As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.
USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release
- Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April. You can check out US Economy and H1B Visa Lottery
- Total H1B Petitions received : USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
- Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
- Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing. First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
- Petitions Not Selected in Lottery : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
- Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
- Non-Cap Subject Petitions Accepted : USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
- H1B Visa stay extensions
- Employee terms changes for H1B visa worker
- H1B petitions filed for Change of employers
- H1B petitions filed for concurrent working for more than one employer

AD/RP, This is what i received from my Lawyer today. I am assuming this is a general notification from USCIS.
It is going to take USCIS at least 2 to 3 weeks to get through all 124,000 cap cases that were filed.

Executive Summary
On April 7, USCIS ran a lottery to choose enough cases to meet the standard H-1B cap of 65,000 and the cap exemption for 20,000 U.S. advanced degree holders from the roughly 124,000 petitions it received. Employers have already begun to receive filing receipts for premium processed cases, but it could take several weeks or more for USCIS to issue receipts for cases filed by regular processing.
I think PP are still in process, RP its time to hold the horses for some more time….

This information came from my Lawyer. He emailed me today morning. Again, as mentioned my source is my lawyer, I tried to google the same but did not get more information from any other valid source.
“At Friday’s AILA Spring conference in Washington D.C., USCIS provided more detail as to how it will be processing the pending H-1B cap petitions filed between April 1st and April 5th. Prior to Friday, the agency had only announced that premium processing cases would be treated as filed on April 15th. More detail was provided by Mr. Neufeld at Friday’s session:
1. Premium processing cases were still being processed and all of the receipts were on track to be completed by the end of Monday the 15th (today).
2. Regular (non-premium) processing cases will not be entered until after all the premium processing cases are entered and receipted. Therefore, no regular processing cases have been receipted at this time, and USCIS expects that they may not enter the regular processing cases into the system until sometime in May. This would be consistent with past experience, as when the cap was immediately reached in 2008 the USCIS did not complete receipting of regular processing cases until June 1st.
3. USCIS does not expect to send rejection notices for cases that were not selected in the lottery until June, after all receipts have been sent out for cases that were selected in the lottery. Therefore, we will not know with certainty if a (regular processing) case was not selected for a couple more months. USCIS indicated that a regular processing case may not be “upgraded” to premium processing until the receipt notice is issued.
4. Mr. Neufeld would not provide any assurances (or even agency goals) for the adjudication of regular processing cases. Last year, many regular processing cases were still awaiting adjudication when the fiscal year began on October 1st, and hopefully there will not be a repeat of that this year.

Something is wrong here though. They have obviously started entering non-PP as well as PP cases last week. This is a fact. Maybe he meant that they won’t start to adjudicate them until May. That would make sense.

A colleague of mine got his receipt today with EAC—13—131—XXXXX. The email was sent out sometime today morning. He is in AD/PP/VSC category. So my guess is that they are still dispatching emails from the people selected from last week.
I am waiting to hear from REG/PP/VSC. Keeping fingers crossed!

If your lawyer did not email you or communicate with you then there is still some hope, but from USCIS side it seems like they are done with PP processing.

My employer received two receipts out of 30 regular non PP petitions on last Friday..
So it looks the regular processing was already started few days back.
By mail or email?
He did’t give the exact info.. but they said all the petitions filed are under regular normal processing..
I am one of the 30 people and eagerly waiting for mine..
All the intial review status say that they have mailed …
So the RP has started .

I’m following website since a week and nice to hear the updates here.
The regular processing has started from saturday as we see many of the applications are mailed.
Saturday VSC has processed 1260 applications.
Today the current no : Eac1313254123
Already 40k applications are processed
And everyday 4000k appl are getting processed.
So in 2 centers : 8k
Within this week all the apppl will be processed according to my view and reg/pp will hear by 20.
So the PP is done or still processing?
Its still processing we see few pp cases in between.
The employers and the lawyers are too busy so may take a day or two to inform us.
So its good if we wait.
Every couple of mins 15-20 appl are processed.

