USCIS H1B Visa 2014 Regular Processing Time? Premium Processing ? FAQs ?

Many of you who have applied for H1B Visa for fiscal year 2014 might be wondering regarding the H1B Visa processing times. Some common questions are like below:

Let me take some time to address some of the above most commonly asked questions around H1B Visa petitions processing times and how USCIS has done in the past. What is USCIS Processing time for H1B 2014 petitions filed under Regular Processing ?

Well, the typical adjudication (decision making) time for H1B visa petitions filed under regular processing by USCIS can range anywhere from 2 months to 6 months. There are cases where the decision was mailed by USCIS in less than 2 months and there are cases where USCIS took much longer than 6 months too.  Every H1B case is different and the time taken depends on various facts and factors tied with a petition…

Is there any set SLA for USCIS to process petitions filed under H1B 2014 Regular processing ?

There is NO set SLA for USCIS that stipulates them to adjudicate a H1B petitions filed under regular processing within certain amount of time.  So, you would just have to wait for USCIS, there is nothing you can do. Unlike,  USCIS has SLA for premium processing H1B petitions, but it comes with a cost.

How long will  USCIS take for H1B Visa 2014 Premium Processing petitions ?

USCIS has a standard 15 calendar days SLA for premium processing petitions.   Typically, it starts from the day USCIS receives the petition and they issue a case number.  But for FY 2014, due to expected high volumes they have pushed the premium processing clock  for H1B petitions to start from April 15th. So, you can expect a response from USCIS on your case by April 30th.  It can be a decision or an RFE, if something was missing.  Read article: H1B Visa Statuses – Approval, RFE, Denial

How has USCIS done historically with H1B petitions processing times ?

Again, as mentioned above, it has varied from 2 to 6 months. The current national average for processing times that USCIS publishes on their website is about 2 months and it seems to be varying depending on how busy USCIS gets with processing at a particular time.  You have to remember that the reason processing times can vary a lot is because USCIS constantly receives other H1B petitions that are not part of FY 2014 quota, which are extensions and change of employers, cap-exempt petitions, etc. that they would have to process as well. If  some of these mentioned are filed under premium processing, the priority changes from USCIS perspective.

Where can I look at USCIS processing times for H1B petitions ?

USCIS publishes the processing times on their website. The only trick is that that, you have to watch for date that processing times correspond to…All you need to do is select the processing center and it will show the approximate processing times. You can check at here at USCIS website

    looks like they have almost finished in EAC..

    they have just generated around 680 receipts by 10.30 am EST and there are very very few receipts for h1b from the lottery.. I guess they are coming to an end now… we’ll know more by the end of the day…

    Got my H1 B application approved. Notice date was April 22, 2013. Never got the receipt number. Directly the approval notice.

    Nothing. No checks cashed. I wonder if they have processed all applications and are just mailing them out or if they still have some to process.

    I was somewhat hopeful until this morning because I truly believed that USCIS wouldn’t be done until into May, but upon seeing all of the receipts being recieved yesterday, and hearing people report how USCIS “said” it would take them about 30 days to process all applications, I feel like I may be in the minority of those being left out. This is really discouraging.

    Considering my checks haven’t even been cashed, I don’t know how much to hope for at this point. I have worked hard to get to this point and now I feel like I may have to leave the life I built here for the past few years.

    It’s really quite depressing. I have a genuine application, with a genuine company and now I am starting to feel all of this is about to come crashing down. I can’t get OPT and going back to school is unfortunately not an option.

    • I am with you man, I have been in this country for 6 years, 1 year exchange student 4 year college, almost 1 year OPT. Is kind of ridiculous that government wants to help illegal aliens, trying to get some kind of permit in which they could work legally. In a way it makes me think what about the people who has done everything right, even paid their taxes while in OPT or paid intership, what about them , you know it almost seem that if I came as an illegal alien and had kids in USA I would of had better chances to stay

    • Same thing with me! I’ve been here a long time. Went to high school, then college and have been working for two years (OPT + STEM). basically american through and through, except for the paperwork.
      It’s terrible that there is absolutely no way to distinguish between someone who is hoping to get an opportunity to come here, which i admire, and someone whose entire life is based here and will come crashing down because of antiquated policies.
      Worked so hard to graduate from a good school, somehow find a job with a reputable company and have them agree to do the sponsorship and after all that..it could all go to waste.
      I’m not a theist but this experience is showing me why people need religion. Who do you appeal to in a situation like this? Entire future hanging in the balance. and a coin toss will decide.

