USCIS received 124,000 H1B Visa 2014 Petitions – Official Lottery Update Results

As predicted by us earlier on USCIS official news update date, USCIS did an official press release today disclosing the details of overall petitions received and lottery process followed, including results. Below is a brief summary of the H1B Visa 2014 news release.

USCIS Official News : Summary of H1B Visa 2014 Lottery Results press release

  • Big News: For the first time in USCIS history since 2008, H1B Visas 2014 cap reached within the first week of filings, i.e, first week of April.  You can check out US Economy and H1B Visa Lottery
  • Total H1B Petitions received :  USCIS received a total of 124,000 H1B Visa petitions for fiscal year 2014.
  • Lottery Information : USCIS conducted a random computer generated random selection process, also called as lottery, on April 7th to select the petitions needed to meet the regular cap of 65,000 and masters cap of 20,000
  • Lottery Process followed: As described in our detail H1B Visa Lottery process, USCIS followed the same thing.  First USCIS conducted lottery process for Masters quota petitions and then the petitions not selected in masters lottery were merged with regular quota pool and random selection process was conducted for remaining pool to select 65,000 petitions.
  • Petitions Not Selected in Lottery  : If your petition was not selected in lottery, USCIS will reject and return the petition along with the filing fee, except for duplicate petitions.
  • Premium Processing for H1B Visa 2014 : To facilitate the data entry process and meet the timelines, USCIS will begin premium processing for H1B Visa 2014 from April 15th.
  • Non-Cap Subject Petitions Accepted :  USCIS will continue to accept non-cap subject petitions i.e, that have already been counted towards to the cap, including petitions filed under below category
    • H1B Visa stay extensions
    • Employee terms changes for H1B visa worker
    • H1B petitions filed for Change of employers
    • H1B petitions filed for concurrent working for more than one employer

    apparently they received it on April 8th, not sure why waited till Friday to notify me
    so people still haven’t heard from your lawyer, please hang in there, I think there’s a delay when they receive the the number and when they notify you. Good luck to all, good luck to all your lives.

    I wanna say congrats to those you got their receipts and good luck to the others!
    I have a question concerning the decision making for the visa once you made it through the lottery..
    Does anyone know a little about the process? Do they just accept anyone whose petition is well done and doesn’t look fishy? Or is it still challenging to get the visa?
    Also, does everyone have to go do an interview or not?

    • My guess is that if the application contains all necessary information and of course the information is accurate, then there is no reason it is not approved. This is especially true for people (probably most people) who hire attorneys to file on their behalf.

    • I know for sure that those who have done Masters (MS, MBA. PhD) from the US, are working for an employer who isn’t blacklisted and who were at all times in valid visa status should not face any problem….

      I guess same holds true for those folks who havn’t done Masters from US but are working for an employer who isn’t blacklisted…

        Our attorney was actually careful to get our hopes up since my Master’s is in marketing and I work in a marketing position. Employer is very reputable, medium-sized, not blacklisted and I have always maintained legal status. However, apparently USCIS sometimes believes that you don’t need a degree for marketing positions (a joke in and of itself) and the attorney said this has been cause for RFE’s in the past. I’m not really worried since the attorney made sure that we put forth a strong case, but I have to get through the lottery first.

        Just an example to show that not everyone is in the ‘classic’ IT fields.

    • And BTW, the fraud fee that USCIS charges on your petition is precisely for this reason (to detect fraudulent companies and individuals)…

    This is the article from USCIS. It says, it has received sufficient number and also says that it will not disclose the total number of applications. I am really curious to know where did this number (124k) came from?

    Did USCIS really say that there were altogether over 124k application?

  6. Got my WAC# today morning from my attorney — status is acceptance..
    it ended a couple of very stressful days for me…

    I sincerely hope and pray all you guys get through…a country as “advanced” as this should never be using such a tactic while selecting applications..

    for me its only the first step now…I am full time but on an EVC model..so chances of RFE are high…hoping for the best..

    Can anyone of you please tell us if your company check has been cashed out?
    I am not a PP, so I hope to find out the result by checking the bank statement rather than waiting for the mail till forever.

    • I seriously doubt that USCIS will spend all this money just for the receipt to arrive quickly…

      It always comes by mail, so it shouldn’t be any different this time.

