USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

  3. Mine is AD/RP/VSC.. My lawyer has received 2 receipts for AD/RP/VSC out of 4 petitions she had filed.. Is USCIS sending receipt notifications in the order of selection in the lottery? Do I have any chances even though my lawyer has received receipts for all the AD/PP cases and 2 receipts out of 4 AD/RP/VSC petitions? Thanks Guys!!

    • I just got an answer to my own question!! While I was writing my question here.. My lawyer e-mailed me my receipt and I checked on USCIS where my petition has moved from acceptance to initial review.. Guys.. Be optimistic.. I am very optimistic that all AD candidates will get their receipts very soon..

          • Same here guys. AD/PP?CSC. I have been consistently checking receipts and I saw over 300-400 PP reciepts outta Cali yesterday and around the same number for Vermont. Looks like they are still doing PP petitions, so dont lose hope just yet

            I am completely lost. again go back to school and rip off yourselves.
            Feels like, entire life what we have established here have been collapsed by these consulting companies. Lottery decided the fate. how stupid it is…
            Why give H1 to H4s and L1s. They already have jobs. They don’t even know how to speak and basic etiquettes to follow in U.S based work environments. We wrote freaking GRE, TOEFL and did everything wnd finally got nothing. We are loosing everything now. Job, status etc etc… didn’t even cleared a bank loan for studies. what the hell we’re gonna do to clear that now?

          • I know one guy who came here last year on H1. He was working for some stupid consulting firm in India. He went to get married in Jan and he got her H4 stamping in Feb and came here in March and applied H1 in april.

            She already got approved for 3yrs. Where we are and what went wrong from our side? Is she going to boom the U.S economy and help americans find job?
            create some jobs inU.S? Is she gonna invent some new product which helps U.S economy to boost up and get profits? What kind of lottery system is this?

            Is it just a luck? what luck is it? What the hell went wrong? Its unacceptable.

          • US govt is not understanding the fact these consulting firms are making money in USD and paying no taxes for what they are making and the same thing with their employees. I saw lot of people who shows lot of deductibles when filing the taxes and lot of stuff just to save the tax amount not paying the exact tax for what they are making.
            Apart from this, there is no use of all these people here. even a bachelor guy can do what they are doing here for less money. They are not doing rocket science. why you need these people here? Coz, they are paying more taxes? No they are not. Everyone is here for freaking money. No one wants to boom your economy or no one is more zealous about their career.

            Its all stupid crappy work what they are doing here. We don’t really need their work to run the companies.

            The guys who are working in IT are already fed up with outsourcing to India. It has become more difficult to the graduate to find a job with outsourcing. Now H4 & L1. Who will be benefited by this?

            None other than consulting firms in India and their employees.

      • It looks like Advanced Degree holders have started to get receipts. I guess we can expect to receive notifications at least by the end of April… Thoughts?

        • I am thinking receipts will start coming in from today for people like us waiting in regular cap. I also confirmed with my employer.

      • Got info from ma attorney that it might take some time between mid of May to end to issue all the regular processing receipts.

      Did you checks get en-cashed?
      Who received the receipt? Is it your employer or attorney?
      I live in central Oklahoma. Not sure when we will start receiving the receipts.

      • My attorney received the receipt and e-mailed me. They got the receipt through regular mail. Fragomen informs you first and then updates on their website(mine is still not updated on their website).

        Not sure about checks getting encashed although the receipt says that they have received the amount(i am assuming its encashed). I am not sure about Oklahoma though.

      I am not sure I understand this receipt thing!
      I wanna email my lawyer now but I want to understand what is the question to ask.. should I ask her “have you received any receipts? or have you received my receipt? or have you heard back from USCIS?” Suggestions?

    • Congrats, buddy! I’m in Florida, too.. Not Fragomen though. Now I’m really anxious if the first AP/PP people from FL have received their notices… Not worried at all yet, just hoping that the wait will be over soon. What city are you in?

  6. Any one from Infosys got any update from the GI team? I asked them if they had any receipts at all…no answers for that question but just one sentence that wait for some more time..