      I fortunately got accepted to an MBA program so I have a last minute escape plan but I feel like that’s just delaying the inevitable..

    • RQ/RP/CSC still waiting…..my attorney received 15 receipts over the weekend and said few more are expected…..Its been a long wait for each one of us….but lets stay strong…its not end of the road…talented and hardworking people will still do good in their lives…

  6. Looks like they are keeping their word.. As I had mentioned before USCIS told my employer that they will send out most of the receipts to all the H1Bs by 30th april..

    They just generated around 5k receipts yesterday.. Lets see how it goes today..

    Today already 250 receipts generated by 7am and very very few are h1bs… Most of them are other applications like greencard, etc.. Lets see later in the day if the number of h1b receipts increase..

    • Till you get the receipt or application package back.

      It might be another 15-20 days is my guess.. keep up the hopes..

      If not, you can ask your employer to verify if the checks are en-cashed. Or, they can call to USCIS stating employer name, beneficiary name and employer id.

      I got mine on day 146 with receipt generated on day 138, so it takes some time.

        • i have received my receipt yesterday but it was approved on 19 th itself.. Due to mail delay or my lawyer delay i received only yesterday.. So wait till end of this week till the mail to reach you.. Also i have not got any details about my check en cached or not before the approval.

    I called my employer they said that they got inforamtion from USCIS “My application is reached”…….Does that mean was i selected in lottery?

      That’s the last # for VSC. However, there is smth weird here. Unless I gone crazy with all this waiting, it looks like they have processed some #s since I last cheked it three hours ago. I noticed that because I left the page open with the number where they stopped today, it was smth still in 54XXX, and now it looks like 55XXX. Do you guys think is possible, or I am just not getting smth right?

  13. So just did a spot check on WAC WAC1314650001 – WAC1314651005 and that’s 1000-(~h1b) it goes beyond …1005 Tomorrow it should start from 147? Correct if anything’s inaccurate. Its some hope left 🙂

  16. My employer and lawer got the notice in the mail today 04/29.
    I’m under regular quota/regular processing/Cali.

    I’m currently on OPT extension that ends around June.
    My SEVIS status wasn’t updated when I checked after the notice day; so don’t lose hope if yours is not updated yet.

  17. I got RFE (Request for Evidence) in my H1B on 24th April 2013. They have sent us a mail to notify what documents they need. but we haven’t received yet. any one knows how long would be the deadline for documents submission?

      • I know around 6-7 folks (IBMers) who are still waiting? do you have any details for the employee who received it.. like which center (I hope its VSC for all of us).. was it regular or premium? who sent this details to him.. CM or thru INSZoom.. by when everybody else would have it…

        • Me and my team mate were nominated. He got his receipt notice through email last Friday. Email was sent by the case manager. Not immigration team or mail from INS Zoom. Both our cases are regular processing, regular cap. There was no mention of service center in the email.

          I am still praying I get it too. I think we have good hope till at least this Friday.

          • This is something which more worrying now.. since CM have already started distributing it dat means they do not have it for us who did not receive the receipt…

          • Yes guys, few people from my account have also received it from their CM but nothing from.They received it long back on 24th I think. The receipts consist of both VSC and CSC.
            Please share ,if you guys have any more updates..

    Even I almost lost hope after waiting so many days and today I got this good news. My attorney emailed me the receipt. I can understand the pain who still waiting . But it looks now centers are processing applications in high number so don’t lose hope. You all will get it . Just keep patience guys. All the best everyone.

    Today my attorney received my receipt number. My last name starts with ‘R’ and five digit of receipt no (EAC13140xxxxx).

    Don’t lose hope friends, I’m sure everyone will get it. Pray god, he will make it for you all. Still USCIS is generating receipts for both PP and Regular processing (For PP cases, couple of friends got back PP amount and USCIS considered their petitions as Regular). Please be relax and you will get it. I will defintely pray for you friends.