While the Senate “Gang of Eight” is close to revealing their “immigration reform” deal, the nation remains deeply divided on how to overhaul our immigration system. Democrats, mainstream media, and powerful interest groups push to provide a pathway for 11 million illegal immigrants in the U.S. Meanwhile, the GOP eagerly supports the measure in the hope of attracting future minority voters. Immigration reform has been put onto a fast-track to pass the congress and become law.
There is a general misunderstanding that this immigration reform will greatly benefit high-skilled immigrants in the U.S. In reality, these high-skilled immigrants, along with American workers, could become biggest losers of this political battle.
The number of highly educated and highly skilled foreign-born workers will always remain small. H1-B is the most commonly used work visa, which allows high-skilled immigrants to work in the U.S. The current cap for H1-B visas is only 85,000 annually or 170,000 if the Congress decides to double this number. In general, legal immigrants need to obtain valid visas before entering this country. H1-B visa holders have to renew their legal statuses every three years. It is a long, expensive, and sometimes frustrating legal process, associated with lots of uncertainties, before they can eventually become eligible for green cards and citizenship. Hence compared to 11 million illegal immigrants, who are offered a promising shortcut for citizenship, it is a major disadvantage for legal immigrants who have invested a significant amount of time, money, and followed all the necessary legal procedures.
If more than 11 million illegal immigrants are provided “a 13-year special path to citizenship,” would American politicians be fair enough to offer the same or a better deal to millions of legal immigrants who are currently in the U.S.? Many of these legal immigrants do not have voting rights. However, do they not deserve to be treated fairly and equally? If not, why would anybody bother to come to this country legally in the future?
As part of this reform, Congress is considering eliminating immigration visas available for American citizens to sponsor their married children, siblings, and other family members coming to the U.S. It may be in America’s best interest to reduce endless chain family immigration in the future. However, politicians apparently have no problem with immediately legalizing 11 million illegal immigrants, without requiring triggers that fully implement immigration law enforcement first to prevent new waves of illegal immigration. Congress will be punishing legal immigrants by cutting off their family members while rewarding illegal immigrants.
Until now, the liberal-leaning mainstream media has been misleading the public on immigration reform by sliding by a few key components of the debate: firstly, The impact on the unemployment rate when immediately legalizing millions of illegal immigrants to compete with American workers; secondly, The long term cost to American taxpayers, especially as illegal immigrants become eligible for most welfare and public benefits, once granted green cards and citizenship. American taxpayers should have the right to know how much this legislation would eventually cost them. The process should be fair and transparent to all Americans.
However, it seems that Democrats are afraid of debating this important issue in the light of public view, as they want to rush this legislation behind closed doors before the public is able to understand and react. Politicians seem to know that the American public embraces the idea of “comprehensive immigration reform.” But they may reject an amnesty, especially if they realize that such legislation could make this nation’s illegal immigration problem much worse in the future.
The well-intentioned reform deal has been pushed forward to mainly benefit a large number of low-skilled low-income immigrants who came to this country illegally. Americans should know that granting social welfare, together with voting rights, could encourage endless waves of illegal immigrants searching for easier lives in the U.S. Uncontrolled illegal immigration to the U.S. is bad for the working poor and the middle class. In addition, Americans will have to pay and support ever-increasing government welfare programs, until the U.S. government becomes insolvent and until the U.S. welfare system completely breaks down. Is this new legislation really fair to the American people? Would our liberal-leaning mainstream media ever inform Americans about the truth before it is too late?
In the past, the U.S. was able to attract many highly educated and highly skilled immigrants because of its democracy, transparency, integrity, and fairness. However, the American Dream is fading when politicians stop talking about the economy and job-creation the day after the election. The American dream is fading when the mainstream media stops providing objective news reports and analyses, and became part of the government’s propaganda. The American Dream is fading when this nation’s tradition of “negotiating to find the common good” is replaced by the new value of “pushing for maximized self-interest at a significant cost to others,” especially if it breaks this nation’s legal immigration system as well as the safety net. In addition, such behavior is tolerated and encouraged by American politicians and the media for their political gain.
In the end, we have no idea whether the American Dream is still going to there for future legal immigrants, and we don’t know whether it is still worth their effort to contribute to this dream

I am so upset that everyone who tries to go the legal way is met with so many road blocks. It’s just ridiculous and completely defies the purpose of why this country was founded in the first place. We don’t get the chance to build a better life for ourselves through hard work here, do we? Well yes, maybe… But only if you are selected in a random process. Ugh!!
Well, though i am in support with above article. But I want senate to pass this bill without delaying. They are going to present the bill tomorrow in senate, lets see how it goes. The only thing which annoys me about this bill is they should give more important to legal immigrant population than illegal. But again who the hell cares as far as we are going to get benefited.

