USCIS Online H1B Case Status Meaning – Detailed Screenshots

If you applied for an H1B transfer or you were picked in the H1B Registration Lottery and applied for H1B petition in the recent H1B Visa 2024  season, you may have received a case receipt notice. When you check the H1B Case Status online, you may see various statuses like “Case Was Received”, “Name was updated”, etc.. You may not fully understand each of these status meaning. This article is meant to clarify each of those H1B Case Status meaning and give a complete flow of the same.

H1B Registration Beneficiary Confirmation Number Cannot be used for Tracking

If you were picked in the H1B Registration Lottery, the registration selection notice would have a Beneficiary Confirmation Number. You cannot use that number to track your H1B on USCIS website.

That number is only for internal reference and to run the lottery. The USCIS case number has a certain format and the beneficiary confirmation number does not follow that as well. So, do not try to check online on USCIS website and be confused.

H1B Case Receipt Number – Check Online

After an applicant is selected in H1B Registration Lottery, the company or H1B sponsor need to file an H1B Petition with USCIS using form I-129. After the H1B petition is properly filed, USCIS would send out a H1B receipt notice to the employer/ attorney indicating that the application was properly filed on time. The H1B Receipt notice would have a case number and it can be used to track the status of the H1B petition. What’s the H1B Case Number?  Processing ?

The H1B receipt number is a 13 character alphanumeric string that is given by USCIS. It typically starts with EAC or WAC. You may read Understanding H1B Case Number Details, to know more info.  For high level understanding of how each H1B petition is processed at USCIS, you should read the article H1B processing steps at USCIS adjudication center.

Also, in the past, USCIS used to assign many statuses like Acceptance, Initial Review, Decision, Post Decision Activity, etc.  Some of these have been changed with the new system this year. To get an idea of the past flow and statuses, you may read H1B Old Case Statuses and Flow.  Below information corresponds to the latest H1B statuses available on USCIS website for a H1B petition.

Below are the various Case Status that you usually find on USCIS website, when you Check Case Status on USCIS website.

  • Case Was Received and A Receipt Notice Was Emailed
  • Case Was Received
  • Request for Additional Evidence Notice was mailed
  • Response to USCIS’ Request for Evidence Was Received
  • Case Was Approved And My Decision Was Emailed
  • Case Was Approved
  • Decision Notice Mailed
  • Error : The application Receipt Number is invalid
  • Name was updated.
  • Fees will be Refunded
  • Withdrawal Acknowledgement Notice Was Sent
  • Case Was Transferred and a New Office has Jurisdiction.

Let us look at each of them in detail

H1B Case Status Text – Form I-129 Petition for a Nonimmigrant Worker

If you notice any of the H1B statuses’ text below, all of them would say “Form I-129, Petition for a Nonimmigrant Worker”. The reason is that, when you file a H1B petition with USCIS, you would use form I-129, thats why you see the status text to indicate the form number. USCIS does not explicitly tell H1B Visa petition in the status as the form I-129 is also used for other visa types as well. It can be confusing, if they put in all visa types in there, so USCIS intentionally does not put in H1B in there and only indicates the form type. Your receipt notice would have “Class Requested” as show in below screenshot, indicating it was a H1B petition.

Case Was Received and A Receipt Notice Was Emailed

USCIS emails receipt notices to petitioners, if they filed their H1B petition under premium processing.  The H1B case status “Case was Received and a Receipt Notice was Emailed” indicates to us that the petition with this case number was filed under premium processing with USCIS. A receipt notice with case number and details about processing was sent to the email of the attorney/ employer. Below is the screenshot for the described status.

Case Was Received

USCIS only emails receipt notices for premium processing applications. For H1B petitions filed under regular processing, USCIS will send out the receipt notices via traditional Mail/ Post.  The H1B case status “Case Was Received” indicates is that the petition with this case number was filed under regular processing and USCIS has received the same. The receipt notice hard copy will be sent to the attorney/ employer’s postal address on how it will be processed. Check below for screenshot of the described case status.

Request for Additional Evidence Notice was mailed

If USCIS wants more information on a H1B petition, they will ask for the same information. The H1B case status “Request for Additional Evidence Notice was mailed” status indicates the same that USCIS wants more info. As part of the adjudication process of the H1B petition, the USCIS adjudicator of this petition, with this particular case number, needs more information to make a decision on the case. The adjudicator issued a Request for Additional Evidence notice, which is commonly called as RFE (Request for Evidence).

