As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.
USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release
- Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April. You can check out US Economy and H1B Visa Lottery
- Total H1B Petitions received : USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
- Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
- Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing. First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
- Petitions Not Selected in Lottery : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
- Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
- Non-Cap Subject Petitions Accepted : USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
- H1B Visa stay extensions
- Employee terms changes for H1B visa worker
- H1B petitions filed for Change of employers
- H1B petitions filed for concurrent working for more than one employer

I am really thankful to the person who gave the idea to call USCIS. It really works–I got my receipt number through them (RQ/RP/VSC) (13142XXXXX) The only problem is waiting on the phone for more than 35 minutes.
When calling, refer to them as a petitioner not beneficiary.

When calling as an employer– first thing they ask is to punch EIN!!!

The number I used to Dial is 1-800-375-5283
They take calls between 8-6 pm (I think it is EST)
After calling in–follow the instructions where it says–if you’re an employer press this…..
after that, they’ll ask to punch EIN number–after that–would say estimated wait time, and then after about 30 minutes or so–you would be able to speak to a rep. the rep will ask if you’re a petitioner or beneficiary. Tell them that you’re petitioner and give them phony name, they’ll not find that name, so they’ll ask for beneficiary’s (your name) name. give them that and few more questions about company name, company address and when did you filed –so and so and they ‘ll give the receipt number.

How do i get my ein number..please help
EIN number is Employee E-verification number. The easiest way to find out is by looking at W2 form (Tax form). If you could not find out through that, please ask HR. They should be able to help you with this.

When exactly are you asked to punch in an EIN? None of the automated options offer this to me. It goes from “If you’re an employer press…” to “Type in your receipt number”…

I’m also Adv/non-pp/vsc, none of these status changes, so I’m losing hope now.
Actually I never checked with my school or attorney. I dint ask my employer about checks. I probably went to HR twice during this ordeal. First time was to know about the lottery process. Second time was the day after lottery when she told me that they have just started processing applications and its too early to know anything and she would keep me posted. So I basically believed her and was waiting for her email. But I was prepared for the worst anyways. Mine is life science research so I started applying for research center jobs and post grad and phd programs.

What they ask/say seems to vary. I was only asked company and employee name. That seemed sufficient for them to look it up in their system. Then they said to check for checks being cashed. End of conversation.

They did ask when the application was filed although they did not mention anything about the 30 day thing. They said to check if the checks had been cashed. That’s all. No question about EIN.

Called the correct number but everytime I get a message saying to call back Mon – Fri between 8am and 6pm. I have no problem with that except it is currently 11 am on Wednesday and I have been calling since 10am EST!

Hello, my employer filed my application on April 1st under RQ/RP. I have not received any response from USCIS yet. I called USCIS today and they could not find any information under my name or company name, does this mean that I am not selected in the lottery?
The person at USCIS told me to contact the attorney to verify if the check is cashed and If the check is cashed they told me to call USCIS again to update them wiht the receipt number.
Any advise guys, does anyone else has the similar situation?
By the way I tried contacting my DSO as I am still in F-1 but they have a rule not to disclose any information until the decision is approved.

I tried calling USCIS and they asked when was the petition filed and whether it was PP. I said april 1st and non pp…and then he said it hasn’t been 30 days so I need to wait for 30 days for a receipt number to be generated so I should call back may 1st if i don’t have it.

I am waiting for my receipt. I am currently in H4. I have applied RQ/RP/VSC. I haven’t received any kind of hopes from employer. I just checked with them they told they have received 10 receipts out of which 7 were Premium and 3 were general. They told me that the lawyer is receiving the packets one by one only. They have told me to wait till this week end. I have already lost all my hopes. I was working back in India. I got married and came here in last june. Already a year has been wasted in my career.. I feel sick. I was so confident that i will clear the lottery. But now all i am left with is only frustration. I wish good luck to all who got their receipts. If working is the only motive (i.e. pay is not an issue; since you already spent a year without pay, I assume it shouldn’t be) then please look at H-1B cap exempt jobs. They will at institutions of higher education or related or affiliated nonprofit entities, nonprofit research organizations or governmental research organizations. This will prevent a long gap on your resume.
H4 dependents Cant work here! I hope I am right! And at any cost! IT companies will never accept non related work exp.
I know people on the H-4 visa cannot work in the US. What I was saying was that, if you get a job at institutions of higher education or related or affiliated nonprofit entities, nonprofit research organizations or governmental research organizations, then they can petition for an H-1B visa for you. Such petitions are not subject to any cap and are granted all the year round. I am sure these organizations also need IT people. But, you should know that when you would want to work for a for-profit company then they will have to apply for a fresh cap subject H-1B for you.

