USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

  3. Guys, I request everyone not to post a false update. Its not the case you know its a Premium Processing case of a Normal Processing case from the receipts you randomly select from the USCIS. Take this example receipt EAC1313154000 which says its in Initial review and this case is posted on Apr 9th. It says it has mailed the details of the petition. Does it mean on Apr 9th they processed the Regular Quota? Not the case, I can see in Acceptance stage they have mentioned Email and in Initial review Stage they are mentioning as Mail so dont get panic. and people who are now aware of the process dont simply blabber and make other panic. Keep your hope alive, we will surely make it… I heard it will take few more days for the Premium Processing receipts can be emailed to attorneys and employers so lets keep our hopes alive. Hope it makes sense

    • WAC1313053800, EAC1313151500, WAC1313052944 On April 11, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case. Please follow any instructions on this notice.

      EAC1313551249 On April 8, 2013, we received this I539 APPLICATION TO EXTEND OR CHANGE NONIMMIGRANT STATUS, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. You will be notified by mail when a decision is made

      WAC1313053861, WAC1313050050 On April 10, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice.

      These are some of the examples, the ones with Mailed are in Initial Review, and those which are E-Mailed are in Acceptance Cases. So nothing to panic!!!!

    I am also a RP-AD candidate waiting for my receipt number. My company is ready to start te green card application if my h1 is denied but the question I have is Can i continue working after my OPT expires in July if my GC is applied?

    • Rohit,
      Though its unfortunate but you have to maintain the legal status during your GC processing. That is the reason ppl first try to get h1b n then apply for GC.

    • You can apply for gc, however, you have to wait till you get EAD.

      If you apply in EB1 category, you will get ead within 6 months

  5. It would have been better if USCIS would have given some unique# on all applications and published the same for selected on their website. This would have made life much easier for us.

    • Yeah. But it would have been good. But they would have to open the packets and then pack them again for the rejected ones and they took the easy way.:) but they are working overtime . So lets cheer them up and hope they will change it.

        • Yes, you are right. They have to issue a rejection notice for each rejected package; even the ones that did not make it in the lottery.

          Wish they implemented Rajeev’s idea but with all the budget cuts its too much to ask!

      • @CD: That’s what I wished sometime back…. “The could have made a process to write a barcode containing applicants email ID and without opening the packet also just by scanning they could have updated users to the email ID directly”. May be no one anticipated that this situation could be so difficult.

    • Don’t think so; there is a new bill oncoming, but it will probably be too late for any change in this year.

  6. can anyone please let me know if they received a receipt for Regular/Non ADE/Non Premium from Vermont..
    has Vermont center started processing Regular/Non ADE/Non Premium cases???

    • I see a lot of people are asking about regular processing petitions. There were two or three people mentioned that they got the receipt on mail –which is a possibility; however I wouldn’t be surprised if someone had wrote it for fun. As we’ve seen, on first couple days USCIS only processed PP cases, and regular numbers started appear only at the end of the week. Mail could take 2-3 or 4 days to deliver depending on which center and you’r lawyer’s locations is. Also law offices may not be operational during the weekend. So if USCIS had mailed some on friday, we should see a decent amount of relive comments tomorrow.

  7. Firstly I am Reg Cap/ PP/CSC and waiting for reply from lawayers ….Just did a study of all the numbers being procesed over the weekend and looks like very few lucky PP being entered. So all those lucky 1/10 premium processing people will hear about their status on Monday and rest PP better luck next year unless we get lucky and are in backup lot and someone who was selected in lottery but later case denied is replaced by anyone of us in PP.

    All the best friends and dont stop working hard due to this fuckall lottery system…and this is my last post as i am gonna see if i am lucky to get approval tomorrow if not just cncentrate on my work and future. Life and the show must go on. All d best !!!

  8. For all of you who haven’t heard from your lawyers at all: There is a possibility that they were in DC this past week at some AILA (American Immigration Lawyers Association) meeting/conference. My lawyer just forwarded my receipt notice EMAIL today…when she had actually received it on the 10th.

