H1B Visa 2014 Quota Cap Reached – USCIS Official News Update

Well, folks, we have a breaking news update from USCIS saying that H1B Visa Cap for Fiscal year 2014 has been reached.  The human psychology has kicked in and many employers rushed to get their H1B petitions ahead of their schedule due to the press release by USCIS indicating that it expects more petitions. Here is a summary of the news release by USCIS on the cap completion for FY 2014.

News Summary by USCIS  on H1B 2014 Cap Completion :

  • USCIS has received enough number of H1B petitions for fiscal year 2014 under regular quota, which is 65,000 petitions.
  • USCIS also have received enough number of petitions for masters quota cap, which is 20,000.
  • USCIS will not accept any petitions for H1B Visa 2014 after today, which is April 5th, 2013.
  • USCIS will conduct lottery or Random computer selection to pick the cap subject petitions filed for FY 2014. The lottery system will be exactly like we described earlier in our blog. Read  H1B Visa 2014 Lottery Process – Step by Step.
    • USCIS will conduct lottery for Advanced quota petitions and pick 20,000 petitions from that pool
    • For all the masters quota petitions that are not selected in lottery will be placed into general quota pool
    • A lottery will be conducted on the combined pool of petitions to pick the 65,000 petitions that are eligible for the FY 2014.
  • USCIS is not providing an exact number to us today as they are still processing petitions received for FY 2014 that were received today.
  • USCIS will give us more detail update next week, stay tuned.

    Happy news it seems!

    New Delhi, April 9: US Senators are working overtime to finalise the immigration bill and holding negotiations to increase cap on H1B visas to 100,000. There is a possibility that the visa cap may be raised to 1.5 lakh. The Senators are framing laws to boost visas for high-tech workers and also to punish companies that train workers in US and them overseas. One of the leading figure in this talks is Senator Dick Durbin (Democrat). He is keen to punish outsourcing firms and wants higher wages for workers brought in on the H-1B visas. According to media reports, there is overwhelming demand from companies like Microsoft, Apple and Google for the H-1B visas, which are now capped at 65,000 annually, plus 20,000 more that are reserved for foreign workers who have earned an advanced degree from a US university. Faced with that kind of a demand, the senators have contemplated lifting the cap to around 100,000, with a possibility of as high as 150,000. If the visa cap goes up, it is a clear win for the tech industry, which has been aggressively lobbying in recent years. Last week, the Homeland Security Department announced that after less than a week of accepting applications, it already had received more requests than visas available for the current year. The immigration bill will also allow permanent US residency to unlimited numbers of people with advanced degrees in Stem (science, technology, engineering and mathematics) from universities in US. The Senate talks began today in Washington after a two-week spring break. There seems to be a broad agreement on the immigration bill, so dear to President Barack Obama, but the sticky point that is holding an agreement is the question of treatment of high tech visas. The bill is likely to be passed later this week or early next week.

  4. Why do you guys think that USCIS didn’t release the advanced degree cap number? I keep trying to figure this out…. They did in 2008, why wouldn’t they this time around. If they are already sending out notifications for PP, they must know the exact number.. Could it be that they are putting all ADE through? Or that there were just a few petitions more than 20,000? Or that there were a lot more than 20,000?

    • I think there are 24k ~ and yes there was a lottery for MS cap.
      Reason they did not post number this year is because there was no gradual buildup of cap depletion. in 2009-2011 everytime they updated they showed numbers up until the cap was filled out, and I remember they just said that they had received enough petitions for that year.

  6. I think the H1b should be limited by country, because it seems to be unfair:

    2/3 of all petitions are from India, even China has less. And if just to limit the amount of petitions depending on the country, it solves all the problems.

  7. To confirm once agn no one has received any receipt number yet including PP guys. Do anybody got a chance to know frm their employers or lawyers that their application is selected in lottery? for ex like check is accepted and money is deducted from account ?