Why are leaving to India. even if don’t get H1. we are in safer zone of living here. We can still be in H4, Until our spouse’s H1 is active. Later your husband might start his GC process and if you get E-id you can start working here. We can stay here and try our chances next year too. I don’t understand why are you leaving to India. There are worst cases for OPT candidates whose gyration period gets over this year. We must console ourselves comparing such worst scenarios. I pray the deserving OPT Candidates whose last chance is this year to get. Rather than for me. Pray to God. You can stay here with your husband and be supportive to him. NO other go we have a career but we need to console ourselves and move on whatever happens. Life doesn’t ends with H1b. It has more options. Getting doomed with frustration is not wrong but don’t drown yourself in it. I also feel very bad, tat i dint get receipt till now. But what is destined to happen will happen, nothing is in our hands. Feel Good. We are newly married., God is giving us a chance to take care of our family and making us to spend some time. That’s not true for India. Indian visa laws are very similar to US. As spouses on H-4 visa can’t work in US in the same way spouses on X visa cannot work in India. The only difference is that India does not cap the employment visas. So, if spouses can get an acceptable job in India they can get an employment visa for themselves.
Under the proposed immigration reforms, US is planning to give spouses on H-4 work authorization if the sending country offers reciprocal treatment to spouses of US citizens. Unfortunately, for Indians it means status quo due to Indian visa laws.
Y would american couples want to go n work in India ????most of them jus go in terms in tourist visas!

Still calm down and hang on there. I had my receipt number by calling USCIS yesterday (RQ/RP/CSC), but when contacting attorney, neither check cashed nor snail mail obtained. And my rec# start from WAC13137… So there could be delay even you are selected, and in addition your attorney/employer may delay informing you as well. Don’t lose hope! Just wait until the mid of next week than may tell yourself that the chance is low at that time. I know how hard those days are, but what can do now is just pray and wait.

I called USCIS to find out my application status, I dont have receipt number yet, they looked up my name and the companies name but they told me there is nothing in the system, and i have a confirmation number from FEDEX stating that they received it on april 1st. Does anybody know about this ??

Ask your employer to check the back of the checks for the receipt number. They can usually do it online.

If you are only filing through one sponsor then probably yes! However it says on USCIV websites that if someone submit multiple petitions then the fees are not refunded.

