When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  1. Any one suggest me the chances of approval if we re appeal or MTR the denial petition. I got RFE and we have submitted valid SOW but still my was denied . I am from a big MNC and my managers are okay to re appeal . Can some one give details about re appeal. How long does it take? Is PP available ? Thank u

    • Hi Slaughter 21,

      Appeal – you can do definitly… But i would say there is no point… there are no timelines on that and you are never sure when you will get a response…However one thing i can tell you is this wont bear anything on your future applications unless there is any incorrect/fraudulent personal documentation submitted by you which is am sure is not the case…

      So best case .. Do a fresh application in April 2017 and if you are from a Big MNC they must have already started the nominations… so do not miss that ride….

      In parallel if you have opportunity pursue this one – do it atleast find out why they have refused. but do not put lot of hopes and pause your valuable time and mind space on this….. In my opinion your best chance is re-application in April 2017…

      Sometimes – Failures are help you determine how badly or how really you want it…. so take this as a test and determine the course of your life……good luck which ever way you go..

      • My employer submitted SOW for RFE response but it will expire in this October, so to support that they also sent manager letter stating the candidate will work in different projecta .Still we haven’t received denial notice but it is for employee employer relation documentation. Is PP available for re appeal?

        • The manager letter wouldn’t help in this case. Your SOW is expiring this Oct. Obviously how can they approve for a job which is expiring this month. It is pure mistake from your employer side and visa team. At least the visa team should have sense not to submit such doc.
          To learn from mistakes which would help others in this forum, any response to RFE should be done with at-most care. It is as if you have given a chance to proof your case with enough supporting doc. If doc is not supporting, they will right way deny it. I don’t think you can appeal also in this case. Your SOW depicts you don’t have a proper job which is eligible for H1 criteria.

          • Are you from tech mahendira ? They are the company which does this mistakes. One of my friend had to come back from US after extension denial because they submitted an old SOW which was expiring soon

          • Completely agree. The OP must have gotten a client letter that says the project will be extended through the end of next year or beyond.
            The SOW expiring this month definitely must have been the reason for denial.

          • So finally what do you say. This time if they submit proper documentation will there be any chance to get approval.

          • I dont think so it will work out. But you can try. Why cant they get a new SOW with longer duration from client organization at the first place ?

          • Have you submitted old sow along with the new sow to show that the sow will get renewed after October. If you didn’t then it is a complete mistake by your employer . You can go ahead with MTR amendment that will work in your case if you have valid reason.

    After waiting for 6 months, status changed to RFE 🙁

    I just want to know if my employer has not responded properly, is there any way to go with another employer ..

    • Hi Harry,

      do not worry… some times it can be additional documentation required by the adjudicator… its not always the employer…..you are better off waiting for the RFE to come through – find the cause send the documentation and see how it goes… there is a good chance that your petition might be approved after RFE… Do not lose hopes… Worst case there is always a next year and another employer…

  5. When my petition was filed my employer asked for dependents documents alao. Now i am blessed with a baby last month. Is there anything separate to ne done for her or while filling up DS160 i just need to fill up separated form for her. I am not very much familiar with process. And my hr is very slow in response. Fyi my petition got approved last week and hr said they will send notice and other docs soon as they receive from attorney.

  6. I have received my H1B petition approval and the approval notice from Employer A. I’m still to go for Visa stamping.

    Is it possible for employer A withdraw the petition in case I decide to move to Employer B now?

    • Employer A can withdraw the petition any time. There is obviously a discrete way of applying through employer B using the cap exempt of employer A….
      However you should consider this . How you would feel if somebody cheated you of $4000.. putting yourself in employer shoes you might not like it……..you should have made this decision right at the stage of applying…

      Anyways.. like they say everything is fine in love war and earning money :-).. you might have your own reasons.. good luck with that…

  7. Mumbai consulate is showing 2 calendar days wait time. Is it true that I will get my interview appointment in just two days ?? Or its just for biometrics n interview would be later ?

    • i got an email couple of days back. They have increased their staff and working hours to achieve all the flow. We are allowed for three times to schedule and reschedule our appointment date. Even though i am done with all three times but still i have an opportunity if i want to change the date. i don’t want to change though but yes when i checked, there were many dates available for bio-metrics and visa interview both.

      You can try selecting first date, go on second page to select next available date for interview. If you have find your suitable date, go ahead, else move back to previous page.

    Aftet long wait,received RFE on yesterday. MY case EAC1435xxx.

    While responding to RFE, can we upgrade to PP? Will it cause any problem leading to rejection?.Can you Please advise ?

      I upgraded to premium. It got approved. 1st alert I got was ‘not ice was e-mailed’. Next day I got another alert ‘ notice was sent by mail’.

      So, was it approved by premium process or normal process. Can I ask refund of PP fees as they approved by normal process.

