When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. If someone claims that, it is pure fraud and they are trying to trick you, we are not responsible for that. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.   • April 22nd, 2016 : (Official Update) USCIS Updated that they will start premium processing from May 12th, instead of May 16th.

  • April 12th, 2016 – 11:50 AM CST ( Unofficial Update ) : It is reported on blog by attorney ( immigrationgirl ) that they have received about 40 email receipts of Premium Processing.     I’ve valid b1/b2 visa valid till 2024 and I’m panning to visit us , in the meantime If I transfer my H1 there in US will that be possible or I’ve to come back to India for that ?

    Please suggest me.

    • H1B stamping will be done only in India. You can apply COS and stay there, but sometime come to India and get it stamped. But that will be a bad idea. Coz’ they will know that you travelled on visit and started working there. So not a good idea.

      You say transfer H-1, so I assume you already have an approved petition.

      So it is possible for a new employer to file cap-exempt H-1 petition + COS while you are inside US on B-1/2. If this is done within 30-60 days of entry to US on B-1/2, then USCIS may issue RFE asking to clarify your intent.

        My New Employer is ready to transfer h1 once I’ll be there i.e after 30 days of B1/2 .

        But, here I confuse if I go there and do the same then again I need to come India for stamping initially which I don’t want to come immediately after H1b transfer for stamping purpose , I need some time for that cause of financials.

        Would that be possible ? If yes for how long?

          If your H-1 is filed w/ COS and the same is approved, then there is no need for immediate stamping. You can start working on H-1 from COS effective date. Next time when you travel outside US, you will have to get the H-1 visa stamped.

  4. Don’t take it personally, but man people like you are at the fault who are ready to pay people like that dude. You are not supposed to pay for the H1-B, IT IS ILLEGAL. if someone asks for money for H1 the red flags should pop-up in your mind. stay away. I know you want to make your career and make your life better. but Are you that desperate to commit a fraud/crime ? If you pay for this, you will loose your money in one way or other, even if you get picked up in the lottery and the application is approved, you will not get VISA from consulate.

  5. When you paid Visa processing fees to him, were you aware that it is not legal? You were aware that Company only should pay all the Visa, Attorney, Travel (Self and dependent) expenses?

    If Yes then I AM SO HAPPY that you lost this huge amount around 2.5 Lacs.

      Today I saw that my status changed to RFE.
      My case number is: EAC1614950***

      Please any one help me to clarify my doubts:
      1) My qualification is: M.Sc (Organic chemistry) and I did one year Deploma in computers in private institute.
      But working on SAP from 7+ years on wards (now 8+ years) on software side.

      My doubt is: Is it impact for H1B. Can any one help me on this. I asked this question several times but no one helped me. Please clarify me.

          I hope before apply for H1B , Consultancy people should do the evaluation/valuation of studies and experience right.

          My qualification is: M.Sc (organic Chemistry) and B.Sc (Maths, Physics,Chemistry)
          Work experiece is: 8.9 years on Checmical experience and
          : 8+ years on Software side (SAP: HANA, BASIS, Security).

          Note: CAN USCIS will consider my qualification is 4 year equalent to US degree and having 8 years of experice.

          Please clarify me.

        As Sai mentioned, check w/ employer is education evaluation was done and submitted. This may be a valid question only if RFE is related to your qualifications. If the RFE is for something else, then this discussion becomes moot.

        I had the same issue. I wanted for December but i could see only February and i scheduled whatever was available. But you know what, as per my experience this site gets refreshed around 9.30 AM to 10 AM IST for those who might have cancelled their dates. I kept my eye on this since last 4-5 days and finally yesterday i got a date of January mid. Keep your eye on it. It may work

    • Do not trust on this. I made the same mistake and initiated my process late based on this information. This information is not accurate.

      Actually when you will go to the actual site to take an appointment, you will hardly get to see any date available for any of the centers. Dates are not available until end of January 2017.

    I’ve been following this forum from the past 6 months and it is very hlepful for H1B related suggestions.
    I’ve applied H1B for client X, but got an RFE for client Y. When i checked with my company they told that it is mistake from USCIS end and will touch base with them to correct/look into it.
    Is anyone heard this kind of issues before from USCIS? Can we request USCIS to look into the case again? What are the available options now?

    Currently i work in a UK project. My H1B was raised and not its in the Case was received state since April 11.

    i have heard that there are future expected requirements that are considered while applying for candidates like me.

