USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

    • EAC1314052020 is the latest receipt today at VSC.
      USCIS is sill processing the at the same pace. Keep up the hopes. As of today you can still expect the mails delivered to you on Wednesday or thursday next week.

  6. Its good to see lot of AD guys getting receipts or some information from DSO. But we still have to wait till all of them get their receipt number.
    Even if you have not heard anything from your employer/attoreny/dso, keep in mind USCIS is not done processing all the appliactions yet.

    I just want to thank you VERY MUCH for coming up with and sharing the brilliant idea of checking with DSO!

    I contacted the DSO last night and got the reply this morning with a receipt number!!! although neither my employer nor the lawyer has heard anything back or confirmed the receipt number…

    I know how tough it can be…I was sent to emergency room yesterday because I suddenly started to choke and vomit at work… the test results were due to “stress and anxiety”

      • Its Designated School Official. Most of the universities in US have offices for Interantional students. DSO is the one who updates your change of status (like when you get OPT or change your job while on OPT and things like that) and he can update you on your official visa status as seen on USCIS portal. That is why people with US schooling (either masters or bachl.) are calling them. Hope this helps.

      • My petition filed in RQ but I don’t think it matters if you are RQ or AD since I asked the immigration officer from the school.

    I contacted my DSO yesterday and he said the SEVIS status is currently H1B Petition Pending, but he did not check if there was any receipt number or not. He will let me know on Tuesday. When i checked with my Attorney today, she said that Check has not been cashed yet and she said In most cases, the receipt has arrived before the check was cashed.

    Can someone tell me if my case was picked up or i lost it.

      • I just sent an email to my International Student Advisor asking to check SEVIS Status, or you can directly call Internation Programs and Services (IPS) office and ask them to see if there is any update on your SEVIS.

  15. Ad guys who already have contacted their school and didnt get any update. Best thing would be call them again not before 29th april. USCIS will be done processing most of the application by then, and you will get some kind of update, I believe. Make most of your call and use it smartly.

  16. The DSO approach….(AD/RP)

    Went through this forum every day and found this DSO approach to know the receipt status and it worked. My DSO at international office replied to my question that they see a change of status to H-1 applying is pending with the number wac1313251*** in my SEVIS.

    No notification for my attorney or mail yet. I will keep posted for any update on my application.

        • i called at schhol yest…they are saying your OPT is not expiring so u wont get any update untill oct…:(.. hope i get something today

          • Hi AD/PP/VSC,
            you will be having a status change pending in your sevis . You wont get any update in your opt and again don’t worry if you don’t have anything. I got my H1b approval on 16th and my it doesn’t reflect in my sevis.

          • Same here AD/PP/CSC, no news and school refused to lookup the SEVIS record because too many people apparently have been calling to find out. This is nerve racking man, have been keeping my cool till now, but its getting more n more annoying

          • Couple of people in forum mentioned, even their OPT was good after Oct 1, they still got some kind of info from school. Seems to me your DSO is just reluctant. But again USCIS has not done processing all the selected applications yet.
            They might not be done processing all selected applications before 25th atleast.

          • Just talked to a DSO from a major school in the US and apparently they got sued last year for revealing a sevis update that wasn’t correct. So just an FYI why some won’t share 🙁

    • Actually, I haven’t received any physical evidence yet. The only good news I got is from my school’s DSO and the receipt number he saw on the SEVIS. So, need patience here.

    • Guys I got my Case No from DSO but still waiting on receipt from my lawyer .
      And I checked my case no at USCIS site it’s in initial review phase.

      You have to go to visa. By not even knowing it, you applied for work authorization in U.S

      See how sad it is.

      Lot of people who studied here worked their a** off are not getting thru the lottery.

    What exactly does it mean? I am bit anxious on the wording… please share your thoughts..

      If it is in initial review, it will get approved in 3-6 hrs. My status changed to this around 3PM (CST) and I moved to Decision stated and I got the approval around 7PM(CST)

      • I doubt that. It just means your case is opened. You might go into RFE (request for further evidence) or Decision stage (which is either approval or rejection). So, it seems to me that you can only tell that your petition is selected in the lottery. NOTHING ELSE!

