USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

      • One can’t even pray coz the game is over but we still don’t know the result :). The worst part is in this age of technology USCIS only sends email for PP and snail mail for RP. The last I heard Email’s were a free commodity…

          We have a form G1145 ( I suppose). If your lawyer submitted this form with email id and mobile number, you will get text/email updates.

          It does not depend on regular /premium processing.

            Clip the completed G-1145 to the front of the application or petition you are filing.

            This service is only available for forms filed at our three Lockbox facilities located in Lewisville, Texas; Chicago, Illinois; and Phoenix, Arizona.

    I feel AD’s have good chance to get selected but still very very nervous .

    RQ/PP/CSC. USCIS didnot send an email, they received the receipt in regular Mail.
    Praying for all..

    • same waiting …attorney misunderstood USCIS guidelines and didnt file PP while applying …now need to wait till i get my receipt for knowing they result !!! phewww….this waiting thing is so frustrating …thanks to this blog atleast know some update

  5. Anyone in Regular Cap on Regular Processing (not premium) heard anything yet? California Center here, waiting still. Also, is it 100% confirmed that Regular Processing people get mail and not email?

  6. USCIS has started the data entry process for H-1B petitions selected in the lottery. Premium processing cases are being handled first and data entry for those cases should be completed by April 15. USCIS announced on March 15, 2013, that the 15-day premium processing clock will start on April 15. At the AILA Spring CLE conference on April 12, 2013, Donald Neufeld, Associate Director of the Service Center Operations (SCOPS) Directorate, informed the audience that data entry for non-premium processing cases will begin after the premium processing cases are entered. Data entry for non-premium cases will likely not be completed until sometime in May, and rejection notices for petitions not selected in the lottery will be sent out after that. Please note that when the cap was reached on the first day in 2008, USCIS did not complete data entry and issue receipt notices until late in May. Non-premium processing cases can only be converted to premium processing
    after a receipt notice is issued.

    “the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER. A notice was sent on this date explaining the specific reason for stopping the premium processing of your case. This notice will contain detailed information on further action required by you. Your premium processing receipt notice contains contact information for direct inquiries on your case.”
    Does this mean a RFE?

    • Not necessarily. This is an intermediate state. You need to wait for an hour or two for the actual status.

    • Hi, my status changed a few minutes ago to the same thing. I then talked to my attorney and she explained to me that the USCIS’s update system is confusing and some changes in the past times makes it confusing. Based on their experience it may be three things:

      1. The case is approved and they will email and then mail the approval.
      2. RFE
      3. The case is still being processed and this is a system glitch.

      I hope for the best for you, me and all here. All we have to do is wait.

        • Its happen to me as well. Any idea guys ? If it is RFE than Circle should highlighted with Request for Evidence but its saying Initial Review and On April 16, 2013, the 15-day Premium Processing clock stopped on your I129, PETITION FOR A NONIMMIGRANT WORKER.

    • Hi ther is nothin to worry… As stated its only a system glitch which happens ever for h1 transfer under premium processing, ma fren experienced for h1 transfer. Keep refreshingly once in a while. She got it approved in 3 hrs… It may be RFE, approval or it may remain in the same status it was, nothin to worry.

      If your case is genuine, it means your application will be approved. I was going bananas yesterday after I got this message. But in 2 hours, the status changed to Approval.

    the new reform bill is supposed to be passed today but post poned to wednesday due to boston blasts.

    once that bill is passed cap would increase to 1,10,000 so the rest people who were not selected in lottery wil also be issued the receipt no.s

    and the bill will be effective from FYI 2014.

    so hope this works out and dreams of many friends come true 🙂

      • Sweetie you are misunderstanding. The bill IF passed will be applicable from FY-2014, that is next year..so it will actually be applicable for 2015 H1B visa cycle, not the present one.

          • Vijay, again reiterating- this bill will not be applicable to us if passed..A- This is just a bill yet not a law. B- If the law is passed, it will be applicable from the actual financial year 2014 which commences in April 2014 and hence will take into account visa applicants for 2015 cycle. I hope it makes sense to u. BOTTOMLINE-this bill /law will not impact us this year so dont build false hopes.

