When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

My Case status is “Response To USCIS’ Request For Evidence Was Received” form November 15 till now no status change.does that mean the case is denied and they will inform later?
I am seeing most of the cases got approved with in 15 – 20 days after Response to RFE status.
If waiting period is more than 45 days after response to RFE means its denied status and will be informed later?

USCIS does not really have any SLAs except in case of PP. So, it does not matter if the waiting period is 1 day or 100, the case decision would be purely based on your credentials (and some luck too).
A lot of ppl upgrade their cases after RFE response is sent (me too), so they will get a decision sooner. But dont lose hope or be a pessimist.

Thanks to admins of this forum ( Saurabh & Kumar). It’s been a great Visa journey so far. I am following this page since March 2015 and believe me, the whole thing is quite a jrny. Having said so, I would like the intellects or Ivy Leaguers, to avoid any conflicting statements on my experience and so called “ethics”.
Well I tried too much to go for US universities, and I got in few like USF,SMU,UTD for MIS programme,(GRE 312) but never was able to follow up with the finances. Time passed, and I stayed in a IT service company ( Top Notch) for 5.8 years and except for few Business trip, they never filed my H1.. and each year they came with different rationale of internal quota and blah blah blah. I didn’t loose up my mind and threw the idea of pursuing a good job in USA. I was knowing that there are many bodyshops waiting to dupe candidates like me. It requires a great risk taking ability. So i started following up with small companies based in USA and who can be contacted over linkedin. Now this part is tricky to find a right employer. That may involve some personal contacts, referral etc. Though i was able to nail an employer XXX ( an IT startup) for me. He filed my visa in 2015, that didn’t come up in lottery. Fortunately, he gave me few piece of work ( don’t judge it as outsourcing stuff) and i kept myself engaged with him over mails and deliverables, while doing my 9 to 5 rigorous job ( I was supporting a fortune 50 company as client) and here comes the 2016 Lottery, where my petition was picked. After waiting for a grueling 6 months, my petition went for RFE, for all the obvious reasons( employee- employer relationship, SOW etc). By this time, i had already resigned from my Indian company and had served notice period of 90 days. As a back up, i cleared few interview and had 3 offers in hand from all fortune 50 companies. I joined one of them and have a very handsome salary.My employer replied the RFE with premium category and , USCIS took 15 working days to approve the petition. Chennai cyclone came and my visa stamping date was pushed for further 15 days. 4th Jan, I came to Chennai, prepared with all the RFE docs, finance docs of company, i797B,C, LCA,i129 and resignation, experience,salary slips, and many more supporting docs. Consulate environment is good to make any body nervous with echo of so many rejections , coming out of different counters( thankfully i had a prior experience of my B1/B2 in 2015). VO just asked me two questions 1> Is this a new opportunity ( Yes)2> What product you will be working on ( explained in 1 line). Typed for a while, and said your visa is approved. 6th Midnight, while I am typing, I checked my Visa status is Issued.
The key here is your case and how you deal it with VO. There is nothing called MNC effect, believe me i work for fortune 30 company(currently) and my colleague got rejected for B1/B2. None the less, what we have in India is good ( can be perceived even better than US), but think about what you want. Its a time taking, neurons consuming process for those who apply from outside through consultancies. But as said, we all can do it.. without a question.

I hold an stamped H1b visa from my current company and stamping is till 2019. The project for which I was given visa was not extended and so no onsite for me as of now. Also, I have been pushed to a dead end project in which there is no USA onsite opportunity. The technology am working on is quiet in demand and my colleagues are saying to get it transferred to some reputed consultancy in US which will hire me on contract/full-time. But I have following question
1) Is transferring visa in my case (not visited on current visa to USA even once) advisable?
2) If yes, then do I have to go for re-stamping or can avail Dropbox facility?

