When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.
  • April 12th, 2016 – 6:30 PM EST : Official Update :  USCIS released a press note that H1B lottery was completed on April 9th and they received over 236,000 petitions for FY 2017 quota. Read Press Release Summary  
  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     Does anyone have any idea when Bachelor Degree / Premium Process will start to be notified?

    Will they be notified right after AD/PP, or they will finish all 20K AD (PP and non-PP) first?

    • There is no preference given for notifying the applicants. Preference for AD will be given only for lottery(lottery for 20K will be done first) and preference for PP will be given only for processing the petitions. I have received receipt number in first week of May 2014 and my friends received from last week of April 2014.

        Are you sure about that? Sorry for doubt, but yesterday, according all comments posted here, it looks that only AD/PP were notified.

        It indicates a “preference” for notifying PPs before others, no?

    • There is no preference given for notifying the applicants. Preference for AD will be given only for lottery(lottery for 20K will be done first) and preference for PP will be given only for processing the petitions. I have received receipt number in first week of May 2014 and my friends received from last week of April 2014.

    • Really? Is visa system to be blamed? When 80% candidates are fake, filing thru dubious and shady IT consultants… Candidates are the to be blamed!! Yaa, if the system is straightened out, I bet 80% candidates will not even qualify for H1!

  2. Quick question: lets assume someone filed 5 petitions and all of them get picked in the lottery. What happens to the other 4 H1B visas the person obviously can’t take up. Will they be thrown back into the lottery pool?

    Btw, I only filed one petition but was wondering what kind of harm all these people are causing filing multiple petitions.

    • Since nobody knows the inner working of USCIS…here are the possible guesses from various forums
      – All those remaining visa will go waste (like 3 out of 4 applications created by a person)
      – USCIS selects more numbers in the lottery to account for such cases and allot those unused visas to extra applicants.

      Again, this is a guess work and only god and inner circle at USCIS would know what happens there.

  3. In the press release USCIS said that USCIS will reject and return all unselected petitions with their filing fees..

    Does it mean it that USCIS start return from today onwards to Attorny / Employer intimating who are rejected H-1B petitioner?

  4. Actually i checked the previous receipt notices as well – i guess they started with WAC1613351743 and are currently on WAC1613352527 .

    So total 784 notices have been sent AD PP from CSC.

    Any one from Accenture for whom the LCA Case Number itself is not yet updated in RMS Portal ? Is there a way to know the current status ?

    • ACN guy here. It won’t get updated in RMS. U can try and raise a request in MyRequests. But they are giving generic replies to all. However 1 of my frnd has clearly been replied that his application was not sent. So try ur luck… 🙂

      • How can we know if our app. was sent. In RMS there is an assignment tab where you can see People Mobility Billing information. there its showing as billed for initiation on 4 april. Does tht confirm that app. was sent.

  6. Since there are many questions from AD/PP guys. Based on ImmigrationGirl blog (she is an attorney), she has only received 25% of the AD/PP/Vermont applicants and 10% of the AD/PP/Ca applicants. Last year, these numbers ended at 71% and 55% so it is not over yet. Please have some patience.

    • You have to wait for couple of weeks to get notified under general cap. If you have applied under premium processing, it should be by next week.

  8. My application filed under bachelor’s degree/RP so when I can expect my receipt? This is my second attempt with one genuine application. Guys please pray for me. Fingers crossed now.

    • You can only expect after 2-3 weeks from now. General cap/RP receipts can go until June,till you receive a notification from USCIS that data entry is complete. Please be patient and good luck for your application.

    • Nope.. ours is regular processing.. USCIS will start sending receipts once premium petitions are done which is two weeks from now.. Lottery Selected Cognizant folks start getting receipts by 29th Apr last year. Expecting a couple of days earlier this time.. Keep faith.. All the best.

    From trying for the F1 visa 5 times to my second shot at H1b, life has always been a war. I pray and hope that all the people who work hard and and genuine get selected.

  10. Human is hypocrite by nature. I know one person who didn’t got selected in H1 lottery last 2 year. However her old family based green card petition got approved. She became permanent resident.

    She still cribs how unlucky she is that she didn’t got picked in lottery. :p

    • I know a family where husband filed 5 petitions last for his wife.
      1 got selected. I this job market she is still struggling to get a job.
      Another one just faked everything. Projected 8 years of experience in IT + BE degree when she was just a BCom.