    • Are you saying they will raise the regular cap to 110,000 or regular and masters to 110,000? Clarify please. Eagerly waiting. If total is 110 then again MF lottery.

    • I am sorry but you are completely wrong. The reform bill will be introduced today and the hearings will start later this week. Scores of amendments are expected. Once the Senate and House approves the bill, it has to be signed by the President. None of these are expected to happen overnight. It could take weeks, most likely months before anything can pass in the US congress. The implementation dates haven’t been finalized and will not be for a while.

      Reform has been discussed/tried many times in the past (most recently in 2007) and they have been unsuccessful. So don’t pin your hopes on this Bill yet.

    • I am sorry but you are completely wrong. The bill was just introduced in the Senate and not passed. Passing a bill (as complex as this one) are very slim. Dont pin your hopes on this bill.

  11. My wife received I-797-C with WAC13131***** today by mail for H4. My H1 and her H4 was applied together. I have not heard anything from attorney regarding my h1b receipt. I have applied in Regular/PP/CSC. Am i selected in lottery ?

    • It’s almost similar case like mine.. My attorny got the e-mail reciept for my H1 and forwarded to me ..My wife’s H4 WAC no, we got in USPS mail yesterday.. so I am quite certain, your petition has been selected in lottery and you should receive your WAC soon, contact your attorny/employer.. p.s. mine is Reg quota/PP/CSC..

      • I contacted my attorney and they mentioned they did not receive anything on my case yet. Received I797-C for H4 to my home address. Stil waiting for my H1B receipt number.

      I am also PP/AD/CSC case and no email/mail notice yet. I almost gave up as I heard yesterday was the last day for data entry for premium processing.

    I can see now people are getting approval for non premium petitions too. Should I wait or try extend my OPT now.

      cannot everify my company as its a bog organization.

    • Really!!! Please read that question to urself and ask again. If you could apply for an OPT extension why not do it, What difference does it make to have an OPT in hand either u get H1 or Not

  20. It seems to me that almost all AD cases will get thru…95% or so. yay for u guys! and even PP cases-both regular and AD are getting a preference! Looks like 8 out of 10 posts I read from Regular quota/ PP-have got receipts..SO That leaves ppl like me Regular quota/RP in a fix! still waiting and hoping that I am wrong on this. PP cases obviously mean expedited processing..but USCIS shudnt be cheap/dumb enough to give PP cases an edge in lottery!

    • PP cases do not get an edge in the lottery. It says so on their website. PP cases only expedite the process to recieve an ajudication within 15 days.

    • I don’t think cases are selected on PP or RP basis . I know its seems like it here that they are giving preference to PP but it can’t be true. So hang in there ..FYI I am In AD/RP/ CSC and Waiting with you guys .

      • I think simply because the PP people are notified earlier doesn’t mean USCIS has a preference…if that is the case surely they will be grilled once found out…no way they dare doing that

        • I hope so too guys..i hope they don’t PP cases as a revenue stream! it should ideally be only for adhering to the 15 day TAT. Neverdaless…m regretting every day that I dint push more for my case to be processed in PP!

    WASHINGTON (Reuters) – The Senate immigration bill outlined Tuesday attempts to meet long-sought demands from America’s technology sector for more high-skilled workers from abroad to fill the gap created by a shortage of American candidates.

    Under the proposed bipartisan legislation outlined Tuesday, the official quota of “H1-B” visas for high-skilled, foreign workers would increase by 69 percent to 110,000.

    But businesses would need to pay these employees high salaries and ensure qualified American applicants are not passed over.

    The visa quota could go as high as 180,000 in future years from the current 65,000 limit, based on certain conditions, according to an outline of the bill.

    In addition, the number of visas for foreigners who hold advanced degrees from U.S. universities would increase to 25,000 from the current 20,000.

    Businesses, particularly tech companies, have lobbied for more H-1B visas for years. Companies apply for these visas annually, and demand routinely outstrips supply.