  11. I’d always been unlucky in my life in all aspects. Most of my friends are in US and some even returned back to india completed his/her tenure,.But atleast I was happy that I got initiated this time , but now I feel the chances are very slim.
    Now every thing has already been decided(lottery is completed), its just we need to hear from our employer.
    If we are thru lottery this time, I next year it is going to be more difficult.

    • More or less the case is same with me… I don’t know its not in my hand.. but could not sleep peacefully thru nights since 1st April…
      All the best…. me to consider myself as one those unlucky fellow who thinks all negative energy is coming to them however positively I try to deal with though… but finally what I think is Whatever is happening is for good for me!! Mind tricks.. what else..

      2011 – h1 application reached one day later than USCICS declared the final date
      2012 – L1 was applied so could not apply for H1.. policies… L1 rejected…
      2013 – lottery..

  12. Noway of getting EAC number today itself or en-cashing the check..

    Guys don’t listen false news.. I am the employer, we applied for around 30 premium and 10 master quota premium( I am just saying about premium quota h1bs)…none of the check encashed so far.. i don’t think, none of our h1bs get selected.. Our applications gone to both California and Vermont.. I been in this business for more than 10 years.. For premiums, we used to get email prior to check encashed, once they assign receipt numbers ( couple of times only, we missed receipt emails so far).. the day they assign the receipt number, they deposit in to the bank.. Any banking check transaction used to update after 3AM EST..yesterday was Sunday, I am 100% sure that There won’t be any check en-cash today.. Probably, you guys will know from tomorrow onwards.

    Finally – It’s upto you whether you believe false news or not..

    Innovation Act 2013 which will increase h1b cap to around 115k and Market-based H-1B visa limits which means if market demand h1b is high there will be addition 30k added to meet the market demand. There is a button to support. Currently 75% and lots of Congress member in the list.

    Any one who is in general quota and got his file number or got information from his lawyer or got the receipt amount deducted from your employer’s bank account please post we can call our prospective employers. Any help will be appreciated. Request you to please stay away from putting forward false information and make me and people like me more tensed :). Hope you will play fair.

  16. I am projecting 24k Masters cap, simply by using the fact that when there were total 163k applications in 2008, they had 31200 in MS cap. Anyone agrees? What do you think?

    That means 4/5 MS petitions should be initially chosen, and then on to 1/1.62 for remaining.

    • Guys do not worry who applied in Master Quota…
      1) May be in 2008 the people who are not selected in lottery USCIS introduce the OPT extension of 17 month for student who are not selected in Lottery.
      so may be the reason for not showing the number of petition in master quota is because they might have selected all MS application and not have done lottery for Master’s people… and only done for the regular people…..
      In 2008 they helped ms people by intorducing the opt extension rule now they will choose without showing the number….
      I may be wrong but lets hope for best….. all the best guys….

      • Sorry but I think you misunderstand the lottery system. They did two separate lotteries, and the leftover from the first (20K) are added onto the second. OPT extension was introduced to help MS students who did not get lottery selected, but if you think about it, it only makes things worse for the next cycle…so it was not really a solution.

          • Nirav: USCIS has no reason to misrepresent themselves or the truth. That is what they say they did, and it is for all we know. No need to be cynical here, try to be hopeful 🙂 I understand the stress we all are going through but remember 4/5 of MS cap applications (according to my humble predictions) will make it through. Plus there is alos your second chance with the 1/1.62 percentage success. Keep your fingers crossed!

          • None…the people who couldn’t make it through lottery were automatically placed into Opt-STEM extension

          • Hope for the best… You guys work real hard to come to this stage…and definitely all MASTER’s degree holders need an edge compared to H4 or people filing from India…it doesn’t make a difference for them..but for you guys its u r bread and butter….

            Not correct. One can apply for OPT STEM extension only under certain scenarios. So there were probably applicants who didn’t qualify for OPT STEM extension and didn’t make through the random selection.

