H1B Visa 2014 Quota Cap Reached – USCIS Official News Update

Well, folks, we have a breaking news update from USCIS saying that H1B Visa Cap for Fiscal year 2014 has been reached.  The human psychology has kicked in and many employers rushed to get their H1B petitions ahead of their schedule due to the press release by USCIS indicating that it expects more petitions. Here is a summary of the news release by USCIS on the cap completion for FY 2014.

News Summary by USCIS  on H1B 2014 Cap Completion :

  • USCIS has received enough number of H1B petitions for fiscal year 2014 under regular quota, which is 65,000 petitions.
  • USCIS also have received enough number of petitions for masters quota cap, which is 20,000.
  • USCIS will not accept any petitions for H1B Visa 2014 after today, which is April 5th, 2013.
  • USCIS will conduct lottery or Random computer selection to pick the cap subject petitions filed for FY 2014. The lottery system will be exactly like we described earlier in our blog. Read  H1B Visa 2014 Lottery Process – Step by Step.
    • USCIS will conduct lottery for Advanced quota petitions and pick 20,000 petitions from that pool
    • For all the masters quota petitions that are not selected in lottery will be placed into general quota pool
    • A lottery will be conducted on the combined pool of petitions to pick the 65,000 petitions that are eligible for the FY 2014.
  • USCIS is not providing an exact number to us today as they are still processing petitions received for FY 2014 that were received today.
  • USCIS will give us more detail update next week, stay tuned.

    I am waiting too MBA-PP-CSC. Also it seems my lawyer fragomen is not giving updates to anyone.
    The only reason I see USCIS hasnt revealed masters quota number is probably masters quota petitions are just over 20k or not significant number to be actually revealed. Also nothing really changed in 2010 as far as graduate enrollments are concerned. Ofcourse I am assuming that most petition will be filed by students who enrolled in 2010. If we assume 22k applications, if USCIS selects more than 20k applications, considering some rejections during processing, probability of selection is 96%+
    So just hope and pray for not ending up in 2-3% unfortunate graduate students.

    • I think you will get an e-mail only if your employer sent G1145 form along with other documents.

      It should be irrespective of regular or premium processing.

      • I honestly dont know.. my lawyer said it was for delivery on 4/1/2013. but in the email my laywer forward – the receipt # email says my file was received on 4/8/2013.. i guess that’s the date they started to process?

  10. I dont see much traffic here today, on stating they got emails today. Does that mean all PP selected had been already notified till yesterday, and those who didnt got email who applied through PP are not selected?

    Whatever the Quota is Masters/Regular/PP, the results of lottery must be known before April 15th.. Am I Right?
    The notification is thru email for PP and Post for Regular.. Is it?

  14. I applied in Premier Processing under Master Cap to Vermont USCIS Location but still did not get receipt number. Just worried, when will I get received receipt Number?

    • We are all in this together. I have read all the posts. We all have dreams and have stories to tell each other that have similarities. Each one of us will be devastated if we do not get to move or have to leave the US. I love this forum as I am comforted that strangers I do not know feel my same emotions, as I stare at the ceiling right now feeling alone with my thoughts. I have had H1’s before and had to move back to Canada. It is emotional to leave the US after 5 years of building a life. Now I hope to come back. Good luck everyone….

  16. I have filed in regular PP.Haven’t heard anything yet from my employer. I don’t know attorney details neither to which service center it is filed.Anyway to get that details?

        • R it will be in vermont Processing center Eastern application center you will get receipt starting with EAC is it is selected in lottery….
          here is one of receipt number from vermont service center EAC1313050902 and anyway its not mine i am still waiting from vermont PP master quota i tracked forward and backward and i found looks like approximately 1500-2000 receipt generated today from vermont service center….. from range EAC1313050902 to EAC1313052558 …… this just approximate

          • I found out, Vermont sent out 2142 receipt no.s in the last 2 days ( on 8th and 9th).
            Receipt no.s from EAC1313050416 to EAC1313052558.

            My petition was filed at California, Premium, Regular quota.My attorney said they have not received any mail yet. Extremely worried.

            If someone who received the acceptance mail from California Centre, posts the receipt no, starting with WAC; we can get the total count of receipt no.s that have been sent in 2 days from both the centres.

            My friend works in Walmart Labs in Bay area and he received the receipt today morning, that means they dispatched it on Monday itself.

            Tracking how many receipts are sent by each service center just by looking at the receipt numbers won’t be easy and not even close to accurate.