    The H-1B is a nonimmigrant visa in the United States that allows U.S. employers to temporarily employ foreign workers in specialty occupations. The duration of stay is three years, extendable to six years.

    Earlier this month, the United States awarded 85,000 H-1B visas while receiving about 124,000 applications.

    Critics of the H-1B visas say the program allows companies to pay foreign workers lower salaries than they pay to Americans with comparable skills.

    To address this concern, the Senate’s draft legislation calls for employers “to pay significantly higher wages for H-1B workers than under current law,” the outline said.

    Businesses would also need to advertise to American workers first any job openings that could be obtained by foreign applicants.

    Companies that are found to be abusing the visa program would be hit with penalties.

    More broadly, the Senate’s proposal would phase in requirements that businesses of all sizes verify an employee’s work status.

    Separately, the proposed legislation would create a new visa for foreign entrepreneurs looking to emigrate to the United States to start their own companies.

    Another part of the proposed legislation creates a new system for admitting temporary workers for unskilled jobs – janitors, hotel and restaurant workers and laborers – for companies that can show they need them.

    Businesses will need to file an estimate of the number of these employees they want to hire, the dates of employment and a description of the type of work.

    Businesses can be denied permission to hire these workers if they have previously violated certain U.S. labor rules.

    Yet another section of the legislation would cover the flow of agricultural workers, creating a new “guest worker” visa program to ensure an adequate agriculture workforce.

    A portable “W” category of visa would replaced the current H-2A visa program for agricultural employment.

      • This will not be for this year, because they want to change the structure of application. Like minimum wages n stuff, so its not untill next year.

      • Manish has written an excerpt from a reuters reports which uses the word OUTLINE . I feel its just a draft and is yet to be presented in the senate and the house for their approval. H1b is not the only thing this law addresses, it might also address the issue with illegal immigrants. So I would suggest you to please not to pin your hope on this law for this year.

    • In light of what happened in Boston yesterday, any immigration bill will be shelved unfortunately. The bill has to be go through congress consisting Senate and House of Representative, and signed by White House to be a law.

      However, the ability to not agree on anything in congress will rear its head in this ugly fought immigration bill. Remember, this h-1b section is a part of the larger immigration reform bill. Although this has garner traction with the majority of the Americans.

      The politics of this cannot be ignored. The Democrat control the Senate and the White House; the Republicans control the House of Representatives. Congress is going to have its election in 2014. This is a tough bill to sell.

      Even if this bill was approved by Congress and White House, I doubt the bill will be retroactive.

      Just some political insight into American legislative process!

      • Yes! There is still hope. I talked to my lawyers today. They told me in some cases the get the H1B approval notice before the receipt. It is kinda rare but there is still a chance. Tell your attorneys to check their mailbox. Good luck!

    • Congratulations! Fragomen told me today that my chances are close to 0 (zero)… AD/PP/Vermont. The only positive outcome possible is if for some reason email wasn’t sent/didn’t go through.

    One of my friend got his receipt through mail. He applied under master’s quota, regular processing, Vermont service center. I’m yet to receive the receipt applied under AD/RP/VSC.

    • still waiting… AD/PP/VSC there is nothing to do except wait and hope for the best and plan ahead. I just keep telling myself that it is not over until it is over. Until I get my application back I will continue to hope.

    • Wouldn’t it be more logical to send out rejection/non-selection notices first so these ppl can look into/carry out other plans, instead of sitting in the chair of uncertainty and having to wait forever to only receive a bad news. For me, I can’t even rent an apartment and have to bother a friend until I get a notice. And they are going out of the country for vacationing soon, I might as well end up in a hotel for an indefinite number of days. :I

  29. My case status changed to RFE this morning and again changed to Initial Review ‘the 15-day Premium Processing clock stopped on your I129,….’. Not completely sure whats happening. Does it go to Initial Review when in RFE? Please reply if anyone has any update on this or faced the same situation.

