What is the H1B Visa 2019 season start date ?
Update : USCIS will start accepting H1B Petitions starting from April 2nd, 2018 as per their official update on their website. In general, USCIS starts accepting applications for the next fiscal year exactly 6 months before the start of the next fiscal year. USCIS fiscal year for 2019 starts from 1st October 2018, which means they should accept applications for FY 2019 from April 1st, 2018. As April 1st is a Sunday, USCIS should accept applications for H1B 2019 season from April 2nd, 2019.
What is H1B visa 2019 Quota for Regular and Masters filings ?
As of the date of writing of article, the H1B quota is as below. This is also called the H1B Visa Cap. You can read more at What is H1B Cap ? Regular vs Masters quota ?
- H1B Regular Quota : 65,000 visas
- H1B Master’s Quota : 20,000 visas. ( only US Masters eligible)
Also, of the overall 85,000 visa cap, every year 6,800 visas are set aside for the citizens of Singapore and Chile as part of the Free Trade Agreement with them. There were few bills part of Comprehensive Immigration Reform that are not active in Senate that were proposed from Obama administration days to change the cap count to 110,000 and Masters to 25,000, including potential to make H1B cap extend up to 180,000. But nothing has moved and all are dormant. Nothing new has been proposed by the new Trump Administration regarding changing cap count. When is H1B Visa 2019 Lottery Date ?
Update : USCIS Conducted Lottery for FY 2019 on April 11, 2018.
There are two things, one is when the H1B petitions are accepted for the lottery and second is when the actual lottery is done. H1B visa petitions for next fiscal year would be accepted by USCIS from April 2nd, 2018 for 5 working days until April 6th, 2018 to be part of the lottery. Now, the actual lottery date depends on various factors depending the volume of petitions and USCIS load. It can be anywhere in second week of April. For FY 2018, the actual H1B Lottery was done on April 11th, 2017 . We can expect anywhere around the same date like April 11th or April 13th.
How to find H1B visa 2019 Sponsors ?
It can be very hard to find a good employer and convince them to sponsor H1B to work in US with major unknown like H1B Visa lottery. Anyways, you would be in one of the three scenarios, if you are seeking a H1B Sponsor.
- F1 Student in US : You can find an internship or co-op at an employer who can sponsor H1B visa and ask them to sponsor your H1B. You can continue to work on OPT once you graduate as well. You find the list of H1B Sponsoring companies using the tool
- International Professionals : If you are outside of US, it can be tricky with all the latest rules by Trump administration. Your best bet is to find an multi-national company ( MNC) and work through them to sponsor H1B visa. You may have hurdles inside the company with all the internal process, many waiting, etc. But, it is up to you to negotiate and ask them to take a chance. Many try the IT body shop route, where they ask them to file H1B. Rules have changed in the last few years and it is very risky move and can jeopardize your US hopes. One company has filled H1b for me last year that if for 2018 and application got picked in lottery in April 2017 but No updates on case till Now status is “Case was received” .. I lost hope so decided to apply again for H1b for 2019 by an other company(Not same company) . My application again picked in lottery for 2019.
Could you please confirm if there any problem in my case As I have two application with status “Case was received” applied by two different company for different year.

It will not be problem. Here are the options you have
(1) update the 2017 to PP and see what will be the results. (another possibilities it might be already approved or denied and your company not informed abt the result)
(2). Wait for the approval results or RFE . If no RFE and no response till September then again upgrade to PP when ever it opens.
(3) Since the 2017 petition was filed by different then better not to withdraw because the results of that one nit having any bearing on the other.

Really see some arrogant comments from AD people who don’t get selected in the lottery, first of all lottery is just a luck and in no way proves that masters are better than simple graduates working in India…..you may have better sight and experience working in US but that doesn’t mean you are more hard working than your peer in India…..it is just a greed and that is why everyone is running towards US…..imagine a situation if US don’t put the cap restriction, the market would get flooded with indian IT guys and you would not even earn what a simple IT guy earns in India…..and yes not all IITians are god , NASA and BARC are sucessful because of normal graduates and not IItians……IITians simple refuse to work wit indian PSUs and chose to work with already established US companies…..late president APJ abdul kalam was the finest example …..also I observed that it’s very difficult to get a job with facebook, amazon and google in US than in India, I know as few idiots from my college got the job in these companies ,don’t know what they are doing in these companies but the linkedin profile says so……

Everybody is correct in their own terms. I understand that people often do get frustrated from the time taken in the process. But lets not use this forum to take out our frustrations on each other, instead be more considerate while putting in comments. After all everybody who applies for H1B has to go through this process which is inevitable.

