Complete Guide to ECR vs Non-ECR (ECNR) Category in Indian Passport

Many of you applying for an Indian Passport will come across this question: “Are you eligible for Non-ECR Category?”. It can be confusing between ECR and non-ECR as many of us are not sure what they mean. Also, you may be asked for emigration clearance for employment in certain foreign countries for ECR passport holders.

In this article, we will look at all these aspects, including how it looks on the passport, how to get that removed if you are eligible and common FAQs.

Background: Indian Passport, Categories ECR & Non-ECR

As you all know, a passport is a travel document that a country’s government issues to its citizens that can be used when they want to travel abroad. It certifies the identity and nationality of a passport holder. You need a passport to visit any foreign country for tourism or to work overseas. It is no different for India as well. India also issues Passports to its citizens as a key international travel and identity document.

In India, there are two categories of passports:

  1. ECR(Emigration Check Required)
  2. Non-ECR (formerly called ECNR- Emigration Check Not Required).

Depending on the individual’s status like their education, age, marital status, etc. their passports would be categorized as ECR or Non-ECR category. This is indicated by a notation/text/stamp in the passport. Let’s look at each of them in detail in the next sections.

What does ECR in an Indian Passport mean? Who gets it?

ECR stands for ‘Emigration Check Required‘.   In general, if you have not passed 10th grade/class (Matriculation or higher education pass certificate)  then your passport will fall under ECR Category. An emigration check is nothing but a verification process that an individual has to go through if they plan to travel to certain countries for work as unskilled workers.

The main reason for indicating ECR in passports is to ensure that unskilled workers or anyone with less education are not exploited when they visit certain countries for work. Individuals with ECR notation on their passports need to get clearance from the Protector of Emigrants(POE) to ensure they are safe and their employment is in-line with proper rules and not they are not exploited when they travel to certain countries for work.

What is Non-ECR or ECNR in an Indian Passport?

Non-ECR, formerly known as ECNR, means Emigration Check is Not Required(ECNR). In general, if you have passed the 10th class/grade (Matriculation or Higher Educational Pass Certificate) or have a higher degree then your passport falls under Non-ECR Category.  

Also, if you satisfy any of the below criteria you qualify to get a Non-ECR category Passport:

  • Official and Diplomatic passport holders
  • Gazetted Government officers, their spouses, and children
  • Individuals who are above the age of 50 years
  • Children up to the age of 18 years.
  • Income taxpayers ( including agricultural income taxpayers), their spouses, and children under 18 years.
  • Professional degree holders such as Engineers, Doctors, CA,  etc., their spouses, and children.
  • Anyone who holds visas for permanent immigration/resident visas for the US, UK, and Australia
  • Individuals who have spent three years overseas and their spouses
  • Individuals who hold a diploma in nursing under the Indian Nursing Council Act 1947
  • People holding diplomas in Polytechnic from any recognized institute.
  • People who work in Sea with Continuous Discharge Certificate or Sea Cadets and Deck cadets.

Documents Required for Non-ECR Category Passport

Depending on your status and the criteria you would use, which are listed above, you will need to bring the relevant documents to support the Non-ECR Category. Some of the standard documents are listed below:

  • 10th Class Pass Certificate (Matriculation Pass Certificate)
  • If you have Bachelor’s or Masters’s degree, their corresponding degree completion certificate
  • If you are above 50 years, your proof of birth or supporting documents like Aadhar
  • If you are under 18 years, proof of your date of birth
  • If you have a polytechnic diploma or certificate related to the same.
  • If you are a nurse, a nursing certificate.

Difference between ECR vs Non-ECR (ECNR) Indian Passport

The main difference between having ECR vs Non-ECR on your Indian passport is your ability to travel and work in certain countries. If your passport has an ECR notation or stamp, then you need to get “Emigration Clearance” from the office of the Protector of Emigrants (POE), if you plan to work in a certain list of countries.

“Emigrate” means, migrating to another country for work. The whole idea of Emigration Clearance for ECR passport holders is to safeguard unskilled workers from being exploited when they plan to work outside of India in unskilled jobs. The Emigration Clearance process makes sure the unskilled workers go through properly certified agents, credentials are evaluated and other checks are done to protect them from fraud. Check the Emigration and You Document from mea.gov.in.

What to select for ECR Question in the Indian Passport Application Form?

You will come across this question: “Are you eligible for Non-ECR Category?” or “Is the applicant eligible for Non-ECR Category” when you are filling out an Indian passport application form.

As described above, if you have not passed 10th class/grade ( Matriculation or high school pass certificate)  and do not satisfy any of the above listed Non-ECR category criteria, then you would need to select NO.
      Alternatively, if you have passed 10th grade/class, or have qualifications above that, or if you fall under any of the above listed Non-ECR category criteria, then you would select YES.

How would I know, if my passport is ECR or Non-ECR?

If your passport falls under the ECR category, your passport will have it listed clearly with either a stamp/ notation or full text “EMIGRATION CHECK REQUIRED”.  For passports before Jan 2007, it used to be a stamp, for the latest passports you will find the text written/endorsement on the address page of the passport.