    I know my company issues visas in and out and it has in a way affected all of us…hate it..

  8. The check in the amount of $290 (filing fee for I-539 for my wife’s H4) I mailed to the USCIS (along with my I-129) was encashed this morning. This probably means that my I-129 was selected. Is it correct? I am AD/RP/VSC.

    • I have read somewhere that USCIS is targeting 2nd June as their deadline to give selected receipts.

      Can’t they just declare at once…. 🙂

      • Seriously? Very nice of them, since my OPT expires one day after that. So I’m supposed to buy a plane ticket and settle everything in one day if I fail…So thrilled!

    • Yes, it is over. Only few mismatched file, but overall gone so you have probability of 0.001 for gettting selected out of 1000 applications.

      I received mine yesterday. My employer received the receipt yesterday and my lawyer this morning. So check with both.

        • Tina: Yes and that’s the reason I wanted to reply to you. I am sure that they’re processing AD/RP to a minimal now and will be on a full force by Friday. They’re more focus on PP. It’s via USPS snail mail. I was informed by my employer first yesterday and today an email from my lawyer about the receipt. I will pray for you too.

          Akanksha: It’s a receipt not an acceptance but I am happy! Thanks. I will worry about 1.5 months down the line 🙂

        I’m in a situation where my wife received I-797 for H4 but i did not receive H1b receipt.

        • Only $290 has been cleared. According to 2 experienced immigration attorneys, this shows that my employer’s h1b petition on behalf of me has been selected. Since my employer mailed I-539 for my wife along with the I-129 for me, the USCIS is not supposed to cash the $290 if my employer’s H1B petition on behalf of me has not been selected.

      Good luck to all the ppl who are waiting. I think all masters people will get through. I see that USCIS is not sending out any rejections so far as they might be waiting for a final announcement of the very famous immigration bill which is under last leg of discussions.

  12. Is anybody tracking daily how many receipts were issued in USCIS as of now to see how many left out of 85K . I tracked for past few days. The last 2 digits may not be exact. But approximate count we can come to know.

      • I dont know either, but my lawyer told me that they are still receiving PP receipts via snail mail (no emails) that’s what making me keep my hopes alive.. I am same case as yours AD/PP/CSC

          • Last week update out of 40 only 2 are selected. I don’t have any information on which category those 2 will comes under.

    • I think $10,000 is not big enough to stop the outsourcing companies. It may slow them down at the most. Simply put they should not allow H1Bs for outsourcing. H1B is for people who want to live and work in US and who are very good at what they do.

      Maybe they should have an exam like GRE/SAT only those who pass that should be given H1Bs.

    The changes under the Comprehensive Immigration Reform (CIR) put a curb on use of H-1B visa for those companies which have a higher ratio of work force under this category.

    Most of the Indian companies will fall under this classification.

    The companies will also have to shell out more fee to get a H-1B visa, if the draft legislation is cleared by the Congress and is signed into law by the US President.

    The US, according to the 17-page outline of the ‘Border Security, Economic Opportunity and Immigration Modernisation Act of 2013’, will crack down on abusers of the H-1B system by requiring the dependent employers to pay significantly higher wages and fees than normal users of the programme.

    If the employer has 50 or more employees, and more than 30% but less than 50% are H-1B or L-1 employees (who do not have a green card petition pending), the employer will need to pay a $5,000 fee per additional worker in either of these two statuses, the outline of the bill said.

    In case the employer has 50 or more employees and more than 50% of these workers are H-1B or L-1 employees who do not have a green card petition pending, then the companies will have to pay a USD 10,000 fee per additional worker in either of these two statuses.

    As such, large Indian IT companies like TCS, Wipro and Infosys will have to pay $10,000 for each additional H-1B employee they would be hiring.

    Such a thing will not be for companies like IBM, Intel or Microsoft who are based in the US and majority of their employee are American nationals.

    In case of companies like TCS, Wipro and Infosys, which are headquartered in India having large off-site offices back home and depend on a small strength in the US, will be affected by such a provision.