  23. Question regarding plan B:
    many of you guys here see going back to school as an option to remain in the US. I’m wondering, is it so easy for you? Tuition fees are really high for non-residents, or are you all rich kids here or what? How are you going to pay for school? And if you have enough money to pay for school here, why are you so desperate abt staying in the US. I think then you are quite comfortable back home with such money.
    And also, how are you going to enroll for school if there is no enrollment going any more for the Fall 2013? All the deadlines have passed, as far as I know. Am really interested in answers.

          I’m gonna loose my job by July due to the companies who took our fate to be decided by lottery though I am in OPT, we would’ve gotten it in the regular category if these stupid companies wouldn’t have been these many…

          My company doesn’t have any branches outside U.S. I cannot relocate until next year. But they can apply it next year. I don’t know whether I want to stay in U.S or just leave.

          Lottery has completely sunk my life.

          • don’t loose hope until its official, I am in same situation too OPT will expire in July , this damn school will not provide my sevis info due to some BS policy and in top of that lawyer will not upto a certain date whether check was cashed or not….

  24. Thank You all for your support i got my receipt today , not comfortable sharing but it was generated on 8th april and received today by mail, Damn USPS. I am RQ/RP/VSC.

    Few points from a silent observer
    1. Indian IT companies are misusing the quota to some extent but I have met some very brilliant people from the BIG 4 IT India. So to say they dont deserve it I dont agree.
    2. I graduated with hons, 3.6 gpa, got a job on Wall st. my parents through loans and handwork invested $150,000 USD for my education (Ohio State Univ, Fisher college, 6th for accounting/finance, GO BUCKS!!), now its time to pay back. Why am i telling you this, I dont like the fact that i have to compete with someone from india who has not invested that kind of money and effort. I appreciate your handwork dont get me wrong, no doubt you guys are talented, but think about it, for me to compete with you guys when BIG 4 IT is 55% of the H1b visa (RQ) its not really fair. Well free market dictates it and its not your fault its US govt.
    3. dont bash other people coz you are frustrated.

    4. Dont forget to thank your loved ones, you faith/ religion, and small things in life like a warm house, ur car, ur pets, fresh air, things should never be taken for granted. All energies work foe you equally.

      You have made a valid point here and I 100% agree with you. It is ridiculous that graduate from a US college already working for an American company on OPT should be in a lottery game with applicants outside the US. Oh well…What will be will be! Your point #4 makes a lot of sense!

      BTW No news from Lawyer, DSO didn’t see and update on SEVIS. RQ/RP/VSC. Still very hopeful thou. 🙂

          • I am still keeping my hopes alive. I am not sure how L1 visa is possible, I may need to ask my lawyer.

          • Go for the canada skilled program, if you have good command over english, have a degree* from a decent school, and show work experience, they will grant you a maple card (green card equal for canada). what sucks: Cold weather, high taxes, few opportunities, lower pay scale around 10-15% below US market rate. **Something like Finance, Computer science, engineering etc are all relevant majors some have high preference over others. Applications start 5th may 55,000 applications is what my lawyer tells me will be reviewed this year.

            2nd NZ and AUS have also started a similar program as canada, no harm trying its $400-500 usd to apply thats all once approved they ask for documents at consular and that it ALL year long.

            3rd India- open a school for the poor in India, ill help you! lets make India a better place 🙂 at least we got a shot some dont have that either.

      who asked you to invest that money? its for ur future, you and ur family invested.. there are many people who are not able to invest that money bcos of their family situation but they might be more brilliant/hard working/smart than you.. lets pray all deserving candidates get thru..

      • @nope , the money my parents spent was for a decent education, and we did get our moneys worth no denying that, but i get one chance to actually learn and apply what i have learned with responsibility on my shoulders, as interns the buck doesn’t stop with you, Full time makes you a man and my company really wants me. most people coming out of Big four IT have experience(my opinion limited to my knowledge) now if i dont even get a chance to get experience how do you except me to learn and become how the experienced techies are from India. I am very fortunate to have parents like that, but this broken immigration system gives some an edge over the others. as far as H1 is concerned i think OPT should have its on quota or give big 4 IT there own visa so they can carry out there operations of fulfilling talent on projects for short term successfully. why this is important in india the jobs offered to me are no more than 30,000 a month it does not begin to pay of my bills and rent in Delhi, I am now independent i cant imagine moving back with my folks. Hope you have a little insight to the mindset of hardworking International students. all the best!