Usually for passports issued after Jan 2007, if you do not find any endorsement / printed text/notation in the passport last page that says “EMIGRATION CHECK REQUIRED”, then your passport falls under the Non-ECR category. The practice of putting a Non-ECR (previously ECNR) stamp has been discontinued and you only see printed text notation in the passport. Check the screenshot below for the sample notation.

Children or Minors Passport Classification – ECR or Non-ECR?

   All children below the age of 18 years are eligible for Non-ECR till they attain the age of 18 years. Once they reach 18 years of age, they would need to provide proof such as their 10th class or higher education certificate during Passport Renewal to have their passport classified as Non-ECR. If they fail to provide that proof, then the passport would get a notation or printed text as in the above screenshot with “EMIGRATION CHECK REQUIRED”

ECR Passport – Emigration Clearance to work in Certain Countries?

As per the Emigration Act 1983, Indian Passport holders under the ECR category, who wish to travel to certain countries for employment will have to obtain Emigration Clearance from the office of the Protector of Emigrants (POE), Ministry of Overseas Indian Affairs.  As per the Indian Bureau of Immigration (BOI), below is the list of those countries :

  • United Arab Emirates (UAE)
  • The Kingdom of Saudi Arabia (KSA)
  • Qatar
  • Jordan
  • Yemen
  • Sudan
  • Afghanistan
  • Oman
  • Kuwait
  • Bahrain
  • Malaysia
  • Libya
  • Indonesia
  • Syria
  • Lebanon
  • Thailand

As of now, there is a ban on emigration to Iraq.

How to Change from ECR to Non-ECR Indian Passport

 The process to change from an ECR passport to a Non-ECR passport is very straightforward. Below is the general process :

  1. Apply for passport re-issue to change from ECR to Non-ECR
  2. When you are applying for the re-issue, you should select “YES” for the question “Are you eligible for Non-ECR Category?
  3. When you go to the Passport office or upload proofs during the process, you need to submit all the relevant proofs for your eligibility like your 10th or matriculation pass certificate or degree certificate, income tax statements, etc. depending on your eligibility criteria.

Common FAQs

For ECR Passport, do I need Emigration Clearance for Tourism and Pleasure?

You do not need Emigration Clearance for any of the above-listed countries as an ECR Passport holder if you are traveling for purposes other than employment like tourism, pleasure, or visiting friends/relatives. For the purpose of tourism or visiting friends, all you have to do is provide a valid passport, valid visa and return ticket at the immigration counters at international airports in India. These guidelines came into effect from  Oct 2007.

I have selected ECR by mistake in the Application online, my options?

You can indicate the mistake done by you at the Passport Seva Kendra and get it corrected by showing proper proofs that you need for a non-ECR category.

What is Emigrate or Emigration?

In general, it means leaving your home country with a plan to work abroad or any place outside of India.

What is Emigration Clearance for Indian ECR Passport?

It is a process that is administered by the Indian Govt body “Protector of Emigrants (PoE)” to make sure all unskilled workers leaving India are working through certified agents, have proper credentials, etc. to make sure they are not exploited in foreign countries.

Can you change ECR to Non-ECR in Indian Passport?

Yes, you can.  If your passport was ECR category in the past and now you qualify to be Non-ECR category due to changes in your situation either age, education or marital status, etc. then, you can follow the below steps to have it corrected from ECR to Non-ECR

      Well, they want the highest degree. In your case, it should be sufficient. But, it is totally up to the team as they usually ask for 10th.

  2. Hey, they don’t seem to accept graduation certificates from international universities. I did my ssc over a decade ago and the certificate is lost. Getting a new one is a long process. Is there any other way to get the ECR removed? I have ITR but they didn’t seem to accept those either. Any advice?

    Does ECR negatively impact your application to ECR countries? How so? How likely are they to deny the application? Is there a problem of discrimination, bribery, etc? Do ECR people find it harder to get a visa compared to ECNR?

      You may not need clearance, if it is for visiting. You only need it for working. Also, ivory coast is not in the ECR list of countries. You can double check with Indian Embassy to be sure.

  9. Hi Kumar,
    I am 41 years old and I am about to renew my passport for 2nd time. I’m a Master’s degree holder but currently all my educational certificates (original) are with my sister who lives in our hometown. I live and work in a different city. Owing to lockdown and related travel restrictions, I’m unable to be in physical possession of the education qualification originals.
    I have lived overseas for about 4 years out of last 6.5 years. One of the criteria for Non-ECR listed is this:
    “Individuals who have spent three years overseas and their spouses”. I’m in a position to provide evidence for the same through exit and entry stamps in my passport and provide a detailed written statement as mentioned in passport india portal.
    My question is: would this be sufficient enough to get me Non-ECR status for my passport renewal?
    Please provide guidance on my question.

Being a new passport is a great thing in itself, in such a situation people do not think about the type and status of the passport document, but now it is not so slow, the passport is becoming a common identity document and someone he also wants to have a passport. Therefore, it is very important that we all know ECR & NON-ECR Category Means and the fee you have to pay to register a new passport.

        Check with the country you plan to get your wife to, if there are any restrictions…In general, there should not be for visiting.