It is too late for this year, USCIS will not accept any new H1 petition for FY2014 cap, unless your wife works at non-profit organization like college, government etc..
Guys – I dont understand all these comments on why AD candidates deserve to be selected over other nationals applying directly from thir countries. I think this clearly shows the lack of experience in the corporate world. The simple reason a corporation selects them over you is because there are better than you – either in acads or more likely in experience. So I think this kind of ‘begging’ attitude doesn’t bode well this early in your career.

nah you got it completely wrong. everyone here (that filed a petition) DID GET selected by a corporation. What we are not happy about it the fact that people who have never made the investment to get an education here in the US are as well entered into the exact identical lottery like those of us who did, and are just as likely to be given a valuable spot all because of this stupid lottery process. Us who hold an American degree deserve to be given priority in the process and the fact that we are not says a lot about how inefficient and stupid this lottery system is.
Perfectly fine if a cooperation decides to hire a Bachelor’s over a Master’s candidate. Not the issue here… The issue is that most AD people are already working for American companies who put a lot of effort and money into keeping them. You don’t give those people an H1b, and the company loses an important employee who has already proven themselves for 12-29 months.
Sadly, it’s not up to corporations or companies to make that decision. If it was, nobody would be complaining.
I would agree with what you are saying were it not for the fact that you missed part of the story.
People are not complaining that “better” candidates from abroad are selected over US advanced degree-holders. People are complaining that the current H1B system (including the lottery) favors large “body shop” companies – chiefly from India – who hog a large percentage (as much as 75%) of H1B visas for candidates who may never use them. These visas sit in their system just in case one of their US clients has a position that matches one of their H1B holders, who will be dispatched to the US for a couple of years to work for a much lower wage than an American would. This is not a secret, or speculations, or hear-say — this is public knowledge.
This is how many genuine candidates from either abroad or already in the US are left without a visa.
Such a system is broken — it does not favor merit, or experience, it merely allows such corporations to operate free of any regulations.
That’s what people are complaining about.

It really is infuriating. Just this year, according to data released by the USCIS last week (and posted on this forum), 3 Indian outsourcing firms applied for about 70,000 LCAs. That’s three companies. Many of those visas will never get used.
I am not from the IT industry. If not for the lottery and all the time I am spending on internet reading about it, I would have never known about the body shopping industry that Indians are proudly running. The numbers are shocking!
When I graduated, I used to receive random calls form representatives of so called IT consultancies (who btw can not even speak proper English) to forward my resume in word format. I tried telling them that I am not even remotely related to IT, but they were insistent that I should just give my resume. I neglected such calls as I was worried about getting a real job.
I agree. USCIS shold be severly punitive on people/companies who do not use H1b visas if approved through the cap. This is just ridiculous. Someone who needs it desperately are left hanging and dudes who will never use it have it. This is really wrong.
Because we went to school here …we are working here paying taxes here…do you have any idea how much we pay in terms of fees every year? its $3billions…I did support some offshore guys. They don’t know how to execute simple commands…because you have more years of experience doesn’t me you are better than us. Why? I bet that at least 5000 of this years petitions are from US based small desi companies, submitted for beneficiaries who do not even have a project lined up. Some of them will never find a job with any project and will eventually change their desi employer to a another. Look at the firm that got sacked in TX. I will also go out on a limb to declare that at least 10% of those who take the small desi company route have their resumes doctored. I am sure you might have met/known guys like that.
So don’t just say shut up. I you are the kind hi looks for ugly shortcuts to gain over qualified candidates, then those qualified will blame the system of ther bad luck.

