USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

  1. Hey guys…

    My employer called USCIS for my application info as I haven’t received the receipt yet.

    They said its not in the system. They confirmed that the receipts for all applications selected has been sent out already. Also they said that there is a small waitlist people for whom they have not yet sent out the receipts. These receipts will be sent out by the 15th at the latest as there are other rejections. So whatever receipts you find getting generated today onwards are those waitlist applications getting selected due to some rejection. They also said they already started sending out return packets for those applications not selected too.. my employer hasn’t received any return packets yet.. So i am not sure about that.

      • a few/couple of thousands was what they said.. but i think they were just saying out of the blue as they didnt know the exact number.. so I would say I am not sure as I don’t wanna give false hopes just because of this call.. but they said these waitlist will only be selected if there is rejection of other applications.. so again its pure luck even if you are in the waitlist and there is no way to know if you are in the waitlist..

  5. Today I learned my case got approved. CSC/PP/AD (lawyer’s office took 20 days to notify…)

    Can someone please tell me if there is a way to tell if the application was filed under advanced quota or regular quota? The tracking number they gave to me doesn’t seem to have information about this nor the i797 notice mentions it.

    My H1b got approve just now. Details as follows:

    18 apr : receipt received
    18 apr – 24 apr : intial review
    25 apr : converted to premium
    25 apr : 15 day clock started
    26apr – 30 apr : acceptance
    30 apr : 1:30AM : clock stopped
    30 apr : 5:45 PM : APPROVED.

    I constantly checked online. All the best to all of you out there.

      • My petition got approve. It does not need any interview. If I want the visa to be stamped then it will require interview in my home country .

    • Congrats PriyaLA. Are you belongs to Regular quota or Masters quota? If you are regular quota then I have one question. Generally when can you go for Visa interview ? Is there any dead line ?

      • I am on master quota. But you can go for stamping within 90 days of the start date. So for oct 1st you can go as early as July 1st onwards.

          Accepted on 8th Apr
          got receipt on 19th Apr and it was under initial review.
          converted to PP on 23rd APR

          but my application went back from Initial review to acceptance and there is no mention of PP on my status check it says ….

          On April 23, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case. Please follow any instructions on this notice. This case is being processed at our CALIFORNIA SERVICE CENTER location. You will be notified by mail when a decision is made, or if the office needs something from you….

          I am confused this waiting is making me crazzy . please let me know if you checked your sevis or spoke with DSO after approval . will there be any mention on the sevis after the approval has been done .

            how did you know about your PP clock start and stopped dates !! My process was converted from Reg to PP on 23rd Apr but the status went from initial review to acceptance but no mention of PP anywhere !!

    First of all, i should thank all the people in this forum, you guys made me feel wayyyy more better during the hardest time !

    The mail got the lawyer’s office this after noon at around 5:30 pm.
    Im RQ/RP/VSC, company and lawyer both in Texas.
    The application mailed at March 29, got VSC on April 1st.
    Receipt # EAC-13-145-53xxx
    Received date : April 8
    Noticed date: April 25

    Before that, the check did NOT cashed, SEVIS did NOT changed, nothing heard from ANYWHERE!

      • i did NOT contact USCIS, since i heard somebody said it’s not good to pretend to be your employer….i did contact the school, also the ICE about the SEVIS update, but there was no update yet the check cashed. Hope you will get yours soon !

        • It should be on your W2, or you can ask your lawyer to provide it to you, it should also be on your h1b applications…..some ppl said you can even google it….

    I called USCIS this afternoon and they said my name is not in the data base and he told to call back after 10 days for any update ???

    Does it mean that I have not been picked in the lottery and I am in the waiting list ???

    • Not exactly, they are still processing H1B applications, so wait for some more time.

      CSC – till now they processed 850+ applications today and almost 450+ are H1B’s.
      VSC – They also processed some applications today, but don’t know the exact number.

      So please wait for some more time. Hope for the best.

  13. Guys today out of 1024 applications processed at vermont 74 were for I129
    with text “we received this I129 PETITION FOR A NONIMMIGRANT WORKER”
    So i guess we still have some hope left.
    Mine is RQ/RP/VSC…waiting and praying.

    I got this data by using a program i created which count the number of cases with text “we received this I129 PETITION FOR A NONIMMIGRANT WORKER”.

        I searched for all the application which says
        “we received this I129 PETITION FOR A NONIMMIGRANT WORKER”.

    • I do not think they have processed only 74 new H1, because I do see many PP today with below message:
      “On April 30, 2013, the 15-day premium processing clock started on your I129,PETITION FOR A NONIMMIGRANT WORKER.”

  14. We cant realy tell, but it makes sense that they give priority to AD holders since they are not even supposed to be in the Quota and stand to benefit country more from a education standpoint. (Of course they are better skilled non-AD degree holders)

    Also, we have seen them favouring AD in processing order.