The employer/ attorney will get an RFE notice from USCIS indicating what documents they need to submit for further processing the case.  It has an expiry date and employer/ attorney has to respond to that request by that date. USCIS will NOT process this particular case until they receive a response from the employer/ attorney with the requested information.  Below is the screenshot of described status.

Response to USCIS’ Request for Evidence Was Received

After USCIS receives a response to the RFE, they will update the same in their online system for the H1B case. This H1B Case status “Response to USCIS Request for Evidence Was Received” corresponds to the same. All the status tells us is that USCIS has received the response for the issued RFE Notice on the particular case with that case number from the employer/ attorney. 

The response from employer/ attorney could be either documents or any other supporting material that was requested by USCIS supporting the H1B petition. If your petition is in this status, it means that USCIS will start processing the case as they have received requested documentation. The status also tells the petitioner that when you can expect a decision/ update on this case. Check below screenshot for RFE response status.

Case Was Approved And My Decision Was Emailed

Usually, if you file in premium, you would informed by email. This H1B case status “Case was approved and my decision was emailed” indicates the decisions of approval that is sent by email to the attorney/ employer. This case status only appears for the H1B petitions filed under premium processing. Below is the screenshot of the status.

Case Was Approved

The H1B case status “Case was approved” is self explanatory. It tells that the the H1B petition with this particular case number was approved and they plan to send out the approval notice to the employer/ attorney by traditional post/mail. This case status appears only for petitions filed under regular processing.

Decision Notice  Mailed

Not every H1B Application gets approved.  Typically USCIS will issue an RFE and then review the evidence before making the final decision. If USCIS is not convinced with your petition’s supporting documents, they will deny the H1B petition and the case status will be shown as ” Decision Notice Mailed”. Your employer will get a notice indicating why the petition was denied and they can act on it as per the instructions, if they want to challenge the decision by providing additional documents, etc.  Below is how it looks.

The application Receipt Number is invalid

If you do not enter a valid 13 character H1B case receipt number, USCIS case status website will give you the above error message saying that the application receipt number is invalid. All it means is that, either you have taken the receipt number wrong from your employer or entered it wrong in the box…or maybe your employer did not give you the correct case number.  Below is the error screenshot. 

Name Was Updated

This is one of the very confusing statuses that USCIS online system gives, when there is some activity happening on your case. The H1B Case status “Name Was Updated” can be very confusing and misleading everyone at times. It may be genuine that the name was updated due to a clerical error, but not always the case.  

It definitely means that some activity is happening on your case and your case is being worked on by USCIS.  There is a perception among users that this status will lead to rejection/ RFE, but it is not necessarily true.  So, when you see something like this status, it is best consult your employer/attorney to check further on your case. No need to panic or get confused.  It looks like below

Fee will be Refunded Status

One of the others status some of the H1B petitioners see is that ‘Fee will be refunded’. What it means is that the employer/attorney has filed extra fees that is not required and USCIS is refunding the same. It can be for a host of reasons related to the H1B fees. As you can see below USCIS would tell that it will not impact the processing of the case, so do not panic when you see this, work with your employer, it will be fine.

Withdrawal Acknowledgement Notice Was Sent

If your H1B employer plans to withdraw your H1B petition or for some reason you believe that you do not want to work for the company and resigned the job, then your employer would withdraw your H1B petition from USCIS. It is not really automatic process, your employer has to request for it. If your H1B case number indicates the below status “Withdraw Acknowledgement Notice was Sent” for I-129 petition, then it means that your H1B was withdrawn by your employer and USCIS is acknowledging the same with the status.

Case Was Transferred And a New Office Has Jurisdiction

Depending on the load of H1B petitions received and processing times at any service center, they are moved to different locations to expedite processing or balance the overall processing loads. If your H1B case was transferred to different location for some of these reasons, you would see a status like below. It tells the date when the petition was transferred and when you can expect a physical copy of notice indicating the same. It does not really change anything in terms of how it is adjudicated, it is just for processing times balancing, nothing to worry.

