When will the H1B visa 2017 season start ? Date ?
Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016. The H1B Visa 2016 season started on April 1st of 2015. Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year. As of now, below are the H1B cap number for fiscal year 2017. The below numbers are confirmed in press release by USCIS on Mar 16, 2016.
- Regular H1B Quota : 65,000
- H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
- Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.
There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000. No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

- F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa. Unlike, if you are coming from outside US, it can be tricky. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA. Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. Also, one key change is that, there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ?
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.
- H1B Cap to be increased from 65,000 to 110,000 per year. Also have provisions to have it up to 180,000 in case of extreme demand.
- Advanced degree from US cap quota to increase from 20,000 to 25,000
- The Filing fee for H1B could go up to 10,000 USD ( Part of this came up as the fee increase in Omnibus Bill )
- Additional H1B rules to avoid H1B Visa fraud by employers
- Mandatory LCA posting for 30 days before it is certified.
The current status on all of the above are basically “No updates”, there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.
What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS. It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016. But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th. USCIS may process the petitions early as well, but officially their clock starts on that day.

Do I have to be on paycheck from 1st Oct or it is okay to start getting paid later than oct 1 once i have a client letter and am placed in some company on contract position. If the later is valid, can I leave the country and come back once I am placed with a stamped visanon passport. Kindly suggest.

If COS is approved, then you are on H-1 from Oct 1 and need to get paid from that date irrespective of whether you are on bench or not.

I am in US and not will start working with COS effective date without going for stamping. Since yours is COS, you can also start working without getting the visa stamped with updated i94 and H1 status. The only thing is one should be on payroll once the status is changed to H1.

If you want to avail cap-exemptness in future, then stay w/ the employer until its approval. Ask the attorney about the RFE reason. Maybe that will give you an idea if this is an RFE which can be resolved or not. If not, then you can accelerate your plan to leave them.

My wife is working here in US with L2-EAD and her employer processed her H1b, the current status is” Case transferred….”, waiting for approval!..Now I have to go back to India since my project is ending up by Sep end, does she need to travel back to India or she can still stay here? Please advise..
As long as L2 EAD is valid, your wife can work. But it is better you must be in US till ur wife’s h1 is approved. Because it may end up in RFE asking to prove you have valid principle applicant( L1) since it is L2 to H1 COS and to submit your L1’s payslips. But that is rare case.
You can upgrade to PP so that you will get an update soon.

Unfortunately with your L1 ending, she will have to travel with you when you to India. Check with your employer if your duration can be extended until her approval is received. (Most of the times if it is internal company transfer they do!). Leaving US with H1B application might have negative effect – consult immigration attorney.
Since you have time till Sept end best option will be to go for premium processing.
What kind of negative effect you are referring to ? I am also in L1B my 5 years stay would be expiring in Oct and I am moving back in Sept end. I applied through another consultancy and was picked up in the lottery but I am still waiting for the approval. I know only thing is that you would need to attend Visa Stamping interview back in India other than that everything is similar.

You are actually right. when I asked my company they said the same, the waiting time for corporates are available for chennai from Feb 1st week only, for other locations it is available from January. I work in a big MNC. So I believe what they told must be true.

Ideally there is no specific documents that you have to have during the interview (passport and 797 is a must). The VO may not ask for anything at all. However, its always advisable to carry all docs related to your H1.
On the other hand, SOW is a confidential doc, which employers ideally dont share with the employee. If the VO has any doubts abt your case, they may ask you if you have the doc, and if you do not have it with you, they may or may not issue a 221g.

Same case here my friend. Please tell me if anything happened in your case.
Your H1B application is employer specific. You cannot take the same petition over to another employer.
But, if your employer (who filed your H1), can find another client/project for you with a new contract, then they can file a LCA amendment and respond to the RFE.

What a great confidence you have! Companies like Wipro and TCS doesn’t share receipt number till stamping as a part of their policy! Better learn things before commenting out loud

Some companies will not share receipt no till stamping. It is their policy.
I am in a medical profession and I my case was also picked in the lottery. My employer upgraded it to premium processing 3 days ago
They are not sharing the receipt number. I even asked them for the receipt # during the time I was informed that my application was picked but they dont. There are really companies that are not sharing those information. But that doesn’t mean that it’s fake. I trust them them. I will let you know as soon as I received any updates within 15 business days.

There are lot of MNC not sharing case no as per policy till stampings.
Mine is one of them..i trust them and i got the result in good way.

Some companies will not share receipt number.. Dont waste your time for finding such companies here. do you work and go to bed for sleeping.

My H1B 2017 petition has been approved .I was in project A during visa initiation .Now I am in project B. After approval I have gone for a H1B amendment for project B. My query is which receipt number to enter in DS 160, the old one (mentioned in I797B approval receipt notice)or the receipt number which I would get after filling amendment(which is not yet approved).
Please ask this to your visa department. They will guide you which one has to be filled.
My petiton from Capg got approved on Aug 8th. No news or updates of hardcopy of approval yet. Anyone facing same?

Employer should receive the hard copy within 30 days. If not, they should follow-up w/ USCIS.

I am Employer 1 who raised the petition and which was approved , If in case i get a employer who is ready to offer me a position with them and if i want go with employer 2 ??
Question :
1.Will employer one has a chance to revoke ??
2.Will the petition needs to be approved again ??
3.I am working with Second Employer India Branch right now , will this causes issue with he adding amendment to the petition raised by employer 1??
4.Will there be a question from USCIS whether they question employer 2 asking why haven’t who have raised this petition??
5.If in case everything is OK , will employer 2 amendment needs to approved again which takes more time again??
6.Can i travel back to US and join Employer 2 Directly will this causes any issue??
7.Employer 1 Can legally go with this if in case i am joining employer 2 ??
Employer change needs new H1B petition cap exempt (as yours is approved) aka transfer.
You cannot work with Employer 2 with the H1B of Employer 1.

You need to apply H1B transfer to Empl2, no other way.

no timeline ,some petitions will take longer depending on the officer verifying that petition, by every year march is the deadline for uscis to update on any h1b petition, because by every year april new h1b cap starts.
it means 2016 h1b cap deadline is march 2017.
i am in same series 3rd time picked, i went all the ups and downs in this h1b process.
keep your mind set to february – march 2017.

We have nothing to do from our end, except paying money. The day I paid money, my employer sent it to USCIS. After 3 days USCIS received and on 5th day my case was upgraded to premium.
How much money spent for changing to Premium

Thank you for all your guidance through out the process. I have a query if you can please help me in that i would be very thankful. My wife would be travelling with me on H4 dependent visa by December. She is completing her PHD on January and has already applied for PDF in US. She is expecting her scholarship to be approved by January end and she has to join the university by March. So to convert her H4 to J1 visa does she need to travel back to India or she can get the stuff done in US itself. Thanks in advance.
Yes she needs to travel back to India for getting it stamped.
She can apply for change of status (COS) from US.
Once approved she’ll be on J1 visa, first check on USCIS website for COS approval time. In future when you travel outside US she will have to get her J1 visa stamped from US Embassy or consulate.
Btw if its just a case of 3 months (Dec-Mar), entering US in Mar on J1 would be advisable.

Indian day time or night time ( status)
Can anyone please let me know, usually at what time period we get to know if status has changed, is in india day time, or need to wait at night like it was in lottery.

All the people whom i know including myself, we all got the status during Indian day time (between 10:00 AM to 3:00 PM IST). Also please install some app and add your case and it will automatically update you the moment it gets approved.

It also updates in the night.. One of my friend got an update on the USCIS case site after midnight & received mail at 3:30 am..