    So, it is plausable that they will consider ALL AD first in waitlist then regular.

    This numbre could be around 10,000 assumning a conservative rejection rate of approx 10-15%. Realistically, rejection rate this year could be around 20-25% given the rush in filing.
    It is unlikely that the AD quota was exceeded by a huge figure., hence WE should expect all AD to go in if the above theory holds

  16. Guys i missed last year qouta by 1 day, prepared my file in same day cap reached. And have waitting since last year for this year. Then comes the lottery and i was thinking that i am totally unlucky, but thank God i get selected and received my reciept num one week ago. RQ/RP.

    So hope you accept God plans and do your best in what ever other plans you have till you have what you want in the right time.

        • Man, you read my mind, I have been following your comments for the past weeks and feel like we are really similar. Only I am already married and my wife is not an American, which I don;t actually regret at all. I still have some hope, but it’s fading with every minute…This sucks so great I can’t even explain!!! I begin to be intolerant due to all this Indian buzz, which is not good, but can’t handle it.

            Think that an indian guy is getting this visa for only one year use whereas we spent and invested so much time, money, energy in this.. whereas we already set-up a life here..

            and now, I’ll take all the stress and risks of a contract marriage.. gonna be standing on a knife for the next 2-3 years..

            seriously, fuck the quota for AD applicants… wtf is 20k when there are thousands and thousands of universities and master programs in this country…

          • These things (the quota, the abuse, the Indians) have been there for over a decade. It happens every year only with the exception of a few years because of the economic crisis. You should have been aware of this system and evaluated these risks before you came here and made your investment.

            Having said that, I do wish that you guys will get your receipts soon.

          • The main point of H1B Visa is specialized skills workers, not your foreign degree and spending money.
            I have done my Bachelor’s and have been working for two years with the big 4 and still waiting for my receipt.

    • @Emre- I am in the same boat AD/RP/VSC… I feel like all my dreams are going to be shattered because of this hurdle in my life… Got my masters, got a well deserved job, and lottery has completely tilted everything upside down… I don’t understand why people have filed duplicate applications even knowing that they would ruin another person’s opportunity.. out of every 10 people that i know, atleast 2 have filed duplicates… Anybody know if they are gonna replace them with the ones in waiting list? Any inputs on waiting list process would be greatly appreciated.. Only hope left is ‘WAITING LIST’… And prayers to God continue…!!!

      • I’m guessing duplicate filings, if found, will be rejected and 2 wait listed application will replace them. If only one of the application is selected, they are lucky.

        I hate duplicate filing. But I’m guessing USCIS has strict validations against this.

      If you can’t get in this year, try Canada, or maybe see if your company can sponsor a green card directly. With a PhD the waiting time for a green card shouldn’t be too bad.

        • I’ve been asking the same question for a while now. I think they probably have a third lottery. I could not seem to find specific information online regarding this. Hopefully most AD/RP/ people who don’t have their receipts yet end up on the waiting list. Anybody knows how this works ?

          • When I heard not heard of anything after the week of the 15th I figured I might be on the waiting list or something. The thing is, who knows when USCIS is likely to let those on the waiting list know that they are on the waiting list ? Would that likely be a month or so from now ?

            I think only benefit is quick response….
            I think it will be more beneficial in some cases where they asks for RFE so that they will get enough time to prepare and provide those documents

      converted to PP on 23rd but there was no mention of any premium process instead the application went from initial review to acceptance on 23rd and since then no activity !!!! Any inputs ??

      Also can you lert me know if you checked sevis after approval anyupdate on sevis records

      what was ur status before h1 approval were you on F1student / OPt / OPT extension ??

  21. I have just received mail from my employer saying that they have received the notification from uscis which indicates the petition that has been submitted has been received by USCIS and it is in queue for Review.
    They have also provided the receipt number WAC-13-137-xxxxx

    when i checked the status on the USCIS site with the above receipt number it was in “Initial Review” Status with following message

    On April 18, 2013, your Alien Registration Number was changed relating to your I129, PETITION FOR A NONIMMIGRANT WORKER. Please check our website at www.uscis.gov for further updates on your case. Please wait until the end of normal processing time before calling customer service at 1-800-375-5283 for live assistance

    Does it mean my application is selected in lottary ?

    My petition is regular quota/regular processing /CSC

      I set up a fookin life in this county like you.. and applied from AD quota… and this fokin lottery foocks everything up…

      • Actually, I find this neither suspicious nor surprising. They have taken a sample and concluded about 60% rejection rate. You can do that easily by looking at a representative sample of case receipt numbers on the USCIS site.

