When will the H1B visa 2017 season start ? Date ?

Short answer April 1st 2016. Typically, USCIS will start to accept petitions for the next fiscal year starting from April 1st of the previous fiscal year. USCIS fiscal year is from October 1st to September 30th. So, for H1B quota of fiscal year 2017, which starts from October 1st, 2017, USCIS would typically accept applications from April 1st, 2016.  The H1B Visa 2016 season started on April 1st of 2015.  Also, in the H1B Rejected Notices of 2016, USCIS mentioned that, the non-selected candidates can file H1B petitions for FY 2017 on or after April 1st, 2016.

What is H1B 2017 Cap ? What are the H1B 2017 Quota numbers ? Regular vs Masters ?
If you new to H1B, I suggest you read All about H1B Visa Cap- Regular vs Masters. In simple terms H1B cap is a congressional mandated maximum number of petitions that USCIS can accept in a year.  As of now, below are the H1B cap number for fiscal year 2017.  The below numbers are confirmed in press release by USCIS on Mar 16, 2016.

  • Regular H1B Quota : 65,000
  • H1B Master’s Degree Quota ( only US Master Degrees) : 20,000
  • Out of the above, a total of 6,800 is usually set aside for Singapore and Chile citizens as part of the free trade agreement between them.

There have been many discussions around change in H1B cap numbers by Obama administration since 2013. The planned proposal was to increase the regular quota cap to 110,000 and Masters quota to 25,000.  No changes for FY 2017, the above numbers of 65,000 and 20,000 are officially confirmed by USCIS in their press release.

What is H1B Visa 2017 Prediction? Will there be Lottery again for FY 2017

Update :  USCIS Updated on April 12th, 2016 that they have received over 236,000 petitions for FY 2017 quota and the lottery was completed on April 9th.

Looking at the past trend of H1B season in the past three years, we could very likely have lottery for FY 2017. Last year for FY 2016 quota, there were 233,000 applications. If H1B lottery, will there be any preference in lottery for Large companies ? Premium Processing 
Well, no preference for anyone, all are treated equally, including premium processing. There are many such misconceptions about lottery process, we have compiled a list of such myths and criteria, you should read Myths of H1B Lottery, Criteria

When to plan for H1B visa 2017 Application ? How soon ? What should be the strategy ?
It is never too late to start planning for your H1B 2017 season. If you plan to work in US on H1B visa in the next coming fiscal year, below are some suggestions based on your situation.

  • F1 Student in USA : If you are studying on F1 visa and about to graduate in next one year, you should seriously look at finding an internship or co-op at companies that can sponsor your H1B visa. You can search for H1B Sponsors in a particular area using our H1B Sponsors Search Tool and try to get an internship to work there on CPT or OPT after you graduate. This is a strategic move and will require sometime, so plan well.
  • Professional from outside USA : If you are a working professional outside US, planning to work in US on H1B, your best bet is to find Multinational companies that have major US presence and secure a job there, so that you can position internally for applying to H1B visa, when the season starts. This is a very strategic decision, you need to carefully assess your options, speak to the company if such options exist and then only choose it.
  • Other H4, L1 Visas : If you are on these visas, your best bet is to find companies just like I mentioned for F1 students that sponsor H1B visas and start interviewing and keeping the conversation going so that you can ask them to file H1B when the season starts.

How do I find a H1B Visa Sponsor – The most asked million dollar question ?
If you are student in the US, it is very straight forward, you find the list of H1B Sponsoring companies using the tool in an area as I mentioned above and get an internship in one of them so that they can sponsor your H1B visa.   Unlike, if you are coming from outside US, it can be tricky.  If you work for an Multinational company ( MNC), then they will have some internal process to pick the candidates and then process H1B visa for them…The other option that has been used and abused is the consulting companies route…Many a times, the H1B aspirants approach a body shop IT consulting company to file H1B for them and they apply for the same. It gets nasty with the body shop consulting companies.  The comments on this H1B Companies Reviews article are quite eye opening. I advise, you beware of the consulting companies and avoid fraud.  Also, WE as RedBus2US do NOT provide any guidance or assistance or sponsor anything. What is the H1B visa 2017 filing fee ? Is it same or any changes ?
It changed slightly this year with the Omnibus Bill passed in December 2015, that will increase the H1B filing fee by $4000 for FY 2017, until 2025 for certain companies that have over 50 employees and have more than 50% of their employees as H1B or L1 visa holders in USA.  Check USCIS Guidelines on H1B Fee increase. Depending on the size of the company, the H1B filing fee can vary anywhere from $1,600 USD to $7,400 USD + Attorney Fee. There are various fees components that make up this number range, for more details Read Summary of H1B Filing Fee 2017 – Who pays for What ? . Below is a high level summary. Also, one key change is that,  there was $2000 USD additional filing fee as per Public Law 111-230, this law expired on Sep 30, 2015 and that is not included anymore.