    The bill proposes that in the fiscal year 2014, companies will be banned from bringing in any additional workers if more than 75% of their workers are H-1B or L-1 employees.

    This provision is in accordance with the US plan to crack down on use of H-1B and L visas to outsource American jobs by prohibiting companies, whose US workforce largely consists of foreign guest workers, from obtaining additional H-1B and L visas.

    Under the bill, the Secretary of Labour must establish a searchable website for posting H1B positions. The site must be operational and online within 90 days of the passage of the new law.

    It requires employers to post a detailed job opening on the Department of Labour’s website for at least 30 calendar days before hiring an H1B applicant to fill that position.

    The bill also restrains employers from recruiting or giving preference to H-1B or OPT workers over American workers.

    It also proposes to establish significant new authorities and penalties to prevent, detect, and deter fraud and abuse of the H-1B and L-1 visa systems by fraudulent employers.

    Don’t you think that the situation is ironic ? Because this visa is used mainly by IT people and in 2013 we cannot know directly the result of an electronic lottery. I really think it wasn’t difficult to give a number foreach application received by the USCIS and publish directly the result of the lottery.
    It’s just that I have the impression that USCIS is hidding something. Even if I’m selected, I will have the feeling that I’m not wanted by US government. I’m just a number selected by a lottery…

  23. Dear God! Thank you! I just received email from my employer stating that “I’m sending this email to happily announce that we have received notifications for each of you stating that you have indeed been granted your H1B valid as of October 1, 2013! ”

    Does “granted” mean selected in the lottery or approved? Because I didnt get any receipt number from them, just this emai….

    Moreover, I want to thank everyone on this forum! Without you guys’ support and pray, I could not have made it thus far. Good luck everyone! I pray for everyone on this forum will get the receipt!

          Thank you for the congrats! Dont lose hope! I just received an email from attorney this morning with my receipt number. And the status is still acceptance, so it hasnt been approved yet. I guess yesterday, my employer said that we are granted the H-1B visa means we are selected.
          They are still sending out emails and mails. They are just a little behind due to the high volumn of workload. Keep my fingers crossed for you. Good luck Jeff!

        • @d: great observation and you have put it in a very funny way. Being an Indian, I have used “even” all the time without thinking that this might be also one of the interpretations. Coming back to your question, I think the use of word “even” in such situations is intended towards moral support meaning that “you are not alone in this, we are also there with you”. At least this was my intention whenever I might have used it. 🙂

        Thank you! Yes, I am on premium processing. Just received another email from attorney with my receipt number. And i checked the status which is acceptance. So i guess its not approved yet.
        For non-PP, they just started sending out mail this week, so it should take at least one or 2 weeks before you receive the receipt in mail. Dont lose hope! It just started! I will pray for everyone on this forum. Good luck!

    Do you think US of A, the largest and most dominant economy of this world relies on a lottery system for the prosperity and growth of their industry?
    May be they are well aware of the deficiency in their immigration policies and are working hard to pick up genuine H-1B petitions from the received lot and using the word lottery selection to avoid any question that come their way.
    Else why wouldn’t they publish the entire list of selected petitions and return all the unselected petitions (except waitlisted) right away?
    Why would they hold on to all the unselected petitions till the last day of this selection procedure?
    Please note, these are just my thoughts and I don’t really claim that USCIS works this way.
    I would like to invite all readers and active bloggers on this forum to share your thoughts…
    Lastly, I don’t want to deprive anyone of hope and wish luck to all those who are still waiting for their results…

    • No. USCIS does have a real lottery. The delay is due to it being short staffed. There are only two centers (EAC & WAC) of USCIS processing all 124,000 applications. The delay is natural.

      Please realize that if USCIS pretended to conduct a lottery and instead used some sort of merit based filtering then any of the ~40K rejected applicants and their attorneys can sue it for malpractice. It would be a pretty expensive class action for USCIS! Further the officials who authorized this filtering would also be criminally prosecuted.