    • I got the same thing and mine was approved in about 3 hours. It can also mean RFE as well. You should wait till end of the day. If it doesnt change to decision, you should contact your attorney to see whether they have received any notice for RFE.

  20. Anyone with receipt number WAC13131XXXXX and still waiting in the Acceptance state….
    Its been like that since last friday april 12th……I see some of the cases around mine getting approved or moving to Initial review……by the way I am AD/PP/CSC………

    • I wouldn’t sweat over it. I don’t know much about H1b. But when I was applying for my OPT. everybody in my school who filed before and after me got theirs. And mine was stuck in initial review for over 3 months. In the end it went over the normal processing time, my school contacted USCIS. they apologized and gave me the card right away. I would think that the USCIS has been extremely busy and they could be reviewing your case any minute:)

    • I was in Acceptance state from April 9 till yesterday when it moved to Initial Review – with the text saying 15 days premium processing clock stopped – and then got the approval around 4hrs later.

  21. I NEED SOMEONES HELP AND ADVISE.
    I’M CURRENTLY WORKING IN THE US UNDER THE OPT. MY H1B VISA WAS APPROVED YESTERDAY.
    MY QUESTION IS, CAN I TRAVEL TO MEXICO FOR A WEEKEND WITH AN EXPIRED STUDENT VISA, BUT WITH A VALID i20? WILL MY TRAVELING AFFECT MY H1B VISA APPROVAL OR CHANGE OF STATUS EVEN THOUGH IT TAKES EFFECT UNTIL OCT 1ST? I WOULD NOT NEED THE VISA STAMPING TO COME BACK BECAUSE I WOULD RE ENTER AS F1. (PLANNING MY TRIP FOR MAY)

    ANY TYPE OF INFORMATION WILL BE VERY HELPFUL! THANKS EVERYONE!

    • Personally, I don’t advice you to do that as your F1 Visa is already expired.

      I think you need a valid VISA to re-enter into USA. But, I’m not sure though.

    • First off, you should ask your lawyer. But from what I know, you cannot enter the US with an expired student visa even if your I-20 is still valid. And also, if you have been in the US for the entire time during your H1b application, your visa is not stamped yet, which again, means that you don’t have a permission for entry. However, I know during your visa application process, you can obtain certain paperwork from your attorney, and it will allow you to travel. But I am not sure if you can still do that since your H1b has been approved and your student visa expired. Congrats on getting your visa though:) That is awesome news.

    • Best to ask your immigration lawyer. But i think you will need a valid visa to return to the country, I20 is not a Visa!

      once you turn in your i94 it means you have left the country, you will go through immigration and there you will need a VISA.

        • Yes, I think you can travel if you don’t come under CAP-GAP. When is your OPT expiring and when are you planning to go ?

          • OPT is good till Nov 2013, visa till july 2014. I am planing to go for 2 weeks in may or early June.
            Also, do i need to go for visa stamping while coming back? (Provided my H1b is approved)

          • you can only travel when h1b is approved. you CANNOT travel while h1b petition is still pending. That means you are giving up your h1b!

          • As Dee said, I think you might not be able to travel with pending status. But once approved you should be able to go and come with out stamping.

            One of my friend is also thinking to do same. But, we are no experts and the best thing to do is contact your attorney.

      According to this info www.ice.gov/sevis/travel/faq_f2.htm#_Toc81222014 I can travel to neighbor countries for less than 30 days with an expired visa and come back. I just don’t know if that jeopardizes my h1b approval.

      • I’m afraid of jeopardizing h1b approval although h1b is valid as of Oct. 1st and as per my attorney can’t get h1b stamp before Sept 20 since I’m inside the US, then I have to travel outside the country to do this and come back.

    • You have to have a Valid Visa to enter the US. The H1b wont start until October 1st so I would not recommend traveling outside until you the H1b period starts

        I understand, its a gray area, there is no sure answer for that. I may have to aviod travelling, I guess.
        @ Benn, have you done it before, with the same case as mine?