    Many people get the visa but are paid so low that I have seen people do not buying basic things like mattress and bed for years, forget about the standard of life.
    I have seen people all sort of things to save some $$$.
    I think these people are better in India where they lead a good life if they cannot get a decent job here in USA.
    And they think they are living “American dream”.

First thought the number will be smaller cause this year the LCA number dropped down 30%. …Now, there must be a HUGE increase in adv petition and I don’t even wanna think about the rate anymore. This is my first and last lottery. Spent soooo much effort in applying for graduate school and finding a nice job, guess it’s all gonna be screwed by some random joke.

  14. I would really like to talk to pundits here on this forum who were so sure about the count being in the range of 190k.
    There are so many jobs out there in this country, companies do not care about 2-3k extra on an application when they know they will make much more when they have correct workforce.
    Also guys this not the end. If you are good at what you do, you will be successful. Be it in USA or whereever you end up. Outwork others when odds are against you. You are at a place where how you react to a situation matters more than whether you get through lottery or not.

  16. I want USCIS to start denying H1Bs for CTS, TCS and all the indian outsourcers like they denied L1B, and none of these companies apply L1B now due to that.

    If 8 out of 10 petitions for these companies are denied, things will become good.

    H1B programme was not created with these large outsourcers in mind, who undercut we americans with cheap labor in the market.

        I know how better you must be. Maybe in departments where MNCs do not care and do not hire full-time employees.

        Put you such people in a project which requires a little bit of brain and I have seen all smartness going out of the window.
        H1B is not meant for dead projects in maintenance mode.
        We all have seen success in getting L1B in visas or how scared you guys are in filing an extension.
        The lottery is the only way for you.

        • I agree with USAPatriot. A lot of Indian companies are exploiting the H1B policies. Being an Indian myself, but associated with an MNC with HQ in CA, I am shocked to see how companies like TCS, CTS etc file H1B petitions just to get some folks out there in the US while the actual talent is left behind.

This is my second attempt at H1B and have been following the blogs in redbus keenly looks like most estimations of lower numbers have gone out of the window.I am hoping that the US govt takes a note of this huge demand and bring about some changes for next year .I feel that there has been a cascading effect from last years result .The trend is big indian companies have filled lesser this year but looks like there is really huge backlog for Advanced Degrees ,considering the sheer effort and aspirations that ppl put in to file for H1B It is tough to digest that it all boils down to lottery.Anyway Wish everyone good luck !!

      Why do Indians expect US government to increase H1 quota? So that fake consultants and dishonest people with fake resumes can come to this land, to screw the US workers?

      Let us be honest: IT folks with fake resumes are not the best and brightest US wants! They are crooks…

        • My friend in California got a offer for $65000 from Delloite and they filed his H1… Are you f****ng kidding me?? Is this your LCA market approved fair wage? $65000 in Calfornia!!

          System allows them to file H1 with this shitty wage, and they rig the system!!

            He will struggle to even buy a 15-year-old car or basic furniture.
            He may have to transfer money from India to pay his rent.

          • Your friend is lying about Deloitte offer. Deloitte starting is minimum 85k. If the person has MS/MBA from US, you are looking at 100k plus starting. Stop BSing.

      • No matter how many visas the US increases the demand will go up. If the numbers are increased to 200000 you will see 800000 applications come in.

        Indian greed and corruption has no limits. I personally know people who have faked things in the H1B market, and I am ashamed to be associated with such people.

        Indian outsourcers need to be denied their visas, because legally the use case for H1B was not for them. I wish USCIS does it, and shows the door to these shady folks.

  18. Really Disappointed to hear the 236k number. I was generally hoping for less number of applications to have a more probable chance of going through. This was my 1st attempt and I am on L1B in my third year now. Will try for l1 extension with the company next year. Will have approved I140 this year but if the trend of applications is the same going forward, I can hardly think about settling here with GC Eb2 lines stretching 8 years back. Hanging in the the middle !

          • Thanks. In case you are getting promoted to a Manager, I believe that you are eligible for 2 more years on L1 Visa otherwise need to leave at the end of 5 years.

    Go to USCSI site, click on News / Alerts / Filter by “Visas: H1-B”.

    More then 236.000 applicants.

    All lottery also has already ran.

    What I can do now is let it in God’s control.
