USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  3. Starting from EAC1315150375 through EAC1315150574, there are 86 H1B receipts entered today, which were received on 8th and 9th April as the description says (90% of which are 8th april). Can someone shed some light if these are all possibly lottery applications?

    • Yes, these petitions must be of lottery selected candidates, that too RQ/RP

    I am on H4 .Applied to H1 this year in RQ/RP/CSC. Upto now I didn’t recieved any notice from the employor. So feeling very upset as I missed the opportunity last year also due to wrong selection of the employor.I have 6 years of experience in India.So now, I have few Queries.

    1.Upto when I can wait for the receipt ?

    2.If not,what are my possible options ?

    3.I am currently located in chicago,so Can I go for MS ? If so,what are my options(means when does it start,which are the universities available so on) ?

    Please please guide me friends ?

    • its late to apply to most of the recognized universities; look at state universities around where u stay; eg i am looking at cal state universities; there will also be many smaller universities in and around chicago; make sure these are accredited universiites; (state universities are accredited so u dont have to worry about those)

        I am also CA based and on H4, please suggest some CA universities for distance learning or part time learning and can we get OPT or CPT there, or we have to wait 1 year.And what would be study cost approx.

          There was one university like that in CA, which allowed distance learning and CPT from day 1. It was called TVU and was shut down by USCIS and ICE. Be very careful when going this route as the university you may decide (and which follows such practices) may be next in the list to be shut down.

    • I think till end of next week. But with very less hope.every one is saying Cpt is an option. But we need to be cautious in this approach. BTW which employer did u chose last time. Who is ur employer this time. This is for our information so that we don’t fall in to problem next time.

  5. I know the words like you will get thru holds no value while you are waiting but trust & faith in yourselves & God will help you deal with difficult times like this.It seemed checking email, reading this blog, waiting, praying & crying has been routing since last few days.

    Just heard back from HR that the check for my application was en-cashed and they expect receipt notice to come in next two weeks.

    My app was – RP/RQ/Don’t know whr application is sent.

    Is this really good news that app got thru lottery or still anything to be concerned ?

    • Congrats RJ. As long as the HR is sure that the encashed check is for your application, you are selected in lottery. Now begins the processing of the actual app.

    Don’t over think it guys. If you have got a receipt number and seen a copy of your I797C form, consider it’s good news. Why is everyone worrying about checks not being cashed or SEVIS not updated etc? Honestly, be happy that you have a receipt number. Not everyone has it. Only the ones who MADE THROUGH will have a number.

    • Maybe you got the wrong message, but NONE of those activities happened.

      The reason I asked for checks and SEVIS is because I see zero activities for any of those, so am wondering if recieving a check is possible WITHOUT any of those other things happening.

        • Okay. I understand.
          Be patient buddy. You will hear soon. If you have a check en-cashed or an update on your SEVIS, you are IN. If you have an update on your SEVIS your DSO should be able to get your Receipt number. That means you are in too.
          Lawyers who have been in immigration law for years confirmed these facts.
          So take a chill pill until your postman delivers the good news.

    Mine is RP/RQ.
    My employer called USCIS yesterday. After 40 min wait, all they replied was they do
    not have any information on the system.
    My employer asked, So can we assume we did not get through the lottery. And here is the reply we got=>

    Sir You cannot assume that way and You need to understand. The system we access will get updated only when employer gets the receipt number and sends confimation on I-797 or when he receives a return packet.
    U need to wait until May 15 for either one of this to happen untill then we have no information in our system.

    Friends: What can i assume from this reply. Did it make it or no. I am confused:(

      • It means like even if we get the return package, our name will be in the database. Correct me if I am worng.

      I also called on Tuesday and my name is not in the system. They told me be relaxed and asked to call back after 10 days.

      If whatever you have written is true, still there is chance for me and all who were told by USCIS that their name is not in the system.

  11. I am too still waiting. Regular processing, regular quota. The check hasn’t been cashed yet and no receipt received. I still hope we will get it, but I am kind of prepared for not getting it.

    Let’s wait for couple of more days, but the chances are slimmer and slimmer every new day.

  12. got my receipt number EAC 131 148 ***** !! got it from my DSO and also my employer called USCIS and confirm that my petition is in Initial review !!! I am RP/RQ /VC sent my application on 1st april.