Nomura believes the most damaging provision of the US Immigration Bill for Indian IT remains the restriction on outplacement of H1 B visa holders at client locations, which hurts outsourcing in a big way
Nomura Equity Research hosted a conference call on Tuesday, with Ameet Nivsarkar (VP,
NASSCOM) to understand how the new immigration bill unveiled by the “gang of eight” US senators could potentially impact India’s IT industry. The proposed Immigration Bill aims to reform border security, employment verification, legalization of illegal immigrants and legal immigration and temporary visas.
Key negatives of the proposed Immigration bill
1. No access to visas from 2015 for employers who have high share of foreign staff: According to the Bill, in 2014 companies will be banned from obtaining further visas if more than 75% of their staff are H-1B or L-1 employees. In 2015, the ban applies to companies if more than 65% of their workforce is H-1B and L-1 workers. In 2016, the ban moves to 50%.
Most Indian IT companies have 50%-80% of their staff as H-1B or L-1 visa holders currently, according to Mr Nivsarkar.
2. Reduced ability to place employees at customer site: According to the Bill, “an H-1B-dependent employer may not place, outsource, lease, or otherwise contract for the services or placement of an H–1B non-immigrant employee”. This means that employees on H1B visas may be restricted from working at the customer sites, although they can work from global delivery centres. This would require a business model change for Indian IT companies and raise the cost on onsite staffing for projects, according to Nomura.
3. Increased visa fees: The bill proposes to significantly increase the fees for employers who are H-1B dependant compared to normal users of the program. Specifically, if the employer has 50 or more employees, and more than 30% but less than 50% of staff are H-1B or L-1 employees (who do not have a green card petition pending), the employer must pay a $5,000 fee per additional worker in either of these two statuses. Similarly, if the employer has 50 or more employees, and more than 50% are H-1B or L-1 employees (who do not have a green card petition pending), the employer must pay a $10,000 fee per additional worker in either of these two statuses.
4. Increased lead time for hiring: The bill stipulates that employers post a detailed job opening on the Department of Labour’s website for at least 30 calendar days before hiring an H1B applicant to fill that position. This would increase lead times for execution and would reduce competitiveness of Indian IT compared to MNC IT, Nomura believes.
Key positives of the Bill:
1. Higher H1B cap limit: The Bill proposes to raise the cap of 65,000 H1B visas (annual) to 110,000 which could go to as high as 180,000 in future years. This is a positive as against the current cap of 65,000, there were around 125,000 visa applicants this year—this forces the Immigration authorities to resort to a lottery system to decide who will receive visas.
2. Green card reform: The Bill proposes to exempt certain categories of skilled labour from annual numerical limits on employment-based immigrants—e.g. doctoral degree holders in STEM (science, technology, engineering, and mathematics) field would be exempted. In addition, 40% of the worldwide level of employment-based visas would be allocated to a certain set of people which include holders of a master’s degree or higher in a field of science, technology, engineering or mathematics from an accredited US institution of higher education.
According to Mr Nivsarkar, the Bill has been introduced in the Senate and it will first go to a judiciary committee and post that a mark-up committee. At every stage there could be amendments. Post that it is put to vote in the Senate and has a high chance of being passed there since the ruling Democrats have a majority.
If passed in the Senate, then the Bill is sent to the House where it goes through the same process. The final compromise bill, which has amendments from both Senate and the
House, is sent back for vote one more time at the Senate and House. If passed, it will then be sent to the president who can either sign it into a law or veto it. There is a possibility for the language to be changed at every stage.
If everything goes fine, the Bill can be made a law by October 2013 at the earliest, according to Mr Nivsarkar. The Bill, however, has less chance of being passed at the House since Republicans have a majority there. As well, Mr Nivsarkar noted that the bigger concerns in the Bill are around the fate of the 11 million illegal immigrants and not temporary work visas.
According to Mr Nivsarkar, the Bill, if passed, would require a change in the way Indian IT does business currently. Indian IT will have to consider one or a combination of the following options to continue doing business normally:
1. Acquire companies based in the US and increase local staff percentage.
2. Start onsite development centres in Tier2/Tier-3 cities, where costs are lower,
3. Tweak the onsite offshore model so as to increase offshore proportions.
Mr Nivsarkar thinks the Bill creates an unfair advantage for MNC vendors against Indian IT players. This is as they would already be in compliance with the 50% local staff provision and hence will not have to do material local hiring or bear increased visa fees with which the Indian IT would have to contend.

Nomura believes the most damaging provision for Indian IT remains the restriction on outplacement of H1 B visa holders at client locations, which hurts outsourcing in a big way. This would be followed by the need to comply with the 50% local staff requirement by 2016 in terms of severity. For most of tier 1 IT, it would not be a stretch to meet the 2015 target of 35% local staff in the US. The brokerage believes the visa fee increase of usd10,000 per incremental application for companies having less than 50% local staff, is a minor depressant on margins and could also be potentially passed on to clients. Overall passage of the bill in the current form would be negative for the sector and weaken competitiveness versus MNC IT players and depress margins.
How shameful that this bill prioritizes AMERICAN companies wanting to hire foreign nationals to fill their needs over INDIAN IT companies wanting to outsource without the willingness to hire locally. Seriously?
Don’t worry too much right now. The clauses preventing Indian IT companies from obtaining H-1B visas, like increased fee and denial in cases of high number of H-1B employees, are not exactly compatible with WTO GATS. My opinion is that the bill in the current form violates the GATS. An attorney in international trade laws might be able to provide more clarity. I am sure the GATS issue will come up some time soon.