What about Comprehensive Immigration Reform(CIR) and Obama Executive Actions for H1B 2017 Quota Increase ? 
There has been many articles and discussions since 2013 around immigration reform by President Obama and changes around and some like below have been discussed in the last couple of years, nothing moved significantly.

  • H1B Cap to be increased from 65,000 to 110,000 per year.  Also have provisions to have it up to 180,000 in case of extreme demand.
  • Advanced degree from US cap quota to increase from 20,000 to 25,000
  • The Filing fee for H1B could go up to 10,000 USD  ( Part of this came up as the fee increase in Omnibus Bill )
  • Additional H1B rules to avoid H1B Visa fraud by employers
  • Mandatory LCA posting for 30 days before it is certified.

The current status on all of the above are basically “No updates”,  there are no set deadlines for any of them and none of these are happening for FY 2017. You may read Summary of CIR Changes to H1B . Officially as per press release on March 16, 2016, the H1B cap is confirmed to be 65,000 for regular and 20,000 for masters…hence, no changes.

What is LCA for H1B Visa ? Processing times ?
LCA is a form that has to be filed with US Dept of Labor and get it certified before filing H1B petition with USCIS. It has to be sent along with H1B Package to USCIS.  It has all the relevant information about the job position like wage, location, title, etc. It takes about 7 working days for processing of the LCA by US Dept of Labor (DOL). H1B Visa 2017 Premium Processing Time :

USCIS Updated in their original press release on March 16, 2016 that the premium processing will begin no later than May 16, 2016.  But, on April 22nd, they updated that the premium processing for FY 2017 will begin on May 12th, 2016. What it means is that the official 15 calendar day SLA for premium processing petitions will be starting from 12th.  USCIS may process the petitions early as well, but officially their clock starts on that day.

  • July 8th, 2016 ( Official ) : USCIS released a press note today indicating that they have completed returning all the petitions that were not selected in the H1B lottery for FY 2017. Read More details here 
  • May 2nd, 2016 ( Official Update ) : USCIS updated that data entry is complete for selected petitions in lottery. if you were selected, you should receive receipt notices in 2 to three weeks.     I checked with a lot of immigration specialist but not getting any response.

    This is very sad and frustrating 🙁

  8. I understand how tense everyone is. I was tensed just like you last year and this year as well. I applied one genuine application AD/Regular last year – full time job (no consultancy). Few of my AD friends got picked up last year. I was not that lucky. My employer applied again this year AD/PP. I received the receipt from VT yesterday night. My lawyer emailed the receipt number to me. Again, if you think the receipt number should start with ’17’, you are mistaken. My receipt number starts with ’16’.

    I genuinely wish all fellow AD candidates with single/genuine application. I am telling you, you will get through lottery this year. All the very best!

  10. As reported by some reputed lawyers, people have started receiving receipts for their selected petitions. Few things to keep in mind:

    1. At the moment only those who applied in PP and made through lottery are being notified. The email notification is sent to employer/attorney, who can then share it w/ you.

    2. If you applied in PP and didn’t receive any email notification, it doesn’t mean that you didn’t get select. The above process will continue for few more days/weeks.

    3. If you applied in non-PP, then your employer/attorney should receive paper notification in next few weeks (probably once they are done w/ all selected PPs).

    4. When checking others/random receipt number online, know that not all receipt numbers will be FY-17 cap-subject cases.

    5. Only those cases that are selected in the lottery, will receive a receipt number. Others will receive a different reference number which will be mentioned in the rejection letters that their employers would receive.

    6. Lastly, as lot of people follow this anxiously DO NOT spread rumors and post about your cases only when you are sure about them. Let’s not do it for lulz.

  11. Guys, Lottery is done .. I spoke to my Attorney just now.. they informed that they started to receive the receipts for premium processing since yesterday night.

    Though I dint get mine as of now.. she told me she got couple of receipts for other candidates.