  1. My Case status is “Revocation Notice Was Sent” as I changed my job from petitioner. Does this mean that my previous employer has revoked my H1B and I will not be able to transfer it to new petitioner or use it again. Does it mean that it is cancelled

      Lot of employers revoke the petition when the employee leaves them. You should still be able to file cap-exempt petition in future.

        My Fresh H1 is Filed and selected in lottery then I got RFE. My employer were asking for money to respond RFE but I could not pay. After that he was not responding to RFE then one letter send to my employer which is prepared by my attorney. When Employer received the lattar same to he responded to RFE but not sure it was for withdroveal or evidence. Now I receved the mail showing below ” ** DO NOT RESPOND TO THIS E-MAIL ***

        If this is revoked then how I can file cap-exempt petition in future. I tried to check it but could not get info that I can file it. Please share me the step or way to file it again with cap-exempt petition in future.

        • You should not pay for H1B, that is illegal. Well, you do not even have h1B approval, nothing will happen, if they do not respond, it will be considered not counted towards cap. You need approval and stamping to be cap exempt, assuming you filed as consular processing.

    on may 4th, i got the Receipt number from my employer, my status on the USCIS now is shown as “My Case Was Transferred And A New Office Has Jurisdiction”

    what this status means? is my processing is still on track, or something is missing from my side.

    kindly help.

    • we have different service centers vermont,california ,nebraska etc .so due to heavy work load your petition has been moved to another service center where there is less work load.. nothing to worry..just hang on…for updates

      • So until when should i wait to get RFE ? Normally for what reasons do they ask for this RFE? I thought i have to fly by Oct 16 why would it take till Dec 16? Is there any specific reasons why it would take too long?

          what about consultant interview in india?,least dates available are around november,i keep checking all over india for the dates 3 times a day,until you got approved from your consulate office you cant travel.
          so till the time your petetion gets a status change may the dates will move to december, this means you can fly december ending or january.
          you can attend at other consulate for interview if dates are near but that might rise to doubts,some will lucky and some will not.
          All these things i am sharing based on my 3 years of h1 filing experience.

    • you can go for MTR- motion to reopen. but should be done by your employer through attorney..but the chances are very bleak..

    I’ve checked the USCIS PROCESS TIMINGS for CALIFORNIA SERVICE CENTRE and it shows NOV 2, 2015. What does this mean? And by when can I expect a change in my stauts from case was received. Please help with the info.

      The file was last updated on April 30 while date entry was still happening for this year’s petitions. Due to the huge workload of the petitions, they haven’t updated the status for I-129. Was your petition applied in April 2016? If yes, then you should expect reply by Oct 2016, although there is no SLA and could be well delayed due to huge workload of applications.

      Thanks. But my Employer says that there will be a reply by the first or second week of august. Can I expect a reply by then or will it be in Oct only? If there is no reply in August can I upgrade to PP coz whenever I ask my employer regarding the upgradation he tells me that I will be in problems if I upgrade to PP USCIS will raise a quiery. Is it true? Can I expect a reply anytime before OCT 2016? Please reply with the info.

      check respective time lines of service centers. vermont date was sep-17-2015 until june 14-2016. now it is 2 months so all the h1b applications pending since 2015 will be cleared on or before aug-14-2016.

And the one you mentioned shows Novermber 2, 2015. So by when can I expect it to be done? I’m confused with this date Nov 2, 2015. By when can I expect a change in the status

          • petition for a non immigrant worker h-1b special occupation- visa to be issued abroad is what u need to check “visa to be issued abroad”. california center last processed application is for nov-2-2015. if ur application should have been after nov 2-2015.(RFe or response for rfe received ) what ever it is. if it is nov 28-2015( rfe response received, then you are very close. may be 30-45 days from now hypothetically.

My case status shows we have received your petition for non immigrant worker petition no WACXXXXXXXXXX on 11th April 2016 and sent you a receipt notice which explains how we are going to process your case. If you donot receive the notice by 11th May 2016 inform us. So can I expect a change in status 30- 45 days? TIA

        I was selected in H1B lottery last year during April2015, then I received RFE & it was responded by my employer, its in RFE state from 5th Oct 2015, I don’t have any great hopes left with this… 🙁 employer says pending with security check –
        “Response To USCIS’ Request For Evidence Was Received”
        Since “Processing Cases As Of Date:” column in this page https://egov.uscis.gov/cris/processingTimesDisplay.do;jsessionid=abcvf699hjMtf9xwAXyyv shows 2months, so can I expect them to close my case by aug14 2016? or where should I check or what will be the deadline for them to respond to me??