  9. I strictly suspect that USCIS is bluffing that they got 124000 applications. Reason why i doubt is they didn’t share the AD count till now and more over it is just a hype by USCIS. I seriously think they didnt recieve more than 85k or 90k apps. I believe everybody will be through this lottery for sure.

    • I second that SRT. I got my petition approved yesterday, but i still kind of worry for other people, i know how hard it would be on you guys!! I slept for 16 hours yesterday after i came to know i was thru, such was my stress level. Hang in guys, everyone will be thru..

    • I would like to agree with you. The first USCIS alert on 04/05/13 said, “Due to the high number of petitions received, USCIS is not yet able to announce the exact day of the random selection process” and then the next News update was on 04/08/13 that they did random selection on 7th (Sunday)…there was no need to do this in such hurry they could have waited till Monday…something doesn’t sound right…may be they did not receive such high number of applications…..or may be I am just thinking this way..

  10. I got my receipt mailed to me today, actual mail came in today (not e-mail), thats for ADV/PP/Vermont.
    If this helps anyone with trying to track the mail delivery notices.

      • Sorry. I did not read the original message carefully. This his just the actual receipt notice after the emails approval for PP. With the current scenario, I don’t even care about PP people getting their printed receipts.

      I am also waiting for my H1B approval.My employers has asked me to wait till the end of this month. But this wait is killing me. Mine was reg cap/Vermont? I am not sure whether it is PP or non PP.

    • Something fishy about your story becuase if your employer/attorney filed your application then the reciept always goes to him and not you.

  11. Can we sue USCIS for this mental stress and physchological tension and disorder. I am starting to loose my temper and strength on this ridiculous process.

    Please let me know if there are any good lawyer will process this case. I will play the victim and i don’t how many other are willing to join me.

    Does it mean that I am not selected in lottery . Loosing hope……………..

    Unofficial information on cap from the USCIS associate director.

    At a conference this morning, the following information regarding the H-1B cap cases from Donald Neufeld (USCIS Associate Director Service Center Operations Directorate):

    1.USCIS began the process of data entry of the H-1B cap cases. Premium processing cases are being entered first and should be completed by the end of this week.

    2.Non-Premium Processing cases data entry will begin only after the premium processing cases are entered. Non-Premium processing case data entry will not be completed until at least the end of April and will very likely not be completed until sometime in May. Please note that when the cap was reached on the first day in 2008, the USCIS did not complete the data entry and issuance of receipt notices until June. Therefore receipt notices for non-premium Processing cases may not be issued for everyone until May.

    3.Rejection notices for cases not selected in the lottery may not be sent until June after the receipt notices are sent out for selected cases.

    4.Premium processing adjudication will begin on April 15th for all cap filed premium processing cases. Mr. Neufeld commented that the USCIS did not receive a larger than expected number of premium processing filings to prevent adjudication (approval, rejection or Request for Evidence) of the premium processing cases within 15 days.

    5.Non-Premium processing cases can only be converted to premium processing cases after a receipt notice is issued.

    6.Mr. Neufeld refused to provide any goals for processing times for non-premium processing cases. He stated that the USCIS may publicly announce a processing goal in the future.

  15. Checking status and found it has updated till EAC1313452522 and it keeps on moving does it mean that VSC centers are still updating the database and they will inform the attorney while updating the database.

    Mine is Regular PP VSC , let me know if anyone else in same boat..

    • I am n the same boat. I have applied for Regular Cap Premium processing and I am not sure which service center. I am losing hope too.. I called my employer yesterday and he said he received 2 receipts but not mine.. I am really bumped and so sad 🙁

    • Count down is @ EAC1313452554 , it moving very fast.. also I saw many in initial-review and very few in acceptance status , so thinking all initial reviews are in Gen category.

      Please add if some one has total receipt count(guess) for CSC and VSC centre yet .

    • Just BS! How could people upgrade their cases to PP if they don’t even know whether they are selected or not by 4/15?

      • my understanding is that you can convert the regular processing to premium any time once you get the receipt. Its is not that you have to do by 4/15

      Here is the link and I hope its not true.. I`ve had enough stress for now please dont delay anymore…Plus I dont think we should believe in any unofficial news. I`m trying to be as positive as I can. This cannot continue for one more month thats utter BS. USCIS should hire more people to update status into their system and people will get employed aswell in that case.. good for US economy lolz……

      • I don’t think they care about the economy. Otherwise, they wouldn’t put people who will possibly be sent to the U.S. for short term projects and crappy pay by Indian IT companies in the same basket as people who have lived in the U.S., were educated in the U.S. and have been supporting the U.S. economy for years.

