When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. This is a strategic move and will require sometime, so plan well.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

I am on H4 visa in USA. My h1B ( Change of status ) got filed in April 2016 with the I-94 ( example – #1111 ) .
In July 2016, i travelled to India and came back in August 2016. And i recevied the new I-94 ( assume – #2222 ).
I rceived my H1B approval notice in Jan 2017 and it has still the old I-94 in the bootom ( #1111 ). We had given the new I-94 (# 2222 ) to the USCIS during the RFE response in Dec 2016 along with the docs.
My question is , Can i start working with the approval notice which has old I-94 ( #1111 ) ?
If Yes then fine , if No then What i need to do ?Please urgent help needed

Damn!!! My Infosys Senior Manager called me and said they are not filing any H1B this time and asked to wait till next year or wait for non US oppurtunities!!!

My employer received the denial notice and come to know that my RFE for educational evaluation not done through government approved agency and they can submit the revised one within 30 days. So, they mentioned that they will do it again and will submit to USCIS. Please advise me whether I can wait? Is there any possibilities for approval? Please help me with your views.

They dont ask much things, especially when you are appearing with an infant. However, make sure you are prepared with all the details mentioned in your LCA filings. You should be confident enough on your employer details and your project’s overview with your duties.

Yes its mandatory as its one of the significant document. If you don’t have the client letter, you should have valid and robust reason that why you don’t have a letter. i would say that if you don’t have client letter OR valid reason for not having it, it may be risky.

My HIB Visa got approved in December.
Now my employer has initiated stamping saying that stamping takes time so may be in March we will have requirement till then go for stamping first.
Amendment is filed now for my H1 stating that there is a difference in salary in what was there during petition.
My question is , is it save to file amendment in situation like this as it will go through whole process again and may get stuck as new file number will be generated.

If you complete the stamping now, you can travel with the Acknowledgement receipt of the amendment which is takes 2-3 weeks. It will save time and you do not need to go for stamping again.

Just put a tentative travel date in your ds160 as per your notice period , they don’t ask for relieving letter , I was in same situation n stamped without any issues and while serving current employer

In marriage certificate, my wife’s father’s name is incorrect i.e. not matching with what is there in passport. I don’t have much time to correct it. Approval depends on the response you send to the USCIS. It is a severe RFE. Kindly talk your company/Attorney and prepare the response well and send. If the documentation are in the right place, you need not worry. Good luck to you!! You cant tranfer your H1B at this stage. Only after approval, it can be done.

In my passport, my fathers’s name is included in my given name (e.g. xxxx yyyy is printed in name field where xxxx is my name and yyyy is my father’s name). This is okay as my all educational documents and other documents has my father’s name included with my name. The issue is in my marriage certificate where my father’s name is not included in my name i.e. it prints only xxxx. Can it create issue in interview? Can I include xxxx as other name in DS160 so that my marriage certi name is justified? Does other name provided in DS 160 need any justification?
If your father’s name is included in the given name, then in DS 160 u need your first name as in given name and last name as FNU. This will appear in your visa too. My employer withdrew my petition after 3 months of RFE claiming some issue with the client. Now, my employer says he will look for a transfer to another client.
What are the chances of getting petition transferred to some other client since it is already withdrawn?
Secondly, if it gets transferred would there be any impact on petition approval and further process.
This is really frustrating after waiting so long.

I don’t think the employer can apply for transfer after withdrawing. What is the current status of the receipt number in USCIS website? If it says Withdrawn, I think it is the end of it and your employer (probably a bodyshop consultancy) is playing around with you to mint more money. I also assume you paid your employer for the original filing. If that is the case, then this was always on the cards. If you did not pay – I feel sorry for you. Find a better employer for this year.

Your Visa expiration date will be provided in your approval notice(I-797). The same will be provided in your stamping too. When you go for renewal, it depends on the LCA and client letter you submit. As of now, we can renew the H1B Visa for max of 6 years.
You renew your visa, when it is about to expire and not on stipulated time of one year or three years. It varies for every individual as their visa expiration date varies.