    Mine is AD/PP/CSC/MinamiTamaki.

  9. My lawyer got my receipt notice EMAIL on the 10th but forwarded it to me only today. My lawyer was in DC with the AILA (American Immigration Lawyers Association)… N that might be the reason for the delay.

    Mine was AD/PP/CSC.

    I hope all Advanced Degree holders inside the USA already get picked…over people trying from outside.

  10. I got my receipt notice today.. But my lawyer had received the email from USCIS on the 10th at 9:30 PM.
    Mine is AD/PP/CSC.

    H1-B receipts (if approved and certified by the USCIS) will be issued no earlier than April 20, 2013.

    We gotta F wait !!!!!

            They still process some AD/PP/VSC, but very few 🙁
            Wish you to get it or to find a good backup plan of what to do now.

    I would like to know whether the regular processing started ? If so ,does anyone received the receipt numbers?

    • Hi Madhu.

      Yes, non-Premium Processing has already started.
      You can make sure by entering latest EAC, WAC number into their tracking system.
      If it sais: “we mailed you notification”, it means it’s a regular processing application.
      Premium processing would say “we e-mailed you”.

      If you’d check latest 10 case numbers, 9 of them are yet regular processing.

      The problem with regular is, that they will send you a paper mail with a notification. It takex several days to be delivered. So we expect first non-premium notifications early next week.

      • It almost took 7-8 for PP, which I expect would be a small percentage. at the current speed, would they finish all the RP by month end ? Or do we have to wait till May end?

        • I think there will be around 50% of premium processing.
          So it should take 1-2 more weeks to process also regulars.
          But we need to wait for the paper mail to be delivered, which will slower the process.
          I think it will take 2 weeks when most of people will receive a letter.

          But it might be also slower, as someone mentioned about 2008.

      • It seems like the PP cases USCIS entered the last few days were entered in ‘initial review’, stating that the PP clock has started whereas the PP cases they entered at the beginning of the week started in the Acceptance stage, stating that the notice was e-mailed and which center is working on the case. I checked back on a few cases from Monday and they are still in the Acceptance stage.

      • I don’t understand why they do not email every one. They have to register the documents into the system for both PP or not PP. It would make things easier and nights shorter.

        • They should be sending mail to all, PP and RP. For RP, they save that time in not entering the mail id — my guess.

          • But sending an email is easier than mail. So if they are ready to send mail to RP, rather send email (less time consuming and free), you know.

    • my attorney said as it will take another 2-3 weeks time to get final listing including NonPP.
      So it could be uncertain till mid of May..

      For California processing center RP last rcpt no yesterday was : WAC1313351557.
      they processed total 1557 applcations y’day.

        I dnt know much about the procedure. How do you know the last receipt number of Californea Service Center ? I entered this “WAC1313351558” on USCIS website and its showing “Initial Review”..

        Once USCIS receives any mail, they issue a receipt number ?? Am I right ?
        My Attorney has n’t informed me anything yet. She just gave me the USPS tracking no.

  16. Are they processing any cases today as well in both the centers? or today is an holiday for USCIS? Do any one got any update from attorneys or Employers yesterday????

    • Hi,

      Yesterday, USCIS started working on 10:00AM.
      Now it’s only 9:55 on east coast and 6:55 on west coast.

      Let’s wait few minutes and check if Vermony will start processing today.

  17. On a lighter note. I have been following this forum from yesterday. It feels more like support group 🙂 a bunch of guys expressing how tensed they are and another bunch consoling them. And then there is another group which demonstrates their joblessness by scrolling through receipt numbers in the USCIS site, hardly improving the situation. Cheer up guys. We already have been either selecte or rejected . Prepare for the worst and anything else would make us really happy !!!! 🙂 am getting off forum and will wait for my HR to get back

    • LOL, I was one of the ‘jobless’ scrolling through receipt numbers. However, I am far from jobless 😉 But yesterday was Saturday, we’re all going bananas and I didn’t know what to do with myself. 😀
      I have to say though that it helped me because we were able to ensure the PP guys that they’re still processing PP cases. At the end of the day, you’re right. It’s crazy to do that. I never said I was normal, right? 🙂

(I doubt you’d have heard that term, for a primitive ape that you are that looks at night sky and meteors streaking across sky and wishing for your visa, and giving away your life for destiny).

    how are you going through the waiting?
    I’m RQ/RP/VSC, still waiting.