        • Looks like you are too much pessimistic person.” I don’t have any great hopes left with this… “. be happy that your petition got picked in lottery. hopefully it will be approved in a month or two.patience is bitter but its fruit is very sweet. person who has no patience will never scale heights in life.

          Petitions that are stuck in security check are not subject to the processing timelines mentioned on USCIS site. They can be delayed for some to several months.

      If you haven’t received any receipt number or selection hint yet, then you didn’t make through the lottery. Rejection letter should be received soon or employer may have already received it.

            Its been 4 months the status is not changed, It is still “Receipt Notice Was Changed”. This status is something in between “Case received” to Case Approved” or something different.

    I got selected in H1 Lottery this year, after that my employer converted it into PP. Now I got RFE.

    Employer shared the reason: its because they need client letter and some other documents.

    Initially I provided the different company name A (while applying for H1 lottery), can I change the company name to B ( while replying to rfe) ? both company comes under one organization.

    In case we reply back with required documents, whether it will be considered under Premium processing.

      It may tricky. If you are changing it to a client at different location, then it warrants LCA change which may not be possible while the petition is still pending. Your attorney can frame a letter to USCIS and request the change, but there is a chance that it may not work.

      Probably something was updated in the receipt. Your employer should receive the notification in some weeks. They can contact USCIS about it and clarify.

    I got my name under lottery in 2015-16. My petitioner is an consultant at US.
    There was an RFE raised by USCIS in July-2015 and the response was made by Attorney in Oct-2015.
    Since then there is no movement and the status is always”we received your response to our Request for Evidence for your Form I-129″.
    Looks like my consultant is not keen to look forward at my case.

    Is it possible if i can get my petition transferred to another consultant or my current company.
    I do have I-797C with me.

      Unless the petition is approved, it is of no use. For H-1 transfer, the original referenced petition should be approved, which is not in your case.

  15. Hi,

    My attorney sent an email on May 15 which says that my status as “case was approved and my decision is emailed”. They also said they’ll receive an approval notice by mail but it’s been more than 2 weeks and I haven’t heard from them. Till when can I expect the notice?

    Mine is AD/PP California centre. Also, I couldn’t apply for COS because I had to leave the country since my opt expired just before the H1b deadline.

    I had the following case statuses (I-129):
    In April: My case was received /EAC number
    May 18: My case was transferred to another Office
    June 1: My case was returned to USCIS

    Its totally confusing! I dont understand as to what’s happening!
    Is the last status denote any problem? I could see a received status if i replace EAC with WAC with same number. Is this my new case number?

    Kindly help explain this.

      Can you elaborate what June 1 message is. Paste the actual text that you see online. Swapping WAC w/ EAC doesn’t work this way. They belong to different people.

        On June 1, 2016, the Post Office returned your document to us. We will hold your document for 180 days or until November 28, 2016. Please go to www.uscis.gov/e-request to request that we resend the document to you. If you do not submit an online request by November 28, 2016, we will destroy your document and you will need to file a new Form I-129, Petition for a Nonimmigrant Worker, with fee. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

        This is confusing, because earlier status mentioned that case was transferred!

          USCIS sent a document to your employer (most likely related to transfer of case), but post office was not able to deliver it to your employer and was returned to USCIS. Your employer/attorney should contact USCIS and get this sorted out.

          • Ok thanks. But the document even if the sponsor have not received, it should not affect the status of transfer right? It will get transferred and go through approval/ rejection process?

            It won’t impact the decision, but your employer should figure out the reason. If the address is incorrect, then employer should get it corrected or all documents will be returned to USCIS.

  18. I asked for a new I-20 from my school and the new I-20 says h1b status change pending and there is a receipt number.

    I used the receipt number to track and it says “Case was received”

    My application was through Premium processing and Advanced degree through Vermont. (Shouldn’t the tracking page says “Case Was Received and A Receipt Notice Was Emailed” instead of “Case was received”)

    The lawyer didnt receive any receipt and the check wasn’t cashed yet.