1. If you are very keen on going to US and working there, you should change your employer. You may not have a shortage of employers, if what you say is true (technology in demand).
If its possible, you could even try to convince your employer to move you to another project with onsite opportunities

Most of the employers always make sure anyone with a H1B visa is packed and sent to the US somehow. They do not usually put people with H1B in a Non-US project. Reach out to your leadership and get yourselves transferred to a different project with US travel opportunities. Pretty much every single employer (major MNCs) always have positions open in the US for long time because there are no travel ready resources readily available. Direct US hires are very expensive these days, and most of the direct hires eventually are fake profiles.

When my case was applied, I had certain designation and now I have been promoted to next level. My case was approved with salary according to my previous designation. When my company actually ask me to travel, in few months from now, can they revise my salary as per new designation or it needs to go through amendment? I’m from Big MNC.

No LCA required if there is no change to end client location and LCA represents only the minimum wage for that location not the actual salary. Your employer has to provide you with a new offer letter anyway before travelling and you have to accept it. Salary is always going to be different from one filed in LAC and in the actual offer letter.
Reading again, I think if there is a change in designation then a new LCA may required.

i have applied H1B from one of the Big IT company from India and as usual they have not reveled file number and now i have received an internal mail saying my application is approved however they have not shared the petition number so is there any other way to get the petition number other then the employer ( as you know they wont tell us until i go for stamping).

Oct 25th got RFE. Resonse to RFE received on Dec 12th and finally approved on 30th Dec. Ours is a startup company and this year only we filed for h1b petitons for the first time. 2 out of 4 petitions got picked in lottery.

Is it possible to change the end client when the status is RFE ? Since the delay in the process of getting H1B , the client has closed the position. Now another client is ready to offer a position. My employer is checking whether the present LCA is valid for the new client. What if the existing LCA is not applicable for the new client ? Your suggestions please
Your employer will need to file an amendment if the client has changed. If they have not yet responded to the RFE, and if you have enough time left to respond to the RFE (USCIS gives a time frame within which a response is required, around 90 days), an amendment can be filed and then RFE response can be sent.
IMO, unless the new position is not within the same client organization, an amendment will be required.

You cant transfer till your petition is approved. You should wait for your employer to respond to the RFE and then get a decision.

I gave my H1 interview in US Embassy in Mumbai on 30th Dec i.e. yesterday with my Wife (H4). VO Officer said that My visa is approved and it will be ready in 2-4 business days.
Today I have received email from UStraveldocs saying that My wife’s passport (H4) is ready and available to pickup and also Visa status is saying issued. But for my passport status is not ready and Visa status is showing “Administrative Processing”
Has any one faced this issue? Do i need to worry and wait for 60 days (as per other blogs) to receive my passport stamped?
Hi, Don’t worry its normal delay of 1-2 days is normal ,I also have similar experience but got the my passport after 1 day.