        • Why don’t you just ask your company’s attorney? He’s the only one you can trust to give you correct information and it’s his job! He’s getting paid for answering your questions, this is part of your H1b processing.

          • @Yours, Yes thinking to do so. But you know what, with this immigration bill going on, i am afraid it is going to be bit risky to travel outside the country atleast untill the end of this year.
            There is one more option, we can also call CBP (Customs and Border Protection ) at Airport. They are saying its ok but they cant guarantee, because they are like it all depends on the officer at the time of entry. Lets see how it goes.

        • @Manish: Firstly, I am really pissed off by the people who don’t even research and are giving you a totally BS answer. Yes, I go to Canada now and then on an expired F1 with valid OPT (Cap-gap ones are not allowed because in that case you won’t have a valid OPT), valid I-20 endorsed by ISS adviser and a valid employment and may be some pay-stubs to show . There are no issues in doing that till the time you are visiting NAFTA countries i.e. Canada and Mexico not more than 30 days. If someone else tries telling you something else, tell him to wack off.

          Secondly, Congrats and have a safe trip. I have been waiting for mine (RC/PP, bachelors from Penn State) especially because my OPT just expired but seriously, I have decided to stop giving a damn about it now. Worst case, I will go back to school. Fuck this immigration system!

      • Thanks Benn! I had heard something like that before, my only concern is the h1b and the i94. When traveling now would I use my old i94 or the new one for h1b visa even though still under OPT??

        • @Manish @Dee: That’s an important point as well. Make sure you don’t surrender your I-94. You will have to use your old I-94. Another thing is also make sure you don’t apply for H1 stamping there. If for any reason it gets rejected, you will have to fly to your home country from there and get the stamping done and come back.

    I am not Indian but have been following this forum for a long time. It is a fantastic forum and I benefit a lot. Just update my information:

    Vsc/Advanced/Non-pp
    Petition received date: April 8th
    Notice date: April 12th
    Checks were cashed on April 15th
    Paper receipt notice arrived on April 18th-Attorney received it and emailed a copy to me
    ( mail was on the way for 6 days)

    My company is located in MA
    Attorney is located in WI

    The methods to check the receipt No.:
    1. Checks got cashed or not? if cashed, there is a receipt no. on the back
    2. Call school to ask the SEVIS-please note: NOT the SEVIS status, but ask them to see if there is any ” pending” or ” approval” at the very bottom of that page. everyone’s SEVIS status is active if he/she is a qualified student in US with a student Visa.
    3. Ask HR stay with you ( both of you should be together) and call the USCIS official to ask the receipt no. ( HR should be nice enough to do it with you because it takes some time)

        Don’t worry. You could ask them to send a copy to you. Please tell them you could not sleep these days and so tired of waiting. They will understand you and email you a copy.

        Then you could see whether there is any receipt number. Sometimes they may just do not want to tell you but when you get a copy of it, everything will be clear.

          • These fucking top top schools are afraid of getting sued. I wish I could sue them for not revealing information pertaining to me! That is just fucking absurd. My DSO sucks.

      Employer told me that checks were cashed on 4/16 morning, but I haven’t received receipt notice yet. Company in NYC and lawyer in NYC.

    • It means you were selected in the lottery. My DSO told me the same yesterday morning and I got my receipt from the lawyer later in the afternoon. I am AD/RP/CSC.Cheers

          • Thanks! My law firm is in CA but my petition was sent to VSC… So I wouldn’t be surprised if I don’t hear anything this week:P I actually looked up the map and it’s like from the northeast corner to the southwest:P

          • LL-Same is the case with me. I am on the East Coast and my lawyer is in California and the case is filed at VSC.

          • Yeah it’s very frustrating when the lawyer is so far away from the service center. And my law firm isn’t even very responsive about the updates. Anyway, I guess there is really nothing I can do other than waiting.

      • Thanks Bebs. What the fuck is the university’s problem in sharing details! I fail to see their logic. It is more of a rant than anything else. It is an annoying situation and I am sure none of the DSOs have been in a similar position, at least pertaining to status situations. Humanity is down in the doldrums. She must be afraid that I will sue the university. Absolutely retarded.