    Guys just so you know last week when my employer called USCIS they did not find me in the system, but his week they did!!! so is not over yet.

    I called the USCIS office yesterday (45 min wait) asking about my application. The ONLY information he was able to give me was that he could not yet see me in the system (RegQ/PP/EAC). So where are you all getting these different types of information? Or is it just rumors?

    I don’t know if this is comforting news for you people who are still waiting, but we may probably assume that processing is not done yet, which means that rejection notices will take a while. Maybe weeks.

    My OPT expires end of May. If I don’t get the H-1B, I can work until I get the rejection notice (even though that date will be post May). My plan B could be applying for a Green Card which is harder, since my employer has to show/proove that my knowledge and experience cannot be replaced/substituted by an American Citizen. The problem is that, when trying to proove this, my OPT-experience may not count.

    • You are correct. I don’t believe reports from people saying “a USCIS operator told them all processing was done”.

      They are clearly still generating receipts. Not in mass numbers, but receipts are still being generated.

      Waiting is frustrating, but I am afraid it will be another few weeks before people can confidently say whether they are out or in for sure.

          • Latest….EAC1315150245, 375, 392, 395, 413, 417, 425, 429, 459, 459, 463, 466, 478, 489 ……..that is decent count from 400 to 500….keep hopes and make this forum alive for people who are waiting…..

        • Maybe some of the receipt numbers are not for new H-1B petition, perhaps for H-1B transfer. We shall do a statistic analysis to filter out this noise…

    • Yes, this appears to be generated today. Also, I noticed EAC has generated quite a few H1B lottery receipts today.

  15. I think everyone will get it eventually, what I observed so far USCIS sending receipts to almost all the petitioners. I know few people applied, they all got it. So don’t worry, good news on the way!!

            But I have seen many h4 guys got lucky this time . I don’t know if we are In those lucky ones , this waiting has given me a bad impact on my health as visited the doc twice already 🙁 . I am not going to take anymore tensions .

      Lets draw a line b/w optimism and facts, as at times being optimistic can convey factually incorrect information.

      Facts: Not everyone is getting the receipt number. Only the ones who made through the cap will receive it and there will be thousands of people who will not receive it.

      Optimism: You can hope that everyone you know or have come across online/offline are the lucky ones who make through the selection.

        You should also check your facts.

        People NOT selected in the lottery may also recieve receipts if they have been waitlisted. Moreover, we do not know the rejection rate this year, so saying that “thousands of people will NOT recieve receipts” is also pure speculation and inaccurate guesswork.

          There are only options – you receive receipt number which confirms you have made through the cap, and you receive the package back which confirms you didn’t make through the cap. I didn’t use the word “lottery” in my post, but the word “cap”. There is a difference.

          I have seen 2007 and 2008 lotteries to see how many petitions are received back. That number is pretty high and we can wait and watch to see the number this time. Do you think only hundreds of petitions will be returned? Even if 10,000 applications are returned, its still “thousands” of applications returned. Unless you are saying that <1999 applications are returned, you are agreeing to what I said above.

          • All I was saying is that EVERYTHING is a rumor at this point. There are no official facts relating to most of what we are discussing here.

            “Thousands of people will not recieve a receipt ” is NOT fact, it is merely speculation based on past data. End of story.

            As of right now, we EXPECT about 20,000-40,000 to be returned or rejected. None of this is a fact.

            I am not arguing, merely separating fact from speculation.

            Anyways, if it gives you more hope then be it. I don’t have a dog in this fight.

        • Not that I want to argue, but the cap limit is 65k + 20k, and USCIS received 124k petitions. Even though it’s very unlikely that USCIS approves exactly 85k applications and not a single one more, we can safely say that at least 25-30k petitions will be rejected, either because they were not selected on the lottery or for any other reasons. Given previous years’ statistics when the rejection rate was around 15% on average, USCIS probably selected ~95-100k petitions on the lottery. Even if the extra 10-15k people on the wait list get their H-1b approved, 24k is likely going to be rejected simply because they were not selected.

          If it’s true, then it’s also possible that most of the petitioners will get a receipt number, but many of them will never get approved…

      • I feel something fishy this year, USCIS did not tell the exact count of no of petitions. It looks like USCIS playing something with us by showing to the world that they are very good in economy situation which is not 100% true. Lets hope everyone receives their receipt. I heard many people got their receipts either.