  12. I request you guys who are spreading not to spread the rumours regarding some serious stuff. Its good to have some fun as every one is bit tense but not this kind. This is a really good forum and very informative for all of us.

    Its our responsibility to keep it informative for all others.

    The guys who are mentioning the numbers WAC1613352527, WAC1613350981 these are the number of FY16 and the new numbers coming out from the lottery will be with WAC17XXXXXXXX & EAC17XXXXXXXX.

    The digit 133 in the above petition number is work start date (excluding weekends), so this is obviously for FY16 would be a transfer petition or other.

      My wife applied H1b last year, and her receipt number is EAC1514XXXX. So if WAC16xxxx or EAC16xxxx might be make sense. I don’t know about that, and I’m just want to clear a fact.
      Wish to hear more post regarding this.

    • You are wrong. I just received an email notification from my lawyer. The receipt number starts with ’16’. I am AD/PP second attempt single application. I wish all genuine applicants a good luck especially AD applicants.

      P.S. I am not joking. I understand how tense everyone is and I would never hurt anyone’ feelings through stupid and fake comments.

    • As per your link , year is the current year which is 2016 and not FY2017 so receipt numbers should be WAC16xxx or EAC16xx .

      The two digits correspond to current year of the H1B filing. For year 2016, it would be 16. To clarify, this corresponds to the current year and NOT fiscal year of USCIS. For instance, if you have filed petition for FY 2017 quota, and it was filed in current year, which is 2016, it would be 16.

      If only ‘YOU’ read the blog link properly. It clearly says this year’s all Applications will bear the number 16. Also if you’re thinking the applications started from 133rd day, you’re wrong there as well. Check for the 131st day. You will find WAC1613150001.

      This was the first person who was counted against this year’s cap. So it can’t be a transfer/ COS case.

  13. Please dont spread rumors by saying you got selected with a fake number. Have patience , psst here is a tip, next time use lottery date in your fake email reciept email not the date USCIS said they will stop taking any more petitions.
    To all other of us, lets wait patiently and ignore people like them.

    • Well, even I’m one of those anxious H1B applicant trying my luck for the second time. So, neither would I wish to post some “fake” information just for fun sake nor argue on some statement you made.

      I did receive a call from my employer saying my application has been picked so I posted it here because this page has been a helpful source of information to me. This isn’t any fake news. Atleast I want to believe so !!!

  14. I got a call from my employer too saying my application was picked in the lottery and will be forwading me the receipt number shortly.

    He said that they started receiving receipts from vermont at 9PM EST and california service center from 12AM EST yesterday night.

  15. 04/12/2016: Indication of U.S. Master Degree H-1B Cap Selection Completed

    As we reported last week, the USCIS appears completion of computer random selection process right after 04/07/2016 for the U.S. Master degree cap cases. There are reports that employers started receiving email receipt notifications from the Service Centers beginning from yesterday, 04/11/2016, who filed the cases with the Premium Processing Requests. This is a good news for such employers in that they know now that their cases have been selected, even though their Premium Processing Services may remain suspended for an extended period of time. Congratulations to the employers with U.S. Master degree H-1B filings.
    Employers who filed U.S. Master degree cap H-1B petitions who fail to receive such email receipt notification should not be frustrated since they will have a second chance during the regular Bachelor degree and foregin Masger degree cap cases random selection process. It appears that this Bachelor degree cap random selection process is likely completed within this week and employers may start receiving email receipt notifications if they filed it with the Premium Processing Requests. EMPLOYERS MAY START CHECKING THEIR BANK ACOUNTS TO SEE WHETHER THEIR FILING FEE CHECKS HAVE BEEN CASHED BEGINNING FROM THE END OF THIS WEEK.

    • Receipt numbers generated in a way that have combination of fiscal year, number of days, etc. You can google it and randomly pick it.

  16. Status are being checked on USCIS site. You go to Tools / Check your case status online (I am not putting the link because moderator needs to authorize my post if I do so).

    However, I think these numbers are just receipt numbers, not results of lottery (people selected).

    I believe lottery will run yet and sorted people will be notified.

  18. The receipt numbers are constantly being generated and entered in the system.
    WAC1613352527 is the last number as of now.

    In some time WAC1613352528 will be updated as well.

    • Aah. I’m guessing lottery is in the process. The computer is selecting petition and creating receipt numbers and putting it in the system.