    I got excited that there was a receipt and now i’m starting to see a lot of confusion around this case.

    Is anyone on the same boat?

      Ask employer to contact USCIS and follow-up on the case. Maybe the receipt notice is lost in transit or someone else’s receipt number has been added to your SEVIS record.

  19. Hi ,

    I on my 19th May when I queried my case status it said “Case Was Approved” and that USCIS will mail my approval notice. Subsequently my attorney got the approval email from uscis which clearly stated “The form I-797 Approval Notice will follow in the mail.” Now when I check my case status it says “Name Was Updated” on May27. Further it says “On May 27, 2016, we updated your name for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number WACxxxxxxx”. What could be the possible reasons for this status change considering my case was approved, anybody else has got similar experience, is there a cause for concern?

        The status changed to “Case Was Approved And USCIS Notified The U.S. Consulate or Port of Entry”. So all is good. Mine was PP.

            It means your petition was approved and they have informed consulate for your visa stamping.

  20. Hi,

    I received H1B receipt notice from the employer, however I still can’t track the case number in USCIS Case status page. It still says “Please verify the case number”.

    Can someone please tell me what does this mean? Is my case status not updated in their systems?
    How to proceed further in this matter?

    • Did you employer gave you the case number ? or did he gave you the official uscis receipt , which has the case number in it. if your employer just gave you the case number over the mail or do you have the case number in the uscis receipt notice. if it is uscis receipt notice then it will not be wrong case no as you can see your name on that notice and if your employer gave you the case number re -check if the case number is of correct format and also it is yours.

      • I received the receipt# from employer. I got the i797 form where my name, DOB and the receipt # is there. But while tracking it, it says ‘please verify the receipt number’. What does that mean?

    My situation is:
    I am presently in US on J1 visa, Applied for H1B through Non-AD, cap, PP, picked in the lottery (april 11), case approved on May 18 and my present status shows” Case Was Approved And My Decision Was Emailed”.

    My employer’s lawyer told me that he applied for Change of Status (COS) as well but I have to wait till he get the final approval from USCIS to confirm whether USCIS approved my petition with COS or not. After that I can decide whether I should apply for COS of my wife and daughter (dependent on J2 visa) for that I have to pay $300 USCIS fee + 500$ Lawyer fee.

    My question are 1. Does USCIS send 797 with COS through email or they only send by mail??
    2. How long does it take to get the final approval notice through mail??

      1. I think they would mention I-94 details in the email. But to be sure its better to wait for actual approval notice as it would have new I-94 (still same number) attached to it.
      2. Paper notice should be received within 2 weeks, but the SLA is 30 days.

    Today, I got a status change, the status changes reads as “Case Was Transferred And A New Office Has Jurisdiction”.

    On May 18, 2016, we transferred your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC16********, to another USCIS office. That office now has jurisdiction over your case. We sent you a notice that explains why we moved your case. Please follow the instructions in the notice.

    What does this mean?

    • Due to heavy work load the petitions are being sent to other service centers. instead of Vermont service center now your case will be worked by one of the case officers in California or Nebraska or Texas service center.

    So, the document which they have mentioned is the receipt notice I received. Right?

    I got my petition selected through Lottery for 2015.

    One RFE was raised and my company did responded them in October 2015, since then it is showing the same status.

    “On October 22, 2015, we received your response to our Request for Evidence for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number . Our Vermont Service Center office will begin working on your case again. We will mail you a decision or notify you if we need something from you.”

    My company and attorney did followed up for this but nothing is happening so far.

    Any suggestion will definitely help.

        Just curious to know, even if this is the normal case, but the response to RFE is raised around 7 months back.

        Is this normal, i mean it’s 2016 started and are there any cases left for 2015 yet?

        My company is not willing to go for premium processing as per them the conversion ratio is not that good.

        Is there any way we can process it fast?

        • Mine is the same case like you. i got RFE in august 2015 and my employer responded in Nov 2015 and since then it is in rfe received status only. most of them are in the same boat like us. if you would like to speed up the process the only way is going for premium processing which cost around usa $ 1700/- 1225 for uscis fee and the rest would be attorney fee. but this can be done by your employer through attorney. else you have to wait that’s all one can do.

      Agree w/ ksmk’s comment. If your petition is stuck in security check, then even upgrading to PP won’t speed up the process.

