USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

  1. Here is the calculation according to me.. Not to give false hope to anyone but its pretty accurate.. I am not sure about PP guys.. But for RP i think this calc holds.

    1) All theories about alphabetical and different type of orders for sending receipts are rumors as my friends have received in any order irrespective of their first and last names..
    2) the only order i can think about is first they sent PP guys (both AD + RD), second the sent all AD receipts for the 20K selection and now they are sending for the rest 58K for the regular selection which includes both AD+RD

    They started sending receipts on 4/8 @ 5k total for both centers combined. i know they actually sent more receipts but all the receipts are not h1b related to the lottery, so i am considering 5K per day and 2K on saturday.

    4/8 – 4/13 = 27K
    4/15-4/20 = 27+27 =54K
    4/22-4/27 = 54+27 = 81K
    4/29-5/4 – This week almost all the recipts should reach by the end of this week as it takes upto 3-6 days for receiving the receipts by snail mail.

    So I would wait till 5/4 to be starting looking for an alternative and giving up hope.

    I am AD/RP/VSC – still waiting.

    • You missed the fact that they oversubscibe the H-1B visa cap to account for denials, withdrawals or closures. So, about 96K to 100K petitions are receipted for the 85K cap.

      • @Gentoo – so if they oversubscribe to 100k and there are not enough withdrawals/denials, what happens to the excess? Do they get denied later on? That is horrible given the pain we’re going through just to get in the lottery now 🙁

        • I am pretty sure they are not that cruel! They usually go a little overboard and approve a few more petitions than the 85K cap.

          • According to the previous data , total applications considered for this year is 113512 ( AD + RD) (i.e 124000 * 0.915) . Out of this USCIS needs to select the 85000 applications.

            Are you still waiting ? Were you PP ? CSC ?
            I presume you did not get any more data for your analysis?
            Are you in the US already ? Plan B ?

          • I am RQ/PP/WAC (i.e. CSC), outside US. Luckily, I got a very active HR and Legal Team, mailing ratio is 5:1 (5 being their mails). I got my receipt on April 8th and approval on April 16th.

            Didn’t receive any more data for analysis. The basis for my theory was that me and my friends, different cities, different companies though all were RQ/PP petitioned at WAC (CSC) got our receipts and approvals in order of our surnames. But, as I earlier said we formed a very small data set for any conclusive analysis.

      • @Gento: when do they receipt the additional ones… so u mean waitlisted numbers will be randomly in between the accepted ones or they do it later?

        • Lottery didn’t happen in the years 2009-12. So, I am not sure how they process a wait list or if they have one. From the data given in the report all I am sure about is that they oversubscribe the visa cap. And, from previous news releases I know for a fact that they usually just accept and receipt all petitions filed on the day the cap closed.

    • Ya you can just count any number of days for snail mail according to you,,

      yes you are correct about over subscription but i am not sure if they oversubscribe right away or they subscribe as they reject other applications while processing them/

      If you are right then we will see 5K applications per day till 5/3 or so. So basically I would give one week after the last day of their receipts generation@5K rate. As we will see a lower number of receipts generated after they finish the h1b receipts. so lets see what day is that..

  4. God id great … Such a relief 🙂 got confirmation from my HR about my h1 receipt. Yet to receive my receipt number. Thank you so much friends for your hopeful words.
    Mine is RQ/RP/CSC.

    I will pray for everyone to get their h1. Please don’t don’t don’t don’t lose hope. Trust in god.

    • i am in the same boat dude. It feels like a dark comedy. I cant believe it all ends up in a lottery 🙂

      I fall in the same category as few others – Ivy league MBA, good job and now worried about plan B thanks to H1 lottery. But then who said life is fair.

      hang on there and hope for the best. eventually everything works out.

      • haha man i just found company. can’t believe that after getting through rounds of applications and interviews, all will likely end in a stupid lottery. had i known this, i would probably partied a lot harder in school.

  7. I know many H4s are worried and waiting. Just want to share that some people in the same boat have got confirmations.

    I’m a RQ/RP/VSC – employer confirmed selection after check got credited
    A friend of mine RQ/PP/VSC – also confirmed selection in lottery

    So keep praying and wait for the best.

    • Hi, did your employer give u a confirmation that your case is picked in lottery basis their cheque been encashed? I am also RQ/RP/VSC. I just heard from someone at my employer’s that the cash has been cashed, but havent recvd a mail or any update form employer or lawyer that my case is selected in lottery. does that mean that my case is picked?