    It seems they focus on processing non-Premium cases now. Out of 10 cases, there are 9 non-PP and 1 PP.

    Does anyone has some experience from lotteries 2008 and other years?
    How long should we wait for USCIS response when on non-Premium Processing.
    Will it take 2 weeks, 3 weeks, 4 weeks from now?
    Till now it is like this:
    Accepted = received e-mail with case number.
    Rejected = didn’t receive anything

    Are they going to send package back to attorneys, so we will know if we accepted/rejected, or we should still wait & wait & wait?

    I’m doing backup plans to prepare myself for the bad message.

    • I understand one of the earlier comments on this forum that in 2008 smone has comeented he recd receipt on 28th april. Also there was one more comment mentioning that few people even got their receipt no along with their aprroval 🙂 so lets wait & hope for the best……..

    I wonder why here in Moscow we don’t have many it professionals from other countries. Salaries here are almost the same as in US. For example, if I get my h1b I will have approximately the same salary as I get now here. Though it is not a consultant/outsourcing company.

    • and the bigger questions is, if the salry is same, why are you trying to go to USA? Your own answer might be the reason no one wants to work in Russia

      • I did apply for it. Just to see how thing go in the USA. It is not about money. Maybe a new challenge.

    • Money is not the only criteria..The growth in career and the equal opportunities..
      in europe can you show me a single example where asian companies and asian PPL had good recognition and growth..

      • I have to mostly agree with JR. Europe is not as accepting to diversity and people from other 3rd world developing countries. Lets accepts the fact. China and India has 1/3 world population. You are going to have a space crunch, and overspills. Those people want a better life and will continue to emigrate. Unless China and India does something to bring their population density levels. With limited land resources, life styles cannot be improved. Space equates lifestyle and satisfaction. Your 10 million dollar Manhattan apartment can never beat a Montana ranch. Reduce population, keep population happy.

          If you keep them happy with fair wages and decent lifestyle, they wont feel the need to emigrate or move anymore. Russia is certainly offering that to you. Which is why you are comfortable there. Thats a good thing, and a desirable one too. Sadly India and China, doesnt have enough land mass and resources, but have not done anything to curb population. Every person can own a 4bhk home with garage and back yard and lawn and 2 cars. The world standard of happy and contended living. Can india and china provide that to all/most of its citizens? Answer is NO.

          • Trust me guys, every corner of earth is equally prosperous and beautiful. Over the history of mankind, the local governments (people in authority) and respective citizens themselves have “made”/”did not make” the best out of it all. Never too late. Policy makers have to understand core issues and come up with fitting solutions that will steer these developing countries into manageable population and manageable civic infrastructure under a systematic governance. Give few decades and these countries will continue to change. I have known friends and people that are happy home. attitudes are already changing.

          • What you’re saying makes a lot of sense. There is no shame in trying to leave one’s home in order to be happier somewhere else. That’s what i did and that’s why I’m here (in the U.S.). Germany is not a terrible country, but over the course of 10 years, I have lived in the U.S. for 5. And I am just happier here. That’s why I want to stay.

            Accordingly, i never blamed the people looking for a better life for this mess. Who I and I think most others blame is the companies who apply for so many visas, don’t use them all, and even if they do, they send people over here for short periods of time to work on projects. It’s just not what H1b’s are for. It’s not a dual intent visa for no reason. If you want to “loan” a worker to a U.S. branch, do the right thing and use L1.

          • I completely agree. But it looks like the government isn’t interested in making life better for regular citizens. It is interested in its member interests in the first place.

    • Dude, I’m from Russia either.

      My H1B is an entry level position in a top company (I have just graduated with MS in Computer Science). With all the bonuses they are paying me 170k a year. Even thinking about high taxes (around 30%) I doubt that in Russia anybody with even 15+ years of working experience can get such a salary as me, entry-level software engineer.

