When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.
- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

For PhD folks with exceptional qualifications, you don’t need H-1B if you have exceptional skills. If your employer is understanding and accommodating:
1. You can file O-1 visa. This applies to MS students too with good research.
2. If your employer agrees, you can work from India remotely or at an Indian location. They can apply for EB1 green card while you are in India. In 2 years when your petition is approved, yOu can go for immigrant visa interview in US consulate and enter US as permanent resident
Yes, well said. I am a PhD. did not get thru in H1-B, so talked to my advisor and joined back my university as a post doc on cap exempt H1-B. I am trying to get a coupe of papers published, then get Green card or O visa. Though this year too, my prospective (for profit) employer has filed for my H1 visa, I feel from within that I will feel more happy if I get work permit through Green card.
H1-B is so de-humanizing.. even if you get selected, you can’t really feel proud and confident of it as an achievement. because it was all luck… .. I like making my own destiny.

I am confused on the process. With so many petitions there is always a great chance of some employer do not get any petition picked up.
Let us say any genuine company files just 50 petitions in total then there is a very good probability that none of their petitions gets picked up.

Guys Not to discourage but last time I had the similar experience. ppl who get selected gets the notice quickly and after 1-2 days chances of getting the notice becomes very slim.I waited last time till the end just to know that I am not selected. If it is AD or RP does not matter when you have paid for PP. Because there is no difference between AD and RP after the lottery is done. It comes into play when they are doing the lottery. After lottery is done the only difference is Regular Processing vs PP. That makes sense to me but not sure how it works. 🙁

We have received email notifications in 24% of our cases filed as AD/PP/CA (Advanced Degree-masters / premium processing / California Service Center)

This forum is so full of life, I can share my experience over here to be listened if not replied by my peer countrymen.
This is my fourth year on H1 here. I came here as a Direct Phd student. This is my 8th year in US, I am 30 years old and sometimes I feel what all I lost. I got a good R&D level job after a doctorate but no one to share that joy.
People come and go in life, in 8 years I haven’t met anyone who I can call a true friend. A close family in US which lives 500 miles away from me yet light years apart. Who don’t have heart or love to even ask me when I am unwell. The same people I shared happy memories when they visited India.
A country of no one, where we fight for our pursuits but what’s the end to it. Whenever i see my friends on Indian trip, they are so happy and even my 5th grade friends are there for me even after years.
My parents are forcing me to get married. They want me settled, I might get my green card in 1 year or so (EB1) then the girl might not be interested in returning To India.
I am just being a hypocrite, neither for here or there.

yeah exactly, go back to India then, here people are struggling to get H1B for three straight years now and risk loosing their jobs, settled life here in US and you are cribbing for no reason when you are about to get Green Card.
Some people are just insane and no matter what they will always crib !!!

Some of my friends who got their doctorate degree have joined IIT kanpur and IIT Hyderabad and IISc bangalore as faculty members. They could have easily gotten green cards, but they had something else in mind. guess what in India you will have the status of a citizen.

3rd attempt and all 3 years, single petition with same employer (full time job, non-IT). Had to leave US last year and work remotely.

There is no correlation in those numbers.
AD/RP- I went to my school and checked my sevis, There is no change. Does that mean I have no hopes.left at all? Or normally does it take some time for sevis to update if it’s picked on April 9? Please answer this question

Nope, that just means that your petition was filed by your employer. You should receive an email stating case processed when you get a selection notice. Accompanied by a WAC receipt number.

You can expect more coming this week. USCIS wouldn’t send all receipts in a day. Moreover, AD guys have two chances, one in Masters quota and other in General cap. We can expect receipts next week as well, as they start sending non AD PP receipts .

Here’s an idea for USCIS. Just allow one petition per person and let them state all their potential jobs on the application. Then ask the applicant which company they want to join, in case their name gets picked.

One question: what happens to the “unused visa slots” if multiple petitions from the same person gets picked?

Are you sure about that? Sorry for doubt, but yesterday, according all comments posted here, it looks that only AD/PP were notified.
It indicates a “preference” for notifying PPs before others, no?
AD may get the notification earlier since they will be notified through email and RP will be notified through mail (postal).
So, even paying PP, Bachelor Degree will be notified only by mail (postal) and not e-mail?
You believe it may happen on April yet?
One more question: For those who were not selected in lottery, how long it takes to know they were not selected?

All PP will start getting the notification through email irrespective of AD or NON-AD. Mostly the employers who filed the petition will know the rejected petitions much in Advance but they are not revealing it to the candidates. From my experience, I would say that you can wait till May 2nd week after which they wont be any possibility. During my filing year, I have received the receipt notice on May 7th from my employer after that none of my friends in same company didn’t get any receipt notice.

Im my case, I am Bachelor Degree/PP applicant. I hope I can receive my confirmation very soon. If possible, today.
Until now, nobody in this forum posted that received a confirmation of Bachelor Degree/PP. Only AD/PPs are being notified till now.
I hope to receive some news about this Bach/PP soon.