    So in that case , is it mandatory that it goes into RFE ? Or
    Can I get lucky enough to get the approval directly ?

    Does working in a non US project affect chances of approval ?

      Delay doesn’t mean there would be RFE for sure. It can still get approved directly. Your current project doesn’t impact the outcome. What your job/project on H-1 would be is the concern.

    My H1b petition got approved. I am planning to attend for the stamping alone first and if it is approved , then I want to send my wife and kids for H4 stamping .

    Please let me know, If me and my dependents attend the interview together, will it improve the chance of approving visa.

    What are pros and cons of attending together and separately.

    • USCIS site is suggesting to go for H1 and H4 together.

      If H4 is alone and they ask questions which your wife may not be able to answer then it will be difficult.
      I have seen some of the experience, they ask company name of the H1, Salary of the H1 and other H1 related things to H4

    • H1H4Doubt,

      If you are working for a reputed employer, then I would suggest everyone to appear together. It doesn’t improve or deteriorate chances of approval, but gets everything done in one go.

      The downside is that if your visa is issued 221g and/or eventually denied, then the same applies to other dependents. So its loss of visa stamping fee for entire family. Had you appeared separately, then only your visa fees is lost and not family’s. Should not be a concern if the employer pays/refunds visa stamping fees.

    This forum has been really great and giving hope to the H1b aspirants.
    This was my 3rd attempt in the race.
    Here’s a brief walk through of my race..
    Completed M.S. from a reputed college in the US with a 4.0 GPA. Worked as a full time employee(not a consultant) for 3 years(CPT/OPT).
    Year 2014 – Petition not picked up in the lottery.
    Year 2015 (last attempt while in US) – Petition picked in lottery from the secondary employer whom I kept as a back up, but not approved. Had to leave US. Felt terrible. Came back to India last October.. Many wonderful life changing events happened, got a great job with a package so high that I didn’t expect in Bangalore.
    Year 2016(my Indian employer applies for H1b), H1b picked in the lottery and approved after a long long wait a couple of days back.
    What a journey it has been with H1b.. !!!
    So what I learnt in this journey is — whatever happens is for the good.. never weigh in too much on anything in life.

    • Congrats bud. My case is slightly similar, though not as fairytale as yours (pun intended), but I have a couple Qs for you.

      You said you came back last October, which would mean your 365 days would be over sometime in next month, before you can go back. From what I understand, that 365 day rule would be applicable if you previously had H1, came back to India, and then applied for a fresh H1.

      1. But since you were never on H1, does the 365 day rule apply to your case as well?

      2. Do you know what was the start date your employer put on the Labor? Was it the end of the 365 day period, or was it simply 1st Oct?

    • Same thing happened to me too dude. but my Company is such a great one that they let me continue to work from home in India as a contractor on paper.
      They applied for me in 2014, and 2015 both the time it didn’t picked in the lottery. I felt very bad after living in the US for over 7 and half years. I literally grew up in the US in my adult life.
      This is was my 3rd time this year 2016 with the same employer, and the application for picked up in the lottery. My only bad luck was that I did BS in US so no matter, I fall under the non-ADV category. Now Just waiting for the result. My degree is with the same branch that my job is and the company is a non consultancy, so USCIS has not reason for assigning an RFE.
      Now I am planning to continue from where I left off after living in india for 2 years in march or april since no interview slots available.

    Thanks for the great information on your blog. Can you please guide me on following queries.My H1b got approved last week and have received the email of the approval. Waiting for the hard copy

    1) Firstly wanted to know if I can take my wife & kid for H4 stamping with me along with the supporting documents. Or is there any wait time or approval process which have to be initiated for the H4.

    Are my documents and the dependents personal documents sufficient to be carried with us or are there any documents to be taken from the employer and/or his attorney for my dependents.

    2) Since the wait time for visa stamping is more in the consulate mentioned in my approval notice, I wanted to go for stamping to another consulate with lesser wait time. Should my employer/their attorney get some amendment and send to me for this or I can do something about it.

      1. The dependents can appear for stamping with you. Just complete their DS-160 forms, pay the fees and add them to your interview appointment.

      2. You can appear for stamping at any consulate and not just the one mentioned in your approval notice. No additional step required here.