I don’t agree. I completed my engineering from one engineering college in Tirupati. I have 2 yrs experience in IT. My employer applied my petition this year. I am hopeful of getting one. It does not matter if you invested or not. You just have to be smart.

Not sure what your background is but I think you have not covered both the aspects before making your judgment –
AD Applicant vs Non AD Applicant:
– Both have an offer of employment or employed in a US org – so I would not say that one in better than the other in terms of skills.
– AD applicant has invested 1000’s of dollars in US for their education. Doesn’t make them smarter than people who did not, but still they made an investment (in US economy prior to getting a job) and deserve some return. Non AD Applicant did not make investment in US
– AD applicant if they don’t get selected in lottery, have to lose their current job. Non-AD don’t have to lose their current job.
– AD applicant are not in their home country – so NONE of them can apply for an intra-company transfer (L1) visa. Some (of course not all) of the non-AD applicant in their home country can apply for L1 visa for US (and at any time of year – there is NO CAP there)
– AD applicant, if already employed, are invested further in their houses/apartments/existing establishment – it just becomes a pain for them to move everything back to somewhere if they don’t get thru the lottery. This of course doesn’t make them a deserving candidate over someone who is not in US, but still a point to ponder upon.
– And finally, the ‘cry’ is not over priority over a particular group of people, it is about the inefficient usage of H1B by sponsoring companies. Impact on AD people not getting H1B is immediate. Knowing that many people who get an H1B in one of those outsourcing companies are going to wait for a while, or may be never travel to US on H1, makes them feel an opportunity lost that could have been efficiently handled.

You don’t really know what you are talking about. Non AD people could have easily done their bachelor’s in the US (like me) therefore they have also invested in their education here. Additionally, they could currently be living and working for a company in the US (like me) therefore could stand to lose their job (and their whole life actually). Stop being narrow minded….
I think everyone that put years of hard work and money into this deserves better than a stupid lottery. We could all tell our sob story and see who has the heart to say “no” to a story about struggle, persistence, and hope…. oh wait, an automated lottery will have no problem doing so…
You are right, you deserve it just as much as we do. Anyone who already has a life here and went through hurdles to do so does. You are probably the exception among thousands of Reg guys who don’t live in the U.S. yet though.
What we (or at least I) are talking about is that we (and that includes you) should get priority over people outside the country who won’t lose their jobs/lives and haven’t invested a lot of money in this country if they lose. BUT at the end of the day, life isn’t fair and we’re all in the same pool to be picked from.
Add me into that few who did regular and completed degree in a U.S university. Has anyone consider about the culture-shock? There is a decent number of people who come here to go to school, and dont perform well due to being far from their family, friends, and their familiarities; in some cases they go back home not because they are dumb but because they weren’t able to adjust. So all those come here for first time, who’s really gonna excel? (Beside the fact that they were given lower salaries, paying a cut of their salaries to 3rd party, and may only needed to be here for a single project) But ranting about this issue here may not influence the authorities… guess just wait and see what happens…
@ come on… I agree with you. I came to USA in 2006 with my parents.. completed my high school, did my bachelors and have been working with a top US Company since 2011. I invested a lot of time, money and energy compared to any AD applicants. So people who doesnt know the full story of non AD applicants shouldnt be saying they have invested a lot here.. Please have genuine facts figured out first.
Secondly.. I do believe irrespective of masters or bachelors catagory, if someone has been living and working in USA for couple years they should be given more preference for H1b compared to people who applied for h1b and are not in USA currently. People like us if we dont get selected we lose our job, our status, and for people who are in my situation ends up losing everything.
I dont want to leave my family and friends in USA and go back to India after living here for 8 years.
But people who are applying from abroad what have they got to lose “NOTHING”. They would still have their job, salary, friends, family etc and can apply next year and come.

– while non AD people have shown interest in working in US and come here with right intention.. while AD people come US with promise to go back after graduation during F1 visa interview but later everyone stays.. since non AD people follow the law in spirit as well and do what they say, I think they should be given priority and AD people should be grilled on why change of heart after 2 years of study in US 😉

So, premium processing starts today, right. I have a feeling that if we don’t hear anything by the end of today, we probably need to start thinking about plan B. I know there’s a chance that the receipt is sent out together with/after the case actually gets accepted and/or processed, but it’s just seems slim.
Thus…if I get no news from my attorney today, I just legitimately won’t bother thinking about it anymore.