          I have been given an opportunity i just want to make the most of it.
          If someone in TCS (just an example) doesn’t get his H1b better luck next time, I loose my job that i fought really hard for, and then starts the cycle again back home in India. this is still easier imagine the people who have families how hard is that decision and i know a few who suffered H4, EAD you name it H1b is where the dice rolls.

          i have been in US before and i have worked with adv degree holders..couple of them were good but there were also guys who were logically very week.. they did not even know to properly write a code.. they have told me, in interviews (phone), the real candidate will not answer the questions but his friend who is strong in technical knowledge :).. can i say that it is not fair to give them 20000 slots .. they were able to do AD bcos their parents were able to provide them… but knowledge wise, nothing special .. i am not generalizing but there are candidates like that too.. hence lets pray all deserving ppl get it 🙂

            First try to learn how to spell English in a proper way and then learn how to write.
            You wrote “week” instead of “weak” and you are pointing out about the people who are on OPT and they don’t even know how to code.

            I will post a petition to congress that H1 people need to clear TOEFL and GRE becoming here. That sounds crazy to you guys, right? I know!
            Second,
            U.S businesses are running without you.
            There is nothing you can do or to prove here. Everyone is working here for building their career and money, its just based on the priorities.

            Why do you need H1?
            Who are you to judge the people that some one deserves it or not?

            If you were in the same situation as just like other OPT, you will come to know.
            You got the stupid routine work experience and you are shouting on the OPT guy that he don’t know how to write code.

            How many years of experience do you have? and how many years of experience does the OPT guy got?

            I bet, he will be more brilliant, and he can write the better code with his intellectual skills than you, when he get the same kind of experience and he knows how to follow the etiquette in a globalized environment.

            You are just raising your words by getting some consulting experience.
            You are just like a guy who is trained in a road side institute in India. Even that guy can do more coding than you. Stop pointing on others.

            Don’t behave like you are in India. If you get your H1, you need to follow thru the VISA process. Don’t forget that. After that, you need to travel to U.S.
            This won’t work here.

            Thirdly,
            You got the job in India just because of the outsourcing. Don’t forget that.
            You got some nice job and experience. You started your career there and some started their career here.
            Don’t ever talk about deserve it or not.

            Why do you deserve it? Are you going to boost the economy of the country?

            Try to boost the economy in India if you have that guts.

            Finally,
            Try to learn or read the exact purpose of H1 from USCIS website and come to a conclusion and justify yourself that you really deserve H1. I just mentioned this, coz you mentioned about the this in your post.

            I’m not from IT. I work for a tech company and I know how to treat people and I never defamed the people and their desires.

            as you said, even writing good code needs experience but writing algorithm for any requirement is the first step, i have seen guys who were not able to do even this.. then why come and join in IT company? then why ask your friend to code for you? why ask your friend to attend interview for you… guys trained in road side or beach side are any day better than these OPT guys .. no generalization about OPT guys. I am sure there are many who are talented also.

            As said before, let deserving candidates get thru..

        • Very true… Looks like unlucky ones are still waiting, including myself. To be honest it’s a really long and stressful wait to find out about a very significant event in life specially for those who may have to pack their bags and leave the country, including myself.

          For those who are here and dont get selected: You didn’t get fired because you didn’t perform well, you didn’t get fired because of the economy. Many of you are perhaps very valuable assets to your company, and may become leaders someday if not already.. But at the end you have to leave your job because your name wasn’t selected in a lottery.

  28. my attorney emailed me saying she had received ‘mail-receipt-notice’ of my selection in the ‘Regular-Cap/Regular-Processing’ today. Case file @ Calif. Service Center. Employer state: CO.

    Anyone still waiting for Reg Quota/Premium processing/VSC?
    Really worried as no information from my employer yet. Still hoping for a miracle.

    • Same here, man! waiting..Employer and Lawyer reverted saying they haven’t heard anything yet. They even asked me to wait patiently till USCIS reverts.

    • That’s very reassuring and in line with what I have been saying from the beginning. I am also RC/PP/VSC and have been following this website for some time now. It seems to me that for whatever reason VSC has not yet processed quite a few PP applications.

      My employer also called last week and they said that they have no record of me yet in the system!

