USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

  1. It looks like starting this week we would be getting more updates for Regular (non premium) processing petitions. So requesting the RP guys to keep posting your updates, so that we all can know how many regular processing petitions are processed from now on.

        Me and my friend applied H1B Regular Quota 2014, friday got call from my employeer, my friend check got cleared,that means he selected in the lottery.
        Service Center: VSC.

        Still I am waiting for result for mine….

    • Depends. If your employer missed some document then mostly it will be approved after submitting the document. If your employer was trying to hide something and was caught then tough luck.

    which USICS centre will my petition be filed ?

    • Are you from Infosys. I had a question form you. When did the H1 Filing process example document collection,employer questionair and other stuff started in your company.

      • My company is also from Plano Texas , My attorney is also from Texas , but she filed my petition in CSC .
        Mine is RQ, RP, CSC .

            My application initited on 27th Feb and finished on 27th March.
            I have not received any updates.

    • @Infosys, If it is Seattle WA, then it must have been filed at CSC (west coast).

      @XYZ, Infosys started the process from Jan based on Employee priority ranking. So for the P-0, P-1, P-2, process started in Jan/Feb. For others, doc preparation continues till 3rd week of March. However this year these all did not matter. As applied for all the eligible candidates at one go (irrespective of P-ranking).

      • So Did they apply in one go in March or In Januarary….As my frnd is concerned his was applied in march and he worries it just that it was just raised as a carrot and wont be taken up with USICS

    • I was in Infosys during 2008 H1B..They sent out emails to selected candidates only after they received the rejection notices for not selected candidates…

      I received my receipt from Infosys immigration team somewhere in 2nd week of June, eventhough my receipt date was in April..after they sent rejection emails to non selected candidates.

      guess you have to wait until early June or may be more….

  4. My case status has been on RFE since friday (19th april), but my employer has’nt received any mail yet.

    What does this generally mean ? Anyone been in a similar situation ?

    • I just got an RFE – I dont know what it means or what the chances are of approval – do you have any info?

      • Has your employer/lawyer for any mail regarding what docs are missing ? I don’t think they’ve mailed my employer yet..Like everyone is saying, I guess it depends on what info they r looking for – Let’s hope its nothing major.

    how is the situation with RQ/RP now?

    I just have been reported from my employer that our checks have been cashed recently.
    It meens we go in.
    RQ/RP/VSC.

    Anyone the same lucky or most of people still waiting?

    Thanks to all of you guys here for making the horrible waiting less exhausting by sharing information here. I honestly hope all of you will fullfill their dreams. If you not lucky this year, please don’t give up and try it next year. Or try another country offering VISAs for specialized workers.

    • if the check cashed means USCIS accepted ?

      below is mail from my employer what this means ?

      Be careful with verifying the status of the check, because in most cases, the USCIS will process all issued checks for payment to them anyway, regardless of whether or not the petition is processed and/or approved (as long as it has been filed correctly)

        Cashed Checks

        One of the first things the USCIS does after receiving a case is to process the filing fees. This is done electronically. Thus, employers may be able to confirm that their cases have been selected in the lottery by checking their bank accounts to see if the filing fee checks have been cashed. The USCIS does not cash the filing fee checks for the cases that have not been selected in the lottery.

      • Hi DABC,

        well I think this is slightly different issue, what your employers mentions.

        A) We’re now facing a petition. If you are rejected in a petition USCIS doesn’t open your package, but send it completely back. In this case they don’t cash the checks inside.

        B) Your employer is right, that if our checks have been cashed, it doesn’t mean we will receive the visa. We can also get rejected at any point of the application. Hopefully, I don’t expect that, based on my education and my experience. But it can happen of course.

      Could you please let us know what do you mean by “checks”?, all the cheques issued by your employer (for every petitions) got cleared at once?

        1) We’re a pretty small company, so my employer filed for only one H-1B.

        2) I unfortunately don’t have any details about which checks have been cashed. He just emailed me he went through his bank account and saw some activity regarding to the USCIS checks.

      My employer told me that my checkes are cashed on 4/16, last Tuesday, but till now I havent’ received my receipt notice yet. Waiting……

  7. Latest California Receipt number generated WAC1313951566. Could anybody confirm what is the latest receipt number received by applicant??????