    Today so many H4 ‘s are getting the receipts. Still do I have a chance..?

    • We can hope till end of the week.. i know with each passing day our hope will fade.. But there is nothing we can do.

  10. Ok, I am AD/PP/Vermont/Fragomen H1B applicant, and I missed it. It sucks, especially taking into account the effort I put in working towards PhD and 2 years of career networking/search, and taking into account the luck of settling in my beloved Florida. But that’s not the point – I’ll get through. The point is information that PP receipts will not be distributed any more, even my lawyer said so, so now it’s time for you guys to look for alternative options. Luckily, during my OPT I proved my value to my employer, so I am being shipped to an office in Europe. Those of you who work for international companies – check, their policies often account for this kind of accidents.

    • While I don’t blame you for being nervous, saying that you missed it is a little naive and premature. Until you recieve your return package/filing fees back you may very well be waitlisted or your reciept may just be lost among all of those still being generated. You still have a chance.

      I am in Florida too, and still waiting. And it sucks, especially for us who have genuinely worked hard for this, but hey — not all is lost, so breathe.

      My HR told me that no hopes for the receipt.
      Unfortunately, I am not a Phd student.

      I don’t think my company will shift me to some other location as I joined in an entry level position just a year ago though it is one among the fortune 500 companies.

      Its really hurting.
      I’m really scared that they’re gonna terminate my employment.

    • They are still generating a few PP receipts. Though very few in number. Also, in case they can’t process a case as PP they refund the PP fee but keep the petition.

  11. people say that we can call to USCIS to see if you won lottery, but how can you check with out a receipt number or case number ???

    • Who told you that we can call USCIS? They would refuse to provide any info over phone if I am not wrong else they would be flooded with phone calls

    I am AD/RP/CSC.. I already got my receipt from my lawyer.. The same day I had also contacted my school DSO and I got a response from them as well.. However, under the comments section it says, “”F-1 status and employment authorization for this student have been automatically extended to September 30, 2012.”.. Shouldn’t it be “September 2013”? Has anyone run into the same thing? Getting worried a little..

      • My DSO told me that it’s a typo from USCIS.. The DSO doesn’t enter that.. She only copy-pasted the info from my SEVIS record… Not sure what to do…

  20. Just recieved a reciept number through contacting my DSO. I am so happy and glad this ordeal is over. Now I just have to wait for the decision.

    My application is RQ/RP/ CSC. Checked my tracking number just now and its in Initial Review and they recieved the case on April 8th.

    I almost lost all hope last night and started applying for jobs in the UK and Australia. I’m glad this worked out and I really hope it does so for everybody else too. We are all just as deserving as the next person regardless of scholastic merit. Goodluck!

      I’m in the same situation as you: got a receipt number from DSO but after I sent the receipt number to the lawyer, she seemed to doubt it since she hasn’t got any email/mail/notice…nor did my employer got any notice…the receipt number is eac131345xxxx
      Is the receipt number I got from DSO reliable?

      • The receipt number is 100 % reliable. There might be a delay in the mail and your lawyer might get the receipt soon

      • My school refused to tell me my sevis status and claimed that in the past it proved to not be 100% reliable. I personally think that while that may be true, they just didn’t want to deal with the hassle of answering every student’s question.

        Not sure what to believe really. My gut says this is fairly accurate…but i guess there’s always a small chance of error until you receive the legit notice.

          I’m confused because my employer told me my petition was filed under premium processing but when I checked on uscis about the receipt number given by the DSO, it seemed to be regular processing…however, if my petition was filed under regular processing, it may explain why the lawyer and the employer haven’t got any notice…although I believe the “134” in the receipt number indicates April 14 and it has been 9 days since then…even a mail should have arrived…

        • Ask your DSO for a new I-20 and it will have your case number printed on the back. They have to give you an updated I-20 regardless. SEVIS is a well automated system and the margin for error is fairly small.

      • Hi, I am in the same situation too.. My receipt # is WAC131345…. I got my new I20 updated with this receipt number and it says tht the COS is pending.. but my attorney has not received any mail or email confirming the same. Infact when i asked abt the checks, he said it not been cashed. I am tensed..