  30. Some of my friends RC/PP/VSC got notified by their lawyers today…so don’t give up hope
    I’m RC/RP/VSC…nothing yet, no receipt, no mail, no check encashed…feeling crushed and hard to breathe. Employer worried too…I’m the first foreigner they hired. I know the chance is small since I only did my bachelor’s degree in the US…not a master…

      • Thank you man…My company is a small one and they never had a foreigner before…Anyone leaving would be bad for the business now…I’ve been here for 6 years, having a significant other too, who is also a foreigner doing a PhD…So worried I cannot eat or sleep. What is your status?

    • I’m the same Reg/Reg/VSC and no news yet. Don’t give up hope yet as RPs just started receiving receipts this week. Plus the chance of being selected is slightly higher than not being selected. 8D

  31. I noticed that the case number before me was in initial review and the case after me has been approved. Mine is still in Acceptance status. (California Service Center). Is it normal that they skip certain cases and approve not by strict order?

    • No, don’t give up, Lilli! We keep seeing PP people today that got their receipts in the mail and never got an email. Your case may already have a case number assigned, but they didn’t send an email. Just wait until the end of the week, ok?

      • I feel soo bad guys 🙁 I cant handle all that stress, my lawyer called them in the USCIS and told them that she did nt get any thing for the 8 PP that she sent! Thet told her that could happen and that they now started the PP :(((((( she was telling me that she is gonna discuss with me the future plans , and that I should not hope more.

      PP people should wait till 30th april, because USCIS started PP cases on 15th and they have to let you know by 30th. Since few ppl got their H1b’s approved yesterday itself. So their is possibility that USCIS may issue you receipt on 29th april and approve your h1b on 30th. Before 30th they have to give you some infomration.

      • The 15 days clock starts only after PP folks recieve Receipt and in Initial Review. If receipts are not received for PP wait and hope for best.
        It does not mean all PP folks should be answered before 30th April 2013 on Approval or Rejection. Please read USCIS release.

  34. Guys Who got their receipt numbers,
    Are you following up with you attorney/employer every day or they are kind enough to let you know on their own?

    • My attorney is a shit …. She helps me a little from the beginning. She even did nt give the news of the lottery to me. Today I asked her about the new Reform Law and my receipt no. She only replied “No Receipt Yet” .. my poor luck.

      • Thats good, atleast she is replying.
        Talking about reform Law, you can get better information on google than through her. In nutshell, they will probably increase H1b Caps but at the same time they are going to make eligibility criterias strict. thats what i got after reading one article. Good luck for your receipt number , you will get it 🙂

    • I called my employer and he told me that he has received all the receipts for pp cases but didn’t get any receipt for RP cases.
      He said he is informing the candidate as and when he is receiving any update as he is aware of the situation.
      He is expecting RP by EOW only. All the best guys!!

  35. I am seriously frustrated..

    I am in Regular/Non PP/CSC and i didn’t get any information.
    I don’t know my employer applied for me or not. There is no way that i can check this..

    Every time i am thinking whether i will get it or not.. To be frank even in Dreams..

    I will go to office check the mails in every 5 minutes. If i call my employer he is giving the recorded reply.. We are also eagerly waiting…

    God know when this wait will over…

    I wish i should get H1B this year as I completed 3 year in waiting stage..

      In most cases employer/attorney are not responsive. We are applicants, so we are applying it 1st or 2nd or may be 3rd time but for them its a every year thing, they apply 100’s of H1bs and everyone keep asking them about update almost everyday. So dont get stressed if they r not replying. and considering your case its too early for you.
      After reading the success stories on this forum, just dont pick up the fone and call your employer. Be calm and understand their situation too. Good luck n hang in there you ll b fine.

    • Have patience and things will work out man. If you want to check if your petition was delivered, I would ask your employer for a reciept notice from UPS or FedEx to show proof of dileverybefore the 5th of April. You will recieve a reciept notice within the coming weeks. Stay positive.

      but you can ask ur employer to give u a copy of H1 petition and the post details from USPS etc…this will essure you that he filed ur petition or no