      • Well, at least you have a receipt number. My DSO doesn’t even share the number. A change of status is indicative that the H1B is being processed, I think. What other change of status can it be?

          • Well, if you have something pending, like I do, the H1 packet must have been opened, that is, to my knowledge, the only way they would know a petition has been filed.

          • Same here, change of status pending, no receipt number. Common sense says that petition was selected in lottery since how else would they know that there was a change of status pending.

          • I really really hope that is the case… I still haven’t heard anything from my attorney yet. This is so nerve wracking:(

    Even though I’ve not posted any msg on this site until now, every one here has been super supportive of one another. I was able to go through these few weeks of anxiety thanks to all your encouraging msg knowing I’m not the only odd one. As such, I want to share this good news with you all that I’ve made it through the lottery! No physical mailed receipt yet but the checks my employer sent to USCIS have been cash with EAC#x…3751 stamped on the back of the 3 checks. I’m RQ/RP/VSC. I wish you all the best of luck and hopefully all of us here will make it through the lottery 🙂

    • Thanks for all the congrats! The checks were indeed cashed yesterday. I’m an accountant so checking whether checks are cashed is my daily job 😀 but you can certainly check with accounting team/ HR. Both my lawyer and work site are based in Northern VA/DC area. I also contacted my DSO last night and got the confirmation this morning that my “change of status” is pending. Wish everyone the best of luck!

  27. THIS WAITING REALLY KILLS EVERYONE!!!

    All the delay is due to the time it takes for the data entry, cashing the checks, generating receipt number, email/mailing it etc.,
    Moreover, getting the receipt number is not the end, its just a starting.
    We need to wait several months to get the final approval. If the data entry and the receipt number generation itself takes more than one month, then the final approval will go beyond Oct 1st.

    Everything in US is computerised, its hard to believe that they manually do the data entry in USCIS.

    A suggestion to USCIS :

    Please change the application submission process as below.
    This will really speed up the application processing time.

    USCIS should completely computerise this process such a way that the below can be achieved.
    Filling the I-129 and the other forms should be totally computerised.
    The attorney/employer who fills I-129 and other forms should fill it in USCIS website directly.
    Once the form filling is completed, the website should give PDF file with a barcode with receipt number in it.
    Attorney should send the print of the PDF file along with the other supporting documents to USCIS for processing.
    Once USCIS receives the hard copy application, they should scan the barcode using RFID and it will pull up the details of the applicant from their database.

    In case of lottery for any year, USCIS should announce the receipt numbers which won the lottery in their website(and also by automated emails to the attornerys,employers & employees) immediately
    after completing the computerised lottery.

    This way we will be able to come to know whether we are selected in the lottery or not immediately.

    This will be much helpful for Fresh H1Bs,H1B transfers, Extensions, even for L1 visa etc.,
    This will really time & money saving for everyone including USCIS.

    Similar procedure was adopted by Indian Passport Office in India as well as here in Indian Embassies.
    This really speeds up the process.

    US should follow India : -)
    If required, UCIS can approach any of the Indian outsourcing company for this automation project. 🙂

    “On April 16, 2013, we received this I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION and request that the filing fee be waived”

    Is it related to H1b, either new or update?

        • I applied thro’ regular processing .. but when i asked if there are any pp receipts , they say no.. don’t know what’s going on …

            They are not even replying to any of my emails now 🙁

            Many of RQ/RP guys have received their receipt …..

  29. Sulk it in, wait is over for all PP guys. Those who have not heard so far are in the 35% of the rejected.
    AD guys are double loosers as they failed twice.

    • Please don’t spread panic here. If you are dejected and sinking, don’t sink everyone with you. There is always hope until either there is any official news release regarding this or if the application is returned back to the employer. People, keep your chin up, it is not lost yet.

    • Please stop spreading rumors. Unless employer/attorney receives the rejection notice, nothing is guaranteed. There could be many reasons for the delay.