I just want to contribute and share my experience to this wonderful site. It helped me a lot while I was going through the H1b process. I understand all the pain and anguish from everyone around here. So, here is my story.
It was my first time for the H1b. My company applied for it in April and I did get the lottery spot. However, my company decided not to go through the premium processing, so I had to wait for a long time for the decision. And it was a long wait. As a matter of fact, I had to wait until late Oct. to receive the decision on my case. It finally got approved and two weeks later, I went for an interview at the embassy. The interview questions were kind of “trivial” in a sense that they did not ask me many substantive questions. I guess the only substantive question was about my job and what I do and about any visa violation that I would’ve had in my past. Of course, I did not have any so everything went fine. After that, I got my passport back in 5 days. You can also track down your passport/visa status at the embassy website. It will initially say that it’s pending but don’t worry too much about it. Everything will be fine once you are done with the interview. While I waited at the embassy, I did not hear anyone getting rejected for the H1b. One interesting thing is that they did not need a hard copy of the id photo. They told me that the photo on the website was enough.
Anyway, everything went fine at the embassy and I negotiated with my company about my first day for my job. So, I entered the country and the “interview” at the port of entry (POE) was also very quick. He only looked at my passport and asked no questions. I think he only said something about the weather….
So, I thought that everything was going smoothly, and I thought that it would be easy to get a driver’s license. That’s when the true drama began. I went to the Department of Motor Vehicle about a week later, and they told me that these days, their system is linked with the Department of Homeland Security (DHS). And even though I came into the country, the system in DHS is not updated with the USCIS, so they do not recognize that I am in the country. They had to file a case, called SAVE, and told me to wait. So, I waited for THREE weeks for it to get approved. Once it got approved, I had to take the computer test and schedule for a driving test separately, which took another week. So, the whole license process took 4 weeks in total and getting a car took another week. However, it’s all ended now and I am finally settled down on my new place.
I know that it was not easy at all. Especially in late September that I did not get my H1b case approved. I did not even get an RFE. During that time, I almost gave up coming to the U.S. in 2016. I thought that my case will be picked up in 2017 the earliest. However, everything ended and got processed. Now when I look back, it was not worth worrying too much. All it did was damaging my psyche. Also, (sorry about saying this) reading all the negative case in different forums and newsgroups did not make me too optimistic. Maybe I was doing it too much.
Anyway, I will end with these comments:
1. Don’t worry too much. Most of the time, your case will get approved, and there is really nothing to worry about once it’s approved. Just relax at the interview at the embassy. They did not even ask me for any document other than my passport. Everything will go alright.
2. It’s worth getting a driver’s license in your home country and get an international license. With that, you can at least drive around. I had to take so many Uber rides and it’s quite costly.

My case was approved on 13th December. But still, I didn’t receive the approval notice. Could anyone please let me know that how many days will it take to receive the approval notice? And also the soft copy is not yet uploaded in zoom tool.

Looks like I’m being luck here. Approved on 22 dec and got soft copy. They asked me to send address for hard copy, i shoukld get it in 6-7 days
Check with your on-site immigration case manager. Ping him/her on sametime and send mail till they respond.

I am sorry that your case got denied. I am sure there are many others like you, and they probably do not want to announce their denials. Life can be very tough and unfair at times. But God rewards you in mysterious ways. Hang in there.

I am going to attend B1 visa interview in jan 1st week, 2017 with my current employer for 2 weeks trip to US. I got H1 picked (april, 2016) and approved (october, 2016) . The H1 employer yet to send the approval copy to me which will be in feb, 2017
Kindly let me know if there any risk or impact on both B1 and H1 visas.

Since you have a approved H1b petition going in for B1 interview might void your H1B status, in case B1 gets approved.
Get if confirmed from immigration attorney
I Prefer you to wait and get H1 stamped rather going for B1. This may affect both visas.

I reached just 10:15 AM and after waiting for 5 mins they let me in after checking the passport. Once we entered one security guy directed us to a room where one lady was verifying the document and asked the sorted document to keep handy.
After waiting another 10 mins the lady directed us to another room where the actual interview was taken. They verified my right hand fingerprints
After waiting another 10 mins one guy directed us to stand on the Q in counter 5.
Me : Good morning, how are you sir?
VO : GM, I am fine, how about you?
Me : Fine.
VO : What is your highest qualification?
Me : Answered
VO : Who is your employer ?
Me : Answered
VO : Are you going to work with your employer or client ?
Me : Answered: Going to work at Client location.
VO : Who is your client ?
Me : Answered
VO : Which state are you going to Work ?
Me : Answered
VO : What is your salary ?
Me : Answered
Finally after 10 secs typing into the system VO said ‘Your visa is approved’ My interview has done with in 30 seconds.
VO did not ask me any documents except my passport at Chennai Consulate.
After complete my interview I have checked my visa status in the below link
https://ceac.state.gov/ceacstattracker/status.aspx its showed as Issued by U.S. Consulate.
The next day morning(29th Dec today) at 11:00 AM I have received email from US Travel docs like your passport has been delivered to my drop box (Pick up) location come and collect your passport.

