USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

        when was it received by USCIS, and when did IBM receive the receipt and when did you get the receipt. Please share the dates… loosing hope… just want to do some calculation to get some hope.

    Applicants u have applied in PP ,is the time period for the decision (approval/rejection)by USCIS(of course after getting the reciept)
    APRIl 15 to may 4 …

          • Where do you get these facts from? Do you even verify something before posting it with confidence? It’s extremely easy to verify this, go to the USCIS website and look for premium processing.

            It’s 15 calendar days not 15 working/business days. So, April 30th is the deadline.

            Is the receipt number EAC or WAC is a sequential number or random number?. I mean the last 4 digits.

          • It specifically says on the USCIS website that PP will be processed in 15 ‘CALENDAR’ days!

      I have been following the comments in this forum since quite some time.

      While I am awaiting the status of my petition, I would like to say that we can still wait at least till end of this month.

      Some of my contacts got the receipt numbers even without their checks being cleared.

      Latest status I know from my contacts is receipts received yesterday for EAC/WAC day 136.

  7. Just send the email to local FDFU and see what they reply. If they will reply same thing then we have to wait. There is no option for us.

  8. TCS will update everybody, once it will get status for all the petition applied and It is very difficult to reply individuals so we should wait for sometime .

    • They should update the system as they get info on any case ID. Everyone has different case ID. After getting all the info and then updating is tedious…. But compaines follow same lathargic approach….

    • I call TCS SSG team to know the status, but they replied same thing. No update from USCIS .

        • we are waiting from 25 days.. it is very difficult to wait for next 25 days….. Hope they give us the info as early as possible……

    • no updates received from TCS Chennai. Internal Visa group/SSG is asking us to connect with our ISU RMG Head for further updates on H1B status. But no reply from RMG yet.
      Still waiting.

  10. Regular processing, regular cap, California processing center: just received my WAC number a couple of hours ago! The receipt was received by Fragomen already on the 22th.

    When you get the receipt and if you don’t mind giving below information then please give the details in below format. It will help a lot to all people who are still waiting –

    Application Type – AD or REG
    Processing Type – PP or REG
    Center – WAC or EAC
    Receipt Number – I don’t think giving it would harm anything.. if you feel so then encode and give the required info in Receipt number
    Receipt Date received to you and to your employer/attorney
    Employer name – TCS, INFY, PWC, Google etc etc

    Also did not understand the part that people with common firstname and lastname will get know their status late.

      All that they are saying is “We are yet to receive any update for anybody from Plano, TX”… don’t know if that is true. Status showing in AIMS is “Ready for Printing”,that btw means it has been filed (GI updated abt this in an email). If anyone is having better knowledge, please share…

    I received an email from my immigration attorney about my application being selected for the further processing today. I applied under AD/RP/CSC. God is good and He gives everything in the right time! Don’t loose your hope and find peace as you’re waiting!

  23. I have been following this forum for a week now. Few things to be noted here.

    I personally am a under-grad engineering student who came here on a long term visa 5 years ago.I have a family and life here. I did not fare well in my under-grad engineering course. As a matter of fact, I am here because of my hard work and patience. Life has taught me one lesson – I am responsible for all my actions and no one else is.

    I respect and admire people who excel in academics. At the same time, I don’t feel inferior to anyone. I believe experience teaches a person more than anything else.

    In the end, people strive to be happy and has all the rights to do so.

    Please refrain from venting your frustrations against others. It is basic ethics of any forum to not to pick on one or a group. Forum is created for people to help each other and not fight.

  24. Did anyone got an update from their DSO that states something like… “. F-1 status and employment authorization for this student have been automatically extended to September 30, 2013. ” but NO receipt number??

    • Got my receipt number from employer. Mine was RQ, RP and Vermont.

  26. My attorney emailed me saying , the cheque he deposited has not been cashed yet, which means my petition is not selected.
    What is the time gap between a cheque being en cashed and receiving a receipt ? Can I still hope that I might get a receipt sometime soon ?

    • Same here… There are quite a few posts I have seen here which read “My checks” were not cashed, but I got receipt number. Given that there are a lot of people who pay consultants might not have seen their checks cashed because the consultant would have provided their check to USCIS. As far as I know, the employers check is first cashed before the number is generated. However, with the fact that it is not cashed till date, I am not sure you could totally rule out your chances.

      According to this link, you can still be hopeful till sometime in May. May be a week or two and if the check is still not cashed then it probably might be over. I would still stay positive till the premium processing cases are adjudicated which is end of this week. Give it one more week after that and if the check is still not cashed, then, well, I think its over. I am hoping for the best as well!! Good luck!!

      But did your attorney say that it means that it is not selected or did you conclude yourself?

      Some people already have gotten their receipt but their checks havent been cashed yet.

      So there is no one way of telling whether your application was selected or not.

      Until you get your packet back, you are still in the game.