          I havent heard anything from my employer. My attorney says the cheque is not cashed yet.
          But my unversity says SEVIS database is updated with a WAC number.

          Doe sthis mean I have been selected? How long does it take to notify by postal mail?

      I can see that – earlier status of one case – ’15 Days Processing Clock started’ Turns to Application received and e-mail sent…

      I think Some of the pp cases are getting converted into Regular Processing ..

      The case Number is : EAC1314150736..

      All should wait now..

      • I got info that ISU RMG, got the info who made it thro’ in lottery. Probably they will consolidate by this week and let us know.

          • hahahhaa…..first i went to FDFU…they told me to go to US Chennai Visa cell….when i contacted visa cell..they told contact ISU RMG….and now ISU RMG is telling contact FDFU….!!!!So better we will wait for the mail..instead of running behind this idiots!!!

          • yes…and the time i contacted is 6PM…so all the ppl in FDFU,RMG and VISA Cell would be in hurry to go home…bcz they have completed 9.30 hrs of there day and they cant work more…very hard working ppl…hahahahaha!!!

    • some people have got receipts. Next week should be the end of the wait. If we don’t get any thing by next week we should prepare for some plan B … head back to india..

    I saw something in USCIS case check status for the EAC***** posted yesterday.

    It says,

    Acceptance

    On April 21, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case. Please follow any instructions on this notice. This case is being processed at our VERMONT SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while th…bla bla….

    • I hope those waiting for their receipt number should get it soon. This wait is really a torture for all of us 🙁

  10. H1B Visa 2014 Lottery Result for OPT Candidates – Find How?

    Firstly, this logic works only for people whose OPT or OPT Extension expires before October 1st, 2013.
    Verify for sevis record update with your International Student Advisor at your university
    If the sevis record is said to be updated recently, you may find out what is the end date of expiry for work authorization.
    If the International Student Advisor mentions the end date of your work authorization as September 30th 2013, it implies that your packet is picked.
    You can also request receipt number for your International Student Advisor, if he/she is ready to provide it.

      • No, in that case your current could withdraw ur current application
        dont change ur job till your H1 is effective

          i subscribe to indeed.com and have set up job alerts for openings in universities that realtes to my current job; u can try something similar;
          also, i wrote this in a earlier comment:
          i believe there are courses that require full time CPT, these are legit universiites with legit courses; not TVU type; explore the options to see if any univ. is offering such courses closely aligned with ur current job so that a CPT can be justified; again i believe that since we have already completed more than a year of studies here, we are eligible for a CPT straightaway but i still have to do some research on the same;
          i will be speaking to a few state universities this week to see if i can go that route

        • I’m guessing those that got their receipts don’t frequent this forum very often, so it’s hard to make ay conclusions based on that sample

        • During the last lottery in 2008, my company attorney mentioned that they did get some PP receipts towards the end of the month. But due to the fact that they were processing both RQ and AD at the same time, it is highly unlikely that anymore PP will be issued as the announcement from AILA mentions that USCIS did not recieve as many PP apps as they were expecting.

          I cannot validate my lawyers statements but the AILA announcement has been mentioned a couple of times in this blog.

      I have silently been following this forum for a while but I felt that it was now time to make my presence known! LOL

      It’s actually very hard to get a clear picture of what’s going on because most people on this forum don’t provide full details as to their situation: ie 1st time application for H1B, renewal etc.

      I am a 1st time applicant for an H1B, in the Regular Cap, paid for Premium Processing at the VermontService Center- RC/PP/VSC

      Sadly I have heard nothing yet but my attorney said that in his experience it could take up to 3 weeks – based on that and when I asked the question that would take us up to the end of April which is in accordance with when the USCIS is supposed to have finished dealing with PP applications.

      I would also say that I have noticed on this forum that very few RC/PP @ VSC have received responses of any kind as yet and therefore I am remaining optimistic and not caving under the pressure of pessimists on this forum.

      Tomorrow is the start of a new week and hopefully many more of us will have something positive to report.

      Good luck to all of us and may we all be able to pursue our dreams in the way we wish!

      • I colleague of mine received his H1b receipt on last tuesday (RQ/PP/VSC) and since then I have not heard many ppl from RQ/PP receive any updates.

        What I saw since April 8th is an out pour of AD/PP first, followed by a few RQ/PP, then AD/non-PP and now RQ/non-PP.