      H1B salaries are generally higher (If speaking about big companies) in US. Almost everything is cheaper in US (except food and rent), Russian climate really sucks, two biggest Russia cities are full of traffic jams, the prices on apartments in Russia are even more expensive than in US, there is nothing to see close to biggest Russian cities comparing to beatiful national parks in California.

      • 170k a year?? I doubt that. Check out monster.com and try to find a job offering for that money for software engineer. Even citizens of the USA with 10+ years of experience get much less.

          Google pays 105 base + 15% bonus + 25k in stocks. (my friend got their offer)
          Another friend got 140k + offer from Microsoft (it’s in Seattle, there is no state income tax, so you should increase this by 10% if you want to compare it to California)

          • Ok, good for you. The offer is really good, but it is not regular. You are lucky to get into one of really top companies.

            Based on my experience, bonus is something that is not 100% guaranteed. But in your case even 100k base + stock options is really good money.

          • Actually 170K is too low for a SE just starting off especially considering you live in SF. 170K in SF is compared to 80-85K here in Houston and most all SEs I know here start off with more than that.

          • do you just post for the sake of it????.I live in SF with a salary of $185K (after top MBA) and I dnot know many who earns this much. Remember I hang out in a circle where most of them have done their MBA, MS, P.hd at top US universities.

            So I donot know where your logic of $170K too low for SF comes…..

    First of good luck to everyone out there. Secondly I was wondering when you put in one of the numbers (i.e. EAC1313551249) into the case tracker at the uscis website how do you know if it is premium processing/ regular processing or advanced degree/ regular quota?
    As for me I m AD/RP/VSC

    • For Premium processing the message would read ” we notified you through e-mail” and for regular processing it would read ” we notified you through mail”

      • Try to see the real thing, in Acceptance case it shows Email and in Initial review it says Mail so its not really Premium or Regular process you can identify from this. So please dont share wrong information here.

        • It doesn’t always say ’emailed’ for PP. But it does state “On April xxth the 15-day clock on your PP started”. This is in the Initial Review phase.

  22. whether its IT , Doctor, Scientist or what ever . IF USA do this no one is going to stress here like we are doing here on this blogs . 65000 + 20000 is very less when the USA is seeking employees from other country. Would be very good if they increase the caps to 150000 now to fix this .

    Senators writing a massive immigration bill plan to greatly increase the number of visas going to high-tech workers, but they’re arguing over worker protections.

    The dispute comes as lawmakers race to put the finishing touches on their sweeping legislation in time to release it this week or next.

    At issue are H1B visas, which high-tech companies can use to bring specially skilled workers to the U.S. The current annual cap of 65,000 is too low to meet demand.

    Senators are looking to raise the cap to as high as 150,000. But a dispute has arisen because Democratic Sen. Dick Durbin of Illinois is pushing for higher wages and trying to crack down on companies that use the visas to train workers in the U.S., then send them back overseas.

        Would you mind what all technologies you work on and know ? Do you write blogs to help people? I think this blog that every one is using to track H1 applications is by an Indian. The semiconductor chip(Intel) for which so many jobs are created was by a gropu of three people out of which there was an Indian. The e-mail (Hotmail) belonged to an Indian. The Zero was invented by an indian. Please do not write such things if you dont have proper information. Namaste.

Did you know NRI’s send $100 bn every year back to India ? We are at much better place than a decade ago.. be patient and keep working hard guys !

  24. I belong to the ADE(PP) category and received my EAC number on Friday where as my employer was notified few days earlier. I work for a huge social media giant in the bay area. I have been speaking to a few Attorney’s out here and they said that unless and until someone is notified of his/her rejection in writing they cannot assume that they didn’t get selected in the lottery. USCIS is cramped up for workforce and are trying their best to send out as many notifications as possible. If a premium processing case gets processed on Friday their employer would subsequently be notified on Monday and the beneficiary gets the information that day or a day later. Relax guys. You are better off focusing on the quality of your work instead of constantly worrying about things that are not in your hands. I am not trying to be guest lecturer on psychology out here but If you are really hard working and posses a good work ethic then your company would go to any extent to bring you in.