        Right now, I am actually holding off on buying a new car because I don’t know what’s gonna happen.

        • haha.. I fail to understand why you feel you have a better right to a H1 visa just because you stayed here for couple of years and educated here. Well, you can continue living in your own well and think that those gettting “crappy” pay from Indian IT companies are lesser mortals. If it does your ego some good, go on. But do suck-up to what’s happening, you have not achieved anything in life by studying here and (LOL) “supporting” the US economy. (Lord, has Obama given you an award for that, for “supporting” the US economy that is).

          You are in a very dire situation and crying over others’ fortune ain’t gonna help yours. The ones trying to come here already earn good pay in India by Indian standards, have a car, a house or two and are very well-off than your pitiful self here.

    • This is completely not true!
      Vermont and California also processed few Regular processing applications. Though the priority was to Premium Processing (based on comparing data for random numbers whether notice was sent through email (PP) or mail (RP)) it was not like they did not start on regular processing applications.
      I do agree that USCIS will try to complete providing receipt no. to all selected PP applications (& it make sense since the clock start date for PP is Apr 15). & if you notice, the PP applications received receipt number are already started for processing and there 15 days clock has already started… USCIS did not wait till Apr 15th to start the 15 day clock for already processed applications….

      As they are almost processing 8k applications each day through both centers… they will finish all the applications by max Apr 22-23rd…. I wont think it will even go to April end and surely not in May….

      • There is something called as waitlist. If someone make it through lottery but this H1B dont get approve then they select someone from list of applicants who didnt make it in lottery. thats why they said, it can b may. By the end of april we should know results. May is just waitlist thing, i explained.

      But that’s just really inefficient. In 2008 they were not prepared. This year hey brought in several contractors to supplement their effort. They even conducted the lottery on a Sunday. So I think they are concerned about he overall efficiency in in executing the process. This makes it highly likely that there are some overlaps between data entry on PP and RP. Besides, they do not have to wait until everything is entered to start sending out info. Do you think they have entered everything in the packet to the computer before sending out the PP Receipts?

      Another thing is, why is it called unofficial if the article is quoting Mr. Neufeld? Where ate the numbers?

      My question is still this. How many AD cases have they received?

Hello Guys, I just got an email from my attorney that they’ve already got the receipt number… But I asked several times this week if they have any news about my case and they all told me no…. until today I asked even not a receipt? and finally they told me yes they received a receipt…. but did not reply me back the number even… So first.. this might happen to you too… your attorney might not know you are waiting for the number… so don’t ask then if they have any news.. just like I did.. ask them about the receipt… Second.. Is that really true that if you have a receipt number, then that means you got selected? I believed that in the past few days.. but now I start to doubt it since my attorney seems even not care about the receipt……….

      Employer can file it at any location?

    I finally got to know an hour back that my application got picked in the lottery. AD(Advanced degree i.e. Masters), PP(Premium Processing), VSC(Vermont Service Center). Actually my attorney got the email confirmation from VSC on April 10, 7:30 AM, but the attorney didn’t report it to my employer till today morning. They might have missed it in the large pool of applications. This might happen in your case too.
    I was very tensed till yesterday afternoon about my friends getting picked and not me, but i didn’t loose hope. I have been reading various posts on different websites and talking to my firends and i believe that the number of excess applications for AD are not too high than the cap of 20K. So hang in there who have applied for PP and the RP guys have the whole next week.

  21. Just checked up with my sponsor. For normal processing (non PP) they asked to wait until 4/20. anyone else got similar response?

    • Yes, when I last checked with my lawyer on the 10th, they said the result should be delievered within 2 weeks (making it the 24th at the latest).

      • Same here, My HR said expecting response from USCUS in about a week, my colleagues who applied in AD/PP got accepted yesterday, I applied in AD/regular, still waiting…….

        • Starting next week all regular process applicants will be receiving their receipts through mails. So hold on and be positive.