          I just got a voicemail left by HR 2 hours ago telling me that she is sure my petition was selected in the lottery! Although when I called her back she was not available, here is what I think my situation is like: neither my employer nor the lawyer has got the receipt yet but after I sent them my receipt number I got from DSO, the lawyer assistant confirmed with USCIS that the number I provided truly belongs to me and therefore they are sure my petition was selected. I think you can ask your lawyer or the assistant or your employer to try this way. Btw, since my application went to Vermont, the “134” in my receipt number indicates mine is even 2 days earlier than yours so I would say try not to stress out…although it is always easier saying than doing…and I myself can’t handle it very well…oh, lastly, I have no idea whether the check has been cashed or not, so that is surely not the only indicator 🙂

            so nervous and stressed bec of this which made me go out and find a girlfriend..

            damn, she wants to get married so that I can get green card etc but how can you trust a girl you date for less than a week…

            Another option would be starting a Phd. but you don’t get work permit with it..

            any other options in case I hear the bad news from USCIS?

            I even participated to a Core Yoga class for the first time on my life, just to stay positive and get rid of the stress.. (was super boring and tiring tho..)

    Washington: A top US Senator has accused big Indian IT companies — TCS, Infosys and Wipro — of abusing the H-1B visa system. “There are some specific abuses of H-1B,” Senator Richard Durbin, said during a Congressional hearing on immigration reform by the powerful Senate Judiciary Committee on Monday, during which the lawmakers discussed threadbare the H-1B visa issues.

    In fact, Senator Durbin went on to brand the top Indian IT companies as outsourcing firms. “These outsourcing firms like Infosys, Wipro, Tata and others — Americans would be shocked to know that the H-1B visas are not going to Microsoft; they’re going to these firms, largely in India, who are finding workers, engineers, who will work at low wages in the US for three years and pay a fee to Infosys or these companies,” Durbin alleged.

    “I think that is an abuse of what we’re trying to achieve here. Most people would think, well, Microsoft needs these folks, and they’d be shocked to know that most of the H-1B visas are not going to companies like yours; they’re going to these outsourcing companies,” Durbin alleged. He said this during the hearing in which two Indian Americans testified before the committee and supported the allegations of the Senator against Indian IT firms.

    Senator Richard Durbin said this during a Congressional debate on the comprehensive US immigration reform.
    Brad Smith, general counsel and executive vice president, legal and corporate affairs, Microsoft, too supported the Senator on the issue. “I personally think it’s important that we both recognise the need for these firms to evolve their business model —I’ve had these conversations myself with them in India — that encourages them to focus on hiring more people in the US,” he told lawmakers in response to a question.

    The proposed comprehensive Immigration Bill if passed by the Congress and signed into law by the US President would bar companies from hiring people on H-1B visa if 50 per cent of their employees are not Americans. The US India Business Council and Confederation of Indian Industry have opposed such a move and said that this is against the spirit of India US strategic relationship.

    The issue was also raised by the Union Finance Minister, P Chidambaram, when he met the Treasury Secretary, Jack Lew, in Washington last week on the sidelines of the annual Spring meeting of the International Monetary Fund and the World Bank. Chidambaram told Lew that “temporary relocation of knowledge workers should not be confused with immigration.”

    Testifying before the Senate Judiciary Committee, Smith told lawmakers that he had told the Indian companies three years ago to change their business model which was heavily dependent on H-1B visas. “I told them that three years ago. They better recognise that there’s no large country in the world that allows people to employ over half of their people from outside the local population. So I do support that,” he said.

    “I do think it’s important that one not eliminate their ability to do good work, because they also do good work. I don’t want to lose sight of that,” he added. Neeraj Gupta, CEO and cofounder of Systems in Motion, who once was on the H-1B system, said the number one users of H-1B and L1B visas are the offshoring industry.

    “Also, the number one reason why enterprises use off showing programmes is for cost reduction. Isn’t there a direct correlation? How could one miss the linkage that the visas are primarily being used for lower costs? It did not matter who the beneficiary of these visas is. It could be a large offshore company with headquarters in India or the US or a global major like IBM or Accenture,” he said.

    Gupta said the US market is the largest revenue source for offshore vendors. “H-1B visas allowed them to create easy mobility and keep utilisation rates high. The first question an Indian business would ask was why do we need to hire an American worker when we can get a cheaper resource in India, benched in India at a lower wage and mobilised on an as-needed basis,” he alleged.

    “The offshore majors mostly hired H-1B employees because the current policy provided them a subsidy,” he said, adding that there’s a lot of resources available that one can hire and train here in the US. “The majority of the work done by H-1B employers is really not specialist work. Most of them have between three to eight years of experience and they go on to do work for large IT departments for US banks, insurance companies, telecom operators. This is not the kind for which we need more H-1B visas such as what Google and Microsoft might need and is not traditionally considered specialised work,” he said.