        A higher rejection rate wouldn’t surprise me one bit since I’m sure lots of Indian IT companies rushed to get as many applications as possible in. They played the numbers game and I’m sure the quality of the applications suffer in the process. So they’d rather take the opportunity away from genuine candidates as long as they can get in thousands of applications. That’s why USCIS is waiting to send rejection notices and why there is still hope for everybody. I bet they are keeping a record number of petitions on the back burner to replace rejections

        • Of course, they wouldn’t know whether it’s an IT company application or not by looking at the receipt. Maybe they have inside sources?

          • Good point @Yours. Also they could use inside info from consultants and see the # of receipts vs RFE… If thousands of applications are filled by a one consultant, bet its done mechanically and may have more mistakes. I believe the job title, and education needs to be aligned accordingly. Also people w consultants may have employer mismatch due to use of third party. Finally why would you waste a 3-years visa that can be extended on a person who has work only for an year or two (project based employee)

          If they are basing on that sample, then I am really interested in knowing the sample size. Mostly PP petitions have been adjudicated by now, and I don’t think IT companies prefer to file it in PP (money saving technique).

          In addition, the data for FY-14 is not public yet. So as part of their sampling, they would have combed through online blogs or contacted companies/beneficiaries about their petition statuses neither of which is an effective method. Even when USCIS publishes the rejection rate, it doesn’t break it down by company or country.

          To me, this news article is more about sensationalizing the report and showing how wrong it has been done to Indian IT companies.

          Petitions that didn’t make through the lottery will be returned in May-June. That is what happened in both 2007 and 2008.

    i guess Infy has alreasy received some receipt , but they will start uploading in AIMS from 2nd may onwards …they will prefer to wait and get a good amount of receipts before updating status in AIMS . Any one from infosys who has got the H1 receipt

  31. My H -1B was sent on march 29th, received mail ack on 9th stating they got it on april 2nd. The application is Reg Quota on premium processing and the first h-1b for me. Checks have not been cashed, so no receipt number yet. My employer also sent another case on april 4th and arrived on april 5th and that one DID get a receipt number. Today my employer called USCIS and was told that my case surely got into the lottery and should wait at least 45 days to get any notice so I wonder… WHY if the case got on april 2nd was put into the lottery, isn’t this a first come first serve thing for people who got their cases before april 5th? I am very very worried right now, so much effort and money and everything put into this to have it sent before april 5th to be in this situation. THank you

  32. I have been watching and occasionally joining in this forum for a couple of weeks now and I have always maintained that there is hope until you hear anything.

    I also believe that what some people have stated here is correct that even if you applied PP the 15 CALENDAR days won’t start until the day they process / put your application in the system and generate a receipt number and furthermore that USCIS has not completed doing this yet.

    Here is proof to substantiate the above from the USCIS website today for VSC applications.

    “On April 29, 2013, the 15-day premium processing clock started on your I129,PETITION FOR A NONIMMIGRANT WORKER. You will be contacted by the office that is processing your case when a decision is made or additional information or action is needed.”

    The above was for EAC1314854010

    If you ask me, there is still a chance and you need to wait until either you hear something or receive your package back to be really sure.

    • I hope you are right and that they are still generating receipts. I still feel it’s slim pickings for those still waiting.

      Someone posted an article about a rejection rate of 60% for Indian H1B visa applications this year. I wonder how true that is.

    • More evidence from USCIS website today to suggest we just need to stay calm and wait – it is not over yet – don’t start with Plan B yet!

      On April 30, 2013, we received this I129 PETITION FOR A NONIMMIGRANT WORKER and we e-mailed you a notice describing how we will process your case. Please follow any instructions on this notice. This case is being processed at our VERMONT SERVICE CENTER location. ”

    • Hi,

      do not want disappoint you guys. but most likely. The receipt you mentioned is likely to be for H1B extension guys or for guys already has a receipt and change it to pp after that. Other wise, no matter on which day they entry your case, the date should be showing April 8th anyways.

    • Sonu, I’m sorry to say there is no deadline. As you already know, there is no transparency. We got to wait. Divert your attention to something else for a few more days. Hope good news will come for all.

  34. Yesterday one of my friend received the receipt number(RP/RQ).She is on H4.I am also on H4 & still waiting for the same. Now in this movement I feel those who got the receipt number are the most luckiest people in the world.Don’t what decided for me.

    • Guys i missed last year qouta by 1 day, prepared my file in same day cap reached. And have waitting since last year for this year. Then comes the lottery and i was thinking that i am totally unlucky, but thank God i get selected and received my reciept num one week ago. RQ/RP.

      So hope you accept God plans and do your best in what ever other plans you have till you have what you want in the right time.

  35. I think its all over now..Today is last day and now attorney or employer can call to USCIS and ask them status of their H1B application as its going to complete 30 days..

    • I am a silent reader of the discussions happening here in this forums. Its been very supportive and lots of indepth discussions about h1b process were discussed. It was very informative.

      I received my receipt notice yesterday from my company’s HR.
      My Petition was sent on 4th April and reached on 5th April. RQ/RP/CSC center.