  22. There is a common spelling mistake in many posts here. The verb that represents a loss is “to lose” and not “to loose”. (i.e. I am not going to lose hope). Loose is an adjective and it means not tight or not fastened (i.e. She let her hair loose and it fell around her shoulders). I know I am annoying and no one likes spelling or grammar Nazis but I am just too nervous and needed a distraction.. Please forgive me 😀

    USCIS has released data pursuant to a Freedom of Information Act Request that reveals that approximately 45,000 H-1B available cap numbers have remained unused in the last four fiscal years. Although the agency has acknowledged the presence of available H-1B numbers for the 2013 fiscal year (October 1, 2012, through September 30, 2013) it has not announced what will happen to these newly discovered H-1B visas or explain why so many remain after the USCIS has closed the quota each year.

    Sorry for asking at this point, but what does AD/Pp/CSC stand for. I am kind of confused.
    I am a Master’s student that applied regularly but I haven’t heard back yet.
    This tip came from my lawyer today: “[My Company] can monitor its bank account to see if its filing fee check, for your petition, clears…this sometimes occurs faster than our receipt of a receipt notice.”

    • AD = Advance Degree (Master, PhD)
      PP= Premium Processing
      CSC = California Service Center

      In my case, I filed under Regular cap (Bachlor), Regular processing, and Vermont service center.

      I think they haven’t started sending notifications for regular processing people….

    • Don’t lose hope my friend . One of my friend received a email forwarded by his attorney which has 9.40 pst today for AD/pp/CSC. you will get it

    • I see CSC has entered almost 400 new petition number today and 90% of them are Non-PP and to the best of my knowledge they have completely into entering all Non-PP into system. Whatever until yesterday late night they entered is what people saying they received today. Just keep following up with the Attorney, this is one thing you can do.

        • Couple of observations.
          1. PP case status updated are emailed where as Non-PP are not; this is very clear from case status messge
          2. PP cases can be in Accepted status because they will move them to Initial review possible on Apr 15th; where as Non-PP cases are always start with Initial Review status
          2) When PP cases enter into Initial review USCIS status shows that ’15 day clock for PP has started on your application’ where as Non-PP does not show this.

          I hope this can clear confusion if you search Case status in USCIS by receipt number

    • hey dont worry guys, i dont think they are done processing PP or Regular, they only reason for delay is the number of applications sent. they are sending responses regardless of PP or regular or AD or General cap. the ppl with PP are getting it in emails so its faster response.

  29. my employer sent an email that i was selected in lotter but they dint recieve any number from USCIS , they said that my checks were deducted so i am selected

    • My employer received for AD/ PP/CSC yesterday. I spoke to my attorney and they said, USCIS may send receipt numbers in the weekend also. AD guys deserve more than any one else. All the best. You will get it for sure.

  32. Guys from EGAN… someone said there’s a portal where you can check the status of your case.

    Is it true? Does anybody have a link/credentials? I wasn’t given anything rather than some paper forms to fill out by EGAN. I contacted them and they told me to be patient.

  33. General quota/ PP/ California Center:::
    Finally got my receipt number. My lawyer received it yesterday around 8:30 pm and sent to the employer in the morning. My employer forwarded now. Checked my status in USCIS, it shows acceptance. Thank God!!!
    One thing I would like to share is, everyone I knew got the receipt. It is just matter of time. I too faced the same tensed moments. Hope every one get the receipt numbers. All the best friends! I pray for you all as I faced the same situation till 11:30 this morning.

  34. Is EAC number unique for each person’s H1b application or a group of all h1b case for a company can be combined in one EAC #?

    Is there anyway I can find name of person on a EAC#?

  35. Do you know if they will be sending the receipts on weekend also or tonight would be the last chance for the PP regular since they are gonna start the processing by Monday the 15th .

    • I think it might be possible that they also send some email on this weekeds as they did lottery on last weekends. So we can be positive. I am also waiting. My case is AD/PP/cali.

        • Can we get CPT if we have to do second masters? I know we can not apply for OPT another time if we do masters second time. I am thinking that If we get into another masters and get CPT and can continue work till april 2014.

          • Hi Sagar,
            You can use CPT. As we are not eligible for OPT for the second time, you can take CPT now for more that 12 months. There are number of universities which provides CPT from first sem for second masters. But don’t lose hope on anything, we will all make it at end for sure.