    Please provide a detailed narrative explanation of the complex and advanced aspects of the position, including the degree of knowledge required for the role:

    JOHN SMITH has an XXXXX degree. Please explain how this degree qualifies a candidate for the SAP X MODULE Consultant position. Which types of classes in curriculum prepare a candidate for the role? What specific duties or functions would JOHN SMITH be unable to perform if he had a degree in another subject instead of XXXXX degree?

    • The start date is Oct 1st for applicants whose cases are approved before Oct 1st.
      For applicants whose cases are approved after Oct 1st, the start date is the next day from the date of approval.

      Process is no different from any other PP upgrade. Form I-907 needs to be completed by the employer.

    I got my h1b selected in 2015 lottery and received approval in December first week. Went to Visa stamping in last week of April and it was successful. In October i am planning to travel to my employer location on in house product development project and it’s same project which i showed in initial filing, stamping. I want to ask here, what kind of questions i can expect at port of entry. my poe wud be Dallas and any experiences will be appreciated. Or heard recently anything suce as deportation to h1b candidates etc like that. Any kind of information is helpful since i do not want to take any risk. I ahve the full project documentation and LCA remains the same through out the process.

    Earlier i have h1b in 2009 and in 2010 i travelled there and worked for 1 year and returned for restamping(since i got vapproval for only 1 year, and came india on personal exigency) and received 221g and later refused. In 2013 i went for B1 and stamped and travlled usa for 1 month in 2014. This is just for information to analyse and reply.

    My petition is selected in Lottery WAC1614252*** since 11April filed through Employer B.
    My current employer A want me to travel on Business VISA in OCT {I still have to apply for B1}.
    Will it cause any issue on H1B outcome as new B1 application will be from different Employer. Shall I really file for B1? or wait till I get H1B outcome.

  23. the processing rate in EAC is around 400 application per day. That means the pending 13240 petitions will get approved in 33 working days( by Nov’16 end )

    I have been a mute spectator of this website. Just to give other readers on what my experience of the H1B was.
    I’m a Civil Engineer and did my Masters from the US (non-stem course). Got hired by a US based construction company and didn’t get thru the lottery the first year. Being a non-stem masters course, I had only one year of grace period on my F1 OPT after my graduation. Decided not to go thru any illegal route and returned.

    Really grateful to the company as they decided to retain me and sent me to a subsidiary office in India meanwhile they applied for H1B the second time. At this time, I had no hopes as the number of applicants were increasing and no short. Anyway, long story short –
    H1B petition received Notice – April 15th, 2016 (regular processing- WAC16137 series)
    H1B Approval Notice – September 07, 2016 (Like many here, I have been seeing “Case received” status for many months and even discussed with my company immigration lawyer (in the first week of sept) to convert the petition to premium processing as the project in the US wants me to join the team by October. When almost the paper work for premium processing was complete and due sending to USCIS, I got the status update saying “Case Approved”. )

    Now, the game of visa stamping was in store. As you all know, the waiting times for most of the US consulates in India are upto 3 to 4 months. Also, I had Chennai listed on my H1B petition. I am a Saudi born Indian citizen and I still have residence permit in Saudi. Spoke to the lawyer if I could stamp from any one of the US consulates in Saudi and confirmed it is okay to shift the consulates unless the DS-160 is submitted to the consulate you are planning to go to. The waiting times in Saudi Arabia is just 1 day or 2.

    Visa interview experience :

    Interview Date: September 20th, 2016
    Consulate: Jeddah, Saudi Arabia
    Appointment time: 9:00 am
    Arrival time: 8:45 am

    The below procedures might vary per the consulate,

    1. First counter to ten-print the figure prints and register to the system (data collection)
    2. Second counter was to verify your finger print.
    3. Interview Counter,
    VO: Good Morning, passport.
    ME: Good Morning
    VO: Why are you traveling?
    ME: Traveling for employment in the US
    VO: At this time, he was already confused when I directly said I’m going for an employment (Apparently, on his system it showed up saying I applied for B1/B2 visa )
    VO: It says B1/B2 on the system. With what visa will you be going for employment?
    ME: I said H1B.
    VO: It says B1/B2 on the system.
    ME: I handed over the appointment and DS-160 confirmation pages along with I-797B H1B approval notice. (In my mind – OHH no I’ll have to come again because the system says so)
    VO: Called his technical assistant to change the details on the system.
    VO: You went to XXX (My Masters University)
    ME: Yes
    VO: Started typing some info and looked thru my passport. Asked you don’t go to XXX (university) anymore right? you graduated?
    ME: Yes Sir. Did my Masters in XX (degree) and graduated.
    VO: He took a stamp and cancelled my previous visa stamp which was already on my passport.
    VO: You’ll be working for the same company as listed as the Petitioner, correct?
    ME: Yes that’s correct.
    VO: You’re visa will be ready in two days.