Where did it says 130,000$. I am not able to find it. I have read the bill on congress.gov.

The bill doesn’t explicitly say as 130K. It talks on percentile basis. It says minimum of 35percentile more the avg prevailing salary currently. So when you do the calculation it comes to 130K for computer Programming.

My case got approved on Jan 11th. But, my consultancy/attorney has not received the approved documents yet (its been 20days).
How long will it take to get the documents after the approval?
Attorney receives it through Mail/Post within 15 business days or within the date that is provided as the cut off date in case status page. If its past the date, you can place a request to resend the copy of approval notice! Congrats on your approval!

Same happened in my case.Attorney had sent mail to Department of Home Land Security to update my correct name in their records.I have taken the copy of that mail to consulate and at the end of interview i had shared the mail copy to the interviewer.She verified and finally visa stamping done with correct name.Make sure this happens in ur case as well.Otherwise it creates big mess.

First of all, Congratulations on the Visa! Please give a couple of days. The time period between your interview and the time when the visa is stamped on your passport is the ‘Administrative Processing’ period. Every single visa stamping goes through this for 2-3 days.
When 221(g) is issued, Administrative processing takes several days or weeks.

The Bill has just been introduced in the Senate. It has to be passed as Law, for it to become applicable. Till then, existing law only matters. If its passed as law, it might affect the new ones and existing ones when we file for extension or amendment.

Well, I am glad that people who took the illegal route to land in the USA are getting caught by the USCIS. Even though not every such greedy applicants are getting caught, the % of such people getting caught has gone significantly up this year.
You have absolutely no rights whatsoever to even talk about Divensi cheating you. You wanted to cheat the USCIS and are paying the price.
I actually want USCIS to come up with a new rule that bars such candidates from applying for any other Visa to the US for a 10 years period.

No one said Divencsi is cheating..every one wants to go t USA and work..there is nothing wrong finding a company and joining..If fake company compe up then USCIS should ban that and take necessary action..Everyone wants to make a living by working for a company… even ppl applying h1b thru MNC’s get RFE.. Isn’t it?
Getting RFE is not what I am talking about. It is the confidence in overcoming the RFE. Most RFE’s sent to MNC result in a subsequent approval as they are able to justify the position with required paperwork – SOW, MSA, Client letter etc.
Companies like Divensi, just pick a random and most of the times non-existing client names and send the petition. When USCIS sends RFE seeking client supporting documents for the position to which the petition is filed, these companies are at soup. In the past years they attempted sending fake client letters, but that does not work anymore. USCIS has started doing a fair job in validating client details and duly denying the petition.
If you are the original poster of this comment (the one who PAID Divensi in a desperate attempt to land in the USA), let me throw a open challenge. Are you 100% confident about the position offered really exists with the client? If the client is legit and truly needs you for the position for which the H1B petition was filed, why cannot your trusted Divensi get a supporting letter and Statement of work which will result in an approval?
Dude, Your statement ‘everyone wants to make a living by working for a company’ will no longer work. You really need to know which company you are working for, and that company should vouch for you and provide the required documents. it is people like these (hailing for particular part of India) who exploited the whole H1B program which is resulting in the current situation. Everyone from that part of India want to make a living by working for a (non-existing) company in the USA and flood USCIS with petitions. They were so successful in the past years. But eventually deserving candidates are now being affected.

And it is not USCIS’ job to validate if the filing company is fake or not. It is the duty of the candidate to know who they are going to work for. Haven’t you read 100s of news articles and forum posts that advise to stay away from companies / consultancies demanding money to file a H1B petition?
People like you still ignore all warnings & throw your money on Divensi like companies. When things don’t go the way they want, they come and be cry babies. They also go over board and tell that USCIS allowed those companies to file and hence should approve the petition. If that has to be the case, every single petition must be approved right along with the lottery process.