  30. Reg, PP , VSC – no update yet

    I called USCIS and said , I am the applicant and some how they transferred my call to next level and they check my name(last and first name) in the list and have not found any matches . They said it needed 30-45 days to enter all the names into the databse and I asked my application was PP they said still the PP will start after the data entered or receipt generated. So till that we need to wait.

      and they said eventhough you are PP, you need to wait?

      I was losing hope, i am also reg, PP and thought all the PP results will be out by 4/30th.
      So… Does that mean we still have hope?

      • I called on 8003755283 , I had case mismatch from selfcheck and the DSO team asked me to call on the above number. I informed same to uscis and they said they will pass to next person and I was on hold around 15-20 min

        Next person , said r u the applicant, I said yes and said I need 2 info
        i> H1 applied in yr 2014 but has no info yet
        ii> and in selfcheck found some data mismatch .

        They asked me about first and Last name and said no data with this. I said, mine was PP then he replied it needs to enter 30-45 days to enter all the data and after receipt generated it will be accounted for PP\non-PP.

        I too keeping hope.
        They did not ans anything on my 2nd qsn.

    just now my employer called me updated .my cheque got encashed…hurrey…i almost lost all hopes.. was considering alternative plans…

        • This is awesome h1blondon, I heard that once the check is cashed, the receipt # is printed on the slip. Company/lawyer may be able to get it for you and start tracking – Congratz!

  32. Just received a receipt notice from the attorney. I feel so relieved now.

    RQ/RP/VSC
    Receipt date: 4/8/13
    notice date: 4/25/13

    My employer and attorney are both located in NYC.

      i am also in the same boat like RQ/RP
      my employer told that they got the information from from USCIS like :”they received my application” does that mean was i seleted in lottery?

      what does it ment by:
      Receipt date: 4/8/13?
      notice date: 4/25/13?

      • I would assume that you were selected in the lottery. For the dates, USCIS accepted my application on 4/8/13 and mailed me the receipt on 4/25/13.

  33. Hi Everybody I was just playing with reciept numbers and found out that even today they genereated one PP application

    check this out. so its better to keep the hopes still..I wish it was my reciept 😀

    • I saw more than 20-30 PP receipts today in WAC, my guess is that they are entering PP receipts late in system to buy some time to process them, as once they enter the receipt in system they have to process it within 30 days, I hope they will continue to enter more PP receipts in next few days.

  34. Just now I have received my receipt number from my employer, who got it today by snail mail. My receipt number is WAC13142XXXXX/RQ/RQ. All the best for those who are awaiting for their receipts.

  35. I am speechless. I JUST NOW got my receipt guys!

    EAC131455xxxx. RQ/RP/VSC.
    Received Date: April 8th
    Notice Date: April 25th

    My office at NJ received it. Attorney is in NYC. I was on STEM ext OPT. Not a consultant, work for a small firm in tech integration and analysis. Um Last name first letter is N (so I really do believe its all random, was an F1). My office receive snail mail. No update on Checks and DSO would not disclose the SEVIS update.

    My dearest friends here, I just really want you to know not to lose heart. As I saw others receipts pour in last week I kept wondering if I had lost my opportunity, if this was over for me. And today God answered out of nowhere, wasnt even checking my email. I want you to know how much I cherish this place and all the support I have got and I also cherish my destiny thats guiding us all forward. I will be here updating my case as it progresses.

    The game is not over! Believe me, I was in the same boat! IT WILL GET BETTER! Have Hope!

            Did you check with USCIS before? Were you in their system? I did my bachelors here and losing hope man..

          • Dont lost hope at all buddy. I had called the USCIS as my own self and genuinely asked if they could provide any info. They said to wait for the 30 days and couldnt determine if USCIS had my info or not. And it seems like there still hope as they are still making receipts and ALSO Snail Mail is very slow some people are receiving today for Notice of April 19th even.

            So keep your hopes high. The wait is horrible I know, but God will do right!

            For me, No update on SEVIS, No checks Cashed, USCIS Can’t find my name in System. Last time I checked with USCIS was on last thrusday.

    Is 29th, today, the 146th day…. If Im correct, there’s still some hope for RQ/RP/CSC people?

      i’m a silent viewer of this thread. Hubby on l1 and me on ead. We both applied for h1. didn’t heard anything ,so we lost hope.

      just now we got mail from our employer that both our applications are selected.