My kids and I are currently on L2 to H4 COS I-539, which is in pending state. I got selected in the H1b lottery this year. What happens to I-539 if my H1b is approved first? My kids too are on I-539, what happens to their status? How/when will my kids get into H4 status?

If your H1B is approved first, I would recommend you to withdraw the L2 to H4 COS petition. Your kids H4 is tied to your spouse’s H1B and they have separate receipt number/application. It would keep processing and would get approved. Good luck!

The whole h1b system has been misused by the indian IT and body shopping companies. I find that the panic mood by those currently working in India and waiting for their h1b is somewhat not normal. They must put themselves in the shoes of the graduates of US universities and working currently on OPT. These students came to US for studying masters on student loan and many of them are middle class. If they dont get h1b after opt period, they have to leave US and go back to India, find job and repay their loan.
If they are getting nervous , it sounds normal and justifiable. If you are already working in IT companies in india and your company has applied for h1b and you did not get selected in lottery or did not get approved, you are not a loser. Your life and work continue as usual . It is like buying a lottery ticket and nobody ponders or gets upset when your ticket gets the prize money. So be reasonable to yourself, empathatic to others who are in a much worse situation ! If your destiny is to go to US , one day you will go ! Just imagine if you are an average guy, and somehow got a job in TCS( through your freind or false resume) and you earn a decent salary. Now compare a guy from IIT , got amission for MS or MBA in one of top ten universities . After his masters ( spent minimum 120 k) he did not get selected in lottery, he must leave US( for MBA , opt period is one year only).
Look at his situation! What answer he would have if his relatives and friends compare a guy like you ( who eventually got lottery and work in US) and questions his status?
Life brings many not- justifiable shocks , but we as humanbeings must take it normally and be considerate and empathatic towards the unlucky!
People applying from India. Its a luxury for you people to come to the united states, but for people already in america who came to study, going through all the hardships, having loans to repay-getting H1b is a necessity. People who studied here in the states have much exposure, knowledge, how the system works in here, work hard to get full time jobs which is the most critical part (I am not talking about people joining Indian consultancies-everyone knows how it works). Moreover, students who don’t get h1b may have to leave the country after going through all these, go back to their home country and start from square one.
Moreover, most of the people coming directly on L1 (These people go any far to keep up their jobs, do WHATEVER to satisfy the employer) and H1b have communication issues. H4EAD people fighting for it as if they earned it by hardwork.

What right do you have to stereotype people. What makes you think people in India have weak communication skills and do not know their way around? Just because you studied here does not give you the right to have an H1B. Everyone who is eligible takes part in the lottery and whosoever gets it deserves it. There are flaws in the process which people are exploiting . One more thing, Knowledge has nothing to do with the fact that someone studied in India or US. If that were the case, India would not have been the hub of Outsourcing. So, rather than being frustrated and writing things, get your facts straight before you write something. I am in US on an L1B visa and do you have any idea how difficult it is now to get an L1B visa. You need to be on your A game to prove to the interviewer that you have skillset and communication to be granted that Visa. If you are so good after studying in US, you would definitely get a handsome Job anywhere and one last thing, not getting H1B is not the end of the world. Try for countries who have skills based immigration (canada, NZ, Australia.)
Stop Cribbing and channel your energy in yourself. Don’t blame the world if you are not getting something.

Extra 20000 for masters – when there are over 300 k students of all nationalaties – seeking jobs or working on OPT and waiting for their turn- no advantage ! This year USCIS has given break up of masters who had filed h1b- it is about 96 k while in regular pool it is about 94 k
Total of 190 k. 85 k out of 190 k would get the lottery!
Moreover everyone in US agrees that the selection of best talents by lottery is foolish ! It defeats the whole purpose of seeking world’s best talents. Imagine you get admitted to the best college by lottery or get into top five IT companies by lottery – how you would take it?

I have not used any abusing words and i have not said that aspiring for h1b while working in india is wrong . Getting panic while awaiting the approvals is not necessary at all because you are not loser at all. And that situation is not same as those who studied and completing OPT. About comments on a guy from IIt and MBA from an Ivy League business school, the news came in print media and was also in other forums on h1b.

It is a nice write up. I do agree there have been a lot in stake and understand the frustration, but who asked you to go in the first place. Did anybody force you ? The dream of dollars forced you there, please understand most of the people do not have the means to sponsor their study so they live and struggle and somehow hope for a better future. Everybody is not you who can sponsor 120K be it in form of loan or any other method.
People know exactly what the risks are so demeaning hard working people who cannot afford what you have is not something you should be vent you anger on. Just because somebody have been bankrolled to US for study does not make them entitled to people elsewhere who slog everyday of their lives for a better life.
People educated in US already get a preference by getting 2 chances in the lottery… so keep your peace in you rear pockets !
USCIS just has to introduce a rule that no OPT or CPT student can work at 3rd party worksites (they should ideally receive training during OPT and CPT at their employer’s office full time) and a lot of the abuse will fall away. All these fraud universities will close and AD quota will be more available for genuine candidates.
Study in US and get job in India.. Apply your US skills in India and make India proud… ha ha…

Probably the USCIS site has not been updated. Please check with your Attorney/employer for latest info. Sometimes this happens, you would get approval notice first with no update online. Good luck! Do keep us updated!