      There is speculation that this time receipt numbers are given to every single case.
      Lottery will be conducted in some time and then the numbers selected in the lottery will be notified again?

      Those are not lottery picked numbers. USCIS issued receipt numbers for all petitions(Just like ref number)After conducting lottery we should check with this number whether our file picked in lottery or not

      • No, you have this receipt number only when you are picked. Otherwise your package is returned to you without a receipt number.

    • This is the standard definition of receipt number. it does not mean that a said application is picked, Usually when USCIS conducts they announce that lottery is completed and they are sending the results to individuals. Please see below link for last year’s update.

      I have applied for last 2 years and have seen people getting results starting from April 15th till 1 week of June.

      The receipt number is a unique 13-character identifier that USCIS provides for each application or petition it receives. The agency uses it to identify and track its cases.

      The receipt number consists of three letters-for example, EAC, WAC, LIN, SRC, NBC, MSC or IOE-and 10 numbers. You can find it on notices of action USCIS has sent you.

  20. I think this time they are giving receipt number to every one. Otherwise, how they can generate receipt on April 5th itself. Check for this WAC1613350002.

    • No I think it just means the WAC1613350002 application was received on the 5th but picked “randomly” after the 001 application (which was received on the 11th).
      If you check a few more, you see (I think 006 or 007) says one is accepted and is being processed at CA center.
      Not sure if that really means lottery is underway? Thoughts anyone?

  21. I have heard that lottery takes 2-3 days and is not a one day event. And moreover if you checque is not encashed in these 2-3 days then you are not selected in the lottery. Is this true?

  22. I entered on https://egov.uscis.gov/casestatus/mycasestatus.do and put a lot of sequencial and random numbers based on WAC1613350XXX format.

    All numbers I put there brought something back. The only difference was in the type of form.

    I think it is just an information that the “package” was received and USCSI will do something, but it doesn’t mean that lottery was done or someone were just selected.

    I don’t want to kick your dreams, but it is what it looks like.

    Saying that They haven’t provided with tracking number as they promised is NOT criticizing the organization. I’m stating the facts here.

    This is the main advantage of many companies and they’re using us to wait for years. Since there is no transparency in the whole process, we have no choice left.

    As stated on april 1st 9.57 pm , the mail u received today is also an automated email ….and ur email doesnt have any information on the fedex number that they hav promised to be sending with the followup email which u guys got today , that clears prooves its jus a way to keep u calm …

      • CTS never provides any FedEx Tracking number.

        If at all it is providing means, this will be the 1st time.

        Also they dont need to lie that we are filing and then playing a game with you.

        CTS spends money on their employees very liberally & I see so many people jus coem to office to withdraw salary. CTS never takes any action

        • They promised to get back with the FedEx tracking number by 11th of April and today we received a generic email stating they confirmed the delivery status with FedEx. Hence the doubt.

            In my account I have never seen anyone with Avg 9 hours.

            What 9 hours, I see 7hrs average from many.

            We jus get Tru Time updates, no action.

    • Today most of us recieved email regarding fedex.They will update docket no in myvisa using which u can see at fedex site at which loc our case was sent.

    This is the 4th time I am waiting for the lottery results but to be honest lost the hope.. Since 2013 my employer is filling the H1 for me but not getting lucky enough to thru the lottery and this time also lost the hope from the day I saw in Time of India that total counts is around 250K so now lost all the hope.. Anyway all the best for those who are hopeful and god might have written something else for me and off course for you as well. so its fine.. Thanks

    • r u sure that your employer filed your petition every time? if you are in India and with any Indian MNC then they might be using lottery process as carrot to retain you.

        In a way are all these MNCs taking advantage of the secrecy maintained by the USCIS in the filing period to retain the employee like as u said ????

        Is there a way to crack this and escape with the carrot ???

      • @Insider, I have got my LCA no every time. Hence I can believe that they have filled every time. Many others who got the LCA no also got the Receipt no after selecting in lottery hence I don’t have any other option except to trust the employer… I am working with 3rd largest consulting organization so again will have to trust…

        • i don’t say all employers are cheating but they have started .. Is your LCA posted had multiple petitions and if so that can’t be trusted.. USCIS will send rejection lottery notice for each petition

    • Me too dissapointed with TOI 250K news..But it seems to be true as the lottery is not yet conducted… Let’s hope for the best…Nothing in our hand bro ….