            I am also waiting for my result and each second is passed like hours…. I spoke to my lawyer today and he told me that they have started receiving receipts since Monday, but till now, no luck for me.

            by the way, do you know what is the deadline one can expect the receipts if they applied for “Masters Cap, PP”

          • No idea. The deadline for all PP is roughly 14th or may be 12th. I think California started sending out late. Mostly people started receiving from Tuesday morning.
            Good for your friend in Walmart Labs.
            Even my employer is in the bay area. The worst part is they applied PP for all candidates, all masters and PHDs in US, for all those recruited from the IITs and who got recruited from Google, Microsoft, Amazon in India and elsewhere. They got no receipt no.s yet. By end of Friday, they would know how many H1Bs will join them. How will such flourishing American start-ups grow if the lottery system continues every year?

            Lottery should have been done company wise.

            We are kind of scape goats for the next bill to get passed. Still good, if it gets passed and the quota increases from next year onwards. Moreover, they should not keep any quota for advanced degree holders, simply make it unlimited.

      • Same here. No reply yet. My employer said they have not received any mail for any of the cases filed under PP. Even they are worried.
        Attorney asked me to wait until 15th.

Relax guys .. there is nothing we can do but wait… it’s all destiny.. if we are supposed to get it, we will… otherwise h1b is not the end of the world.. if we are talented people enough we will do something better in life… all the best everyone… I am also waiting for the visa… but I am sure god has something better planned for me if I don’t get it.

      • Haha..if I don’t get it I will have to go back and start from scratch.. so there are mixed feelings…but what can I do.. I did my part .. rest is destiny.. if I am supposed to get it, I could be one out of million otherwise I am going to be one out of billion in india .. haha

Coz i moved here and started from scratch all over again.. probably one of the hardest things i have done.. I just hope i get it… Coz gng back is not even an option for me..

  18. Can someone please explain to me what is PP (Premium processing) while filing H1B ? I know premium processing makes H1B processing faster once it will get selected. But USCIS holds that till Apr 15th.
    Then how come people are saying they have received receipt number because they filed in PP ?
    How can they file in Premium if USCIS stopped that till 15th ?

    • i asked my lawyer the same question.
      they said the 15th is the date that uscis starts to process pp cases. all h1b package has to be arrived at uscis service center no later than the 5th include pp cases.
      in this case, pp case will have result by Apr 30th, reg case will take longer time to process.

        • Dude: There is no bill as of today. There is a gang of 8 congressmen who are negotiating. After that there is the senate and house for full discussion and voting…way too long to go. Plus policies are always planned for coming fiscal years not current one.

          Once again do not give yourself false hope. Plan according to available realistic options. that is all. Good luck to all.

    Me and my 3 friends received conformation email that my H1b petition is selected for lottery ( Attorney forwarded email). All of us masters quota and premium…… Just letting people know… attorney says don’t panic wait 1-2 weeks

  20. Below is my assumption for masters
    Suppose 40% of the applications are for pp = 8,000
    20% goto each of the two service centers = 4,000 x 2
    At each service centre,If there are 100 caseworkers working – that means 40 applications per case worker.
    Lets say for each application it takes 15 mins to enter the basic info into the system and that triggers an email notification ..it takes 10 hours at least for all the 4,000 applicants to receive an email.
    So I would say we should receive an email at least by EOD Thursday if not we’ll be receiving our rejected applications anyways by the end of this week.
    Not sure what I thought really make any sense. Lets be positive.

    • Yes, uscis employees are humans and not robots, give them some time, wait till friday. All Advanced cap and premium, wait till friday. In the meanwhile chill.

      The part that really sucks is…. if you get rejected it even takes longer to get a notification. I already have trouble with the last couple of days not knowing.
      I wish I spend the money on PP instead of the regular. Than at least I would know.

  21. finally had to resort to commenting here. Was tired reading all these bashing around among people as to who should get priority. Well here is my story undergrad – Anna univ – 3 yrs experience in a silicon valley giant in India, MBA – IIM Indore. Currently product manager in the same silicon valley giant. Never been to US of A before, my current team and work needs me to be there for a project this year.Those of you in this forum and in US claiming that you need a high priority cause you finished MS or MBA or whatever in US need to make a strong case as to why i am not equally qualified for this visa. Speak up!

    • Why don’t you go through L1? Isn’t that exactly what it’s for, intracompany transfer?
      Also, what will you do after this one project? Go back home?