          • OPT extension is an option to some, do make plans to make use of it if lottery does not work for you. Good luck.

          • OK I misunderstood. But those guys got lucky since 2009 recession slowed H1B quota depletion. Next year you will have a ton of backlog from this year, in addition to another 165k ++ (expected with a stronger economy) so unless new immigration laws are passed it will not be too pleasant in 2015 lottery.

      • if u didn get thru lottery u have to apply for stem opt.u do not get it automatically. N if ur in ur final yr of stem like many here. Then this yr lottery is ginal chance. Total possible opt is 27 months. Do not frget that ther are lot of us stem opt ppl n its our last chance

        • I understand. For some this will be the last train to catch. Some work for non E-Verify businesses and STEM not an option altogether. I personally will not be able to make use of STEM extension so I need this to work. Praying and hoping now.

  18. If possible, can i know how many weeks it takes to get receipt number for regular processing applications? I have to contact my lawyer tomorrow morning. Do all of you guys got response from your lawyers that your application is picked in lottery?

    • if you are on regular petition then it might take anywhere from 1-4 weeks. best thing is not to panic and just be patient. nothing you can do anyway.

  19. They should make this lottery algorithm open source. I hope they are using some sort of reservoir sampling.cant trust, problems include implementation errors, seeding, and a modulo bias caused due to incorrect division of range of the random generator. MAKE it open source or am i just over reacting in this state of anxiety.

    • Dude, Even if the algorithm has “problems”, correcting the problem does not solve our “problem”. The total number will never go above 65k+. So the probability of getting a H1 will never increase (And it will no way help you/us). As long as the program runs, and selects 65k applications, and is not biased, it should be fine. The only thing your correction will do is change the beneficiary of random selection. Hope u get my point.
      To answer your question, Yes, u r overreacting.

  20. The quickest way to figure out if you were selected in lottery is to keep an track of the check you/your company send to USCIS.

    If the check gets deducted that means your application has been selected.

    This is how my friends figured out in 2008.

      • Back when I applied for OPT it took longer for my check to be cashed than to receive an email and then a letter saying that my application was received. Guess it might not be different here.

  22. Please stop spreading rumors.It is too early to receive receipt numbers.

    It will take atleast 3-7 business days to receive the receipt numbers by mail.

    In case your attorney filed G1145 application.It will take around 1-3 business days to receive the email notification from the service center.

    At this point it is too early to receive the receipt numbers.Please do not panic.

  23. I got the EAC from my lawyer. If you are selected, your lawyer can tell you the number now. Contact your lawyer to find out the lottery result and get the EAC.

  27. It is making me laugh, whatever we are predicting everything is wrong. First people said lottery will last longer then they said there will be max 100k cap.
    Now, can anyone please guess when will we start getting the receipts?

      If your employer applied for H-1, then they should know the result of random selection process within next few weeks. Once the petition has made through the cap, USCIS will adjudicate the petition, which can take another 2-6 months (or less in case of PP).

    • It’s not 80% chance for the normal applications, it’s 62.5% which is very low.

          We don’t know what the situation is for the MS because they didn’t specify how many applied for MS. We only know that more than the 20000 applied. That means we can safely say that the normal lottery will be made up of 124000 – 20000 (the MS that were accepted). That leaves 104000 (all of the rest of the MS applications + the normal applications). So we have 65000 / 104000 which is 62.5%.

          • Its not 65000, 5800 is allocated for Singapore and Chile. if there is any unused visa numbers from last year Singapore & Chile CAP, that shall be added to this yr.

            So the regular numbers may not be 65000. it might be some where 60000 to 64000

          All MSs petitions that were not selected will be included again in 65,000 undergrad lottery. So yes you have 2 change to get selected in the lottary if you are applying under Master degree. The chance is right, it is 62.5%

          • you dont get two chance in masters. you get high probability because of only 24K masters applications. Everybody in regular gets 65K chances to win: this is not lottery by elimination but by selection. So unless you are selected and 65K is not over you can still be selected in the next step.