    • Hi Suman no issues .. you can upgrade to premium… However with most of the processing for the calendar done.. you should get a response in normal processing with in 2 months after providing documentation.. Why waste the money unless your employer is willing to spend it……if i were you have waited for 6 months already 2 months wont make a difference….either ways if your petiton is bound it get approved … it will whether it is premium or normal.. so suggest to wait and enjoy the journey… Some times the fruit that you spent a lot of effort in plucking from the tree tastes sweeter 🙂

  10. Hi Raghu, my h1 got approved in 10 th oct & I hv started my new project from oct 19 th. My h1 approved with company abc, but now I am working with xyz company. My questions is:
    1. can I apply h4 petition for my wife and child before I received my first payslip?
    2. Also Can I apply for them before my h1b amendment?
    3. Is there any chance to get rejected if I apply h4 with my previous company’s (abc) payslip?

    • Hi Omi,

      Congratulations….Hope you are liking the new phase of your life…I am assuming that you are already in the US and when you say you changed employer.. i am assuming you applied for H1B transfer because amendments are only filed for the existing employer for change in project / location of work etc.,
      I am assuming your dependents are not in USA . Is that right?

      So with those assumptions here is what i will do… different people can have different ideas but i am a little risk averse…

      1. Upgrade your H1B transfer to premium … you will get your response in 15 days

      2. In the mean you would have got your payslip

      3. With rest of the documentation send it for H4…

      In my opinion…Its better to be cautious and get the right result than rush…. A month to two of delay is fine when you have a number of years with your partner in the new place of your life…Also since you are already in USA… a word of advice… if you / employer can afford premium…. do it … The whole visa system is so screwed and they are just introducing new processes which is causing massive delays in processing…… if money can give peace of mind.. I would literally burn the whole lot of green papers with washingtons face on it 🙂

I already do my all pepers ready, make my mind for premium and I do agree with your suggestions,coz I m not taking any risk of h4 application. U really have a big heart to help people.       Normally validity is determined based on a number of factors – your adjudicator, your documents especially your work related documents that show how long is the project for and finally and most importantly your luck…. i say luck because it determines the adjudicator who in some cases can be so stingy that when he is giving validity rather than giving the full h1b period he focuses on the validity dates on employer documentation….

      So to circumvent that – Make sure your documentation covers for the whole period of H1B time which i agree sometimes is not possible especially on client letters and project letters. So if things are in your control work on them and some like the validity are not under your control…. so you cant do anything…
      Nothing is permanent in life…..enjoy the time… if you get more.. enjoy even more… if you even more….and you are bored.. get the hell out of there 🙂

    • H1B2017,

      You can travel while it is pending. Employer can take care of RFE while you are outside US. You would need a valid visa to enter US. H-1 will be approved w/ consular processing. So to move to H-1, you would either have to enter on stamped H-1 visa or apply for COS to H-1.

    • You can travel outside of USA. But if ur H1b is approved with COS, then u will have to stamp and re-enter US. or come on dependent visa and do COS to H1b which will involve same amount of money which is need for new H1b.

        • It depends on ur employer how he has filed it. If it is COS you would get new I94 with ur approved I797 copy.

          It should not create a problem. but still get a advice from attorney.

      there is no problem to convert to PP while responding to RFE.
      Normally RFE gets actioned with in 60days and so if you can hold off – you can save around $1200… good luck fren

    • Nothing to worry – Work with your employer and attorney closely and you should be able to resolve it. You can be glad that they have give you an opportunity to respond with documents …So they must have seen some credit in your app… Good luck buddy!

  16. One of my colleagues got a reject notice today after RFE response submitted on Sept 7th. Series starts with WAC146. RFE was regarding employee-emploer relationship and client letter. He submitted both the docs. Could anyone please publish the number of rejections in each series?

      • many consultancies do submit fake client letter and docs. It is just try and error. If it gets approved, they will on board candidate and start marketing for other contractor jobs.

          • If it is genuine documents, the attorney can re-open with all strong supporting docs. What is rejection reason ? Another reason of rejection would be if your name is matching with their blacklisted name database.

    • Nothing is bad my fren.. there are worse things in life like death cheating dishonesty etc.,
      This is just an opportunity in life which wont probably matter to you in 2years time if things didnt work out…
      Coming to your question ..RFE is not bad. They must have seen some credit in your app and thats why they have give you am opportunity to provide more documentation to satisfy their quesions rather than rejecting straight away… So work closely with your attorney / employer to understand the RFE requirements and provide all documentation… and soon you will be in the country flying the flag of 50 stars.. good luck mate!!

    Still my status is showing case was transferred to other office on 05/20/2016 for series EAC161495***.

    Please suggest me, what could be the final SLA for this series and its regular.

    • There is no SLA in regular processing. You might get it in one month as overall received status is reduced much now.

      Mine took 2.5 months to get approval.

