When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

    Can anyone confirm about the available stamping dates .
    I can see in all the consulates in India dates are available with in 2 weeks but i dont know why my company saying they can,t see any date before
    February across the consulates.

    • That is rubbish friend. Two possible reasons i can think of – either your company has pissed off the embassy or they are trying to delay your travel. The later looks more probable. Some times with organizations you have to be assertive. Show them the proof and ask them why they cant book it. If they are unable let them know you will book it and claim the amount as expense.. fair isnt it

    After RFE, the cases which gets approved under regular processing, does their status later changes or “Case is approved” is the final status??

    Ideally how much time it takes for the approval notice to reach at our end?

    • Case approved is the final status until you go to stamping or you file an amendment or you take any action subsequent to that using the petition number as reference.

      In rarest of the rare circumstances i have heard some peoples status being denied as USCIS has approved theirs by mistake but this is what i heard.. so could be a rumour.

      Normally it takes 7-15 days. If in a 3-4 weeks your attorney/employer does not receive the receipt – they can contact USCIS to verify the address where they have mailed or ask them to re-issue a new approval copy

  3. Hi Sourabh,I am filling out DS160 and need a small help, there is a question asking whether a US visa was ever denied.
    I applied for L1 a couple of times in 2011/2012 and did not get it, in both cases I got the blue form(I guess it is 221(g)).
    Is it visa denial?
    It was long time back but I remember the form did not say that it is a denial but something like that at the moment we cannot conclude if a visa could be awarded…
    Pls suggest how should I answer this one

    • 221 is never a denial. it is part of visa approval process asking to produce more documents to support your case. Even if it is pending for some reason, it cant be considered as a denial. So no need to mention it.

    • Please do not follow the above advise. 221G is a visa refusal and the wording on the document including many attorneys agree that it should be revealed on your subsequent visa application (Unless that decision has been overturned and visa has been issued subsequently).
      In most cases you might have got 221g on your employer documentation. For no fault of yours dont let that effect your current application. Just imagine if you tell that there is no 221g AND case officer finds that on the system. It might result in administrative processing un-necessarily on your current App.

      Also when you reveal everything on your application – you are not carrying any burden to the interview and you perform better. Be truthful and if its meant to be – you will get a visa for sure

    My H1B is currently in RFE stage and I would like to upgrade it to premium processing while replying to RFE.
    I know PP fee is $ 1225, but the employer is asking $ 2000 ( saying attorney fee will be around $775 ).

    Is it true that attorney charges around $775 to upgrade petition to premium processing

We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice

    I asked my employer they said you got 2nd rfe. Notice contains below points

    Position is not a speciality occupation
    ¥ complexity and uniqueness of the offer d position
    ¥ why a bachelors degree is needed
    ¥ Nature of the duties are so specialized and complex that knowledge required to performed duties is usually associated with the attainment of a bachelor or higher degree
    ¥ Degree requirement is common to the industry in parallel positions among similar organizations

    My application was in RFE initially then Denied.Could you please tell me what could be the reason? Should i lose hopes? My Employer says it is denied and they cant to anything. We are very disappointed with this. Please reply.

    • If you are waiting more than 90 days after responding to RFE then you can raise a case with USCIS. Ask you attorney to take it up with USCIS.

    My petition is approved till sept 2018. If i am not able to fly till then, would my Visa stand null n void ? I mean, will i have to go through lottery again ?

    • If you never fly on that visa. You can apply for a cap exempt visa on that petition. This is much easier to apply if you are in USA. From outside US too i have heard recent cases where petitioners have been successful.

      2018 is a long time. Not sure if lottery will be there then or not or even if H1B visa will exist or not.

      so take it as it comes

  16. Seems like everyday the Rejection cases are increasing . I have received RFE October 18 th on Education Evaluation , My Employer has not yet responded. I am very much Worried 🙁

    • @ Jahnavi, even I received same RFE + Specialty occupation RFE on 18th Oct, My employer not yet started preparing for it. Just 4-5 weeks are left to submit it, i am worried now.

          • Hey Guys,

            Do not worry – I am seeing guys who have got RFE on all the headings getting approved. The Key is responding comprehensively with conclusive proofs or documents for the USCIS well with in 90 day period. So i would advise you to get involved with your employer and check how is planning to respond and what documents he is planning to provide.

            The key is documentation and approval will follow.

  17. Hi friends,
    I am working at ABC company currently and XYZ company initiated H1B and it got approved 2 months back. I have been continuously asking for approval letter to fill DS160 and attend for stamping but yet to hear from XYZ. Recently I was informed that I need to wait for another 2 to 3 months for stamping (not sure of reasons).
    My question is, at this point of time can I approach any other employer say LMN who is willing to do H1 transfer?
    Is it possible for new employer LMN to initiate the process without approval letter?
    Currently I am located in Chennai.

  18. I have resigned my present employer and by the time I attend the Visa interview I won’t be an employee of current employer. Will there be any problem?

    I see there is no available date for appointment in Dec in Hyderabad.

    • Why did u leave your current employer before stamping is confirmed?.