Somebody mentioned yesterday they were able to find out the receipt number by calling USCIS as the employer.

Yes it is. I did it yesterday. Could not bear the wait anymore. They told me the receipt has been sent out on April 19th, the attorney should receive it this week.

I had called up USCIS and they didn’t have my info. they only checked via the employees name. They didnt ask about the company at all. They told me sometimes the receipt doesnt reach properly and so the best way to know if you were selected if you don’t have the receipt is check if the cheque has been encashed. If it is encashed then you can see the receipt number on the back if the check on the online account. They also told me that they might not have a record on their system and still the receipt could be generated for your application.
So its not certain that you have not been selected even if they dont have your information over the phone as I think the customer care dept and the processing dept are different and might have diff info.
Well i had done postal money orders, so those are hard to track and you have to pay a fee to track them. So the checks were not an option.
they will also ask ur employer’s 9 digit ID, which you can get if any of your friends/relatives work in the company or you can ask your HR team for that number.
You can also get your EMP_ID from your W2 form

They are still sending receipts for sure. They only started RP/RQ on Friday. The others in your company just got lucky.

I meant candidates started recieving receipts last Friday. Likely they were mailed before that, however it is still early days.
My employer told me that they received regular quota mail last Friday…so USCIS has sending receipts earlier….

Few points that a RQ/RP should consider.
1. People who say they got receipt are few in number when compared to 58k (whatever number that is)
2. Not everyone who has not got the receipt is coming here and posting. Many are not seeing this forum (because it makes them depressed), many are seeing and not posting, just withering away in despair
3. Repeated refreshing of the page to get an updated status is very bad for health. Rises your anxiety level and produces some harmones that I understand are very undesirable for good health.
4. You have not got receipt. You have not got the packet returned either. (For the optimistic lot)
5. You might not get it in the end anyway. VISA interview can screw you up. (For the pessimist lot)

Me too missed last year because of the idiot HR, she quit her job just before applying my visa and quit without handover, I got screwed last year. They extended my offer till this year and this year it is Lottery, my luck is always very bad, i never ever win anything in my life if it comes to LUCK. I lost my hope.

Suggest to be a little more optimistic, here are a few things you can do to keep your focus on. Find a full time job that qualify in Cap-Exempt H1B ( They can file an h1b anytime of the year. Now how to get in for them to agree to file an h1b is that you will have to get their confidence and prove it to them that you are capablity. A workable way is take up a volunteer job)
Go to School in H4 Visa (There are loads of community jobs and online courses which will hep you in you career in your days ahead. You can use this as a break to enhance your career.)
Go to School in F1 Visa. Join a full time course like a masters and it truly helps in the coming days considering I2 act coming in place.
Volunteer in your field in H4 Visa. ( This truly helps, probably not monetarily but to understand the culture and helps in interacting with people. More over it also helps in supporting society with a good cause. Imagine if someone helped you out with any benefits, how would you feel)
Take a membership in one of the local libraries, it comes free. It can help you in reading and learning. There are loads of degrees/ certificates which you can obtain by appearing just exams. Staying optimistic and cheerful and exploring possible options would surely help during these days waiting. Wish you all the best. You are on dependent by immigration and visa status, else wise its more to stay close to your near ones and carry one with life. Dont lose hope.

Me and my friend filed our H1 through the same employer and on the same day ie 2nd April under RP/RQ.. My friend got his receipt yesterday, but I did not get mine..Should I assume that my application is not picked in the lottery or should I wait for some time…feeling very tensed and nervous…any method/process followed to send out receipts…
That’s frustrating. But maybe they sent the receipt to your colleague before to you. My employer got the receipt on 18th and my lawyer got it on 22nd though they are both in the same city….. It’s government entity so there are always weird stuff going on!!

three of my friends got their receipt number last week- They are class of 2013 (MBA) and will be graduating in June 2013.
It seems you applied under AD quota, did Mckinsey allowed you to work on OPT for one year? I have also got an offer from them and waiting for my H1B receipt number.
I noted that in their employment letter, they have mentioned a clause that the contract will void if I donot have H1B by 1 Oct 2013 and they will not petition for another H1B. I am not too sure how do they take it practically. Please advise. thanks
