USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

  1. Just received an email from my HR that USCIS has acknowledged the receipt of my application. Did not get the receipt number from my HR yet.

    My husbands H1b is filed as regular . Is there any update , if the processing started for regular.
    The employer has they are waiting for an update within next week or two.

  5. Noticed that the last application (possibly for H1B) at Vermont center was EAC1313754844 on Tuesday. Would someone know the last one from Monday to get the number of applications processed on Tuesday.

    Of course it includes all other kinds of petitions as well.

    • EAC1313754844 means, EAC-13-137-5-4844. Which tells us that 4844 applications were processed on that day (working day 137 of fiscal year ’13).

  6. Just out of curiosity. Will the attorney get his full fee even if we are not selected? The reason i’m asking is to know if the attorneys too will be anxious to know if we are selected or just feel “i don’t care if this bugger gets selected or not, as I got my full fee anyway”

  7. For lawyers/employers with lots of cases filed, how would they know which employee’s file got selected in lottery even if the check gets cashed – won’t they all be the same amount for similar cases?

    • When USCIS cash the checks, they leave receipt number or kind of memo, which implies to correspondence employee. good luck

      • But that would mean that you would have to know your receipt number. We’ve had quite a few people here who realized they’ve been selected by having their checks cashed without having received a notice. Maybe they leave the name of the beneficiary.

        • For me and stupidity, we are the only ones applying from our respectives companies. That being said, I have nothing yet 🙁

    i had a question What if i get through a lottery and file rest of my H1b application process in premium How much will it affect ..

    Coz, thats the only option i have now.

        People say there are more chances of RFE in this case ??

        • Not sure about these things. I think your attorney can better assist you in this. Ask some people who have done this in the past and they can give you a precise answer.

        • Yes they say its lil risky, becoz PP cases are evaluated by experienced ppl since they have to be done within 15 days , also sometimes if USCIS seeks more time or they r overworked they can issue RFE for some silly reason, so they get extra time.
          But I am going for PP most probably, mine was regular processing too.
          See, there are mainly two reason becoz of that u get RFE, either something is messed up with ur docs or somehting is wrong with ur employers documents. The best thing you can do is, call your employer and ask him that you want to go for PP and how he feels about that. If he has sent all the documents correctly and he suggests that its ok to go, you can upgrade your application to PP. Good luck

      Do u have any idea if regular/non pp/vsc started receiving receipt or atleast got to know the status by means of check getting cashed.

      I just saw 2 guys updates in this forum, Manish and the other ones name ia updated as “stupidity”. I guess these 2 guys are AD/RP.

      Has anyone in regular/non pp/vsc got any update ?

      • I had asked in the afternoon at around 3:00 PM to my employer. He said he had not received any acknowledgement for any one for whom he has filed in RP/RC/VER.

      • Hey Savitha,
        In regards to your question, How long it takes? Find out your attorneys location and your service center, and u can estimate rough time for mail to reach to ur attorney from USCIS centre. and then if ur attorney is active enough he will let ur employer know and ur employer will inform you.
        In my case, before the mail, my employer got notification about check cashed, which is another indication that they are working on your application, in other words you r selected in lottery.
        Lastly, USCIS is genrating around 6-8k applications per day, with that speed they will be done sending all applications by 25th april. if your application is in the last day lot, then they will send it attorney n then to employer n then to u, which can take extra 1-2 week. So there is nothing to be panic about till 1st or 2nd week of may.
        After that also USCIS will replace rejected applications with waitlisted ones. Bottom line, keep your hopes alive untill u get the package back. but I know you will get the receipt number in next couple of day 🙂 Good luck

          Well, even I tried to check my employer around 2 days back about the check getting cashed.
          As updated by them none of the checks are being cashed. They also told me that they would inform me as soon as my check is cashed.

          I have a question : Will the check be cased as and when they pick up the application for processing? Or, all the checks already cashed for the selected application

          As you mentioned, till 25th april, they might process the application. So, does it mean that there are chances of check getting cashed till 25th april?