      U know that stamping may get complex sometimes with admin processing and all.

  20. My case was approved last week ( h4 to h1b). Now my employer is saying my project got delayed till feb and he can’t pay me or generate a pay slip till feb. now my doubt is can I stay without salary till feb in USA?

    I’m really concerned, pls respond.

    • offcourse you can stay for atleast 60 days. Just this week, legislation was passed in US that allows stay for 60 days without job.

      • The Legislation (60 days stay period) will be effective from Jan 17 so till that date old rules apply.

        if you want to transfer you need to go out of the country for stamping (or ask him 0 working hr payslip they can bench you up to 2-4 month in some cases on h1b) . or stay with same employer get 1 or 2 pay stub and you can transfer.

    22nd November: Premium processing request received
    1st December. Case approved

    There were no RFE at all.

    “We mailed you a notice informing you of the action we intend to take on your case. Please follow the instructions in the notice and submit any requested materials .”

    I am yet to receive the mail, any idea where my case is heading ?

      I also got the same status and it was related to employer documentation.
      USCIS needs documents like Tax sheets, ability to pay etc.

      My employer had replied back to RFE almost 2 months back but still its in RFE received.

      Do not worry.

        Mine was related to wrongly calculated ACWIA fee.

        My employer paid the difference in fee and response was sent and my petition got Approved (It was Premium Processing).

    Nov 30 – RFE Response Received .

I have been waiting for an answer since Sep 12th, that’s when my status changed to RFE response received and it’s been already over 2 months and a half and no change, I check in the stats page that someone posted here and there’s a decrease in Case Received status but not in the RFE Response Received, are they even working on those, is from VT I just can’t wait to know what’s going to happen, hoping for a positive outcome soon please!!!!!!!!!!!

  30. I had complete my interview in Mumbai office on 29-Nov-2016. And Officer did said to me my visa is approved and kept my passport. He gave me back just I-797 and did not gave me any pink or white or 221 slip.
    But status is showing “Administrative Processing”
    Any idea what does it means?
    How long usually it takes on even though on site it says several weeks?
    What are the chances of visa being rejected?

    Is it the same we are getting for PP also ?

      There wont be any clock or deadline mentioned on the status normally. You can assume your clock as has started ticking for 15 days based on the status update as SLA is 15 days for PP.

    I have filled the Intended date of fly as 01st Dec in DS160 and got the schedule of interview on 05th Dec for stamping, would that be questioned during interview or will there be any impact? In initially i got the stamping dates are in NOV 21st and 22nd but during this period we have very urgent project requirements so my manager ask me to reschedule the interview dates and then i got the new dates are 05th and 6th Dec but still in my DS-160 the Intended Date of Arrival is 01st Dec 2016. Is this any impact in my stamping time.

    Me: I told the client location
    Officer: He gave me a whit slip and asked me to go through that before entering US. And he said You Visa Got Approved sir !!!!!

    Thanks a lot for this forum… Guys who are waiting for the Approval dont lose the hope… Guys who are waiting for stamping just go through some standard questions … Be Bold and dont get panic about the questions officers asking to other persons.

    I got Rfe regarding Specialty occupation and my employer suggested me for expert evaluation for my position .
    I’ve 3 years Bachelors degree(BSc IT) and 3+ years BA Experience.

    I just want to check I move forward with the same, would that increase the chances of approval ?

    • Hi Riya,

      Expert evaluation is possibly the best option but an expensive one, Would cost your employer some where around $600 where a University PHD professor or someone well renowned in your field of employment studies your profile and provides a comprehensive response to the Points raised by USCIS. This sort of gives confidence to USCIS to take a positive decision on your RFE. The other option is simple education or experience evaluation together with further proof from your employers. So depending on your situation – proceed with whatever way you think is best for you

    I am having H1b Visa till Sep 2018(currently in India), but my passport validity till Feb 2018 only…If I renew my passport now…any impact on my H1b Visa(during board of entry)….Please suggest me on this….

      No you will not have any issue. while PoE (Port of Entry) you have to show both passports Old which has stamp and new passport where they will stamp PoE entry.

    If I suppose filled the Intended date of fly as 17th Dec in DS160 and if I goes to US on 11th of Dec after stamping, would that be questioned in POE?

  41. Looks more of RFE issued rather than Approval these days. It is very painful getting RFE after waited almost for 8 months. To get RFE responded and get Approval will take average 2 more months. Then stamping logistics will take minimum one more month.
    You really need to be lucky in all these steps.

    • I had an offer(h1b) from this firm. But I rejected it because i had good offer from another firm. Was it through some Techitrack consultancy ? They had asked me to sign a contract of 10Lakh in stamp paper. If h1 is picked and i dont join, i have to pay.. is it same case for you.

        • I really don’t understand why some guys are so desperate! Most concerns that demand money or contract are never to be trusted. You must have realized this when they demanded sign in contract. You chose to go ahead and now you are in trouble! It was all just your own mistake. Enjoy!

          • Can u give a consultant name who doesn’t ask for a bond? May be there are but not easy to find. Why would someone spend money without any assurance.