    • Did a search of case number on 04/08, which is the 130th day of this year. Most of cases are PP and very few are non-PP. Also, wrapping up for mail took some time even if it is shown on the USCIS website that the rcpt was mailed. Actually, it might not be so and it may delay 2 or 3 days I guess.

  25. eac1313551215 seems to be last one from vermont. Does it mean that they have processed 51215 cases?? Does this number include the ones processed in California too? If not they might close to completing the receipt generation for the 65K + 20K soon ?? not sure if i am missing something

    • eac1313551215 means in the 135th day they processed only 1215 cases. They always start with 5, thats why it is 51215

  26. Dammit!

    In light of the current situation we are finding ourselves in, I would encourage all AD / US Uni Degree people to congregate and request something to be done. Write polite and robust arguments to the law makers to consider making interim rules to address certain issues NOW. This has to be done ASAP.

    Mass filings by Indian IT firms, although not illegal, is preventing fair competition. They need to be penalized for robbing a large number of qualified applicant’s already diminished chances of making successful careers. Note that most of the H1B’s from these firms will not even get to the US in 3 yrs, much less contribute to the US economy. By encouraging such incidents, these IT companies are exploiting the system. However, the law firms that represents these companies get their fees and they don’t care.

    If there is a finite cap on various categories, why not establish similar cap for Indian IT companies.
    Make it 200 H1Bs. Too less? I do not think so. Provide a different class of visa for consultants applying from outside of the US. Or force them to use B1, dammit. Outsourcing is here to stay. So if there needs to have a consultant brought on-shore, then force them to use B1 or something NOT H1B. Impose heavy penalty on the company if it cannot hire locally.

    Indians have accomplished something significant in Tech field which no other community have in the last couple of decades. However, as I say to all my friends, Indians form the least powerful community anywhere outside India BUT the most passive.

      I am not against IT companies taking a large chuck of visas, I am against companies that take a large chuck of pie like a greedy fat buffoon and then don’t eat it (in other words, don’t utilize visas)….

          • Visa Hoarding used to happen before, around 2005-2008, when the visa fees was not too high. It doesn’t happen anymore after the visa fees was almost doubled by Obama. When even big companies like Infosys are not shwing a lot of profit year on year, dumping lots of money in dead visa investments are the last think they want to do. I know for a fact that every visa application in most Indian IT companies have been scrutinized thoroughly, to provide an ROI report to the upper management. The entire IT industry is running on paper thin profits and a dead visa investment at any level, would cause the personwho approved it to be pulled up by the upper management . so the presumption that visas go unused is a MYTH

          • Its nice to know that the H1B petitions are being scrutinized thoroughly. My presumptions is not based on hearsay. I have personally interacted with 9 H1b visa holders from the company you just mentioned , who were here in the US for 6 months working for a huge Insurance company. I don’t have any issues with Indian IT Companies filing thousands of H1B petitions as long as the need of each and every petition is real ( and not on paper).

Sewage and Milk cannot mix, they have to be controlled by separate pipes and valves!

    • Why, u afraid that your job will be taken away by a mediocre from India. What is the bloody use of your PHD then, when a mediocre can do the same job at a much lower price. Adding degrees means nothing if you do not add more value to the company than an average joe. Keep cribbing, just because you have done your PHD doesn’t mean you are the lord.

      I guess there are smart ppl who have framed these laws, and probably a smarter set who have found loopholes. If you really think you are smart, find a loophole. Many ppl have done it. They are filing through 2-3 companies, even though I hate those people, I guess everyone has an equal right to fight for those spots.

      What I would really like to see is penalise heavily companies who file for h1b and don’t use it.