          • If the application is selected in lottery, they open the package and make sure the amount on check (filing fee) is correct and then they cash it.
            Now, in most of the PP cases they emailed the receipt number first and then cashed the check. But for regular processing (your case and mine), trend is more like they are cashing the check and then sending an postal mail. So if your employer keep track of bank account, he will come to know as soon as check is cashed.
            25th april i mentioned is just the estimate, it can be couple of extra days and it all depend on speed of their work. (for example someone mentioned california center yesterday processed 3200 applications and today 2700).

            If the check is not cashed, then it means H1 is not through. So it roughly gives an estimation.

          • its not about company, you r missing the point. its the location of attorney. because uscis dont send the mail to your employer, they will send it to your attorney(in most cases) and then attorney will inform ur employer.
            my attorney is in california while my company is in new york.

            ALso, please tell me is the check cashed just before sending the receipt. This gives me a approximation as how long i can wait ….

          • Looking at the trend from today, like in my case and “stupidity’s” case check got cashed and I believe they have sent receipts to us, so we are waiting for receipts.
            If you have any more questions, i will reply u after 7-8 hours, as i am going away from my system .

    I understand from above updates that the Regular processing is already started as week ago and 650000 applications were chosen from the total applications received. Is there any time duration when we can expect an update from USCIS/Employer. How do we know that our application is accepted? Do we receive any notification for any of the case (selected/rejected)?

  10. My employer requested for 3 years but submitted client letter for this project for 14 months … So they approved till that day and I need to file for ext based on next project. I am rp/ pp/csc

      USCIS told that, its been delayed and they are still doing data entry.

      • They notify the HR in my company and HR called me this noon. My guess is that it took time to mail to fragoman and then they will email your employer.

    I have been following the forum for few days now. I am about to finish the medical residency and applied for job. I was pretty confident early on, but as each day goes by my level of hope coming down too. I am in regular quota/regular processing and Vermont center. Haven’t heard any word from anybody. Checks not cashed either………

    • one more thing, How long do you guys think that I should wait before starting thinking about plan B (which I dont have so far)

      • Patience! We just had the first few people from RP receive their notices today. There is absolutely no reason to worry yet.

    Increase H-1B base cap from 65,000 to 110,000, can go as high as 180,000

    Dual intent visas for all students who come here on bachelor’s degree programs or above

    Startup visa for foreign entrepreneurs
    Repeal Diversity Visa Program(Green Card Lottery)
    Repeal F4 green card category for brothers and sisters of U.S. citizens

      • The bill proposes work authorization for spouses of H-1B workers only if the sending country of
        the worker provides reciprocal treatment to spouses of U.S. workers. Unfortunately, India does not provide work authorization for spouses of Employment ‘E’ visas.

          Conversion of ‘X'(Entry) visa of the spouse of an employee on an intra-company transfer into Employment Visa may be permitted within the country subject to fullfillment of the following conditions:
          1. The Applicant will have to fullfill all the conditions laid down for grant of Employment Visa.
          2. Conversion of ‘X’ Visa into Employment Visa in such cases shall be permitted only with the prior approval of Ministry of Home Affairs.

          • You are going off track.
            The current H-1B and H4 visas of US are similar to E (Employment) and X (Entry) visas from India.
            1. Spouse of an H-1B visa holder is given an H4 visa similarly, spouse of an E visa holder is given X visa.
            2. H4 visa holders are not authorized to work similarly, X visa holders are not authorized to work.
            3. H4 visa holders can apply for an H-1B (or other work visas) for themselves and can work if it is approved similarly, X visa holders can apply for E visa and can work if it is approved.

            What the I Square Bill is talking about is, spouse of a H-1B visa holder automatically gets to work on H4 without applying for H-1B if the sending country reciprocates the system. India simply doesn’t.

  19. I am Regualr Quota /PP. I am so worried. I have been checking my email evry now and then to see if my employer send any emails.. But no update.. I am praying god I am accepted and gets approved.. Wish all the folks best wishes

    CSC seems to be processing applications very very slowly – Last CSC application processed – WAC1313551825

    Looks like PP still has hope and everyone here please dont give up so soon, I have said this before and I say this again, even if our PP petition was processed today we wouldnt know until friday/monday when the mail would reach us. I know its a horrible state to be in but we have to power through.

    Application reached USCIS on April 5th

    Employer checked the bank account right now… Checks not cashed yet …

    Is USCIS considering the selected applications in the order they were received? Meaning I will find out the last because my application got there on the 5th of April?