          Was your friend a 1st time applicant outsie the USA?

          The problem is as I said before there are so many different types of applicants that it’s confusing people & posters are not clearly stating their situations.

          Are you also 1st time H1B applicant RC/PP/VSC?

            But this is my point exactly about missing info from people on this forum & people getting worried when ultimately the situations were not the same.

            OK your attorney is in the US – but are you & your friend? If you and you friend are in the US is it because you are NOT a 1st time applicant; have you just finished studying there or what?

            I ask the above question because in my opinion if you are already in the US your situation is not the same as a 1st time applicant located outside the US & the USCIS may process it differently!

      Waiting for my employer to tell me about the next steps, as he said “Our #1 goal is to have you start as planned this year – and we will do whatever possible to make that happen.”

  16. Sometimes I really feel very sad readin this forum. Everybody is crying, whinning. Why does everybody think that “HE/she is the only eligible candidate for getting the work permit”

    The AD have problem with the RQ guys getting a visa.
    The Non IT guys have problem with the IT guys getting a visa.
    Some people have problem with Indian getting a visa.
    The Americans have problem with the visa plan alltogethe.

    All of us are fighting like kids. Taking names. Abusing each other. Some people show what hardships they have gone through.

    If a Indian who works for the likes of Infy, TCS etc get an opportunity to work in the US. What’s the harm. Why does anyone think that he is less deserving than you.

    And finally what do you gain by fighting here, will USICS look at the post and suddenly decide to change their policy. There is a huge lobby group in the US who will fight for their profits. Everyone here wants to make his life more beautiful and I believe everyone has that right to do it.

    If you still want to fight, cry, whine nobody can stop you and nobody will. Everybody has a opinion and frankly no one is wrong. If you really think your opinion is good, make it count rather than showcasing it here.

    • People who are crying or fighting here are the ones who think that they are out of H1B race this year and having no one to blame are just channelizing it here. It doesn’t matter what skills you have or what specialized knowledge you have, if you made it you are happy and content and if you haven’t then you feel sad which is natural.

      No one here has any right to decide who should get H1 Visa and who should not.
      We all strive for better future for ourselves and thus working towards it in the form of getting any visa or any work permit of different country is purely justifiable.

      I suggest no one should loose any hope till packages are returned to the individuals and at the same time prepare for the worst and prepare for the plan ‘B’.

Also expecting life to be fair to you just because you are good is like expecting a hungry tiger not to attack you just because you are a vegetarian.

      • Man believe I have got tired of people complaining in this forum. But as someone here rightly said, i guess it is just their frustration. They just need a medium to vent it out. It is probably good for them if they vent out their frustration.
        It is just like if lets say in cricket an Indian bowler gives away 20 runs in the last over and India loose the match, people will get really angry. They may curse that player that day. They may also curse the captain for giving the over to him, but then in a few days everything is back to normal.
        In the end i guess all us are educated individuals and sooner or later everybody will be normal. This is definitely not the end of the road for any one of us. People who make it will be happy. People who don’t make it will surely get another chance.

    • I am AD/RP. I called Uscis last week. First they asked for a receipt number. I told them I didn’t have it yet and would like to know if I was selected in th e lottery. They said they can reveal further information only to the employer. I asked my employer to call them, but they have not done it yet. May be you can try calling them too.

      In the same boat. My employer has started looking at Plan B. According to them, all PP should have had receipts handed out by now and they don’t expect to receive anything now.

        Would be grateful if you can let us know what Plan B is in your case. As for me, I’m looking at possible relocation to my company offices in Australia or Canada.

          Looking at relocation plans for now but its too early for them to make a decision as my OPT expires in November.

          Hopefully they can come up with a solution where I can come back in a year. It sucks because I love my job and now because of a technicality, I cannot work beyond November.