          Even if they have not given the break-up of AD and regular petitions, they still published the overall counts, which is way more than the caps. So there are rejections bound to happen.

    Don’t panic. Everyone will hear back eventually. My lawyer said that USCIS will continue data entering until END OF MAY. She gives pretty legit information. Most of your receipts are still in transit. It will take time.
    Be patient. I know it’s killing you. I was like that too. I only heard back yesterday but I still visit to see good news from you guys as well.

    • Please don’t call USCIS and take a risk. Call your school If need be. That’s the most I did, and my ex-gf happens to be an International student adviser. So she was very helpful 🙂

      Because if not, everyone will of course hear back eventually — either by receipt or returned package.

    Some one may clarify this.

    I’m working in Client place, New Jersey. My company office address is California address and my attorney is from California. I thought my petition would go to California center for processing but my petition sent to Vermant center.

      • Honestly, I don’t know the answer to that so it’s not gonna be too much of help. Perhaps because you work under Vermont Service Center’s jurisdiction? But it shouldn’t and doesn’t matter at all regarding the outcome…

  18. It seems as though quite a lot of people are still waiting for receipts.

    I find it hard to believe that so many capable and willing people – especially ones with advanced degrees – will be left out of the lottery. Part of me thinks that eventually the majority if not everyone will be issued a receipt.

    Some people posted that USCIS has stopped entering cases — really? I think the have reduced the number of cases they process, sure, but they are by no means done. What one USCIS operator says may not in fact reflect what in fact happened.

    I am still waiting, freaking out and hope is slowly drifting away, but part of me feels it would not be fair that the lottery system would leave so many good people out in favor of body shop candidates. I am hopeful…

    RQ/RP….

    I work for a US based MNC (related to tech research) and have been toiling for more than 5 yrs, everyday till 4 am in the morning… I thought finally my pains are gonna end, but USCIS created problem by informing everyone that there is huge demand when there wasn’t much (read in ILW.com)
    Not sure what to do if I don’t get thr’ H1B. I may have to find a new job and waste 5 yrs of excellent career progression in the current company and start from stratch. I was promoted 6 times in 5 yrs, all that hard work, toiling and above all, great luck seems to go down in drain….

      • AHOLE company OR BHOLE company, AHOLE employee or BHOLE employee all works for there profits and all does hard work. Do not live in a dream land where you will be treated as king , No over haul will give you direct citizenship to live here as long as possible. You have to go through all the shit required to get there as like any body else.
        Do not feel priviliged you are also part of any CHOLE company only. Some got lucky others were not. Even if process is converted to Exam based selection some will be selected others will not.

          • One thing you have to know is IF american citizens are avaialable in open market for given skills no body will hire outsiders they do not have to. Real thing is unavailability of technical resources in America, which attracts body shoping nothing else. Why clients / companies support that body shop ? because they have to get there Job done and at reasonable cost. In the era of recession companies are not so rich to pay every one hefty salaries. They have to rely on outsourcing and body shop thats the truth of todays economy. What ever resources are competing here are all considered skilled workers because there not as many american citizens to fill those positions. At the end of Year no company wants to run there bussiness with out good profits. Client is making profit , provider companies are making profits , economy is improving. Anything which needs to be corrected is education and training system of America thats when there will be no need for any technical workers to be hired from outside.

            2. There might be some truth in the skill shortage issue you brought up. But I am sure IT consultancies don’t even look for local talent before hiring. Locals demand more compensation apparently. 😐

It’s not entirely true, Local might demand more compensation just becuase of shortage, once education system is improved and training programs are in place there will enough supply and instead of working in shopping malls or subways American youth will work in the technical industries.

          • @stupidity. I am not sure what is source of your data about 80 Hours/Week that’s not legal and I have not seen it happening in 10 years of my experience. Which means may be there are some real ignorant people who do not know there rights and labor laws? You only know that as I do not know any such scenerio. Here is what I know –
            1) IT contractors – Paid at Hourly rate. If client pay 80 $/H to company they keep 20% and give 80% to employee
            2) IT permanent employees – They get fixed salary and have to work 40 Hours, they get lot of other benefits (Insurnace, stocks, Awards, Travel charges, allowances).

            May be you have seen some bad examples and generalized your understanding that all IT companies or employees are doing it that way. I think you need to correct your undersating.