I can’t mention the complete receipt number for security reasons.. And I have no reason to lie.. This is what I got:

My attorney told me she received it today in the morning. She sits in Santa Clara, CA and I am in Ohio. Hope that helps..

How do denials work? Do they factor in some anticipated denial rate when they do they lottery and select slightly higher number of files? In either case, when does one definitively know that they wouldn’t be getting a H-1b? Will they first work on approving/rejecting all H-1b petitions selected in lottery, come up with the actual # of cases denied, and do another lottery to select from cases unselected in the first lottery till the 85k quota gets reached? If non-selection in lottery is informed prior to all approval/rejection decisions on all selected files are made, do they tell unselected cases that there is some chance that you might still get a shot later?

While many people are scrambling for lottery selection, What many people dont know is that what matters is the rejection rate. While your application may not be selected in lottery, once rejections are made, your application is IN. This year, rejection rate may be over 30% since people just filed in a rush. This means that probably around 25,000 to 30,000 selected applications will be rejected. The advanced degree will be considered First as replacements for obvious reasons. Effectively, all advance degree holders will get a chance. also, many more regular ones will get a chance.

How do you know that AD people will be first replacements? Sounds like a whole lot of speculation to me, but no facts to go by. It may be logical to work this way, but we know by now that the system doesn’t work logically.
I think it makes sense to gain some optimism on high denial rates. Do you know how much it was in 2012/13? Looks like it was 17% on 2011.
The thing is, we don’t even know if they have waitlisted anyone. It was in the press release about lottery in 2008, but they didn’t mention anything this year. So maybe they just won’t replace rejected applications this year.
Not trying to be a downer, just realistic. All of this is just speculation, we don’t know anything for sure.
Ok guys if rejection rate will be around 30% or 17% or whatever, it can be yours and mine application too. So dont get happy. Rather pray.

In my understanding, USCIS is still working on sending the receipt notices for PP. May be your application has already been picked up but it’ll take them few more days to dispatch notices to all. So please wait until Friday.

You are exactly right! Especially because your receipt number is 132 for the computer work day. That is last Wednesday. It took Cali 3 days to send your employer the receipt email. It’s not over PP guys, there is stil hope.
Are you sure? for CSC 132 is Friday(not Wed) and it could be true that they processed on Friday and triggered mail on Friday and Attorney could have received it and his employer might have received it on Saturday.
Oh, you’re right… Didn’t realize they had different computer working days in both centers. Sorry!
Per email from USCIS, they received my packet on 04/08 and sent a notice to my employer on Sat 04/13. So I believe they have an automatic system which triggers the email notifications. They also mentioned to adjudicate the case within 15 calendar days of the ‘Received Date’ which is 04/08 in my case.
Conclusion: It may take a few more days for the email notification to reach out to your employer even if your packet has been opened already.

New week, new opportunities… I hope the rest of our PP AD guys will get their receipts today, tomorrow or by the end of the week. Wouldn’t be surprised if anyone got their H1b approval before or with the receipt notice. Remember, it’s only over when you get your package returned in the mail!

I’m regular/RP. For Regular/RP it may take much longer time than a week. One of the guys had posted the email from his attorney and it said that Neufeld (Acting Associate Director, Domestic Operations) has informed it will take as long as mid of May to process all regular/RP

My h1b expired last year as I could not travel due to some personal reason. Now my firm has applied h1b fresh this year and it has gone into lottery. In case my lottery is not selected, can i file out-of-cap as i still have 2 years left out of 6 in my old expired h1b.
Any expert out there, please help .
@Inxs – You will come under the cap if you have not utilized your previous H1. Only if you have worked on your previous H1 and the gap is not much, you can re-apply along with the paystubs from your last H1.
Sorry, but thats about it. I am also in a similar situation. Got my H1 approved in 2011 and it is still active. I have changed my employer and my employer has to file a new H1 now. Good Luck!!!