      • This is not necessarily true.. Those some people might be referring to the checks they gave to the employer. (many pay their way to an H1B). As far as I know, your checks, or rather the employers check to USCIS would be cashed before the number is generated

        • Thats not true coz as per the discussion with my attorney checks are cashed by some other department in USCIS and receipts are issued my some other..One department just provides the List to the other and they both work independently..So its possible for the receipt to come before the check is cashed..

          • Cashed Checks

            One of the first things the USCIS does after receiving a case is to process the filing fees. This is done electronically. Thus, employers may be able to confirm that their cases have been selected in the lottery by checking their bank accounts to see if the filing fee checks have been cashed. The USCIS does not cash the filing fee checks for the cases that have not been selected in the lottery.

            Please type H1B understanding case selection in google and read the article in murthy dot com.

            The receipt number is generated for only selected cases. So if a receipt number is selected, a precursor to that would be the fact that the checks would be cashed…

          • Dude read the earlier threads of this forum..there have been N no. of cases where receipt was issued and checks were not cashed…soo theory is always different from practicality..

          • Again, who’s checks is what is in question. Many people might say that their checks were not cashed which might be the checks given by the employee to the consultant which is again illegal.. However, wishful thinking is what we resort to, to keep us hopeful but the truth is, there is a process and that is what would be followed. I am in the same boat but the hard truth is if your checks are not cashed yet, there is a high possibility that you might not be picked… The cases that you said, on previous posts did you read any cases where the employers check were not cashed?

          • How does an individual have information about the employers checks being cashed unless the employer tells them? and which employer tells that their checks were not cashed yet but gave the receipt? Dont get me wrong, I am actually happy if this is true but I find it incredibly hard to construe. Which thread has that info? can you give the page number?

  27. Guys, I know lot of people are from top schools and loosing their career due to this so-called IT
    consulting giant (just for them) companies. We all know why they are so desperate and why we are desperate about H1.

    But, the immigration reform is like that. Every Indian IT company is taking an advantage of that.
    I’m one of the victim here who is from NON-IT struggling to get the receipt by having a Masters Degree from a reputed school in U.S.

  29. Whenever I read the words “my check” I feel like kicking the person posting it.

    The H1B visa is supposed to be sponsored by the employer, not bought through money paid to pimps, or consultants, as many call them here.

    And I’ve every reason to be bitter – Top 20 US MBA, six-figure salary at a Big 4, in the US for 3 years – and now forced to leave because of borderline criminals abusing the system. Hopefully, immigration reforms make such abuses impossible from next year.

    Finally, please, please, please, stop using “loose” when you mean “lose”. This seems to be a problem affecting a majority of the commentators here.

      I have been here for almost 7 years now, and almost been with the company for 2 years gaining valuable experience as an Engineer and this lottery system might not help me propagate forward.

      Everyone’s in the same boat. All of us have a reason to be bitter, too bad that can’t change anything.

    • I feel for you. I have and MBA and have been in US for 3 years too (including 2 years of MBA and 1 year of OPT). I know how hard it is to find an MBA level job. I am lucky to receive my receipt last week (AD/RP/CSC) but otherwise I would feel the same. All the best.

    • Exactly Seanfan! I feel the same for AD guyz who LIED THAT THEY WILL RETURN DURING VISA INT and now are blaming others for not letting them stay. Didn’t you lie to your VO that you will return to your home country after you finish and that you are spending this huge amount solely for gaining deep understanding of blah blah blah…???
      And now aren’t you complaining that you spent this much amount and you deserve to stay here like the same pimp you are accusing.

      • First of all, I called the consultants the pimps, not the applicants. Please read carefully before you rush to respond.

        Secondly, and this may seem strange, I was NEVER asked about my future plans during my student visa interview. The facts that the university is perhaps one of the best known in the US (and the world) and that I had a full scholarship would have contributed to the visa officer being so accommodating.

        Finally, let me make this clear – my beef is with the consultants, not the applicants. Everyone has the right to try for a better life; but the way of the consultants should be legally barred. A separate visa category may be created for them, but I don’t think they satisfy the intentions of the H1B visa.

        • Applying for an F-1 visa automatically means no immigration intent. But, then H-1B is also NIV. So, whatever.

          People actually buy their H-1B visas? Huh. Anyway, buying an H-1B visa is criminal as an F-1 applicant having immigration intent.

          Tough Luck dude. If you do not get through the lottery this year then you will not have an AD cap exemption next year. So, Best of Luck for now.

          • That’s exactly what my employer and I are planning – Australia and Canada are my two top options at the moment. Do you have any suggestions?

          • Well if you become a Canadian or Australian citizen, you can use TN1 or E3 visas to work in the US which are effectively capless.

            But if you want to return to the US, you will very likely get in via next year’s lottery because of your advanced degree. If the new legislation passes, there will also be more visas available.

            Can your employer sponsor you for a green card without H1-B? If you are not from China or India, that might take less than a year to process…

            Thanks for the suggestions.

