
Buying things and sharing among 4 people illegally like phone connection etc.
They do everything except improving their skills. Most of them except few spend years like this before they can get a decent job. Few never achieve that.
Eventually they save Rs 50000 per month after doing all this.

You easily need about 2000$-2500$ per month if you are not in bay area to live a decent, quality life that includes a first hand car/insurance (very high in case you have just arrived in US) , independent apartment, eating 2-3 times outside in a week, enjoying culture and life. There are so many things to see out here and vacations here can be expensive with flights/stays etc unlike vacations in India. I went to Universal Studios a month ago in Florida and whole trip for me and spouse exceeded 2000$ easily. 60K can be a stepping stone but in case saving and going back to India is the only aim that you might feel defeated here in case you also want to experience a quality life. your definition of quality might be different from what I think about this though. No offense.
Now let me talk about what happens to Rs 50000 which they save per month.
Either they simply do no go back to meet their parents and friends or 6-month saving evaporates in one trip to India.
God forbid if you get a traffic ticket or have to pay for any damages in property reduce 2 more months of saving.
Wait I have not even talked about travel expenses. People either gravel in a group of 10 and stay in a single room during their travel or spend 2 more months of savings. The best option is to just do not go anywhere.
List is endless…I will need months time to write about everything.
So at the end of 3 years with one visit to India with family you have Rs. 10lacs as saving at best.
Having said that if your only aim is to post facebook pics to show people back in India how cool your life is then you are most welcome at this salary.

Do you know what the LCA is ? You are supposed to know your salary before they file your petition, and if you dont know where your job will be, this is a classic case of immigration fraud, because the LCA contains your job location.
Before H1B is filed company needs to have a real job. Is this in a shanty in Hyderabad ?

Considering your salary is at 60K you don’t fall into 30% tax slab. Moreover, if your wife isn’t working here you will have a dependent and your tax slab is going to be even better. Coming to your calculations for other expenses, talk to somebody at your work place or who live in the city where you live they will be able to provide a better estimate. Good luck with your visa !!!

Very good calculations, now also consider the point that in India in next 6 years you and your wife can increase salary 10-20 % every two years, way more than that if you guys are smart. In US, changing jobs is not that easy as most jobs do not sponser H1 VISA. You will end up with Desi consultants who mostly pay less than 70K.
Come to live, visit if you want and forget about saving.

If any check is cashed, then its a good enough indication that you made through the lottery. Other checks should get cashed soon.

I do not really want to make you sad. But I think that means your case was not selected. Because PP cheques gets cashed even if you are not selected. Other cheques get selected only when you are selected.

Both my wife and I are IN this time!! (AD/PP/CA) We are both US Ph.D.’s, spent 6-8 years in US, paid taxes, got decent jobs in big companies and only to find that we had to leave this country last year because of the stupid lottery and multiple petitions [from different employers – well you may argue its completely legal – but to me, this is insane and totally unfair]
Both me and my wife lose in our first two lotteries – We are filing SINGLE GENUINE, REAL petitions every year!!!! This time we are in ! Wish every genuine, single filing get picked up this year! and WISH ALL FAKE PETITIONS and MULTIPLE PETITIONS get rejected or petition revoked this year!!!

I had been a regular follower of this forum from past 2 years. Tried my luck 2 years and gave up this year.. Yes, I did not apply for lottery this year. Rather, I opted for another option of working abroad for the same company for a year and return to US next year on a L1 visa. Just wanted to give you all few tips. I exactly know how it feels. Nervous, Chills, Sleepless nights, checking on redbus everyday, 3 months of summer would just fly off thinking of this.. But trust me i have been there.. Enjoy summer.. H1b is not the end. You have more options in life which might be better than waiting for this stupid lottery which decides your fate based on luck. I will pray for everyone who has their last chance so they get it.. Good luck guys..

Same here. But I only did it for a year. This is my second year. If things go wrong, I’ll also come back on L1B. But I heard that L1B visa is also tough due to the flood of those consulting companies? I’m not Indian, nor IT majored. Still worried though. When is your transfer to the us?
Clearing an L1 B interview is a big thing for sure because you need to convince the officer that you have specialized knowledge. If you come on L1 blanket it is even worse. You need to file for extension before you complete three years on the VISA. For blanket petitions USCIS will be validating your case the first time when they receive the request for extension. The wait time for regular processing is 6 months and then you would get RFE. It takes almost four months to get a response to RFE in regular processing by which your work authorization would expire.
Long story short each VISA has its owns pros and cons. Ultimately, if you are destined to be in the US it would happen.

Yeah I know about the L1B. I will come on the individual petition. I am just worried about the petition itself first, not to mention the visa interview. I still report to my boss in the US. Just different location. So I don’t know when they see my petition, will they ask why and think it’s odd.

Most of the dates are indicative and based on past experience. The dates may move faster or slower as nothing is set in stone. The only date published by USCIS is May 16 by when all selected PP candidates would know about their selection.