    • Very well said. I know a friend applying who has 3 yrs post undergrad (IIT), and 3 yrs post MBA (IIM) experience! Isn’t that talent enough?

      The MS junta crying are unreasonable when the say they need preferential treatment just because they spent 30-40k $ for studying here!! Insane!

      • 30-40K $ sounds cheap ? Its profits for the companies, but bread and butter for MS people. Think about it! Our careers cannot or should not be defined by the companies who get H1Bs and do not make use of it till they get their ‘clients’.

      • You may be proud of your accomplishments coz u have been through Big Institution and Big Life..

        Ask MS/MBA People what struggle they go through when they come here no matter what they are in INDIA.
        How they have to start from Scratch .. be competitive in this way.. fight their way to find an employer who would support to file their H1.

        Simply not chanting about accomplishments and your career would make a voice. You have L1 to apply We have none..

        An Yes 30-40 seems easy for you .. but not for us .. coz thats just a tution fees we pay .. Theres more than that..!!

    • That is very simple. Any lottery based visa or green-card selection process has country caps. We all know this…

      And there should also be a thing called “First Come, First Serve” as in pretty-much any selection or application process… (I still don’t get why they keep applications open for 5 days even after caps has been reached to the limit)

      Finally, you are equally qualified for this visa (according to the regulations) so that you are here and waiting for your EAC nr.

      And my advice to you would be to calm down..

    • My point was not for H-1B or L-1 my point is the unnecessary bashing around, this presents a confusing picture to lawmakers and does not serve the purpose of putting forth a meaningful solution in effect.

    • i still see none of those people who were claiming to be more worthy of the visa make a case or defend their statements. Perhaps they all got the receipts and feel there is no more trolling to be done and have left like a wuss.

        You really think that a person who was educated in the U.S. on U.S. business practices and then gained some valuable work experience at a U.S. company, which is in dire need of their services, all the while building a life for themselves in the U.S. should be treated the same as a person from a company based out of India who applies for thousands of visas on a just-in-case basis only to MAYBE send some of them over to the U.S. on a short-term project basis?

        I completely understand that the desire to be in the U.S. may be the same for everybody but some of us have already lived here for several years and are trying to use the H1b as a path to permanent residency.

        • Like I spend 3.5 years here as an international student by working shitty jobs (anywhere paying cash).. And I was a Microsoft corporation employee before leaving my country(Turkey) 3 years ago.. I hope you will be able to see how much of a big sacrifice this was.. Getting a job after graduation was another roadblock.. finding the company to sponsor your visa was supposedly the last road-block..But now everything is all about luck…

          Btw. I also have long years of working experience as a professional.. But stories here are all different..

          “Yours” simply tried to clarify the difference of the situations in his above comment… If you don’t get it.. you’ll keep your job, right? but If foreign students on OPT don’t get the h1b, they will loose their jobs, their legal statuses, and their future in this county…

          In addition to this, I will also go to the Army for mandatory service…

          So, please, no one come to me and defend the “outsourced” people here!

          • Thanks for finding better words for what i was trying to convey. We lose everything we’ve built for ourselves in the last few years in this country whereas others can just stay with their company abroad and try again next year.

    • Your description does not qualify you for H1B. L1 is the appropriate visa for your case. The fact that there is a higher rejection rate, does not mean that you should abuse the H1B. Secondly, if you obtain an advanced degree from the USA, that means you were supported at one of the labs/centers etc by US government/business and it makes more sense for USA companies to be able to hire you and make use of your skills.

      No offense to anyone, but the H1B was not created solely for IT professionals, as giant Indian IT companies are abusing it as of last 10 years or so. There will be clear language in the upcoming immigration reform bill, that for any company to be allowed to process H1B applications, they need to have less than 50% of employees not on H1B. Automatically puts abusive consultancies out of business. Also they plan to remove the cap for anyone who has MS or PhD STEM from US university.

      There you have it. Your application belongs in L1 not H1B.

    • Because we are already here, we got degree from US universities, we have apartment, we are already all set up in USA, more over we have been paying tax to US government since we came here. Most of Masters students and almost all PhDs got their degree paid by federal government money (tax payers money) as we had assistantship. More over, we already have job that we started during our OPT. This is a difference between you and us (who are already here). If we don’t get H1-B visa than it is like packing our bag to home country. Just like someone bringing you on top of the hill and kicking you down the cliff. We will be out of status. You live in your home country and you are never going to be out of status even if you don’t get this visa.
      You asked me the difference and I gave you the difference. But as per US government, you are equally qualified and deserving for this visa under 65K cap limit.