    • Normally around 2 months.. By the way if you have a great opportunity you can not miss and wait.. then you can upgrade to PP by asking your employer to pay around $1200 and upgrade to PP…so it involves money and so your must be willing to do it. In that case.. you will have a response in 15 days.. good luck fren… keep the hopes alive and the fires burning

          For inhouse project
          – Market research done by the company for the product
          – Revenue projections
          – Any pilot customer letters
          – Project / Product description
          – Your role
          – Statements showing investment put in by your company on the product

          Also if possible carry the companies financial and tax statements to prove your company has got sufficient funds to fund this project.

    My visa was approved last friday ( Hyd consulate) and received passport on 19th Oct.

      Attended Visa interview on last friday at Hyd consulate.

      My one is In-house project and does not have client letter.

      My employer provided letter (Pdf doc) saying list of in-house projects handling and mentioned that we can t provide any individual client ltter and will be working at employer location only supporting one or more projects.

      Employer one MSA (master service agree ment) signed in 2012 and workorder.

      I was worried if VO asks about the project and client because As per my employer I am not working for any project.

      First question it self from VO is what is your client and I replied that I am not working for any client and full time resource to my employer.

      Then Vo asked simple Questiond about salary and Education Qualification and marrage and approved my Visa.

      hope it helps some one who are going Visa stamping.

    My h1 has been approved on September 1st but till now I haven’t recieved I797B from USCIS.
    Please can anyone help me what might be reason and why?? Or is it me or still anyone like me??

    • Hi @Gajula,

      Usually we will receive the approval notice I797B with in 10 to 15 days. My case got approved on Oct 6th its direct approval and I have received approval notice with in 5 days Oct 11th. Please check with your petitioner about your approval notice its already too late.

    My H1-B got picked this year. my employer sent me the reference number ( Whats up messages : EAC***) on May’16. I was asking send me the confirmation number (notice of action – Lottery Number ) till today he is not shared that number.

    Around July this reference number EAC** got approved.

    After waiting couple of months he was keep on saying that he haven’t received the I797-B from USCIS.
    Around September 2nd week they inquired customer care center and provided the reference number with me. With in next 2 days they have closed the inquired and status has been changed to completed. Again i started asking employer about my I797-B. Again same answer. Not received…

    Last week he was saying its mistake from my side instead of WAC*** wrongly typed EAC*** sorry for that. Just on word.

    I said at least now please share the ” right number ( copy received from USCIS) ” – Since 1 week i am following-up but he is not responding my mails.

    What to do – Is there any way I can find-out. Please help!

    • I suspect your employer is playing games…As soon as your petition gets picked in your lottery.. uscis sends the receipt no on an I797C form… Request for that document and you can check for the status yourself online…
      Worst case -if he is still wagging his tail.. you have these options
      1. Report and shame the company on online forums by leaving review
      2. Report to USCIS if he has collected money from you
      3. If the company or the directors of the company have any roots in your country.. file a police complaint for cheating and make sure you get your money back..

      Evil should be fought and defeated.

    My H1 got approved for FYI 2015-2016 and now my employer has filed amendment petition which is yet to be approved. Can I still attend visa interview with amendment receipt?

    I have got H1B approval and my visa interview is on november. I have worked in

    Company A – Have proof
    Company B for few months – no proof other than Paystubs
    Company C – present employer
    Company D – offered H1B.

    While filling DS – 160, I did not mention Company B’s details. But I have mentioned
    Company A – previous employer
    Company C – current employer.

    Will there be any problem for not mentioning Company B’s details?
    Please provide your valuable inputs.

    • Create a new DS-160 and add the details properly , you should mention all the required details.

      Ideally DS-160 plays a vital role over your Stamping Interview. So make Sure you dont miss anything which is important. This would be a Suggestion from my side.

  29. Hi Surabh,

    As per my employer request for my RFE response, I submitted Organization chart and Position description. In both of the documents I given my role as “Application Developer”. But as per my LCA it is showing as “Application Programmer”.

    Could you please let me know if this will be an issue??

      I dont think this would be problem , because roles would say you will be developing some application.

      Last 2 days around 140 caae stauses were changed!!!

    I recieved RFE on my case on Sept2. They have asked to submit offer letter along with other few documents
    My Question is
    I was employed for Company A and have the offer letter of Company A with me.
    Company B acquired Company A and later Company C had acquired Company B
    So I have applied my H1B through Company C now
    Is it fine if i submit the offer letter of Company A
    is it required to get any further supporting documents that all the 3 companies have merged and one and that all three are the same now?

  32. Finally my case was approved on 14-Oct-2016 NonAD/RP/ EAC16143*****
    Now preparing for next step – VISA STAMPING
    1>For Interview purpose can I carry scan copy of approval notice (I129 & 797)
    2>I had work for Company A for 11yrs and resign six months back. My H1B is from US based Company X. Do I need experience certificate from Company A with all projects details mention?
