What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.

What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?

  • H1B Regular Quota : 65,000 visas
  • H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)

Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. Will there be Lottery for H1B 2019 season ? Lottery Predictions ? Filing Numbers ?
Update : USCIS had lottery for FY 2019 quota and received 190,098 petitions.

When is H1B Visa 2019 Lottery Date ? 
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.

How to find H1B visa 2019 Sponsors ? 
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor. 

  • F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
  • International Professionals  : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. What is H1B 2019 Filing Fee ? 
H1B visa petition filing involves USCIS fee towards certain things and attorney fees, which varies by company size, and attorney involved for the case.  As of FY 2018 season, it can range anywhere from $1,600 USD to $7,400 USD + Attorney Fee.  In year 2016, for FY 2018, the H1B base filing fees, increased from  $325 to $460.   2. Hello Every one, I know i writing out of topic but really i do not know where should i ask this question. i need help( urgent)
    I am filling DS-160 form and in form there is one section which has asked have you ever been issued US visa and asked about last visa issue details.
    I came in USA in F1 visa then i changed it to F2 ( in USA) then again O3 ( in USA ). Now I am again applying for F1 visa and I am a phd student. My question is about which VISA detail should i fill in the DS-160 form

      • You need to specify every single entry and exit and the corresponding Visa status you utilized while entering/staying in the US… better to be crystal clear should they find DS160 details inconsistent with the details they have…

    • I dont think that it is RFE. This should be your initial status called “Case was Received”. Are you able to see your status here or validation error? https://egov.uscis.gov/casestatus/mycasestatus.do

      • Well I checked this out in my case status after creating id to know the latest update. I beleive its RFE since they mailed and process once they get require documents

        • I dont think so. Did you get RFE notification from your employer? This reflects same status to me as well for the past 1.5 month. For RFE, status will appear as below. So, yours should be in initial stage.
          Request for Additional Evidence Was Mailed
          On June 11, 2018, we mailed a request for additional evidence for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number EAC18XXXXXX. The request for evidence explains what we need from you. We will not take action on your case until we receive the evidence or the deadline to submit it expires. Please follow the instructions in the request for evidence. If you do not receive your request for additional evidence by July 11, 2018, please go to www.uscis.gov/e-request to request a copy.           • Thanks Ricky. I would hope that whatever you said is correct but not sure internally i checked with my employer. (HCL) they said its RFE but yes i did not got any officially confirmation or any RFE notice. Any idea by when it or how much time it took to move ahead the status from the current status. Thanks for your inputs. appreciated.

          • We have to wait.. Per last year status, some of my friends got approval in June, July and even in Sept too…

  6. What is considered as duplicate filing. If I have two petitions with different employers with different requirements, these should not be considered as duplicate filings right?

    • Violating duplicate petitions are the ones where same beneficiary has multiple petitions with RELATED employers… and it violates the USCIS rule to further extent if job duties and skillsets are the same.. it simply makes easier for USCIS to derive those petitions as duplicates… here they see that the employer is gaming the system by flooding applications for the same job…

      Multiple petitions with isolated employers are multiple jobs available in the market… so technically they are 2 separate applications…
      employer A is not aware that person X is also applying through Employer B…

    • Yes that’s correct, as long as you didn’t file multiple applications violating USCIS’s latest mandate on employee employer relationship(duplicate fillings with related employers) you should be good…

  8. To create account on my.uscis.gov/account they only ask for email address and mobile number(for security) which is NOT a proper key to tie to an application.. And there is no verification step when you add a case in your account that would tie your account to the case…

    So one can create account without any worries, I find the account details more precise since it gives you the actual date they sent the “Case Received” notification… on other hand on case status page most of us would see a mid April Date (that’s when USCIS finished lottery and listing of the selected petitions)

    Looks like my H-1B petition got approved. I can see the status change in https://myaccount.uscis.dhs.gov/ only. But, not in https://egov.uscis.gov.

    Anyone on same boat? I am yet to receive the physical copy of approval notice.

    I got selected in lottery and notice date in May 8th. My current status is CASE IS RECEIVED but i have got an update from the immigration team like the my case is in RFE status.
    Any idea how we can get a STEP BY STEP tracking of my H1B Case in any website?
    And also how much time it will take for my RFE to be cleared and what kind of update i will get after my case is approved. Working for MNC.

      • That site tells a generic status that CASE IS RECEIVED. I wanted to know a step by step process updates. ANy leads??

        • There’s no way to get a “step by step” tracking. We just don’t do that. We are exhausted with processing all the cases.

    • It depends upon what is the RFE about?
      If they have asked for evidences pertaining to Speciality Occupation, Employer Employee relationship then it may take a while to get this cleared. In case you are going to work at client site, then more evidences will be required and USCIS will scrutinize the application in details. So your employer may take close to 70-80 days to reply that RFE and again USCIS may take anything between 2-3 months to share their decision. You will not get any notification. You can only check status online.

    • There is no other website apart from USCIS case status page to track the case status. Irony is now a days it is also not updated promptly for few cases. So better to get update from Attorney too.