      • Agreeee! I’ve lived here for three years, I paid damn much taxes, I bought a new car which I have a loan for. I have an apartment, friends, all my life is here. If I go home it’s gonna be back to nothing. So damn unfair! and I am not an IT or an engineer. Why wouldn’t they consider different areas of expertise, cause you get only a couple visas for people with my job. there should be some distinction, why would only IT people take all visas!

        Because you did Masters here, you have 20,000 visas set aside. Asking for special treatment beyond that is not fair.

    • Because we paid $25k in fee and another $20k in taxes from past 2 yrs what the heck u did? Also there is no guarantee u guys will be here… Also u will be paying taxes only after oct 1 but we continue tonpayb$2500 pm in taxes…..

      • What the heck YOU did? Your claim to visa is only spending money to study! Hahaha. So, you were thick enough to spend so much money and jealous because others can start working without spending so much money. You studied so you paid fees, you earnt so you paid taxes – how does that entitle you to a visa?

        And H1B visas are meant to be temporary work visas and people are assumed to go back to home countries once that is done. Is the USCIS asking for “guarantee” to grant the visa? Your arguments are laughable at the best.

        So miyaan anyway go back to delivering pizzas or sweeping gas stations and look for deals in Walmart.

        • H1b is a dual intent visa… Meaning that it’s perfectly legal and acceptable to use it as a path to permanent residency, which some of us who have lived here for years are doing. This argument doesn’t fly.

  23. USCIS received 124,000 application in total.
    The Lottery is already done on April 7, 2013.

    By approximation, probability of winning the lottery is 70 %. (85/124)
    The employer/attorney would be notified if you won the lottery.

    • I am also in the Master’s cap (Regular Processing). I guess we have to wait a week for any updates about the processing. For PP people the receipt numbers are issued from yesterday but for regular processing I guess we have to wait…

      • Waiting is killing me… After investing so much time, money, effort. getting an MBA from Cal State, getting a job, convincing my company to sponsor my visa… What else I can say.. Now, everything is a matter of luck…

            My employer in the Silicon Valley said they did not receive EACs for any of the cases filed under PP. God knows how such American startups would sustain in the long run with such broken US immigration system.
            I am an Indian but I hate those companies (TCS, Infosys, CTS and other Indian outsourcing companies) coz of whom I would probably be no where.

  26. Well, all this talk of H1 lottery and creating the buzz is okay. But can anyone explain me why the USCIS needs to do lottery in the first place?
    USCIS says it received a greater number of applications than the quota through April 5. Let us assume that this limit was reached on 3rd April. So USCIS should only do a lottery selection for the applications received on 3rd, 4th and 5th of April.
    Why are people who filed on 1st and 2nd April being subject to this?

    In normal years, USCIS sets a cut off date when it receives applications equal or greater than the quota. So why not do that this time around too?
    Else, it is like saying the filing dates are open from 1st April to 30th Septmeber, send in all applications, we’ll do a lottery to decide who gets to work on 1st October

    On blogs, I see people bickering about the worth of H1 between a Google and TCS employee, a PHD and a bachelors candidate etc., but no one seems tgo think that this problem can be solved by just doing the random selection for the ‘late’ applications.
    All worthy companies have their lawyers and application ready and on time for 1st April.

      • Or simply give priority to people who earn advanced degrees in US, and only consider overseas H1B seekers after the local applications are exhausted.

        • Totally agree. The problem is that even for local candidates, these ‘desi consultancies’ are selling H1s (for $3500). I know someone who has 4 applications in this year’s pool just because it was the last year for him to apply, at the end of 17 month extension.

          • You see something you should report it. USCIS is actively putting pressure on these illegal activities and we should help them by reporting any suspicious consultanties that engage in these behaviors. They hurt us all.

    • So shall I assume your application reached on April 1st or 2nd? I don’t know why people in this forum is so childish. Certainly, I agree that USCIS needs to cap per company level.

      USCIS basically allow 5-7 days to receive the petitions since the petitions could have been delayed by 1 or 2 days because of postal delay.

      Plan for the both the options. Assume you get visa (plan A) and Assume you don’t get Visa (Plan B). Plan A you already know. Plan well for B. Be happy.

      • My application for h1b was filed in Vermont center under regular cap for Premium processing. No news so far! I feel worrisome but nothing I/we can do.