            If I move to Australia, then most likely I won’t work on US projects. However, if I move to Canada, American engagements will definitely occupy my time.

            Doing some research, I’m amazed that major cities in both Australia and Canada have higher costs of living as compared to Chicago where I live now. Hopefully, my employer will be open to some salary adjustment. Also, Canada has very high taxes. That’s the major reason I’m not too keen on Europe.

            I believe an employer can apply for an EB1 GC without an H1B. Since I do have managerial responsibilities and have multiple publications, I may be eligible for that. But then again, I may very well fall in love with the place I move to and decide not to return to the US.

          • @patty If the new legislation passes he will no longer have the benefit of AD cap exemption. Under the new act the AD cap is reserved for people with US AD in STEM subjects.

            @sean If you do not get through the lottery then try to get relocates as soon as possible. After one year outside US your company will also be able to apply for a L-1 visa for you. L-1 is also dual intent.

            If you were a manager for 3 years outside US then you are elligible for Eb1. If your publications have lots of citations, then you should try for Eb1

          • Also, there is difference between intent to immigrate (i.e. intent to stay on, whether legal or not) and desire to immigrate legally. Technically the second one is allowed.

            But it is a silly system. The new proposed immigration legislation will change student visas to dual intent, like H1-B visas, because obviously if you educate someone you might want to keep them and their knowledge in your country!

    • How do you know you are forced to leave? Have you received the returned package? If not, keep hoping, they are still processing. Most, if not all, AD will get selected.

    • I agree, what I heard is that filing fee must be paid by the employer, and is not legal to be paid by the employee. It could be that the 3rd party is making some extra cash making someone else suppressed.

      According to USCIS website, “there are approximately 70,000 students currently in OPT…” and “approximately 12,000 will take advantage of the STEM extension.” Counting the apx 10% rejection, its 63000 for OPT; and I don’t think think there’s that much rejections in STEM. So that’s only 75k which is less than H1-B cap of 85k leaving extra 10k. (I may have not consider all facts, so please correct)

Your own actions will take care of jerks like u. BTW how does it matter ppl using loose or lose or whatever …. do u think u r the most learned person on earth. For your information right from 2009 onward USCIS is taking care that they don’t give visas to ppl who are from fake consultancies and this is the reason they are selecting 10% – 12% more visas.

Read the answers before mouthing off – I never lied during my F-1 visa interview ; I was never asked what my future plans were. As regards the correct use of language, your sentences are evidence enough of where you stand on the issue. And my disdain for the likes of your employer, because I’m sure you are one of those who “work” at “consultancies” has nothing to do with my salary.

        I don’t even consider myself the top candidates being screwed by this lottery – I read of a Wharton grad who is facing the same issue.

    Does it indicate that it’s a H1B Petition?
    Also, does it indicate the employer who filed for your behalf?

    Can someone please answer this?

    • Hey Priy,
      Your sevis will get update as soon as the USCIS will take up your case.

      If it take up, it means, you are picked in the lottery.
      They will generate you a receipt number and the SEVIS will be automatically
      updated.

      Ask your DSO what is the status on your SEVIS.

      If it is updated, she will provide you with some info such as,

      your work authorization has been extended until sept 30, which is a cap-gap for us.

      It will also shows the receipt number.

      Again, it may sometimes get updated before you get the receipt or later.

      Thats one of the way to find whether your application got picked in the lottery or not.

      • Don’t let your impatience ruin your chance, even when the possibility of being caught is small. There’s a reason that they collected $500 for “fraud detection”.

  31. HI Any updates for AD/RP/CSC/Fragomen.. My sevis wasnt updated till last thursday and my DSO asked me not to bug her any more in nice words.. M kinda stuck with no other option but to wait…. Hopefully i can find some hope by knowing i am not the only one waiting…

      • Kumman can you let me know where is your company and lawyers locate. My Company is located in Nor-Cal and Lawyers in So-CA.
        I checked with my DSO.. Hopefully she will respond.. I hope there is an update coz she is not ever checking it again..

        • My company/lawyers is based on Michigan. I did not receive any information from them. But sevis was updated yesterday. So i am waiting for the receipt from fro. to confirm with my DSO

        • I got similar response from my DSO – She won’t check it again. The only information she provided is that there is a ‘extension approved’ status posted on my SEVIS. It didn’t mention about a extended date or a pending change of status. LOST HOPE.

  32. My H1B (AD/RP) applied April 1st week. My OPT status expires in July. As per my attoney I have not received receipt for acceptance. So i called my college DSO and she looked at the sevis and she told my OPT is extented till september 30 (from july30). She gave me a receipt number like WAC13137 5****.

    My question:

    Is there receipt delay and I got selected in lottery?

    what does automatic cap gap extension means? I dont need to file a cap extension? Is my H1B visa pending or approved?

  33. Got the confirmation document from USCIS saying the application has been accepted for processing (regular). However, the checks have not been deposited. I also got to know that the SEVIS information is not updated. Any thoughts? Thanks.