  12. Reason I got this doubt is when I am creating an account it asks to provide the email id with a note saying “provide your email id if you are the one who is filling all online forms”, in my case its my attorney who does that….

    I got my receipt on May 10 but when I enter my WAC in the USCIS site to check my case status it says cannot recognize the receipt number entered. Has it happened to anyone?

    • Yes. It happened to me as well..its normal scenario.. Nothing to worry.. Pls create account in myaccount.uscis.dhs.gov to view your current status..

  15. Today I inquired about my application status from the VISA team and they informed that they have started getting H1B drive status from attorney and they are yet to know about my status of application and will inform once they have it from attorneys.
    Does it mean that its in progress and still have a chance to get the receipt or have less chance to get through ?

    • It is too late now..but again if you are working for any MNC, you have to wait. They have a habit of not declaring the lottery results for some reason..Check with your Manager or his Manager to confirm

      • @Plan : Yes , I am working in Accenture (MNC) , also discussed with other colleagues who are also in same situation as me because employer has not disclosed anything as of now. Even the managers are not willing to share . Dont know behind the logic to not disclose lottery results 🙁 . Let see if at all we are lucky enough to be through … Thanks a lot for your reply.

        • typically the reason for withholding the information is to make sure you dont take any unnecessary action like quitting. Once you find out lottery is done – you may look for other jobs and in 3-4 months may be out. On the other hand by delaying this piece of information your manager makes sure you stay in your job for few more months in the hope of h1b. Then once you get the result (aug-sep), if you start looking and are ready to leave your job in 3-4 month – you are already around the start of next visa season. remember for most such MNc nominations are sent in Dec-Jan and process starts in feb. So you get the carrot again.

      Question:In the history of H1B lottery , has anyone got approved without getting receipt notice first ( not knowing whether his/her case was picked up in lottery or not , becoz his sponsor did not confirm for some reason, but later got his petition approved).It might sound stupid/illogical , but still someone active/more experienced in this forum for long might have information/ comments.   16. I cant access my SEVIS login. I was able to before I submitted an application for a sevis transfer to a new university? I tried to reset password (says that they cannot generate)

    What can i do now? does it mean anything?

          • This is just the start of wait. My intention is to just take you guys closer to reality and not to discourage.
            If you have applied from any of the big MNC or any by any chance if you are going to work for a client, then 99 % of you all will get RFE. Once you get RFE, don’t get disheartened as majority of these RFE’s will be cleared.
            But this RFE process can easily take 5-7 months to get approval.

          • For my case I am not into IT field nor working for MNC/client, I will be chemist in a small cosmetic company so Hopefully things will turn right shortly Without RFE! We’ll see 🙂

    It seems they are revoking prior approvals. Probably because of duplicated applications. This explains why they still haven’t returned the petitions that were not selected in the lottery. They are going through everything (selected and not selected) to find fraud and deny them.

    Gayathri, keep on checking on status. You should be getting something like this soon…

        No_Shame did not file duplicate applications..he/she is referring to a case where they revoked because of multiple applications…..looks like all those dumbasse’s who have filed more than one application are scrwed BIGLYYYYYYYYYYYY

    • Just fyi, someone used python to pull data from USCIS website and found a lot of cases like this one.

      This is not my case, I’m a legit full-time applicant with wage level 4 working in the Bay Area.

      Everyone who submitted multiple applications and already got approval, should keep on checking for a possible revocation.

      Worst of luck for all the fraud and consultancies garbage!

      • Revoked receipt numbers will be wasted. They have already selected more than 85K in the lottery with the assumption that many will be denied

  18. Is anyone still facing this? https://egov.uscis.gov/casestatus shows below error. But, https://myaccount.uscis.dhs.gov/ shows my case was received.. Its been more than a month I received my receipt.

    I have approved 1797b h1 petition valid from Dec 2016 to Sep 2019. Till now I didn’t go for stamping. I’m now planning to use the petition and go for stamping.

    So, will I get full 6 years from now or I already lost the h1 time from Dec 2016 till now?

  22. Is there any chance for any H1B or legal immigration legislation to go thru the US Congress & become law in Summer/Fall of 2018 so as to be operational by April 2019 ? Seriously some drastic changes are needed. Something should happen before midterm elections.

    • I think, its fine as long as you hold valid receipt#. It may be transferred to different center depends on the volume of petitions at one center. This is my thought.

      • Yesterday I have received the receipt details from my employer.
        When I checked the status online in USCIS it shows that
        Received date – 4/12/2018
        Notice date – 5/08/2018

    • It should be fine. sometimes, they move cases. You can ask your employer to share the case receipt copy, so that you can confirm, if it is yours.

    • I guess at this juncture your chances are pretty slim (less than 1%). The late receipts are due to postal delays and chances are for such postal delays pretty slim. If your cheque is still not en-cashed then its almost over. I know it feels pretty bad to be in your shoes. I hope you to be in that 1% , best luck 🙂