Please wear formal. Be cool and listen to VO before answering and the last not the least please never tell a lie to VO.

i have applied through consultancy. my case was picked up and got RFE in oct. Now my consultancy is saying they cannot provide the documents which were asked in RFE. Is it possible to change the consultancy? Now how can i move.. Could any one can suggest.
So you applied for H1B without even having a client that has offered a position for you? And BTW how much did you pay the consultancy?
And the same consultancy may have provided the same receipt number to multiple candidates. They would have filed the petition definitely expecting an RFE.
Ultimately, lets assume 30 candidates paid the consultancy 5 lakh each. The consultancy now had 1.5 crores of money with them. They just file 5-6 petitions, and get 1 or 2 selected in lottery. Now they give the same receipt# to each of the 30 candidates. Since petition is selected in lottery, they don’t have to refund the money. Petition goes to RFE to which they don’t respond back.
All 30 people lose their money. Consultancy made a quick 1 crore profit.

26th Biometric:
Appointment at 9am, We went at 8.30am.
Since I had 2 year old in my hand, I got priority slot, so, it was little quick. Completed at 9.10am.
27th Consular interview:
Appointment at 11.30am.
We went at 10.30am.
I was nervous, but, my 2 year old kept me busy, so didn’t feel much of heat.
Again, as we went with our daughter, we were given priority slot, so, skipped the long queues.
1st counter: one Indian checked for the passports, after that suggested to go to another counter where an Afro-american lady checked for biometrics, asked date of birth of my daughter and suggested us to proceed to final counter where we met VO.
VO: Good morning.
Myself, mywife: Good morning.
My daughter: Hi (she can’t speak anything else other than Hi and Bye), she kept saying this
VO: Hi with a big smile to my daughter
VO: (to me) can you give your passports?
Me: Sure, (handed over the passports)

VO: Have you been there before?
Me: No, this is the first time I am travelling to US
VO: Who is your employer?

VO: (was checking something in system for about 30seconds and then..) How did you know about the job opportunity?
Me: Through online job portal
VO: What would you do in US for your employer?
Me: Explained my position and roles, responsibilites.
VO: (again, was checking something in system for 1 minute, and then, he got up, went to another VO in next counter, had a brief chat and came back, I was really nervous) Can you give me your visa application copy if you have (I was thinking, may be I am going to get 221g)
Me: Yes, sure, (handed over the I129 copy)
VO: Thanks (again, was checking for something in system for 2 minutes), then, asked, Did your employer come over to India to interview you?
Me: Yes
VO: Do you know how many attended the interview and how many got selected
Me: (After hearing that question, I was bit more nervous, but, didn’t show that in face) There were few on the day I was interviewed, but, I don’t know how many got selected. (This is the truth by the way!)
VO: Good, How long have you been working with your present employer in India?
Me: Answered with my total years of experience
VO: Good, What is your education?
Me: Answered my education
VO: (was checking for something in system for 1 minute and then..) Please have a look at the pamphlet. This has your rights. Your visas are approved, have a nice day.
Me: (with very big sigh of relief and smiling face) thank you and you too.
My daughter: Bye 🙂
Overall, it took about 15-20 minutes, though I was bit nervous, never showed it in face and I answered the questions confidently.
We came out at 11am.
Got notification today (29th Dec) that passports are ready to pickup!
Got the passports with stamped VISAs!

Hello, I was taking H1 B Interview through online in Sept 2016 from US and at that time, my last visa stamp was valid till 9/30/2015 so I checked yes for the question where it’s asking ‘existing visa is valid or expired in last 12 months’ so system shows I am eligible for Dropbox. I am currently in US and visiting India in January 2017. So anyone has any idea if there will be any issue in visa stamping by dropbox as my existing visa stamp is expired for more than 12 months.
Last I797 was expired on 9/30/2016 which was valid from 10/1/2015 but I don’t have visa stamp for that.
Current H1 is approved from 10/1/2016 – 9/30/2018.
Please advise if anyone have any insights or experience!