    We all are Indians first, stop judging each others. For 150 years British ruled by using Divide and rule, looks like this time its America.
    @Shri–Listen dude, i sympathize with you but don’t be whining baby. To start with, you will get your H1. If not, after October apply for some small university for 1 year course or 6 month course. If you have a full time job now, you can get it again.
    As you have masters, the new immigration bill is coming with some point system for masters for green card, so chill.
    If you want to burst out here, its ok but don’t target Regular (Non AD) guys. Ask USCIS to uncap Masters quota. Good luck

      • xxx i understand. Keeping this in mind, USCIS has kept 20,000 visa aside for we AD guys since 2006 or something. We should complain USCIS to make masters uncap.
        People applying from India for H1b, if their employer ask them that you have opportunity to go to US for 3 months or 2 years or whatever, what you want them to say no we dont want to go?? If I was non AD and in India and someone ask me that you have project work in US, i too would have said yes.
        BUT i am against people who are giving money to consulting companies in India and asking them to “Arrange” H1b.

            But USCIS cant put cap on profession. They are trying to make life difficult for companies with more than 20% or 50% H1b employees from next year. (So i am hoping that people coming through “fake consulting” problem will be taken care of) but putting cap on IT and non IT i don’t see this happening. Its ok for IT people to apply as far as candidates are genuine.

    • Under the new proposed immigration law even though the AD cap will be increased to 25,000 it will only be available to AD applicants from STEM subjects. The merit based immigrant visa will fully kick in from Year 5 of the bill’s enactment, further having a masters degree gives only an extra 5 points over bachelors. And, the degrees are not even required to be from a US bases institution.

    For all those Masters or mathematics champs, can someone do a quick probabilty math and find out the odds of winning this lottery, with 124,000 applications of which 85,000 are to be selected. When I hear, 2 out of every 3 is going to get selected, it sounds positive, but if I hear 40000 applications have been rejected already, then it doesn’t sound that much positive. 🙂

    • Are you really asking for this? I mean seriously!

      1) In the simplest terms, 85,000 visas and 124,000 applicants means 124,000 – 85,000 = 39,000 rejections.

      2) But, the cap is actually a little less than 85,000. Out of 65,000 regular cap visas, 6,800 visas are reserved for Chile and Singapore nationals so remaining visas = 58,200 visas.
      But, the Chile and Singapore cap is never fully utilized so last years remaining visas from this cap are added to this year’s regular cap. Only 1,000 visas were used last year. This gives us 58,000 + 5,800 = 64,000 regular cap visas for this year and a total of 64,000 + 20,000 = 84,000 visas overall.
      84,000 visas and 124,000 applicants means 124,000 – 84,000 = 40,000 rejections.
      So, at worst 40,000 rejections.

      It was really simple to this point. Why did you need someone to work this out for you?

      3) Now to calculate probablity. 64,000 visas and 104,000 applicants means probablity of selection for a regular cap applicant is 64/104 = 0.62 ~ 3 out of 5 applicants will be selected.

      4) Without proper data on AD Cap applicants it is not possible to arrive at a probablity for them. Let’s just say it is significantly higher.

      5) The 40,000 number is the upper limit on rejections. Unfortunately not all of the 64,000 visas selected in lottery will be approved. The denial rate is 10-15%, so USCIS keeps a few extra petitions on waitlist. Assuming a 12% denial, we get ~32,000 rejections in lottery for regular cap. And, a probablity of 0.69 for selection which means a little more than 2 out of 3 applicants will be selected.

      • Thanks Gentoo for your time to analyze. So, 40000 rejections and 2 out of 3 successful, similar to what I mentioned in my question.

        • Not exactly a waitlist. I think they just oversubscribe the Cap-Subject petitions. Check out the USCIS report for H-1B Cap Subject petitions for the years 2009-12. They have always accepted more than 90,000 petitions in the past 4 years to account for denials. Even the total approvals have been usually slightly more than 85,000. Others were withdrawn, denied or closed.

        have you checked this?

        there’s 2 kinds of CPT: full time and and part time;
        since you have already been on f1 status for more than 1 academic year in the US, i believe you can explore the option of degrees that include full time CPT;
        i am not talking about TVU and other fake places;
        look for legit universities and legit courses that allow full time CPT for courses aligned to your job;
        double-check on the legitimacy of the university before enrolling; u don’t want to mess up your long term prospects for the sake of a short term stop-gap arrangement;
        i have seen posts that say that its not legit (i don’t know if they were referring to just fake universities like TVU or in general?); but i have also been reading up university sites that talk about full time CPT if the course actually requires it; so look for such courses that align really closely with you current career path;
        again do not take my word for it, do ur own research- but it may just be one of the options to explore
