When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.         Did you also get an email yesterday? Yeah, they told me at the time of processing it may take till September also in extreme cases and we need to be patient

    Keep calm .We will be receiving updates only from last week of April[best case] and shows will continue until early July.

    • Guys From Desi Consultancies can expect result from next week onwards till end of this month this is for Non AD/RP people as they can inform you by checking check encashment status but maximum by end of this month not in may or june because in may june they will give the status wheather its approved or RFE

          You are right, that’s what I am saying if someone check is encased then definitely they will tell, but if not by the end of this month then chances are very slim, I know that from my last year experience this year again I applied through them and waiting;)

        • After all you are from that state where every god damn individual is fraud. You all started those fake consultancies. Nobody cares if you have 8 years of experience. You are trying to enter US through some fraud company. I am not questioning your experience. I am questions your route. You could easily join a big corporation who is willing to sponsor.

          I know many desi consultancy people from your state. They can’t even speak English. They all are fake and selfish people ruining regular applicants.

    Non AD/PP/VT applications are started picking from which date ? In general going by the current situation, after which date I should loose my hope…..

    • this week is last week for AD/PP, NONAD/PP guys, next week they will update about the RP applications, i am telling this from my last 2 year experience.

        I don’t think that “this week is last week for AD/PP, NONAD/PP guys” is true, as in none of the forums I read anyone saying that Non-AD/PP received anything as of yet. So I would guess that they haven’t started Non-AD/PP fully yet.

        Btw, I am Non-AD/PP/VT myself.

  9. Sorry for the probably asked-before question. I was wondering if an AD/PP make it in the regular lottery, will he get notified now (with the other AD/PP) or will he get notified later with the nonAD/PP winners?

    • I am also in the same boat. AD PP. Even if AD petition is selected from regular pool I believe they will notify you via email early because lottery is done only once even though there are 2 logical steps . After it is done there is no difference between AD and RP . Only difference for them is PP and RP since PP guys paid extra bucks they will send notice to PP (does not matter if it is AD or non AD) guys first.

      • Even though what you are saying is logical, it does not seem this is what is actually happening. If there is no difference now between AD and RP and the only difference is PP vs regular then it would make sense that all PP people would be getting emails but whats happening is only AD/PP are getting emails

      Employer may or may not hire an attorney for LCA filing. If they did, they will mention so on the form. Anyways, if the LCA is certified, it doesn’t matter whether they had an attorney or not.

But is it mandatory to file h1b petition through Attorney? i got a 90 pages document from my employer and wonder whether they filed themselves or via any attorney.. my petition was prepared in feb mid 2016 and it traveled to NJ and then it reached USICS vermont on apr 1st.. 30 petitions for single LCA and i got the fedex tracking # its showing entire route. ship date a feb 19 2016 and delivery date as apr 1st 2016

          It is not mandatory to use an attorney. Most of the companies do it, but some employers do it themselves. Even if they don’t have an attorney now, they can hire one for the case as it progresses.

          • ok got it.. that’s the reason they file lots of H1bs and that 4500$ doesn’t matter for them.. i thought if they file more h1bs they will incur more attorney fees.. here attorney is employee of my company based out of usa and they have 20 member team working in offshore with no access to any contact to IT employees and this attorney job also outsourced and soon more h1b petitions will be prepared from India if this lottery system continues..

    Any ideas on how long my wait will be? Do we estimate that all 20,000 AD would have been picked by now?
    Would they have notified only AD/PP by now, or all AD by now?

      Lottery has been done, which means that most of h1b caps have been already selected. For regular processing including me, we have to wait for the receipt to be mailed if picked.

      I can only say that last year my husband (ad/rp) got receipt on 04/23 in mail.

      Usually we expect to receive it by mid May.

    I have been reading all these posts intensely since yest morning and have been anxious as hell
    1st attempt, AD/PP/Vermont. Non IT, single application.
    Just got receipt number at 5PM Eastern Time.
    Happy and I wish all the best for all you guys, its been a journey since finding a job with a sponsor after graduating and the whole H1 pressure, this surely gives a big relief.