    Ron Hira, Associate Professor of Public Policy, Rochester Institute of Technology, alleged that right now the majority of the H-1B programme is being used to hire cheap indentured workers. “The bulk of demand for H-1B visas is being driven by the desire for lower cost workers, not a race for specialised talent or a shortage of American talent. The results show this. All of the top 10 H-1B employers last year used the programme principally to outsource American jobs to overseas locations. Outsourcing firms have received the majority of H-1B visas issued last year. Globalisation and outsourcing will happen, but we shouldn’t be subsidising and promoting it through flawed guest worker policies,” Hira said.

    Noting that many claim that the H-1B guest worker programme is primarily used as a bridge to permanent immigration, Hira said top H-1B employers have no intention of ever applying for green cards for their workers. Accenture, for example, received a remarkable 4,000 H-1Bs in 2012 alone, but it only applied for eight green cards.

    “Outsourcing is only the most visible and obvious symptom of the underlying problems. Programme misuse is widespread even beyond the outsourcing terms. This is due to two fundamental problems: First, H-1B workers are cheaper than American workers, and second, American workers do not have a first and legitimate shot at jobs and, in fact, can even be replaced by H-1B workers. Simply put, there’s no shortage necessary before hiring an H-1B worker,” Hira said.

    USCIS sent it to my lawyer by USPS.

    Has anyone actually received their packages back? Sorry to be depressing, I was just wondering how long it takes them to return it, as that seems to be the only definite way of knowing that one wasn’t selected in the lottery…:( I’m RQ/RP/VCS, my employer said this morning the check hadn’t been cashed…:(
    I know we still have hope though, so fingers crossed! Congrats to those who’ve heard good news!!

    • The non selected packages are the very last thing that will be sent out, after all rejections and waitlisted applications have been dealt with, so I would not expect those for a while.

      As for your category, they have only just started mailing receipts for RQ/RP a few days ago, so you’re still in. Go for a walk to Battery Park and relax.

    • Hey Chelseanyc. Same boat. My employer said the same that the check has not been cashed so they are not sure if I was selected in this year’s quota or not.

      RQ/RP/VSC. But some people are just receiving mail via USPS today and yesterday. So I am keeping my deadline till Friday at least for anything definite. Nothing else we can do anyways but wait. Fingers crossed and hoping to see something good come from this.

    • Yes, of course. You may still recieve a receipt. If you can’t check whether your check has been cashed, your best bet is to wait. What matters is there is still hope so don’t worry too much.

        My employer received the receipt notice by snail mail. 12-18 hours before that he noticed
        the check to USCIS being cleared.

        Application date: April 1st
        Receipt received date: April 22nd

  29. Realistically guys, and given previous years operating time – How long should we wait to hear anything from USCIS? I know that RQ/RP just started to hear from last friday and even today we have some AD/PP-RP cases getting their receipts, what should be the estimate for us?

    I am RQ/RP/VSC. DSO cant update me and no activity on the checks either so really all I can do now is to await any updates directly from USCIS to my lawyer or employer.

      • I did my undergrad here and then entered OPT and now under STEM extension. So my SEVIS is still attached to my school.

      • I think people who did Bachelors (Undergrad-degree) here also can check by contacting DSO. Although they don’t come under AD quota.

    • PKaiser, I am in the same boat as you. Did my bachelors here, there are no updates on my SEVIS record, check hasn’t been cashed, no receipts sent to lawyers or employers. It’s still somewhat early but I wish this waiting game would end soon! RQ/RP/VSC

        Totally agree man! People have just started receiving stuff in this category. Most official confirmations are via Snail mail. So I am keeping my hopes till the end of this week. After that its all in the hands of fate. And its slightly encouraging to see some AD/PP-RP still get their receipts this week. So yeah hope for the best.

  30. Well while its a lottery I don’t think they are going to separate H4 to H1 applications from the rest . But I am sure this lottery process is put all the RC/RP into trouble as there are very few in this category who got there receipt numbers .

    We can just hoe and pray for the best !

    • Well, if you see this forum itself, I don’t see many H4 to H1B got the results yet and hence the apprehension

    • I am h4-h1… Even 2 of my friends has applied for h4-h1. Until now none of us got through lottery… As some one said seeems we are on low priority..

    • They just started sending RP receipts, of course it will take time! All those people with AD/RP posting here have got their receipt numbers from their SEVIS records or from the checks cashed by USCIS. RP receipts will take time.