        • @Concerned Citizen is right. No matter who was selected in master’s, the chance for regular is just %62.5… very low opportunity…

        • I think he did. More over i think you can calculate the probability for a Normal candidate more accurately than that of a MS in US student. Assuming 65k applications available (ideal case ) .In case it is N number of application received for advanced quota it will be (20000/N)+65000/(124000-N) .

          • with 17% error in petition, total petitions = 124K*(1-.17)=103K.
            103K-20K=83K for 64K regular.
            Probablity is 65/83=78%
            Hope more errors are there this time because people filed in hurry.
            Then chance of getting selected is 80% 🙂

  29. Lottery was not suppose to happen. Did you see total number of applications received in 5 days, its only 124K. Last time when it had happened it was way over 160K+. It was just due to USCIS, if they had not predicted it had never happened.

    1. Employer / Lawyer will get notification by email or by post-mail?
    2. Since they have not opened the application prior to random selection, there is a chance that a selected application might get reject upon opening. Does USCIS keep all not selected application with them until they find 65k + 20k valid applications?
    3. Anybody’s Employer / lawyer have received receipt number?

    The experience people please reply…. I know responding to these questions will not change the scenario but it will really give relief from anxiety…

    • Your lawyer will get an email with the receipt number if the application is selected in the lottery.

      I think USCIS will hold on to the applications until they reach the 85000 limit and then send the non selected applications as you have suggested rejections will be there.

        We all didn’t hear anything from HR yet today. My another friend in different state also didn’t hear anything yet from his hr beside that got info that his is in lottery.

      There are no lottery numbers assigned. If you make through the lottery, your employer should receive the receipt number in next few weeks.

    • You are right! People should get a lottery number and should be able to get the result online. At least a “on-hold” status will make us happy. USCIS is backdated. It could have asked petitioner to write certain information on bar code on the envelop itself and that could have container passport number or email id and used that one to scan applications fast and setup website to view results.

    • does this mean that if someone has duplicate filing then fees will not be returned for duplicate filings not selected in lottery?

    • In english terms it says that if you did a duplicate filing then you will be rejected but will not receive your money back.

USCIS has also received more than 20,000 H-1B petitions filed on behalf of persons exempt from the cap under the advanced degree exemption.

On April 7, 2013, USCIS used a computer-generated random selection process (commonly known as a “lottery”) to select a sufficient number of petitions needed to meet the caps of 65,000 for the general category and 20,000 under the advanced degree exemption limit. For cap-subject petitions not randomly selected, USCIS will reject and return the petition with filing fees, unless it is found to be a duplicate filing.

    The agency conducted the selection process for advanced degree exemption petitions first. All advanced degree petitions not selected were part of the random selection process for the 65,000 limit.

    As announced on March 15, 2013, USCIS has temporarily adjusted its premium processing practice. To facilitate the prioritized data entry of cap-subject petitions requesting premium processing, USCIS will begin premium processing for H-1B cap cases on April 15, 2013. For more information on premium processing for FY 2014 cap-subject petitions, please see the related USCIS Alert.

    USCIS will continue to accept and process petitions that are otherwise exempt from the cap. Petitions filed on behalf of current H-1B workers who have been counted previously against the cap will not be counted towards the congressionally-mandated FY 2014 H-1B cap. Accordingly, USCIS will continue to accept and process petitions filed to:

    extend the amount of time a current H-1B worker may remain in the U.S.;
    change the terms of employment for current H-1B workers;
    allow current H-1B workers to change employers; and
    allow current H-1B workers to work concurrently in a second H-1B position.
    U.S. businesses use the H-1B programto employ foreign workers in specialty occupations that require theoretical or technical expertise in specialized fields including, but not limited to: scientists, engineers, or computer programmers.