          Only 2 ways that I know:

          1. Raise SR and hope that they respond with meaningful information and disclose about security check
          2. Upgrade to PP and if they don’t process within 15 calendar days, then it is stuck in security check

          Do you know if employer has filed other petitions and what happened to those?

            Per consultant, they got 40 applications in lottery and out of those 36 were approved and only 4 are still stuck with same reason.

            They did raised SR but still there is no response, they are planning to raise another SR in 2-3 days.

            For PP, consultant is not that keen for. As per him the conversion ratio is not that good.

            Is this true?

            PP success rate fears are like urban legends. You hear about them but they are not true.

            See what happens to new SR which they are planning to file. Nothing else you can do here.

            SR response in April 2016 was that it was stuck in security check.

            Another SR Response in june 2016 was it was pending consideration.

            My employer does not seen interested in PP.

            Feel helpless.

        • As of March 31th, USCIS Vermont was processing H1B which sent to USCIS on September 17.

          A person was in the same situation like us. He sent the RFE on October 17th and he got approval on May 7th. I hope we will get approval notice from USCIS soon.

    Can I change from regular processing to premium processing at this stage and send additional documents to USCIS for my application? Or can I send additional documents only in case of a RFE? Please let me know. Thanks.

      It can be upgraded to PP using I-907 form. However, the SLA won’t start until May 12. Additional documents cannot be submitted unless they issue RFE.

      It should be ok as you didn’t break any rules. You may be asked about the reason for not using the F-1, and you can respond truthfully.

    I work for company in India. I have filed H1B through a firm in US which got ‘Approved’ on November 2015. Now that my case is approved, and i can head to VISA interview, my employer who filed the case is not responding and gone missing. (He is no more interested to get my process done)

    Can i transfer my H1B Approved case to another company? (If Yes- how can that be done?)
    How do i get my i797 form which is send to attorney upon my case approval?

    Please suggest me what action should be taken in this case.

    • Manz,

      Another employer can file a cap-exempt petition for you. For this you need to find another employer and ask them to process H-1 for you. Process is pretty similar to your initial H-1 w/ the exception that is not counted in the cap.

      Documents required are similar to what were required for your initial H-1. Initial documents required include proof of having H-1 already approved. The best is to have copy of previous approval notice. If you can get it from old employer, its very helpful. If not, submit just the receipt number and a copy of online status showing it as approved. In this case, the new employer has to trust you that petition number belongs to you and was really approved.

      I’m here in US for around 2 years on H1B Visa. After the Visa extension denial(after April 20-2016) from USCIS, please suggest what are the options to work here without leaving USA.
      My i-94 expired on 30-Sep-2015. My Employer applied extension so I was able to stay for 240 days.

      1. Am I eligible and can I apply for Cap-Exempt now ?
      2. If yes, can my same Employer file ?
      3. If not, can I apply for new Job/new Employer.
      4. Do I need to leave USA now ? (How many days I can stay in in USA after H1-B visa denial this week ? Wanted to know so that I can decide to stay here or should I rush back to India.)
      5. If I resign from my current Employer,how long can I stay here and apply for the new Job/Employer.

        Your I-94 has already expired and you have no timely filed extension petition currently pending w/ USCIS. So in this case, you should leave US ASAP. There is no grace period.

        You can continue to file another cap-exempt petition through this employer, or through another employer (H-1 transfer); but it is important that you leave now.

        Talk to your employer/attorney about next course of action w.r.t. them.

    I filled for H1B for last year (for 2016 session).
    It got picked in lottery in April 2015, which then traversed through RFE > RFE response received > and finally Name Update stage (as of 19 Jan 2016).

    Should I still keep hope?
    Is anyone in the group still from 2016 session and with application in processing state.

    The is really bad.

      If the case was revoked b/c employer withdrew the petition, then it is still cap-exempt. If it was revoked b/c USCIS discovered an issue later, then it is not cap-exempt.

  37. I don’t know whether I should be happy that my case moved or sad that I got RFE. Mixed feeling are generating. What could be the reason, is it because it has been one year and they want conformation that I am still required or company screwed up something while filing. Any insight you have please share.

