When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

    My Wife H4 petition status now is “ISSUED” while mine (the H1B) is now being shown as “ADMINSTRATIVE PROCESSING”.

    Is this anything to worry about? I know its too early to check status as we appeared for the interview yesterday. But the admin processing kind of looks scary.

    If i am working in Level5 US concern in India. And i applied H1B through some mid level US concern (not desi consultancy).

    So how to answer if a VO asks me: Why are you leaving this good company and moving to one mid size company in US?

    I got RFE a month ago. Today my attorney called and asked me to send the original Educational certificates as USCIS wants to verify them. But as far as I know they will request us to send the copy of the documents.

    Could you please guide me whether I can send the original certificates.

    I asked them to send me the RFE questions.

    • I never heard USCIS asking for Originals that too by Post. I don’t know but did you applied through small desi consultancy? Desi consultants are known to get Original Documents to keep you remain with them.

    My case status changed to “RFE was mailed” on October 6. I am not able to reach my employer or attorney, so I am not sure if my RFE was received.

    I am worried that if they can reply to RFE before deadline.

    Is it possible to change the employer now?

          Have a Masters US degree – I used up my 6 years of H1B and stayed in India for more than one year. Re-applied for H1B and was picked in the lottery for this year. No change in EAC receipt status, still in received status

          • I have no idea why they are taking this much time. I have seen couple of people on other sites with same status for AD/RP/VT. I have done my masters, H1b got denied in 2014. I have applied again this year from India.

    Then for the next 10 minutes…some other dude shows up and they go through my petition on her computer screen. Both me and wife anxiously wait for 10 long minutes…and then the golden words.

  12. I appeared in interview on 10th Nov alongwith spouse and 2 kids, Consular gave me a white 221g and told that he required some other documents for the final decision. Upon asking by myself for the required documents list, he did not respond me and kept our passports with him.

    Today my case’s “status updated date” is changed to 15-Nov-2016, it was 10-Nov-2016 before that. What this mean?

        • Status date means your case is being worked upon by them. Or they might sent you the passport back thru courier.

          What are the documents they need which was mentioned in 221g ? Have they submitted the docs already or yet to be ? Mostly they ask for client letter, project description and contract doc b/w your employer and the end client.

        They said the reason is this year USCIS team came in person to the client location to check on the integrity of the details provided in client letter. They failed to prove so a petition got rejected. So they want to do the damage control by withdrawing the other petitions who have got the same rfe i.e., employer employee relationship.

    • You may hear it anytime soon. Mine was also similar to you except that RFE Response received was 9/28. I’ve got the approval on 11/4(4th Nov). There is nothing like transferred cases will be processed last.

    I applied H1 through a consultancy and it went into RFE. One of the RFE is ” submit copies of pay records(leave and earnings statements, and pay stubs etc) for the last two pay periods”

    May I know what are the documents to submit for leave and earnings statements.

    • If you have been working for the consultancy, then you should have their payslips, which would list your earnings and deductions. I guess that detailed pay slip for every month should be good.

      If you are not working with the consultancy, then you will need to discuss it with them since this now puts you in a tricky situation.

      • You dont need payslips if you are not working for a firm. You just need to valid offer letter from the firm. Generally they need for H1-transfers, it is not for a fresh H1. Are you doing COS from L1 to H1 in US itself or something. In this case, you need to provide your L1 payslips to prove your current status in USA

    • Absolutely. Your extension was denied but original petition approval for employer A is still valid. Btw when did u get approval for original petition for employer A?.. Does it crossed 6 years???

    I was previously in US on F2 visa for sometime and had to return back India on personal work.Here I work for MNC company A and company B applied H1 this year.

    I have waited for almost 6 long months and as status was in Received status, So I planned travelling back to US on dependent visa and then apply for COS once the H1 is approved and also booked tickets for Dec.
    Now the recent 2days back My Visa got approved and also I am in notice period with Company A, So my questions are:
    1.Should I travel after my H1 stamping or Can I travel on Dependent visa and then apply COS coz the trip is planned and booked? Which case would be the best?
    2. Incase if travel on Dependent visa, Will I get questions/problem at port of entry on my H1 approved case?
    3. If go for my H1 stamping and hope not the visa is rejected incase, Will I havea chance to resume this approved H1 i.e. I797 after I enter on dependent visa and If so what are the steps that I should take to change the status to H1?
    4. Incase if travel on Dependent visa and apply for COS for H1,will I face queries on my COS as i have traveled on approved H1 visa?

    Please any suggestion will help me to proceeded further.Thanks!

    One of the h1b petitions filed by my employer got rejected because of failure to prove employer employee relationship. Now my employer is scared of other petitions who have got the same rfe and has decided to withdraw them citing the company reputation.
    Is it really a reason to withdraw the petitions just because he failed to prove one?
    What is going to happen to my petition if he doesn’t withdraw?
    Does it really affect the employer if one of the petitions filed by it gets rejected like they r saying?

    Please suggest me!

      • NicheSoft inc. Is the employer. Unlike every year, USCIS officers are checking at the client location in person to cross verify the details and so that one person’s visa got rejected. So my employer has decided to withdraw other petitions of same rfe. I.e., employer employee relationship. They r claiming that company’s reputation will be damaged if visa rejections are high.

    Last Year I received 221g on my H1B visa and it was further sent to USCIS and I have still not got any reply on it. This year H1b2017 my current employer again has filed a new petition for me (not cap exempt) and I will be attending the interview next year. Do i have to worry about the previous visa in 221g.     My case was approved last week and waiting for the documents. i have applied H1B for new passport and my old passport expired on May 2014. I lost my old passport and i realized the same when applying for H1B through my employer. I didnt mention this when applying but parallally i lodged complaint and got Missing certificate from Police. There is one question in DS-160 that did you lost any passport like that. What exactly should i mention for this question and will it impact in Visa interview?

    PLease suggest.

    Through xxxxx applied for my H1-B in 2014,
    I went for consular interview at Chennai consulate with approved I-797B on 21st Jan 2015.
    I was given 221G stating it required further processing.
    In April 2015 I received “Refusal Worksheet”.
    Again for FY2017 cap applied for h1b and it was approved while ago.
    My question is will be there any impact of refusal for this time h1b?

    My petition got approved last month, received my hard copy also. My interview was scheduled on 14th November, however, my company’s mobility team told they will postpone my interview as my petition has been filed for amendment under premium processing, can anyone please let me know how long does this process take and what are the procedures, is it again waiting for a long time?

    My client wanted me to report on 28th November, which is not possible now, can I at the least tell them i can join by 2nd week of December, will this be realistic?

      • I got approval on7th october and approval copy one week back, now I have another receipt number which is filed for amendment how long it takes this procedure and it’s in premium processing. Thanks

        • If its premium processing, you should receive a decision within 15 calendar days. If your case is approved, then you will get your approval in email. And once you have your 797, you can schedule your stamping appt.

          I would guesstimate it would take you a minimum of 30 days — from when your employer actually filed the amendment — before you can actually fly to US.