      • @Bharath, I’m sure you agree that most of the job market which is outsourced to any country is revolved around ITES/services. US attracts many foreign nationals because they work on the latest and the greatest technologies and create so many products, to work on the latest and greatest technologies, you need people who know things in their field, so while doing a PhD or even masters, the students write papers journals thesis and do research in their field, this is the reason that they are sought after by the employers. They know about their field more than their employers in some cases. (I’m not talking about big companies, I’m talking around 100-400) Dont you think a PhD deserves more respect, as a matter of fact it brings pride to the particular nation. I’m sure people who are genuinely talented can survive anywhere and the company can go to any extent to get them back here if it was unfortunate due to the lottery. Also if a foreign company wants to send its employee to us there are a lot of other options like b1/b2, they can certainly make use of it. as far as filing twice or thrice with different employers, there is a line to be drawn on what’s moral and what’s not. Anyway I can talk all day and I’m sure you can as well, I’d like to wish you all the best.

        • @manish. What I am saying is accept life as it is. I am hearing all sort of comments on this forum. What I am saying is this is life. You have all kind of people living here. Cribbing that xyz company has taken away 10k positions or that idiot has filed from 3 companies wont lead you anywhere. I agree you also might be a bit frustrated like i am. I have got a job as a VP in a leading investment bank in NYC and probably can’t afford to loose it. But if I do loose it, which has quite a high probability, I might even cry. But then what can be done. Blaming the biggies from India or a few idiots who have applied for multiple position will not take me anywhere. Because at the end the fact of the matter is I have lost the battle. I am now slowly starting to be an atheist with the belief that “Everything is fair”.

        • @karma. That’s the screwed up part of the entire H1b program. Yes, PHD deserve respect, but just because someone has done a PHD, he cannot tell me not to apply for a h1b. Or just like some insane soul above commented that normal quota are like sewage.

          Just for clarification, I have applied only through one company, a leading IB in NYC for the post of a VP and right now hoping that I get through.

  28. By now the non-selected packages would have been sent back and received, right? Wouldn’t that be a better to check if the petition was accepted? Since it looks like takes time to process all reg non pp petitions

      • my HR mentioned that we’ll have the information about accepted petitions this week (april15th). Is it really possible? or would we not know until month end? I have applied for regular h1

    This is what your scenario is as of now from the receipts and talks from many of your sources like friends, lawyers, employers.

    PP applications as already said in this forum are still being generated but very few – like 1/10. this number will start decreasing by tomorrow if they are working or monday. According to a few lawyers if you have been selected in the lottery they have to finish processing ur application by the end of this month irrespective when they send you the receipt. So even if they send you the receipt on 18th April they have to finish by 30th April. So by common sense they will not wait out on PP to send their receipts late. Now regarding rejection of applications. USCIS in 2008 had a few applications in the waitlist which replaced any kinda rejection cases. This year in the same way they will consider a few in that way. But for those people the receipts will be generated only when someone is rejected.

    I would say don’t loose hope as long as you dont get your application/check back in mail which will be only after they send all the receipts. So instead of panicking just hold on. There are many employers/law firms not working today. Also in a few cases the emails may have been gone to spam or never made it because of some reason. USCIS also sends a mail notice to all the PP according to some lawyers/not sure though.

No worries, seeing the scenarios since monday, we shud understand that USCIS guys r really processing slowly and moreovr they are following a very traditional proceedure of updating the lottery pickups……They shud have instead used some online update to all folks who ever got selected in the lottery……Anyways, lets wait with hope……!!!!

  30. People stopped updating or receiving notices today for PP, because its a weekend.

    Centers must not have stopped processing PP, but it is the lawyer and HR’s who are off today and wont check their e-mail until Monday. We should probably see a bunch of PP updates here on Monday.

    Those of you working in American firms on OPT and do not make the cut in the lottery: what options are you looking at?

    About me: MBA from top US university, working as a Senior Consultant in a Big 4 firm out of Chicago for the last 10 months. My lawyers, in their infinite wisdom, did not file under AD category because the geniuses felt my job description “aligned better” with my engineering degree from India. Also, since it was PP, I have all but given up hope.

    Anyways, I was wondering about opportunities with my employer in other countries. I presume I would still have to return to India while I get a work visa for Canada/Singapore/Australia/Middle East. Would love to know what some of my fellow unfortunates are thinking.