            Regarding your research work – If America feels your research is of immence value to the country and human kind then they would do everything to keep you.

            Labor law of USA does not allow companies to recruit resources at salaries below standards and with out benefits.
            Every one is educated enough to know what is good for them. You can not decide what is good for an individual with out knowing enough.

            Its just competition of Quality, cost and innovation – who leads in these three aspects goes long way. Others just keep complaining. Even after Lottery if indivdual or company is not providing package of (Quality, cost and innovation) they can not succeed in longer run.

            If you feel you have that package be content.

        • She/He has a point. I don’t know if you ever worked for any of these companies, but very very few of them would be considered as special talents. There is no professionalism at work or after work.
          Not only these companies abuse the workers (paying less), but also reduce the chance for other talented people.
          This also goes for desi consulting companies as well. Putting fake experience does not make your candidate specialized.

          • I think there are 2 different things here – whether the applicants are qualified or not, and whether these companies “try to game the system” or not.

            The first one may still be up for debate, but I think we should have a consensus on the 2nd one. These companies do file H-1s in bulk so that at least some of them make through the cap. Non IT giants file petitions based on candidates, while the IT giants file on the basis of count of candidates. To non IT giants, it matters which candidate made through the cap and which didn’t, while to IT giants, it matters how many made through the cap.

          • I agree…I specialize in a non-engineering science… and though my H1 is approved, I can totally empathize with other people from non-IT fields.

            Thanks to this lottery: there are companies who cannot get H1Bs for deserving candidates while there are people in the IT field who claim visas in bulk through consultancies without even having projects to work on…

            I’m so glad USCIS has started to realize what is happening and is rejecting so many visa applications from the IT consultancy companies.

        • I am pretty sure u r working for one of those sweat shops…that is the reason u r supporting the current immigration system…current system definitely needs a major over haul to block people like u and companies like the one that u work for to block the people who super exploit the system…

          I think u like to be exploited b****. U guys dont speak out and demand more wages….u just like to work for bare minimum prevailing wages….sorry for u…

          They should also implement a category cap so that IT guys dont bother real engineering people (Chemical, Mechanical, Electrical, Aerospace etc)

          • I work in IT for one of the big 4. The main point of H1B visa is the specialized skill workers. It has nothing to do with IT or engineering.
            I agree that the current system needs to change. It should be more related to the qualification of the person rather than the lottery.

          • Exactly! We are making the debate so polarized. It should not matter which field you are in, if you have the knowledge and skills that are rare, you deserve a chance. But yes, no other sector than IT seems to be into body-shopping. :p

          • Immigration system might need an overhaul but more than that America needs to overhaul there education system so that there will be enough talent locally and they do not have look for preople from outside who just assume that they deserve much more than others. Some self centered outsiders.

      After the case is approved, USCIS will send out approval notice (797) to the employer/attorney. They can then send all the required documents including 797 to you for stamping.

      Stamping process varies from country to country. In India, the process is outlined on the US travel docs website. In general, it involves submitting fees, taking biometrics, completing DS-160 form and appearing for interview on the scheduled date. If approved, you can travel to US as per the start date. If you are put in administrative processing, then it can cause some (minor/major) delay.

  23. Has anyone got WAC 13 145 ….(Regular Processing) It looks like there’s no H1-B receipts (Based on someone mentioned that all H1-B got picked from the lottery should states, “On April 8, 2013, we received…”)

    My friend got his yesterday with WAC13142….. Im assuming the last day to expect something would be this Friday (from CSC) ?

    Have a feeling I didn’t get thorough, but just dont wanna give up yet 🙁

    Any tips would be greatly appreciated!

    • Nothing man.. I just checked with some HR, he said GI team has already received all the data. But i am not sure whats their problem in sharing it with us. Wait kills.. 🙁

    • Got a mail from GL with list of selected cases. We have received the first batch of people who have got selected, mail say below things.

      As you are aware, H1B FY14 cap reached on 5-Apr-13. On 7-Apr-13, USCIS conducted computerized random selection process (known as lottery) to select 65,000 H1Bs. The applications selected under lottery will be adjudicated by USCIS and cases not selected under lottery will be returned by USCIS along with the filing fees. We are expecting receipt notices (confirmation that got selected in lottery) and returned H1Bs (not selected in lottery) from USCIS in batches. We received the first batch of selections on 30-Apr-13. Please find the status below

      • TCS-er is correct. We got a list of selected cases(for BFS domain) Nearly 10% cases got selected , remaining cases status is “Pending with USCIS”

          • This mail is sent only to GL’s. As of now we have clear information, we individulally will get updates only when all the batches are received, also thr is a mention that we will be knowing both ‘Selected’ & ‘Rejected’ cases, so we have to wait for some more time.