    • Be happy that you have got RFE and not NOID(Notice of intent for DENIAL). your employer must have filed correctly in the first instance.but uscis is now checking all the documents in a very granular level. if you could share the questions of rfe : madhu.karur@gmail.com then i can tell you the chances of approval or denial or second rfe.

        • if yours is regular process it is “case approved” else premium means “case approved and decision is mailed”. if your status is either of this,then you need to get the documents from your employer(uscis will send to attorney and attorney to employer and employer to employee.) once you have all docs go to stamping.

    All those who have eagerly awaiting to hear on H1 B status for 2015 please read below

    All of us are aware of the lengthening processing times for several product lines at USCIS centers. However, most pronounced is the extraordinary expansion of processing times for H-1B.
    Today assess how bad is the situation I checked the status of processing at California Centre ( https://egov.uscis.gov/cris/processTimesDisplayInit.do). open this page and select appropriate center and click button “Service Centre processing data” it should take you to the designated page

    It says they are currently processing applications dated July 22, 2015. I am not quite sure of this date (does it mean the application which has “RFE response received state” dated July 22, 2015 or is it something.

    Vermont Service Center is the fastest with processing file dated September 17, 2015.

    Please let me know what your take on this

    • As per the website updated information Vermont service center is processing dated sep 17-2015.i have seen the rfe petitions response received in dec-23-2015 and petitions received in sep,oct still no response. so there is no clue as how they are processing the petitions. it all depends on the case officer and the no of files he/she has in hand at that moment to processed on a day to day basis.bottom line is “complete chaos”

        • Regarding the processing dates Vermont Service Center is the fastest with processing file dated September 17, 2015.it means they are processing the applications that have the RFE response received date on or before sep-17-2015. technically it means they should have cleared all the RFEs on or before that date. Kumar correct me if i am wrong or missing anything.

      Till date there is no response. As the latest processing date for Vermont center is Sep 17 2015, is it possible that my application has been processed but the status is yet to b updated on the website of USCIS?

      • If the application is processed then it will be updated in the uscis site at any cost. as all the petitions are processed very meticulously by uscis. so the chance of not updating the case status is possible.if you still have concerns call the national customer center and enquire about your case status.

            I would suggest you request your consultant to raise service request in your case (please note it’s not premium processing).
            This is simply a request raised to uscis seeking explanation as to why the decision is not yet taken..

            My consultant did this on Mar 1st for and a revert is expected by Mar 16th

          • Generally they ask for the lawyer (attorney) or the employer to call them. but you can try and call them. 90% they will not answer to the employee that is the petitioner, in case if they say i need to talk to your attorney or employer then tell your employer or attorney to call uscis and seek the information. if the status is updated then it will reflect in uscis website 99.99%.

    • sorry to know about the denial after such a painful wait,your employer can challenge the decision by “motion to reopen” but you need to know on what basis the petition has been denied.

      Am I cap exempt for the next year by chance? not clear with your question.

      They are raising valid concerns. I have seen extension petitions hanging around for more than 6 months (including mine) who had to be finally upgraded to PP to get some traction.

      Also, this may very well delay FY-17 processing. As these petitions have been delayed for so long, USCIS may still process them prior to FY-17 regular filing petitions.

      USCIS will publish FY-17 PP timelines sometime in late March and early April. That would be another indication how slow they expect FY-17 processing to be.

          Historically they have done that. But this year there are additional factors like several H-1 amendment petitions and H-4 EAD applications. I think it may still happen but it may be unchartered territory.

            When there is a need to change approved petition, an amendment needs to be filed. Recently, a rule went into effect stating that an amendment is a must if the person’s work location happens. Lot of folks working in consulting business then needed to have these amendments filed whenever their client location change. Hence the flux.

    My RFE response has been given on Nov-18-2015 and since then i have been waiting for the status. there is no timeline for the approval this time.USCIS has heavy work flow of applications this time .(H4 applications). there are people whose status is still in case received (april-2015) and whose RFE response has been given in the month of aug,sep,oct 2015. if you want to check drop me an email at my id :madhu.karur@gmail.com . i will give you the case no’s. this i have obtained during my random check . just out of curiosity i checked some 300-400 case nos and their status. is it my case which is lagging behind or others like me are also in the same boat.unfortunately it is the latter one. can’t do anything. only you need to wait or change it to premium processing through your attorney. hope this info is helpful to you.