    • They probably did that because an MBA isn’t very specific and they may run into problems with arguing for a specialty occupation. My attorney had the same issues with me, I have an American Marketing Masters. But marketing is even more specific than MBA.

      If I don’t get the H1, I am out of options and will be leaving my life here and return to Germany. I’ve lived in the U.S for 4 years now.

        I believe we are in a similar situation. I’ve been here for 3 years as well. At least in Germany you can get a comparable salary and quality of life. If you do have to go back there, will it be for the same employer you are with now?

        My lawyer’s the favorite and fastest-responding lawyer on this forum – Fragomen. That “fastest-responding” was satire.

        • Seanconneryfan, I would have to start from scratch in Germany. I can’t work for my current employer there. I know I’m not going back to a terrible country, but my life is here now. I just don’t want to leave and just think that H1b was made for people like you and me, and not for companies like Infosys. If they want to send people to the U.S. so badly, that’s what L1’s are for. But of course, rejection rate is higher, so why not take all the H1b’s from people already in the U.S.

          • I quite agree with you. Indian outsourcing firms have completely negated the purpose of the H1B. In my opinion, not only should such visas be capped per employer, unused visas should be heavily penalized.

            Also, I’ve heard of several bodyshopping firms, politely called consultants but more akin to pimps, who file H1Bs, have the candidates work for third parties and take 1/3 of their salaries.

            I’m trying to explore opportunities in other countries because my employer has offices throughout the world. However, I don’t know whether it’s possible, and if so, how long it will take. My EAD expires at the end of this month, and so I’m in a real pickle.

            I am dealing with Fragomen’s LA office , and oMg they are just outstanding. I had to call them to check if I was filed in the ADE category . I have done my MS and I am finishing my OPT in July.

            I am working out of Chi, Applied to CSC. PP , and used fragomen.
            I have heard back nothing. Idk man whats up.

            Is it high time for us to just give up?

            Yeah, I’m dealing with the LA office as well. Unfortunately, by the time I checked on AD vs Regular, the damage had already been done. Since I considered this was quite obvious, I didn’t check until it’s too late.

            Theoretically speaking, you do have a better chance than me of making the cut. And you have 2 more months of employment than me (my EAD expires end of this month). In the event things don’t pan out, what options have you thought of?

            Have you actually discussed your current situation with your employer? I also work for big4 out of chicago. we used to deal with fragomen, but somehow they switched law firm last minute. my lawyer emailed us that they will figure out other solution if ‘worst case scenario’ happen to us (if we don’t get the lottery).

            Don’t give up.

      • The way I see it, You can apply in master’s quota even if your job description aligns with your degree from India. The alignment issue will have to be explained in your petition but the master’s cap is for anybody who holds a master’s degree from the US.
        I know its too late now, but if you try again next year, maybe this should be kept in mind ?

      To be honest, your attorney did err big-time…Since you did MBA from USA, the MBA degree supersedes your previous degree (your undergrad degree) even though there may an overlap of the job function with your undergrad degree…

      Don’t lose hope since the receipts are going to continue to come (and especially since they put you in Regular category, it may take some time)…I sincerely hope that you get your receipt…However, Europe/Singapore wouldn’t be a such bad choice if your employer is willing to put you there till you sort things here…However, I do believe you will hear the good news soon!

        I am in completely agreement. Blocking visas and not using them is criminal in my book and should be severely penalized.

        While Europe/Singapore may not be a bad alternative, shifting would entail uprooting my life here (and I’m married, which makes it more difficult) and starting anew in a new place. Also, I’ve no idea how much time such a shift will take, even if my firm is amenable to it.