          • For our account(one of the largest US Bank) >500 cases are filed, in which 58 cases are selected in lottery. Remaining are in “Pending with USCIS” status.
            But don’t lose hope these are the case status which TCS got as on Apr 30

          • I m also from the same account, update was as of Apr 30. But looking at the % selected, i m losing hopes. USCIS are almost done with RP receipt, so chances seems to be very slim.

          • Yes, only 10% of the cases says “Selected”, seems to be very less. Also received another information saying that they will get more batches, expectation seems to be 50% cases in the “Selected” range.

        • True that for one of the BFS domain, the list was shared and 10% was the selected ratio. Unfortunately my name is not in the lost. Loosing hopes as its already first week of may. Fingers crossed. I am really frustated and getting demotivated.

    My OPT ends in July.. and if i apply for admission for June and got thru, till when i can work on OPT..? till sevis gets transferred..? when the sevis transfer actually occur.. ?

      Has your H-1 been selected in the lottery? If yes, then you are eligible for cap-gap. This allows you to stay and work until Oct 1 or H-1 denial date (whichever is earlier). Just let your DSO know about the selection in the cap.

        Nope, i dont think mine wentgot thru the lottery.. AD/PP/CSC.. I dont want to quit my job, and my manager has given options,
        job from India till next years H1, working in India.. both would be tough.. as my status ends till my opt.. the pay roll dept wont be happy paying in both options.
        Joining university which gives cpt from day seems to be option with light.. so wanted to know if i join and gets the cpt work authorization.. can i continue ?? the same q..wanted to ask HR.. but dont know exactly how to put the question..

          A person can work on CPT from day 1 only if:
          – the course/program requires you to work from 1st semester/quarter
          – the work is related to your course

          You have to be very cautious when going this route as some schools use this CPT from day 1 as promotion tactic and issue CPT even when they shouldn’t have (like TVU).

    I have been a silent follower of this forum . RQ/RP/WAC. Nor my attorney nor my employer had heard anything from USCIS. Nor the check was cashed . Today I called USCIS and they said that my name was on the list . After a brief silence when asked her again she went on to say that the receipt processing was complete all the names have been entered and that I have not been selected in the lottery . This was different from the previous week when I called and all they said was that my name was not on the list . It is sad but thought would share . If you call USCIS may get an answer soon. Best of luck to all those waiting .

      • Sorry for the confusion . Typo error . I called them today and I was told I was not on the list . As mentioned she went on to make those comments saying that I was not selected in the lottery . I was a bit shaken but coming from USCIS I think it is reliable and I given up hope . All the best .

    • YES, you were not selected If your name is not in system.
      It has been confirmed by those who have called that Data entry has been completed and they have been sending back packets.

        Its a good idea to back your statements before you tear down people’s hopes.

        1) They are still inputting H1bs; today’s entry EAC1315050708 (April 8th). Now I do see that the number of reciepts generated for H1bs has reduced today, even compared to yesterday, but they have still generated over 50 (counted myself)
        2) In 2007 (FY2008) and 2008 (FY2009), they announced when they completed the data entry process and started the return process. In both these years this happened in late may to early june.
        3) NO ONE ON THIS BLOG HAS POSTED THAT THEIR H1b APPLICATIONS WERE RETURNED TO THEIR EMPLOYER/LAWYER. There was one guy few days ago who posted that he was told by employer of not being selected, but did not mention anything about returned application.

        Think\research before you type (this comment is intended for everyone).

          I would have used my program to find you exact numbers processed today but USCIS has banned my IP because of exceessive number of requests coming from my IP (program running in loop and checking each receipt number 🙂 ).

  35. My employer told USCIS encashed the cheque in 4/19. But till now he didnt receive the receipt.
    Applied in Regular processing.
    Any one in the similar situation?

        You should make sure from your employer that check cashed was paid for you and also make sure you follow up with attorney since lot of times it happens they actually already receive receipts but sometime they do not notify immediately….