  30. Again, for anyone still anxiously waiting, I still believe the “unofficial/official” news update mentioned by others in this forum that:

    1. USCIS are handing all PP cases as their top priority now. So, the end of this month is a reasonable date for those petitions to receive at least a receipt number.
    2. For all NON-PP cases, we really should be more patient and our receipts are either on their ways to our lawyers/employers or are to be sent out. Anytime in the May is not a surprise to me.
    3. Those not selected in the lottery will get the returned package after the data entry of both PP and NON-PP are mostly done. So, I don’t think anybody will receive any returned package in April or even early May.
    4. I have to admit that this process is really driving all ppl nuts and grueling. Nobody can do anything about it. So, just treat yourself and family with a smile if you could. Life needs to move on, even if you are not that lucky. And, never say lose your hope, buddy.

      it seems RQ/RP will not be done until end of this month. 15 day period for PP still in play
      i guss guys on PP still can have hope for a week or so. once Rq/RP recipiet surfaces game for PP guys is pretty much over

  31. I checked the USCIS website only for the CSC applications. Below list gives the total number of application processed on each day from days (128 to 137). I don’t see any applications processes before 128th day or after 137th day. But these applications include New H-1B, H-1B extensions etc., I guess. If the below count is correct, in CSC center alone they have processed around 35056 applications.

    • That is encouraging and disocuraging at the same time !
      Unless we have information of the proportion of new H1bs, that information just leads to speculation.

    • HEY DABC- I was in a same boat but my check got encashed and USCIS mention EAC# behind the check, thats where i got to know my EAC # and got it confirmed from international officer from college and got new I20 for Cap Gap..

  34. Reg/PP/CSC

    Finally got an update of sorts from employer last night. Still no luck, but HR advised lottery is due to be finalised today, so I guess we’ll know if it’s all over by tomorrow. She says they’ve started looking of plan B options for their unsuccessful candidates, but don’t think there’s much available for us (senior engineer with 15+ years experience and masters from top UK university and provisional job offer from top US company, none of which makes any difference in a lottery situation!).

      • Her exact work were (sent yesterday) “The lottery will be finalized tomorrow. At this point, I don’t have any update on yours yet but should be by tomorrow.” We’re taking that to mean CSC have advised they will have processed/emailed all receipts by the end of their working day today. We’re 8 hours behind, so likely won’t hear until tomorrow morning. This may only apply to PP of course.

          • How your HR can know this ? USCIS hasn’t post any news about this. My lawyer said it could take several weeks even for PP applications. I think lawyers and HRs don’t know how USCIS is processing lottery results. They are both wrong. Until USCIS make an official announcement, we know nothing for sure.

        • Here adds my employer’s words “we want to pause on making a final determination until we get a case return notice from the USCIS. I should have final confirmation by the end of this week.” I’m not sure whether she will get a case return notice today (I’m UK time as well) or what will happen on Friday. But I’m holding my breath now 🙂

          I’m in the same situation as you Apple Fan (apart from the fact you are much more senior ;-)).

          • Hi gbav, my employer is in the bay area. The lawyer is morgan lewis according to the HR, but I haven’t got chance to talk to them.

            A bit anxious in waiting for the California daytime to arrive.
            (and I feel a bit guilty monitoring this blog at work :P)

            Mine is Fragomen and they just want you to wait until they hear one way or other. the uncertainity is excruciating !

          • The wait for California daytime is so stressful – come 4pm, I start checking emails obsessively!!

            (It’s actually my husband who’s the applicant – I’m currently out of work and therefore free to spend all day on the internet, having taken voluntary redundancy from my own professional career at the end of last year on the naive assumption that a job offer meant we were definitely moving. How silly was I!!)

          • @gav, when the BST time came, I was in Italy and that’s 9 hours time to wait! That ruined my holiday 😉

          • Our lawyer’s from Morgan, Lewis & Bockius and employer is in Silicon Valley. It seems like CSC has been slightly slower than VSC, but they are getting there.

            Regardless of what happens today, like others have said before, it’s not truly over until the package is returned!!

          • @apple fan: according to people’s post, there are still PP receipt generated yesterday from CSC, like WAC1313753821 and WAC1313753829. Finger-crossed that we will see some emails coming in a few hours later, with good news!

            (although I keep telling myself to stop day-dreaming :))