    I just thought I would share my experience, for those who lost hopes thru H1B lottery, H1B approval wait. Trust me I was taking one step at a time and been calming myself down at every single junctions (even when I had to leave US, I knew something different or better is there) Don’t close your mind thinking this is it. There is a lot to explore about ourselves. Now, again I have the Port of Entry left (I believe it would go smooth. But, again if it doesn’t no issues 🙂 Something better will be there.

    Mine was filed in the first week of June with HNSC (H1B not subjected to cap) from India.

    My petition is picked in lottery with series WAC1614551XXX . I am getting following error from the USCIS tracker.

    Validation Error(s)
    You must correct the following error(s) before proceeding:

    My Case Status does not recognize the receipt number entered. Please check your receipt number and try again. If you need further assistance, please call the National Customer Service Center at 1-800-375-5283.

    My employer says not received any RFE/Approvals/etc status.

    I would like to know Is this normal , until they update it ? or something wrong with my petition.

    Any time frame , when it going to be updated?

    Got my approval 15 days back EAC16148XXXXX series. Just got the email from the Global mobility team.. Another waiting game started….

    “Dear Associate,

    This is for your kind information. Since there are no interview slots available for any of the US consulates across India, we are not able to schedule your appointment.

    Once the slots are opened, respective case manager will schedule the appointment based on availability and share the details through visa stamping app.

    Following up on the same with the case manager is not required. Your patience and understanding on the same will be highly appreciated.

      I am on H4 visa in US currently and my H1b Petition was filed in my home country in April 2016 and this got approved on Sep 17 2016,and i dont know what step i should take inorder to set my career.

      Having said that my H1B petition is Approved (USCIS status says “Case was Approved” and we will mail you the details)

      1. can we change from company x to company y here in US and try for a job? or
      2. Do we need to home country and change this as company X is not having any openings at currently in US as I dont see any opening coming for almost a year now?
      3. What if company X cancels my Petition? will i be still able for cap exempt any new new employer can file a new petition for me and I can still go ahead to US?
      4. When we say H1B Petition is Approved? does that mean I797 is approved?

      Please suggest what should be the best option for me, if above queries are not as per what i think?

    One my friend has upgraded from Regular process to Premium Process on April 21st but still its not updated anything on his case. Its showing “Request For Premium Processing Services Was Received”.
    On April 21, 2016, we received your request for premium-processing of your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WAC1614250+++, and mailed you a receipt notice. Your premium-processing receipt notice contains contact information for direct inquiries on your case. Please follow the instructions in the notice. If you move, contact the premium-processing unit directly to update your address.
    @Admin or any one please let us know why its not updated still now is there any security check has to receive by USICIS. If yes is it required for employee or employer security check clearance.

      If it was upgraded to PP on April 21 and no status update happened thereafter, why didn’t the employer/attorney followed-up with USCIS until now? They should immediately contact USCIS as this is beyond SLA time of 15 calendar days.

    After 5 months of waiting my status got changed to “Notice Explaining USCIS’ Actions Was Mailed”. Can anyone please explain, what does this status means is it similar to RFE or is this the end of the game for this year?

      I also got the same status and my employer told that USCIS have asked for few additional employer documents.

      I believe you are from Divensi and I also applied through them.

      • I think all Divensi got the same updates. This seems very fishy and seems it is almost near to rejection. Because I see this status for very few.

      • Did you ask what document was missing and why it was not prepared earlier. And if due to this reason they reject wh would be responsible. I am pretty sure it is some document which they would never share with USCIS (Some tax related or pay related stuff) and all such cases would be rejected finally.

      Can you copy paste the complete status message. Probably the meaning is same for both messages. The petition is PP and has received RFE for which docs have been emailed and mailed.

  32. Finally almost 6 months of wait is over. I got my approval on today the 21st of Sept. I got RFE 10 days back and submitted documents and switched to premium processing last Friday

        I did not get any information from employer and they are waiting for the mail. But in some forum I found it is related to all petitions where employer show that they aregoing to hire for internal position but do not have document to share from where they would pay for the employee.
        ADmin please provide some insight.