        Yeah, I guess I should have checked about the AD category before they put my petition in….it’s just that it was so damn obvious to me, I didn’t think they wouldn’t do it

        • Around 30% of Master Degree holder is USA (particularly those from India) don’t employable. I have seen some of those people who didn’t do well in their job or even didn’t find a job in big MNCs (IT & Non-IT) after completing their Bachelors did go for higher studies to USA. A Master degree doesn’t necessarily improved their ability in any sense. Some people from southern part of India, can go to any extent, just to land in USA, be it thru consultancies or be it thru higher studies. So everyone, who is good enough, will get a VISA and job. And, employer will find the means to retain the person.
          So, these guys (AD) should not shout against big Indian IT firms for applying H1B in horde.
          Having said this, this these big India IT firms, particularly Infosys, TCS, CTS and Wipro, have crossed all ethical and legal means to be in competition. Around 20 – 25% of their VISAs go unused on a year-by-year basis. So those companies should be heavily scrutinized and penalized, and if necessary black-listed.

          • @Manish, It’s not for you, unless you consider yourself among 20-30% of AD degree holders that I mentioned. From my personal experience, I have worked with people (in US) from various backgrounds e.g. “Chaiwala”, defence, travelling and etc. do the same coding jobs that you guys are boasting to do better.
            In India, go to all big IT firms, Infy, TCS, Wipro, IBM, all of them hiring non-technical (B Sc., B Com) graduates for their IT support jobs. And, with 2-3 years of experience, they are qualified to be eligible for H1B.

            So, where is value of “merit” being judged and how can you differentiate the genuine candidate for H1B which explicitly meant for “Specialized Occupation”?

    About the Premium Processing Being Over issue:

    I did a little test. Tried to review 10 case numbers.
    Result: 9 cases are Regular Processing
    1 case is Premium Processing
    Site: Vermont

    Conclusion: If you are Premium and you haven’t hear back, you still have some chances. But let’s make a backup plan.

      • Regular non-pp – u have ample time till 4/25 (+/- 2 days) based on the velocity apps are getting processed (rite now its like 6k /day so 16 days) – for pp it seems like 19k appox. are processed so far and as the reg non-pp started within 2.5 days after 4/8 – keep hanging in there n gud luck! per my est. 85% chances for adv and 75% for non-adv if 124k is rite figure.

          • Sending back is the last thing they want to do now, they are currently looking into the selected petitions. So sending back packets will happen only in the last phase, probably mid or end of May

  36. I wanna check if any one from Michigan PP AD CSC got their reciept number? I checked with my lawyer and she is telling me that they are not gonna receive any thing before 4/15!! I know that sounds stupid. When I told her that most people got their receipts, she said that don’t listen to the forums talk and wait, I ‘ m so upset now! I think she does nt believe that we should get our receipts before 15!,, am really upset and mad 🙁

    • Same here…..My employer had filed 19 H-1B cases, of them only one turned up so far. I am an AD/PP/CSC guy from Michigan. Can’t keep my hope alive any longer. I believe 04/15 would be the last day for PP folks to receive the notices.

My lawyer told me that she did nt hear any thing about any client, am checking the cases numbers and it looks like PP is over in California center, I wish that I can do something to keep a little hope, but we can’t change this fact, its over now. Does your lawyer tell you there could be hope? Man I feel that we know about the situation more than our lawyers ,!!

        • They just don’t understand what we are going thru. I have seen people being notified by their lawyers after 3-4 days of the actual receipt date. My lawyer said they would start getting responses from 04/15. God knows!!

          • @Sam .. Dont lose hope, Wait till till next weekend, my lawyer said that usually they are very slow during the initial period when the quota gets filled within the first week. So you can hear back next week too, just because the ppl stop updating about PP here does not mean that the centers have stopped PP.

          • Ram, its not because people stopped reporting their PP cases acceptance, but if you checked todays cases status from the USCIS you are gonna see that the cases are all regular, they are no gonna start processing regular cases if they did nt finish with the premium,

            I do like to stay optimistic, but I am so realistic that I dont want to keep hoping about something that is over now.

          • I just checked around 10 numbers in CSC.. I found 3-4 PP . Ratio for RP might be high but still you can hear back from HR/lawyer on Monday only right ? So don’t lose hope, just because the PP numbers started to trickle down.

            1) If notified via email we should wait until 04/20.
            2) If notified by a regular mail then it could be another 2 weeks.
            3) If 1 & 2 didn’t occur then we should expect to see a return packet anytime within a month from now.