Who said that ? USICS or GM Team? The only option I think is that they have receipts and delaying the results, which is less likely to happen in CTS.

60 days grace period after H1b denial
If I transfer my h1b from company A to B and join on the receipt notice. Then the petition got rejected after 3 months from leaving company A. Can I get the 60 days grace period to find new job??
I still have admit until date of 2019 on my I94.
I guess you only get 60 days grace period one time within 3 year period. There is detail explanation about this in USCIS website. My understanding is it is possible to use the 60 day grace period if your visa/i-94 has a validity. If the rejection comes (i hope not) it is better to schedule a meeting with an immigration lawyer to clarify the various options, because it is worth to spend $200 instead of run in to status violation.

People do get RFEs on this… But provided valid response to the RFE it should be good… And attorneys should know better to handle this… That’s what they charge money for..

I’m a first time poster. My employer has received a courtesy copy of my I797c, but my attorney did not receive the original copy. The notice date is 4/21/2018. Today was the first time I checked my case status on USCIS website and it says “We mailed your document for your Form I-129, Petition for a Nonimmigrant Worker, Receipt Number **************. If you do not receive your document by June 18, 2018, please go to www.uscis.gov/e-request to request that we resend the document to you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.”
What does this mean?
This means you are selected in lottery…
You will have to wait for further updates….
I-797c is a standard form used by USCIS to communicate with employer/attorney…. Google USCIS I-797c you will find more details about it…

On may 29th, one slot of receipt numbers were sent by USCIS. Unfortunately i am not selected in H1b lottery in this slot. My HCL immigration team is telling there will be 2 more slots released by 1st and 2nd week of June. Keep hopes alive guys. OM SAI RAM.
Hoping for some positive news .. But im fed up alrdy.. lost hopes.. lets see if any miracles happen.

your case indicates that many others can still be hopeful of getting receipt number. I am concerned about check encashment, becoz mine was not encashed until 15 may as per my employers attorney. After may 15, he has not updated the info. So plz find out your check encashment date and let us know. I am only depending on HIS blessings!

My kids and I are currently on L2 to H4 COS I-539, which is in pending state. I got selected in the H1b lottery this year. What happens to I-539 if my H1b is approved first? My kids too are on I-539, what happens to their status? How/when will my kids get into H4 status?

See that a couple people here have already been approved and also other people on my floor with Masters degrees. I only have my undergraduate degree and this is my first time applying so would like to know how much longer do I need to wait. What’s the average waiting time? Other than the 2-6 months that says on the webpage.

AD first time. I checked with my employer and they said there is no receipt number mentioned on the back side. DSO is not ready to help either.
As far i know your employer has to contact uscis for receipt number once uscis releases the statement all the unselected petitions are returned.

Ask your DSO for duplicate copy of i-20 like you lost it or traveling etc. The number will be there in the second page.
Hey guys. I finally received my Receipt notice today. AD Final attempt STEM OPT ending on Dec 30. I had given up all hopes and even signed just a 6 month lease starting July. I was all set to leave back to my underdeveloped home place. But finally I got the big news from my attorney today. Good luck to all in the waiting zone.

Super. I too have this issue in USCIS Case status online. After registering here myaccount.uscis.dhs.gov, I am able to see my receipt status as Case was received with receipt dated 5/3.. I believe, we will hear about approval in June.

Non-AD for a major US employer
On 5/29 I received a “I-797C Notice of Action” from my employer’s immigration department.
Received Date: 4-12-2018
Notice Date: 5-8-2018
What I am concerned about is the wording on the form that says
“This notice only shows that your case was filed on the “Received Date” listed above. It does NOT grant you any immigration status or immigration benefit and it is not evidence that your case is still pending”

Of course it is. You are not at the end of the way, your petition after being selected in the lottery needs to be approved. There can be denial, that is why they specified that having a receipt number does not guaranty you immigration.

I797c is used by USCIS to communicate receipt of payment, rejection of application, transfer of file, rescheduling of appointment

Sam, Have both companies applied for you? I kno for sure that Deloitte doesn’t wait till the end. They inform proactively. Do you kno any colleagues at your firm who had their h1 applied. I personally don’t know anyone at my current firm.