      In general, having ECR does not bar you from entering another country. You can check with Australian embassy, if any restrictions exist. Generally, ECR restrictions only relevant for some countries in middle east.

    I applied for a fresh passport but it has been marked as ECR since my school and college mark sheets reflect my first and middle name along with my surname whereas aadhar and pan card display my first name, father’s name and surname (but not middle name). How do I get my passport changed to non ECR? What documents would be required to validate my marksheet?

      You should have all the details in Marksheets, Aaadhar card to be same. If you already have a passport, those details should match too. They will verify all three. So, your goal is to get the names to be same, do whatever you can and get them same, then you can get it corrected.

      I am not sure, if they would allow that, you need to check with the Passport office. Call the customer service. You can always get duplicate, try doing that to be safe.

        If your passport does not say you are under ECR Category, you are not in that. See the screenshot in article, if it says like that then only it is ECR.
        In any case, you have 10th class pass certificate, so submit the same and apply as Non-ECR now, when you are doing the change to the name.

        Well, they may or may not check your passport ECR status for work in US. I would suggest you check with your US employer on the visa type you plan to go first and then go from there, if ECR passport works.

I applied for the renewal as per passport officer I can’t get non ecr passport now because I have done my 10th class from nios ( national institute of open schooling.) Which is not valid . 10 year I used non ecr passport and I have 5 year international experience. I worked in uae 5 years. In my case i need your suggestion .

      If the RPO has said that you need some different proof, then you need to get the same. You can try to ask the RPO on what else is needed to get non ECR. If you get a bachelors degree, you can use that to get non-ECR…do update here after you speak to RPO.

      Yes, you should be able to get it corrected, if you have a degree. mention to them that you did a mistake and they will correct it during appointment. Carry your 10th class and higher education documents.

    • I and wife are 60+ in age. I retired from bank. We want to apply for ecnr passport. I hv matric marksheet and provisional certificate of graduation. My wife’s matric certificate/mark sheet is misplaced but she had graduation mark sheet/degree. After marraige I deleted her surname which was cast related. Now the name in Adhar, PAN and election card is same but differ with degree. I file ITR every year. She also filed ITR but in ‘nil”. To get EVNR Passport what should we do.

    • Well, you could technically use it…But, it is up to them to accept or not. You should get the spelling errors corrected, if you can in certificates.

    • Well, you need some sort of documentation to prove that he is 58 years old. He would get it as Non-ECR as he is above 50 years. You need either birth certificate or school leaving certificate for that…

    • Yes, he can. He automatically qualifies for Non-ECR category due to his age. You need to submit either birth certificate or go to his old school and get the school leaving certificate for age verification.

I wish to apply for a new passport but i have submitted my 10th and 12th certificate to the institution they will return back only after 3years of my course completion but i have my orignal marks card of degree for the 1st year published by the recognized university.is this is ok to apply a passport

    • You should be able to use 10th Class Transfer Certificate (TC) and try. Call the Passport Office or email them and check. You maybe able to use your degree details. See, if you can get a study certificate or something from them and try your luck. Also, try to ask the institution for the originals for passport and tell them you will return them after applying passport. Also, do share your feedback on how you applied with community here after you apply.

          All you need to do is apply for passport re-issue with the proofs of your education certificates. You should apply for duplicate certificate and get that first before you apply for passport. You will need that certificate to get the passport as ECNR

    My parents are at 50+ yrs of age.I am applying for Non-ECR but my mother doesnt have either Birth Certificate or School leaving certificate as mentioned in “Documents Required for Non-ECR” for “All persons above the age of 50 years”.we just have Adhaar card and PAN Card.Can I apply for passport.Please assist.

    • I am not sure, if the passport office would accept those certificates for age proof. You can give it it a try with Aadhar Card. If it is not too much effort, you should get a birth certificate or some letter from the municipal office that indicates her date of birth or age…If you have access to her school, you could get the transfer certificate as well…Please do share your experience with community after you apply…

    • You would need original for any corrections in passport or get a Non ECR passport. Go to the school or State Education department and get duplicate X class certificate, otherwise, it may be difficult without proof to change it to ECNR.

    • You can mark non-ecr as ‘NO’ it is to be marked yes when an individual having a qualification certificates from 10th std on wards. since your child is 6Yrs old only so you can opt as no.

  35. Sir, My passport is ECR & I want to change in ECNR, I have already done my Education like graduation but Age diffrent between Marksheet and Aadharcard (3yrs) , Now What should I ?
    Please suggest me best solution for it.

    • For ECNR, you may or may not need the age to be fixed, but in the long run to avoid issues, you should fix the issues and correct your aadhar card or Marksheet, whichever is wrong.

  36. If a person falls in any of the above category o f Non-ECR category listed in the “Passport Seva” webpage, then he/she has to select “YES” in the documents required question ” Is applicant eligible for Non-ECR category?” .
    It is adivised otherwise in the above article. Please correct it as it misguides the readers of this article.

  37. the passport appointment prosess has been complited without 10th,12th&degree cetificat but i have degree certificat then possibel any change ?