        Our attorney havent heard anything about him yet.
        so probably, they will send out those receipts soon after this.

    Plan A: Get an H1-B and stay in the US.
    Plan B: Relocate to London with the same employer.
    Plan C: Find another employer in London.

    • That’s what happened to me last year. Now I’m waiting for the result. If not, have to go through L1B. Thing is those consulting companies are also made the USCIS to tighten the L1B…. They just scrutinize everyone’s chances. So selfish.

        • London is nice but expensive. When they moved me here, they didn’t adjust my salary to the cost of living in London…

          Why do I prefer the us? Because my boyfriend is there, food is better. Basically, I feel life is better over there.

            – I am more optimistic about the long-term prospect of the US. The demographic situation in Europe is worrisome.
            – The UK is not my home country but it’s close enough (less than 1 hour’s flight from home). I like being in a foreign country.
            – Silicon Valley is kind of magic.

  17. I got AD/PP/VT today!

    Fragomen received it yesterday but didn’t update the system till today afternoon. Folks if Fragomen is your lawyer, please hang on. They are super slow in updating. I had thrown in towel yesterday evening and had started working on plan B. Wait till end of the week.

      • I saw the update in the immgration port WWIHP. They didn’t send me any email. In fact the USCIS case tracker said that case was recieved on 12th April itself. I had sent them an email yesterday and they said no updated. Today after checking the immigration portal, I emailed Fragomen my screenshot from the system only then they confirmed. Very very careless.

          What I stupid human being you are ? USCIS will anyways accept duplicate filings for same applicant from multiple employers..so filing multiple applications from different employers won’t be illegal.

          Just answer to yourself, who sponsored your H1B ?

          To be honest, most of us are not genuine right from submitting H1B application, paying H1B fee, resume preparation, applying for many irrelevant jobs, include fake experience etc..so just try your luck and learn to survive…Don’t cry on others luck or fate.

            Putting fake experience and doing Job with full fake seems clever to them and the guy who has genuine experience and applied H1b through different employer is fools to them. I would like to suggest them to see H1B rules and regulations again.

    • Hello Indians, I want to address to Indians as they are the only people for h1. I want to thank you for giving all your money for tuition, applying opt’s multiple times, h1b. We want to keep you Indians but with no strings attached. Live and give us money and LEAVE. I will make a wall in india as well so Indians cant fly to other counties and make india great again just like I will Make America Great again! Thank You

    • See. This doesn’t have to be your last night just because you don’t get H1B. Do you think H1B would guarantee everything in life for you? The only thing it guarantees is you is that you can stay in USA longer and earn more provided you have a good job. Ultimately it is money. Expenses are also increasing day by day which decreases the amount you save. Don’t think that not getting H1 is the end of life. Explore new ways of making money. There are many people in India who are earning in dollars by working online through freelancing and tutoring. Many websites have come up these days which pay you decent amounts for working online. If you diligently work, you can earn upto average $5000 a month online itself wherever you are in the world. Imagine making that kind of money in India. There are more things to explore and try to build something on your own. If you get H1 and want it, well and good. But if you don’t get it, don’t make it the end of your career and life. See it as a new beginning.

  21. How does being on the first/second/third attempt make any difference? Isn’t it all on luck, when it comes to lottery?

    It’s my second attempt though.. Non AD/PP/VT. Haven’t heard anything yet.

        • @ Rav What do you mean? Are you saying there are dependencies? The chance of you winning this is year is obviously independent of what happened to you last year !
          The only factors effecting your probability this year, is now of applicants, given the random selection is truly random

      • I agree each lottery is independent but if we assume (for simplicity) that the odds of being picked is 50%. Then the odds of not being picked three times is 12.5%. You have to be an unlucky bastard to lose three times.

  22. Can anyone help me understand this: my lawyer didn’t send me anything, so I went to the IHP system for Fragomen and just saw an updated NIV number with EAC16XXXX. Does it mean I got the lottery???? Thanks for any information
